Abstract

This thesis is the result of a literature study entitled “Imām al-Shāfi’i Thoughts on Talak Tafwi̅ḍ and Its Relevance to the Theory of Gender Equality in The Practice of Developing Islamic Family Law in Indonesia”. Academic problems are felt by the author so do this research, because there are still many people who consider that the absolute right of divorce belongs to a husband. This study aims to answer the question of what is the opinion and legal basis of Imām al-Shāfi’i thinking about the ability of the practice of divorce tafwi̅ḍ?. And how is the relevance of talak tafwi̅ḍ with the theory of gender equality in the practice of developing Islamic Family Law in Indonesia?. The results of the study concluded, Imām al-Shāfi’i argued that divorce tafwi̅ḍ the law is permissible, because of the surrender of the authority of divorce to his wife was once done by Rasullah saw. which is based on naṣ al-Qur'an surah al-Aḥzāb verses 28-29, and hadith ṣahih narration muttafaq ‘alaih from Aishah r.a. The relevance of tafwi̅ḍ divorce with the theory of gender equality, that with the practice of divorce tafwi̅ḍ this can help to lift the status/gender of women, especially in relation to divorce. When a husband submits his right to divorce authority to his wife, then surely a husband has raised his wife degree in the concept of gender equality.

Abstract

Nikah-Kawin, a deeply rooted traditional marriage in West Java, has been passed down through generations in indigenous communities. This marriage differs from conventional marriage practices in several ways. In particular, women are given greater rights of choice, with some even taking on the responsibility of reciting the marriage vows. The article aimed to explore the gender-responsive construction in the nikah-kawin tradition of West Java communities through the concept of qiwamah. Using empirical legal research methods, this study utilizes primary data obtained from interviews, observations, and documentation. The findings reveal a gender-responsive construction shaped by the principles of qiwamah embedded in the nikah-kawin tradition of West Java communities. Interestingly, this constructed gender dynamic contributes to the formation of an egalitarian household environment. The presence of traditional guidelines upheld by these communities underscores their commitment to respecting and valuing women within the societal framework. This exploration highlighted how the uniqueness of nikah-kawin not only endures but also fosters a balanced and egalitarian approach to household life.

Abstract

Klepu, a beautiful village at the eastern tip of Ponorogo Regency, has long been known as a model of harmonization between followers of different religions: Islam and Catholicism. However, if we take a closer and deeper look within the Muslim community itself, it turns out that there is quite severe ideological plurality. This research succeeded in capturing this plurality and the reasons behind it. Using a phenomenological approach, this research found that the process of ideological plurality within Klepu Muslims, who initially practiced Javanese Islam and then became diverse ideologies, occurred because of the process of cultural hybridization and diffusion brought by the Indonesian Islamic Da'wah Council (DDII) to the Klepu community. The presence of DDII, which was then followed by other similar preacher groups such as Muhammadiyah, was not value-free. They brought Puritan culture with a spirit of purifying Islam to Klepu. Then, the culture is selected by society so that attitudes of acceptance and rejection emerge to varying degrees. At this stage, the plurality of Klepu Muslim ideology occurred: Some accepted it ultimately, so they became Puritans. Some accept some elements of Puritan culture and reject some, then enter into a dialogue with their culture to produce new cultural entities and ideologies. However, some resist the presence of this new culture and continue to carry out the culture they have been practicing all this time.

