Abstract

Pemerintah Kota Surabaya sebagai pemegang Hak Pengelolaan Tanah, telah lama menyewakan tanahnya dengan dasar Izin Pemakaian Tanah atau yang lebih dikenal dengan Surat Ijo. Hal tersebut menjadi permasalahan yang tak kunjung usai, hingga akhirnya Pemerintah Kota Surabaya mengeluarkan Peraturan Daerah Kota Surabaya Nomor 3 Tahun 2016 tentang pelepasan tanah asset pemerintah kota Surabaya. Pada Perda tersebut, masyarakat pemegang Izin Pemakaian Tanah dapat mengajukan hak atas tanah berdasarkan Izin Pemakaian Tanah yang mereka miliki dengan ketentuan adanya pembayaran ganti kerugian sesuai dengan nilai pasar. Besaran ganti kerugian sesuai harga pasar tersebut dimaksudkan agar Pemerintah Kota Surabaya terhindar dari masalah mengingat tanah tersebut sudah dimasukan kedalam asset Pemerintah Kota Surabaya. Tulisan ini mengangkat permasalahan tersebut dengan tujuan mengkaji apakah pelepasan tanah Hak Pengelolaan Pemerintah Kota Surabaya dapat dilakukan tanpa restirbusi sesuai harga pasar tanpa menyebabkan resiko pada Pemerintah Kota Surabaya. Penulisan ini dilkaukan menggunakan metode yuridis normatif, dengan pendekatan statute approach dan conceptual approach.

Abstract

The issue of digitalized forms of payment systems has required adjustment from a State to accomodate and respond. One of the issues is concerning the use of virtual currencies, and Central Bank Digital Currency. It requires the accomodative and responsive of the law instruments in Indonesia to arrange that issue. The payment systems’ policy in Indonesia has not placed any issues of crypto/digital currency as one of the payment methods. Central Bank Digital Currency is a the digital form of fiat money. Through the Bank Indonesia Regulation Number 18/40/PBI/2016 concerning Operation of Payments Transaction Processing, and Bank Indonesia Regulation Number 19/12/PBI/2017 concerning the Implementation of Financial Technology, it can be understood that Indonesia remain bans the use of any virtual currency as payment instruments. Central Bank Digital Currency has different form of virtual currencies which are not issued by the state, but it is remain called as virtual currencies. In fact, the use of virtual currencies has been exploited by money launderer to do laundering. Virtual currencies has no underlying asset or responsible authority or administrator, volatile, risky, and speculative. This article is a normative legal research method that will analyzed the direction in which Indonesian Law can headed Central Bank Digital Currency while the option has become more less for not response it.  The result of this research has showed that it is urgently need for Bank Indonesia (as a central bank in Indonesia) to recognise Central Bank Digital Currency as payment’s instrument.

Abstract

Spatial planning is a system of spatial planning processes, space utilization and space utilization control. Spatial planning is carried out to be able to realize spatial order and provide welfare for the entire community. However, often there are many violations of the use of space committed by the community. O ne of them is the violation of space utilization by the Islamic Boarding School Manager for the existence of a boarding school building in the form of a special flat located in Purwobinangun Village, Pakem District, Sleman Regency without being equipped with a permit. The location is included in the Disaster-Prons Area III, where this area is very dangerous because of its location very close to the volcano. Through the Jurifical Normative Research method by conducting a literature study on legal materials, the results obtained that the management can be charged with legal responbility in the form of imposing administrative sanctions relatrd to violations of space use because it was built in Disaster Prone Area III. Abstract

This research aims to analyze the regulations regarding the elevation of land rights for dual-function residential buildings, specifically shophouses, as stipulated in Government Regulation Number 18 of 2021. The formulated problem statement is about the elevation of building rights for shophouses according to Government Regulation Number 18 of 2021. Beforehand, shophouses and home offices were only classified as buildings with a business function; the building Use rights on shophouses and home offices could not be upgraded to ownership rights. Based on the Decree of the State Minister of Agrarian Affairs/Head of the National Land Agency Number 6 of 1998, it is necessary to upgrade building use rights to ownership rights of buildings with residential functions only, as stated on the Building Construction Permit. This research was conducted using a normative juridical method through a statutory approach and a conceptual approach to see the existing arrangements regarding the issues raised and expert opinions related to these problems. The result of this research is that shophouses and office residences play a dual role, serving both residential and commercial functions. Government Regulation No. 18 of 2021 emphasizes that shophouses and office residences with building rights can be upgraded to full ownership rights upon the rights holder's request by fulfilling the specified requirements.

Abstract

Legal issues in Indonesia are often dominated by political considerations, frequently sidelining fundamental legal principles. Decisions made by law enforcement authorities in Indonesia are often politically motivated, resulting in populist policies. One such case involves the relocation of the Depo Pertamina Plumpang in North Jakarta, impacting the residents of Tanah Merah. Although various legal instruments have been provided to the residents of Tanah Merah, they fundamentally lack legitimate ownership of the land. This study examines the legal and political aspects of the Depo Pertamina Plumpang relocation. The research employs a normative legal method, incorporating statutory and conceptual approaches, with primary legal sources and materials. The findings reveal that the legal politics underlying the relocation of the Depo Pertamina Plumpang serve to grant legitimacy for the residents of Tanah Merah to establish residential buildings. However, this has led to populist policies that conflict with the legality of land and property ownership. Specifically, the Temporary Area Building Permits (IMB Kawasan Sementara) issued by the government are legally invalid and cannot constitute a basis for land ownership. As land ownership is authenticated through land title certificates, the actions taken result in the residents of Tanah Merah occupying hazardous areas within the buffer zone, further exacerbating the risks associated with these settlements. 4o Keywords: Politik Hukum, penegakan hukum, Depo Pertamina Plumpang.
