Abstract

The case begins when someone buys a building from Defendant 1(Director of PT. Indojaya Pan Pratama). The price is paid through the company’s manager on behalf of the defendant1. The plaintiff buys the house by installment with a contract that when the price has been paid off, the certificate of the land and the building on it will be made. According to the contract, after the installment has been paid off by the plaintiff, the company has to hand in the certificate, but the fact is that it defaults. The research used juridical normative method by conducting library research while secondary data were obtained from primary, secondary, and tertiary legal materials. The result of the normative research shows that the liability of a property developer who defaults toward a buyer is that he is required to be liable for compensating for all costs, interest, and fine which have been expended on the price of land and building which have been sold to a buyer through the court. The seller can be sued due to any violation of breaching a contract as it is stipulated in Article 1320 of the Civil Code.

Abstract

Constitutional Court Decision No.69/PUU-XIII/2015 on Article 29 of the Marriage Law No. 1 of 1974 concerning Marriage caused the rules regarding marriage agreements to change, where previously a marriage agreement could only be made before or at the time of marriage. This research is a normative legal research with analytical descriptive character. The approach used is a conceptual approach. Sources of data used in the form of secondary data. The location of the research was held at the Medan District Court class 1 A specifically by interviewing Judges and also interviewing Notaries. This research was conducted by means of literature/document studies and interviews. Data analysis was carried out qualitatively. The results showed that with the Decision No. 69/PUU-XIII/2015, there are two things that become the ratio decidendi of the Constitutional Court to grant the petition for a judicial review of Article 29 of the Marriage Law. First, because of the needs of people who are married to foreign nationals. Second, the Constitutional Court evaluates it in terms of justice. The marriage agreement can be made at any time as long as it is still in the marriage bond. As a result of the decision of the Constitutional Court on the extension of the marriage agreement to the bankrupt debtor, namely the opening of the bankrupt debtor's opportunity to make a marriage agreement, but still the marriage agreement is made within one year before being declared bankrupt so that if it is made during bankruptcy and there is a third party who is harmed, the marriage agreement is canceled for The law is considered to never exist because it is not in accordance with Article 1320 of the Civil Code. That way, the marriage agreement must still not harm the other party.

Abstract

This article aims to examine the implementation of the Regulation of the Minister of Transportation No.18 of 2020 concerning Transportation Control in the Context of Prevention of Covid-19 (“MoTR No.18/2020”) as amended by Regulation of the Minister of Transportation No.41 of 2020 which serves as a guideline for infrastructure providers. transportation such as managers of terminals, stations, seaports and airports in implementing health protocols and transportation control. This research combines normative juridical law research methods and empirical legal research. Normative legal research is carried out by taking an inventory of related laws and regulations, journals, other encyclopedias related to the topic of this research. Meanwhile, empirical legal research was conducted by conducting interviews with the management of PT. Angkasa Pura II (Persero) Kuala Namu and direct observation at Kuala Namu Airport. The data obtained will then be analyzed qualitatively and deductive conclusions are drawn. The results obtained, that there are still some discrepancies in the application of health protocols properly and correctly due to lack of awareness to carry out health protocols and the absence of strict sanctions and supervision for violations of these

Abstract

Child marriage still occurs in Indonesia, even though Law No. 16/2019 has increased the minimum age for getting married from 16 year old for the bride specified in Article 7, paragraph 1 and 19 year old for the groom to 19 year old for both of them. Indonesia is the country which participates in the Convention of Elimination of All Types of Discrimination Against Women as it is specified in Article 16, paragraph 2 which reads : “the betrothal and the marriage of a child shall have no legal effect, and all necessary action, including legislation, shall be taken to specify a minimum age for marriage and to make the registration of marriages in an official registry compulsory.” Indonesia is also the country which participates in Beijing Declaration and Platform for Action in which there is the 12th of critical areas of concern : one of them is the elimination of all types of discrimination towards girls. Abstract

