Abstract

Marriage in Islamic law plays a vital role for individuals and society, with the guardian (wali) being one of the essential pillars for the marriage to be valid. However, issues can arise in practice when the designated guardian, particularly the father, refuses to fulfill his duty, a situation known as wali adhol. This article discusses the importance of the guardian's role in Islamic marriage, the legal and social problems caused by wali adhol, and the solutions provided by Indonesia's legal system, including the appointment of a judge guardian to replace a guardian who refuses or cannot be present. In this context, the Compilation of Islamic Law (KHI) and Minister of Religious Affairs Regulation No. 22 of 2024 provide the legal basis for the religious court to appoint a judge guardian in wali adhol cases. The article also explores the differing views among Islamic schools of thought on wali adhol and how Indonesia's religious courts play a key role in ensuring the validity of the marriage despite challenges posed by the guardian. This study concludes that while wali adhol presents challenges, Indonesia's legal system offers clear mechanisms to address this issue, ensuring fairness and the successful implementation of lawful marriages in accordance with Islamic principles.

Abstract

Waqf is a recommended form of worship for Muslims because its rewards continue even after the donor (wakif) has passed away, as long as the donated assets provide ongoing benefits. In Indonesia, waqf is regulated by Law Number 41 of 2004, which emphasizes that waqf functions to realize economic potential for worship and public welfare. This highlights the importance of strengthening nadzir’s role and capacity in managing waqf assets productively. This research aims to examine nadzir’s role in managing waqf assets in Bekasi City and to identify strategies for optimizing their skills to support social and economic development. The study uses a combination of normative juridical methods, by analyzing laws and regulations, and empirical juridical methods, by collecting primary data through interviews with nadzir, wakif, the Indonesian Waqf Board (Badan Waqaf Indonesia/BWI), and the local community. The findings show that nadzir has a strategic but challenging role, as many lack adequate training and support from relevant institutions. Therefore, optimizing nadzir’s capacity through structured training and government-backed guidance is crucial. The study concludes by recommending sustainable skill development programs for nadzir to ensure waqf assets can truly contribute to community welfare.

Abstract

This research is in the background by the many cases in the community regarding the distribution of customers' personal data by online loan corporations. We need to know that sharing someone's personal data is a violation. The problem of disseminating personal data by corporations makes people feel uneasy and unsafe because of this situation. The main problem in this research is how corporate responsibility is regulated for the dissemination of personal data of online loan customers according to the Personal Data Protection Law Number 27 of 2022 and how corporate responsibility is regulated for the dissemination of personal data of online loan customers. The type of research that the author uses is normative juridical and a descriptive analytical type of approach, namely where this research describes in detail the responsibility of corporations for the dissemination of personal data, as well as knowing the sanctions imposed by the Financial Services Authority (OJK) as the authority on this matter. . Data collection techniques use interviews, questionnaires and literature study. The results of this research show that of the many cases of dissemination of personal data, not a single corporation has taken responsibility for this, there has been no compensation for customers whose personal data has been disseminated. Corporations that have committed violations are still operating as usual, corporations that have committed violations do not respond to what happens to their customers and do not have the good faith to take responsibility for their actions, and do not apologize for the violations that have been committed. Due to the lack of accountability, the public complained about this to the Financial Services Authority (OJK), the Financial Services Authority (OJK) quickly and firmly met with corporate parties who had committed violations, and the Financial Services Authority (OJK) gave administrative sanctions in the form of written warnings, restrictions on business activities, and revocation of permits in accordance with Financial Services Authority Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Money Lending and Borrowing Services.

Abstract

Kasus kekerasan terhadap anak yang marak terjadi di Indonesia yaitu tindakan kekerasan seperti penganiayaan, pelecehan seksual. Hal ini tentu saja menjadi sulit dikarenakan dapat merusak jiwa mental dari anak tersebut. Dari beberapa tindakan pelecehan seksual dan penganiayaan yang paling memberi dampak besar bagi kerusakan jiwa dan mental dari anak tersebut. Tindak pelecehan seksual terhadap anak merupakan contoh pelanggaran hak asasi manusia (HAM) khususnya hak asasi anak (right of child). Banyak peraturan yang dibuat untuk melindungi anak-anak dari kekerasan seksual. Namun pada realitanya, ternyata pasal-pasal yang diatur dan diterapkan sangatlah lemah sehingga tidak bisa membuat efek jera bagi pelaku tindak pidana pelecehan seksual pada anak. Rumusan masalah dalam penelinian ini yaitu; 1 Bagaimana pengaturan perlindungan hukum terhadap anak korban pelecehan seksual sebelum Putusan Mahkamah Konstitusi Nomor 21/PUU-XIX/2021? Bagaimana dampak yuridis terhadap perlindungan anak setelah Putusan Mahkamah Konstitusi Nomor 21/PUU-XIX/2021?. Metode penelitian yang digunakan pada penelitian ini adalah penelitian yuridis normatif, dengan menggunakan pendekatan normatif. Sumber data yang dikumpulkan dalam penelitian hukum yuridis normatif adalah bahan hukum primer, sekunder, dan tersier yang berupa bahan hukum yang dipakai sebagai pendukung. Penemuan dari Penelitian ini ialah dampak Yuridis Terhadap Perlindungan Anak Setelah Putusan Mahkamah Konstitusi Nomor 21/PUU-XIX/2021, bahwa perlindungan anak yang bersifat yuridis menyangkut semua aturan hukum yang berdampak langsung bagi kehidupan seorang anak, dalam arti semua aturan hukum yang mengatur kehidupan anak, yang menjamin perlindungan anak sesuai dengan kebutuhannya agar mereka dapat melaksanakan hak-haknya dengan baik. Dalam penegakan hak-hak anak, faktor yang dapat mempengaruhi dapat diklasifikasikan menjadi faktor eksternal dan internal.

Abstract

E-Court has been implemented in all courts in Indonesia. However, among legal experts, implementing electronic-based trials (e-litigation) raises pros and cons, especially when parties must attend the trial. This situation is interesting and must be investigated immediately to create legal certainty. The issues that will be examined are: 1) the appropriateness of electronic trial arrangements (e-litigation) based on Supreme Court Regulation of the Republic of Indonesia Number 7 of 2022 dated October 10th2020, and 2) the form of strengthening the implementation of electronic trials (E-Litigation) in e-court. The research method used in this research is normative-empirical legal research, also known as applied law research. The data types used to study normative-empirical legal research are primary and secondary. The results show that 1) Electronic trial arrangements (e-litigation) based on the Supreme Court Regulation of the Republic of Indonesia Number 7 of 2022 concerning the Administration of Cases and Trials in Electronic Trial (e-litigation) are appropriate. However, this regulation still needs to be improved and strengthened so that the litigants as e-court users can obtain law enforcement and justice. 2) The regulation of e-courts needs to be strengthened, as the law must absorb what the community wants in judicial practice. Policy strengthening regarding e-court can be carried out through a) amendments to the Judicial Powers Act, primarily related to regulations for the electronic announcement of decisions as a consequence of legal reforms; b) establishment of the law on the implementation of e-court and e-Litigation; c) establishment of a new Perma to strengthen Perma No. 7 of 2022.