Abstract

It is suspected that the community in Pelem Village does not fully understand the concept of zakat's amil (mosque official who collects the zakat) or the duties, rights, and obligations of zakat's amil itself. In addition, there is also a lack of understanding of zakat's amil in mushollas or mosques about its status and distribution of zakat. The purpose of this study was to examine the misperceptions of the people of Pelem Village, Bungkal District, Ponorogo Regency regarding the concept of zakat's amil, to explore the factors behind the misperception of the community of Pelem Village, Bungkal District, Ponorogo Regency about the idea of zakat's amil, and to examine the impact that occurred from the misperception of the community of Pelem Village, Bungkal District, Ponorogo Regency regarding the duties, obligations, and rights of zakat's amil. This study uses qualitative methods with qualitative deductive research types with data collection techniques through interviews and documentation. The study shows that there are various community misperceptions that exist. Those misperceptions some people think that zakat's amil can be formed only by the takmir of the local musholla or local mosque without any certification from the local KUA (Religious Affairs Office); the community thinks that the duties of zakat's amil are only limited to collecting and distributing zakat to mustahik or people who are entitled, and the community thinks that zakat's amil in mushollas and mosques have the right to receive zakat on behalf of zakat's amil. The factors behind these misperceptions of the Pelem Village community towards the concept of zakat's amil are the lack of education level of the community in Pelem Village so that zakat's amil is considered not too important and trivial and minimal or lack of experience in managing zakat, both in collecting and distributing zakat fitrah. The impacts that arise from people's misperception of the concept of zakat's amil. Those impacts are parts of zakat managers or zakat administrators confused in determining who is entitled to receive zakat fitrah so that part of the rest is later used for the local musholla or mosque treasury, parts of the community think that zakat's amil does not need a legal standing (SK), but it is enough to be formed by the takmir of the musholla or mosque, and people who take part in administering and distributing zakat are considered only to want an allotment of zakat. Keywords: amil; misperception; zakat distribution Masyarakat di Desa Pelem diduga belum paham sepenuhnya tentang konsep amil zakat maupun tentang tugas, hak dan kewajiban amil zakat itu sendiri. Selain itu, juga ketidakpahaman amil zakat di musholla atau masjid tentang status mereka dan cara pendistribusian zakat. Tujuan dari penelitian ini untuk mengetahui bentuk mispersepsi masyarakat Desa Pelem, Kecamatan Bungkal, Kabupaten Ponorogo terhadap konsep amil zakat, untuk mengetahui faktor-faktor yang melatarbelakangi terjadinya mispersepsi masyarakat Desa Pelem, Kecamatan Bungkal, Kabupaten Ponorogo tentang konsep amil zakat, dan untuk mengetahui dampak yang terjadi dari mispersepsi masyarakat Desa Pelem, Kecamatan Bungkal, Kabupaten Ponorogo terhadap tugas, kewajiban, dan hak amil zakat. Penelitian ini menggunakan metode kualitatif dan jenis penelitian kualitatif deduktif dengan teknik pengumpulan data melalui wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa bentuk-bentuk mispersepsi masyarakat, yaitu (a)sebagian masyarakat beranggapan bahwa amil zakat cukup dibentuk oleh takmir musholla atau masjid setempat tanpa surat keterangan dari KUA setempat; (b)masyarakat beranggapan tugas amil hanya sebatas mengumpulkan dan membagikan zakat ke para mustahik atau orang-orang yang berhak; dan (c)masyarakat beranggapan bahwa amil zakat di musholla dan masjid berhak menerima zakat atas nama amil zakat. Faktor-faktor yang melatarbelakangi terjadinya mispersepsi masyarakat Desa Pelem terhadap konsep amil, yaitu (a)tingkat pendidikan masyarakat di Desa Pelem yang kurang atau terlalu rendah sehingga pemahaman terhadap konsep amil dirasa tidak terlalu penting dan dianggap sepele; dan (b)minimnya atau kurangnya pengalaman mengelola zakat, baik penghimpunan maupun pendistribusian zakat fitrah. Dampak yang timbul dari mispersepsi masyarakat terhadap konsep amil, yaitu: (a)sebagian pengelola zakat ataupun pengurus zakat kebingungan dalam menetapkan siapa saja yang berhak menerima zakat fitrah sehingga sebagian atau sisanya digunakan untuk kas musholla atau masjid setempat; (b)sebagian masyarakat beranggapan bahwa amil tidak perlu Surat Keterangan (SK), melainkan cukup dibentuk oleh takmir musholla atau masjid saja; dan (c)orang-orang yang ikut mengurus dan membagikan zakat dianggap hanya menginginkan jatah zakat saja. Abstract

The competition felt by Bank Syariah Indonesia KCP Ngawi is very tight and Bank Syariah Indonesia KCP Ngawi tries to provide services. Therefore, further research is needed on the services provided. The main objective of this study is to analyze good service practices, service strategies and the impact of service strategies used by Bank Syariah Indonesia KCP Ngawi. The method used is qualitative by using the type of field research. The research was conducted by collecting data through interviews by interviewing customers and customer service of Bank Syariah Indonesia KCP Ngawi. The results of the study indicate that the role of customer service is also applied at Bank Syariah Indonesia KCP Ngawi quite well to improve customers and bank image. The service practice at Bank Syariah Indonesia KCP Ngawi is quite good, although not all of the criteria for good service have been fulfilled or carried out by customer service at Bank Syariah Indonesia KCP Ngawi. In providing services to customers. Bank Syariah Indonesia KCP Ngawi uses the Ultimate Service service strategy and customer complaint strategy. The services provided by the Customer Service of Bank Syariah Indonesia are good, it can be seen through customer service in carrying out its role, in carrying out the criteria for good service, and it can also be seen from the determination of strategies used to improve services to customers at Bank Syariah Indonesia. KCP Ngawi. Persaingan yang dirasakan Bank Syariah Indonesia KCP Ngawi sangat ketat dan Bank Syariah Indonesia KCP Ngawi berusaha memberikan pelayanan. Oleh karena itu, diperlukan penelitian lebih lanjut mengenai layanan yang diberikan. Tujuan utama dari penelitian ini adalah untuk menganalisis praktik pelayanan yang baik, strategi pelayanan dan dampak dari strategi pelayanan yang digunakan oleh Bank Syariah Indonesia KCP Ngawi. Metode yang digunakan adalah kualitatif dengan jenis penelitian lapangan. Penelitian dilakukan dengan pengumpulan data melalui wawancara dengan mewawancarai nasabah dan customer service Bank Syariah Indonesia KCP Ngawi. Hasil penelitian menunjukkan bahwa peran customer service juga diterapkan di Bank Syariah Indonesia KCP Ngawi cukup baik untuk meningkatkan citra nasabah dan bank. Praktik pelayanan di Bank Syariah Indonesia KCP Ngawi sudah cukup baik, walaupun belum semua kriteria pelayanan yang baik telah dipenuhi atau dilakukan oleh customer service di Bank Syariah Indonesia KCP Ngawi. Dalam memberikan pelayanan kepada pelanggan. Bank Syariah Indonesia KCP Ngawi menggunakan strategi layanan Ultimate Service dan strategi pengaduan nasabah. Pelayanan yang diberikan oleh Customer Service Bank Syariah Indonesia sudah baik, dapat dilihat melalui customer service dalam menjalankan perannya, dalam menjalankan kriteria pelayanan yang baik, dan juga dapat dilihat dari penentuan strategi yang digunakan untuk meningkatkan pelayanan kepada nasabah di Bank Syariah Indonesia.
