Abstract

The development of the government system in Indonesia has resulted in significant changes in the form of granting autonomy to the regions. Regional autonomy includes the granting of authority to regions to regulate local issues in accordance with the needs and characteristics of the region. Special autonomy is a variation of the concept of regional autonomy that gives special authority and responsibility to regions with certain characteristics. The purpose of this research is to analyze the way the concept and implementation of special autonomy is interpreted in the situation of regional autonomy. This research uses a normative legal approach method to examine relevant legal regulations and literature related to this topic. The results show that special autonomy is an important step in building governance that is responsive to local needs. While recognizing the privileges of regions with special characteristics, special autonomy must still maintain the unity of the state and respect the values of diversity. The implementation of special autonomy has had a positive impact on regional empowerment, but needs to be improved to remain in line with national goals and human rights. The interaction between the central and local governments in the context of special autonomy also needs to be maintained and strengthened to achieve sustainable and inclusive development throughout Indonesia.

Abstract

This study aims to identify and analyze the effectiveness of law enforcement against unlicensed sand miners by the Pangkep Resort Police, and to identify and analyze the factors that impede the effectiveness of law enforcement against illegal sand miners by the Pangkep Resort Police. This type of research is empirical juridical. The research results show that the effectiveness of law enforcement against the perpetrators of sand mining without a permit by the Pangkep Resort Police is not running effectively. This is due to the understanding of the Satreskrim investigators of the Pangkep Resort Police in determining and finding the elements of crime from the perpetrator's actions, so that the investigation requires and/or presents expert witnesses to clarify the actions of the perpetrators. Factors hindering the effectiveness of law enforcement against illegal sand mining by the Pangkep Resort Police, namely; substance, structure, and legal culture. The three factors that most influence the criminal act of sand mining without a permit is the legal substance.

Abstract

This study focuses on analyzing the role and challenges faced by the Constitutional Court in upholding political and civil rights in Indonesia and Austria. This research explores various conceptual and comparative aspects of law through normative research methods and delves deeper into how these institutions operate in practice. Analysis shows that the Constitutional Courts in both countries serve as the primary guardians of justice and human rights. However, it must also operate in a complex environment, dealing with social, political, and international challenges. The study found that changes in laws and regulations have significant potential to strengthen the authority and effectiveness of the Constitutional Court. This is reflected in the constitutional evolution in both countries, where legal and regulatory reforms have played an important role in shaping and defining the authority of the Constitutional Court. This study confirms the importance of increasing the capacity and legal knowledge of members of the Constitutional Court, as well as the need for greater understanding and appreciation from the public of this institution's vital role and function. This research contributes to understanding how constitutional institutions can adapt and evolve to meet challenges in enforcing political and civil rights.

Abstract

Pemilihan umum adalah bentuk perwujudan sistem ketatanegaraan yang demokratis berdasarkan prinsip kedaulatan rakyat dengan tujuan menghasilkan wakil rakyat dan pemerintahan negara yang demokratis berdasarkan pada Pancasila dan Undang-Undang Dasar Negara Republik Indonesia. Dalam setiap pemilihan umum terdapat dua sistem pemilihan umum yaitu sistem proporsional terbuka dan sistem proporsional tertutup. Penelitian ini merupakan penelitian hukum normatif dengan bahan hukum primer, bahan hukum sekunder, dan bahan non hukum, dengan pendekatan konseptual. Hasil dari penelitian ini adalah Indonesia telah menggunakan sistem proporsional terbuka dan tertutup sejak pelaksanaan pemilihan umum pertama pada tahun 1955 sampai pemilihan umum tahun 2019. Sistem proporsional terbuka adalah sistem pemilihan umum yang mendekati dengan konsep demokrasi. Dimana pemilih dapat menentukan wakil-wakilnya yang akan duduk di parlemen secara langsung.