Employees and workers may be fired by a firm as long as it complies with the procedures and requirements outlined in the Manpower Law. But it is not acceptable to fire a worker or employee arbitrarily or for not following the correct procedure. This work is normative juridical legal research with analytical descriptive research features. Legal papers gathered through literature review procedures, classified as primary, secondary, and tertiary, make up the secondary data that is employed. Techniques from qualitative analysis were used in the data analysis process. Although the Manpower Law enables unilateral the termination of employment (PHK) due to efficiency and business closure, based on reduced productivity, is allowed under Law No. 6/2023, often known as The Regulations on the creation of work. This law permits layoffs without necessitating the company's closure. As per the terms of legislation 6/2023, the Creation of Industries Act, layoffs are outside the jurisdiction of the Industrial Relations Court (PHI). The Termination of Finding work, however (PHK) process under the Manpower Law requires direct negotiation between the employer and employee. The panel of judges examined the legislation in Decision Numbers 83/Pdt.Sus-PHI/2020/PNMdn and 105/Pdt.Sus-PHI/2021/PNMdn with the aim of safeguarding the rights of employees who were terminated unjustifiably. This entailed bestowing upon the plaintiff the rights specified by the Labor Law. Although the judge did not take into account the Job Creation Law (Law No. 2/2020) that was in existence at the time, it is believed that the verdict adequately safeguards the rights and provides legal protection of employees who were fired without cause.

Abstract

Kekurangan, kerusakan, hingga kehilangan barang selain disebabkan oleh pengangkutannya dapat juga terjadi karena proses pembongkaran dari kapal yang dilaksanakan di pelabuhan seperti kasus antara CV. Sumatera Sejahtera yang menggugat PT. Pelindo Adapun tujuan penelitian ini untuk menganalisis batasan tanggungjawab dalam hubungan hukum antara pihak ekspeditur, pengangkut, dan otoritas pelabuhan dalam kegiatan pengangkutan laut; dan menganalisis pertimbangan dan putusan hakim berdasarkan Putusan Mahkamah Agung No. 2665 K/Pdt/2022. Penelitian ini menggunakan metode penelitian hukum yuridis normatif bersifat deskriptif analitis dengan pendekatan perundang-undangan dan pendekatan kasus. Berdasarkan hasil penelitian disimpulkan bahwa pertama, batasan tanggungjawab ekspeditur sebagaimana Pasal 87 KUHD, batasan tanggung jawab pengangkut diatur di dalam Pasal 40 dan 41 UU No.17/2008, batasan tanggungjawab otoritas pelabuhan menyediakan fasilitas kepelabuhan, perizinan, pengawasan, dan menjaga kelancaran dan ketertiban penyelenggaran kegiatan pengangkutan laut; Putusan Kasasi No. 2665 K/Pdt/2022 yang menguatkan putusan hakim tingkat pertama No. 728/Pdt.G/2016/PN.Mdn telah mempertimbangkan berdasarkan landasan yuridis, dinilai tepat, dan telah memenuhi tujuan hukum yakni kepastian, keadilan, dan kemanfaatan.

Abstract

Insurance is a financial services business that collects public funds and provides protection against losses due to an uncertain event. For supervision, the government has formed an Insurance Supervisory Agency, namely the OJK (Financial Services Authority) which functions to encourage the progress of the financial services industry and protect insurance customers. Indonesia has Law Number 40 of 2014 concerning Insurance. This study aims to provide legal protection for insurance customers in overcoming the risk of default and awaiting the formation of the Policy Guarantor Institution. Cases of unit link insurance defaults and governance violations have also occurred in several insurance companies. Such as Bakrie Insurance, Asuransji Jiwasraya, Bumiputera Insurance and Kresna Insurance. The Financial Services Authority imposes sanctions on defaulted insurance companies, including: written warnings, revoking business licenses and bankruptcy. This research is of a normative juridical nature that is qualitative descriptive. This study shows how the insurance industry in Indonesia provides protection for customer funds in resolving defaults to realize legal certainty by forming a policy guarantor program. In conclusion, although OJK imposes sanctions in cases of default, it does not appear that policyholders are protected, especially in the disbursement of claims. Therefore, a Policy Guarantor Institution needs to be formed as soon as possible to realize legal certainty.

