Abstract

The Religious Courts are the only legal institution authorized to resolve sharia economic disputes, based on Law Number 3 of 2006 concerning Religious Courts. This is also supported by Supreme Court Regulation Number 14 of 2016 concerning Procedures for Settlement of Sharia Economic Cases. However, there are still many sharia business/shariah banking cases in commercial courts where legal submissions are tug-of-war in a dichotomy between the absolute competence of the Religious Courts and submission to the authority of the commercial court within the district court environment. So that there is regulatory disharmony and legal uncertainty regarding jurisdictional decisions in bankruptcy cases of Islamic economic institutions. This research method uses normative research by examining legal materials related to bankruptcy and PKPU. The results of the study indicate that it is necessary to unify and harmonize regulations that specifically regulate the settlement of sharia bankruptcy cases so that there are no jurisdictional conflicts between the Religious Courts and the Commercial Courts. Legal consequences if the bankruptcy case of Islamic banking is still filed at the Commercial Court, there will be coercion of the substance of sharia economic law to become conventional economic law, so that the settlement of the dispute is not in sync with the contract and the concept of settlement of cases which prioritizes business concepts and business continuity rather than fairness and certainty. substantive.

Abstract

Masyarakat sering membandingkan Bias gender disebabkan oleh tubuh dan biologi laki-laki dan perempuan. Bias gender sering kali berasumsi bahwa perempuan lemah dan menjadi sasaran diskriminasi, kekerasan, dan pelecehan. Akibat perkembangan sosial-tradisional, pandangan ini sering terjalin dalam masyarakat. Tujuan pembebasan adalah untuk memuji perempuan atas hak-hak mereka yang tidak diakui. Di sisi lain, struktur sosial yang memaksa perempuan untuk bekerja di rumah tidak berubah meski ada pembebasan yang memungkinkan perempuan memasuki profesi publik. Kajian ini bertujuan untuk mendefinisikan isu-isu pembebasan perempuan pekerja dari perspektif Islam. Penelitian kepustakaan berbasis analisis deskriptif adalah metode yang digunakan dalam penelitian semacam ini. Informasi primer dalam penelitian ini berasal dari tulisan profesional yang membahas tentang pembebasan dan kesetaraan gender, sedangkan informasi sekunder berasal dari buku-buku dan karya-karya objektif yang berkaitan dengan modul penelitian. Studi ini menemukan bahwa Islam menerima hukum perempuan bekerja sebagai langkah menuju pembebasan perempuan selama mereka melindungi kodratnya sebagai istri, ibu, dan perempuan serta menerima bentuk amal untuk keluarganya. Abstract

This study is an analytical descriptive study of normative juridical law. Constitutional, conceptual and cases based approach is used for this research. The data comes from secondary data resources. The location of this research is on Medan District Court Class I A, particulary by interviewing commercial judge and the curator. The data collection techniques and tools are library research, field research, document studies and interview. The data qualitatively analyzed.The results of the study indicate that the third party’s lawsuit against the property that is designated as boedel bankrupt by the curator in the decision number: 2/Pdt.Sus-Another-Lawsuit/2019/PN.Niaga jo. Verdict Number: 7/Pdt.Sus-PKPU/2018/PN. Niaga Mdn is not the asset of the bankrupt debtor. To determine the status of third party callateral objects in bankruptcy, it refers to the provisions of Article 21 of Law Number 37 of 2004. The phrase in this law is associated with Article 1131 of the Civil Code means all the debtor’s property, both movable and immovable, both existing and new in the future. The decision of the Panel of Judges in deciding this case, has provided legal protection to third parties as holders of fiduciary guarantees in bankruptcy in a preventive manner, namely the curator in carrying out his duties must apply the precautionary principle before determining the existence of assets by taking nto account the basis of the rights used as olleteral so that it can provide legal certainty. Meanwhile, repressively, by filing another lawsuit against the curator’s actions that include fiduciary guarantees in the bankruptcy filing.
