Abstract

Covid-19 telah menghebohkan dunia, virus yang pertama muncul di Wuhan Cina tahun 2019 ini telah meluluhlantakkan tatanan kehidupan, baik itu di bidang ekonomi, bisnis, hukum, politik, keamanan, sosial kemasyarakatan, dan keagamaan ikut terkena imbasnya. Hal ini disebabkan karena virus ini mudah menular dan mematikan. Untuk mengatasi permasalahan ini pemerintah menggerakkan program vaksinasi Covid-19 secara serius antara lain dengan menggratiskan biaya vaksinasi ini. Namun demikian, masih banyak masyarakat yang tidak mau mengikuti program ini, dengan beragam alasan. Sehingga, pemerintah kemudian memberlakukan sanksi pidana bagi penolaknya. Pemberian sanksi ini rupanya melahirkan pro dan kontra pula di tengah-tengah masyarakat tak terkecuali kalangan ahli hukum, ulama, dan penggiat HAM. Tujuan dari penelitian ini adalah untuk mengetahui kelayakan pemberian sanksi pidana terhadap penolakan vaksinasi Covid-19 dan tingkat hukuman pidana yang diberikan menurut perspektif maqashid asy-syarih. Penelitian ini merupakan penelitian normatif analisis yang berbentuk library research. Metode yang digunakan adalah metode analisa isi (content analysis) dengan teknik deskriptif dan komparatif. Hasil penelitian mengungkap bahwa pemberian sanksi pindana terhadap penolakan vaksinasi Covid-19 sesuai dengan maqashid asy-syariah terutama dalam hal pemeliharaan jiwa. Sedangkan tingkat sanksi pidana yang diberikan tergolong kepada pidana ta’zir yang berat ringannya hukuman diteantukan oleh penguasa.

Abstract

From a number of tafsir books it is known that no mufassir views giving to relatives-what is meant by the Qur'an-is zakat. But the the opinion of the scholars of jurisprudence who allow zakat on relatives and even they consider that relatives are people who are more important than others. This study intends to know the view of the Qur'an related to the living of relatives. Therefore, the author seeks to conduct research library (library research) using the method of tafsir mawdhu'i. Based on the results of this study the authors conclude that the rights of relatives in the form of material contained in the Qur'an is not related to the issue of zakat, but the Qur'an emphasizes those who are able to provide a living to relatives in accordance with the ability.

Abstract

Hajj is a worship required by Allāh to his servants who can carry it out. The obligation of this pilgrimage is general, covering all able-bodied Muslims, whether male or female. However, the obligation of this pilgrimage for women has raised many questions among the public. It is due to the hadith, which forbids women to travel alone without being accompanied by their husband or mahram. This study aimed to find out the opinions of classical and contemporary scholars about womens pilgrimage without being accompanied by their mahram. This research is normative analysis research in the form of library research. The method used is the method of content analysis with descriptive and comparative techniques. The study results reveal that there are differences of opinion among scholars regarding the departure of women to perform the pilgrimage, the differences of opinion occur in both classical and contemporary scholars. As with contemporary scholars, Muhammad bin Salih al-Utsaimin argues that a woman's pilgrimage without a mahram is legal, but her journey without a mahram is forbidden. Meanwhile, Yūsuf al-Qaradhāwī argues that the pilgrimage for women not accompanied by their mahram is legal and without sin. Ibadah haji merupakan ibadah yang diwajibkan oleh Allāh kepada hambanya yang mampu untuk melaksanakannya. Kewajiban ibadah haji ini bersifat umum, mencakup semua umat Islam yang mampu, apakah itu laki-laki maupun perempuan. Namun kewajiban ibadah haji ini untuk perempuan banyak menuai pertanyaan dikalangan masyarakat. Hal ini disebabkan adanya hadits Nabi yang melarang perempuan untuk melakukan perjalanan sendirian tanpa ditemani oleh suami atau mahramnya. Tujuan dari penelitian ini adalah untuk mengetahui pendapat ulama klasik dan ulama kontemporer tentang perjalanan perempuan dalam pelaksanaan ibadah haji tanpa ditemani oleh mahramnya. Penelitian ini merupakan penelitian normatif analisis yang berbentuk library research. Metode yang digunakan adalah metode analisa isi (content analysis) dengan teknik deskriptif dan komparatif. Hasil penelitian mengungkap bahwa terjadi perbedaan pendapat ulama tentang keberangkatan perempuan untuk melaksanakan ibadah haji, perbedaan pendapat itu terjadi baik pada ulama klasik maupun ulama kontemporer. Seperti pada ulama kontemporer, Muhammad bin Shalih al-Utsaimin berpendapat bahwa ibadah haji perempuan yang tanpa ditemani mahramnya secara fiqh sah, namun perjalanannya tanpa ditemani oleh mahram itu merupakan perjalanan yang diharamkan. Sedangkan Yūsuf al-Qaradhāwī berpendapat bahwa ibadah haji perempuan yang tanpa ditemani mahramnya secara fiqh sah dan tidak berdosa.

Abstract

This article is intended to look at the variants of the legal implications of abortion, both from the perspective of Islamic law and positive law in Indonesia. This research uses a juridical-normative approach which is based on the laws and regulations and the fatwas of ulama. The results showed that abortion can be classified into two, namely abortion for medical reasons and abortion not for medical reasons. Legally, abortion for medical reasons and performed by a doctor with integrity is a justified act. Both Islamic law and positive law in Indonesia justify this action by meeting certain conditions. The act of abortion that is not accompanied by medical indications is a prohibited act in Islamic law and positive law at the same time. This research is expected to contribute in completing the assessment of the variant of abortion in terms of Islamic law and positive law. However, this research needs to be continued by considering quantitative data on abortion, so that the resulting legal opinion is truly oriented towards the general benefit.