Abstract

This study is an analytical descriptive study of normative juridical law. Constitutional, conceptual and cases based approach is used for this research. The data comes from secondary data resources. The location of this research is on Medan District Court Class I A, particulary by interviewing commercial judge and the curator. The data collection techniques and tools are library research, field research, document studies and interview. The data qualitatively analyzed.The results of the study indicate that the third party’s lawsuit against the property that is designated as boedel bankrupt by the curator in the decision number: 2/Pdt.Sus-Another-Lawsuit/2019/PN.Niaga jo. Verdict Number: 7/Pdt.Sus-PKPU/2018/PN. Niaga Mdn is not the asset of the bankrupt debtor. To determine the status of third party callateral objects in bankruptcy, it refers to the provisions of Article 21 of Law Number 37 of 2004. The phrase in this law is associated with Article 1131 of the Civil Code means all the debtor’s property, both movable and immovable, both existing and new in the future. The decision of the Panel of Judges in deciding this case, has provided legal protection to third parties as holders of fiduciary guarantees in bankruptcy in a preventive manner, namely the curator in carrying out his duties must apply the precautionary principle before determining the existence of assets by taking nto account the basis of the rights used as olleteral so that it can provide legal certainty. Meanwhile, repressively, by filing another lawsuit against the curator’s actions that include fiduciary guarantees in the bankruptcy filing.

Abstract

ABSTRACT            Guarantee sellers in the form of land are accepted because land has high economic value and does not experience a decrease in value, so that the state regulates everything related to land as outlined in the Basic Agrarian Law which provides for arrangements for land use and supervision. Land guarantee institutions that provide strong legal certainty and protect both creditors and debtors, namely Mortgage Rights. The problem in this study is regarding the legal rules governing the obligation to register mortgage guarantees, the position of mortgage guarantees that are not registered by individual creditors, and legal protection for the parties in guaranteeing mortgage rights that are not registered by individual creditors. Normative juridical research method The type of data used is secondary data consisting of primary, secondary and tertiary legal materials. The technique of collecting data is by studying the literature. The data that has been obtained is then analyzed qualitatively to obtain descriptive research results. This research shows that lending and borrowing money usually uses the submission of property rights certificates as collateral, the use of collateral in the form of land certificates must be based on mortgage rights as collateral for repayment of debts to creditors based on the UUPA. From the copy of the mortgage land book and the copy of the Mortgage Deed, the APHT must be registered at the local land office, but in practice the registration of the mortgage is negligent or the creditor does not register it, giving rise to legal consequences.

Abstract

This change in legal form is regulated by the Minister of Home Affairs Regulation No. 3 of 1998 concerning the Forms of BUMD and Government Regulation No. 54 of 2017 concerning BUMD. This research tries to examine the problems: the legal regulations change the legal form of a regional company to become a regional company, the factors that encourage the change in the legal form of a regional company to become a regional company and the legal consequences that arise on company assets after changing the legal form by referring to Law No. 23 of 2014 and Government Regulation No. 54 of 2017. The method used is normative legal research method. The nature of the research is descriptive. The type of data used is secondary data sourced from primary, secondary and tertiary legal materials. Secondary data were collected using literature study techniques and field studies with data collection tools in the form of interviews. Furthermore, these data were analyzed using qualitative analysis. The results show that the legal regulations changing the legal form of a regional company to a regional company have been regulated in Ministerial Regulation No. 3 of 1998 concerning Forms of BUMD and Government Regulation No. 54 of 2017 concerning BUMD. Meanwhile, the factors that led to the change in the legal form of a regional company to become a regional company were encountered, namely too much intervention from the government, no separation of political interests and economic interests, the lack of interest from other investors, and a lack of competent human resources. Based on the analysis of the change in the legal form of a regional company to a regional company, there is a legal vacuum on the accountability of asset management after changing the legal form.Keywords: local companies, regional companies, legal form..
