Abstract

Tujuan penelitian menganalisis efektivitas pencegahan dan penanggulangan tindak pidana penipuan jual beli online di Polrestabes Makassar. Tipe penelitian ini adalah yuridis empiris, data yang diperoleh penulis dari studi dokumen maupun wawancara dengan pihak yang berkepentingan dalam hal ini pihak Kepolisian Resor Kota Besar Makassar, kemudian dilakukan analisis kuantitatif. Hasil Penelitian penulis mendapatkan bahwa: 1). Efektivitas pencegahan tindak pidana penipuan jual beli online di Polrestabes Makassar, kurang berjalan secara efektif dikarenakan dalam upaya represif pihak Penyidik Satuan Reserse dan Kriminal menemukan kendala-kendala yang terjadi dilapang seperti: Penyidik kesulitan menemukan pelaku dan barang bukti pelaku sehingga pada saat penerapan sanksi pidannya yang kemudian dituangan kedalam Berita Acara Pemeriksaan (BAP) oleh Penyidik memakan waktu cukup lama. 2). Faktor yang mempengaruhi efektivitas pencegahan tindak pidana penipuan jual beli online di Polrestabes Makassar, terdapat beberapa aspek yang mempengaruhi antara lain: Alat bukti; Saksi; Sarana dan Prasarana. Pada ketiga faktor tersebut yang paling mempengaruhi efektifnya adalah mengumpulkan alat bukti, kebanyakan pelaku melakukan penghilangan alat bukti dengan cara dihapus maupun diubah-ubah. The research objective is to analyze the effectiveness of preventing and controlling criminal acts of online buying and selling fraud at Makassar Police. This type of research is empirical juridical, with data obtained by the author from document studies and interviews with interested parties, in this case, the Makassar Big City Police, then carried out the quantitative analysis. The author's research results found that: 1). The effectiveness of preventing criminal acts of online buying and selling fraud at the Makassar Police is not working effectively because in the repressive efforts of the Criminal and Criminal Investigation Unit investigators, they find obstacles that occur in the field, such as Investigators have difficulty finding the perpetrator and the perpetrator's evidence so that when implementing criminal sanctions, then it is written into the Investigation Report (BAP) by the Investigator which takes quite a long time. 2). Factors that influence the effectiveness of preventing criminal acts of online buying and selling fraud at the Makassar Police, there are several influencing aspects including Evidence; Witnesses; Facilities and infrastructure. Of these three factors, the thing that most influences effectiveness is collecting evidence. Most perpetrators remove evidence by deleting or changing it.

Abstract

This research aims to evaluate the effectiveness of preventive strategies implemented by the Makassar Police Headquarters (Polrestabes) in handling triangle scheme online fraud, a form of cybercrime that is increasingly prevalent alongside the rise in online transaction activities among the public. A qualitative approach with case study methodology is used to examine in depth the digital literacy strategies initiated by Makassar Police Headquarters, including collaboration between internal functional units and synergy with external stakeholders. Research findings indicate that although institutional frameworks and legal regulations are available, the implementation of digital literacy programs still faces constraints including budget limitations, gaps in digital technology mastery, and suboptimal reach of educational programs to peripheral areas. SWOT analysis and application of social system theory, community policing, and digital literacy implementation models indicate the need for strengthening human resource capacity, diversifying socialization methods, and establishing cross-sector collaborative forums to strengthen the community's digital security ecosystem. This research recommends the formulation of strategic policies that integrate digital literacy with law enforcement based on the Information and Electronic Transaction Law, Criminal Code, as well as personal data protection and consumer protection regulations. With a comprehensive and sustainable approach, prevention of triangle scheme online fraud can be optimized as part of the national cyber security strategy.