Abstract

The effectiveness of regulations regarding elections that are able to provide fair and appropriate sanctions in any election violations that have been committed based on the applicable legal system can determine the success of organizing transparent and accountable elections. Lawrence M. Friedman explains the elements of the legal system consist of legal structure, legal substance, and legal culture. This research is a normative legal research that uses a conceptual research approach using primary legal materials, secondary legal materials, and non-legal materials. The result of this research is that the legal structure related to general elections still has obstacles related to the efforts to process the handling of alleged election criminal violations. In terms of legal substance, Law Number 7 Year 2017 needs to explain in more detail about election crimes and the qualifications of actions taken are offenses or crimes. As well as in terms of legal culture, both election organizers, election participants and the public as voters have not fully realized the nature or purpose of general elections. So that law enforcement in general elections based on Law Number 17 of 2017 concerning General Elections has not been effective based on a review of the legal system according to Lawrence M. Friedman.

Abstract

Tujuan penelitian menganalisis efektivitas terlaksananya tugas Komisi Pemilihan Umum (KPU) sebagai penyelenggara pemilihan umum sesuai dengan aturan yang berlaku dan faktor-faktor yang mempengaruhi efektivitasnya. Tipe penelitian yang digunakan adalah tipe penelitian empiris yang dilakukan di KPU Kabupaten Majene. Hasil penelitian ini menyimpulkan bahwa fungsi KPU dalam mewujudkan pemilu yang demokratis pada tahun 2019 ialah kurang efektif, meskipun tingkat partisipasi masyarakat hampir mencapai 90% namun pada saat yang bersamaan surat suara yang tidak sah mencapai 3,02 % atau berjumlah 3676. Adapun faktor-faktor yang memengaruhi efektivitas fungsi KPU yaitu faktor eksternal dan internal baik dari cuaca, beberapa lokasi yang sulit dijangkau secara langsung dan tidak langsung atau aksesibilitas, sumberdaya manusia yang berkualitas dari jajaran KPU dan pengetahuan masyarakat terhadap pemilu pada umumnya. Rekomendasi dari penelitian ini adalah dengan beberapa upaya peningkatan dari pengalaman pesta domokrasi rakyat Indonesia dalam memilih pemimpin, yaitu hendaknya KPU lebih bersinergi dari berbagai pihak, lebih meningkatkan kualitas sumberdaya manusia melalui rekrutmen, sarana dan prasarana yang masih terkendala, sosialisasi serta pendidikan pemilih agar KPU mampu mewujudkan pemilu yang demokratis.

Abstract

This study examines the reformulation of age requirements for young leaders as candidates for President and Vice President, reflecting a shift in leadership preferences within society. The aim is to analyze the rationality of the minimum age restrictions for presidential and vice-presidential candidates and to formulate an ideal change through the ius constituendum approach, to create opportunities for the emergence of young leaders in line with contemporary political aspirations. The normative method is used with a legislative and conceptual approach through literature review and qualitative data analysis. The results show that the minimum age restriction of 35 years aims to ensure the quality of mature national leadership, although some argue that it has the potential to hinder the emergence of innovative young leaders. The ideal formulation of changes is to revise Article 6A paragraph (1) to lower the minimum age limit to 30 years, based on principles of democracy and non-discriminatory political rights based on age, involving public participation and constitutional mechanisms.

Abstract

Tujuan penelitian menganalisis keabsahan surat penetapan tersangka dan surat penghentian penyidikan dalam perspektif hak asasi manusia. 2). Untuk mengetahui dan menganalisis faktor yang menyebabkan keabsahan surat penetapan tersangka dan surat penghentian penyidikan dalam perspektif hak asasi manusia. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: 1). Bagaimanakah keabsahan surat penetapan tersangka dan surat penghentian penyidikan dalam perspektif hak asasi manusia apakah sudah berjalan secara optimal. 2). Faktor apakah yang menyebabkan keabsahan surat penetapan tersangka dan surat penghentian penyidikan dalam perspektif hak asasi manusia di wilayah hukum Kepolisian Resor Selayar yaitu; substansi, struktur, dan budaya hukum. Pada ketiga faktor tersebut yang paling berpengaruh terhadap keabsahan surat penetapan tersangka dan surat penghentian penyidikan. The research objective is to analyze the validity of the suspect's determination letter and the letter of termination of investigation from a human rights perspective. 2). To find out and analyze the factors that cause the validity of the suspect's determination letter and the letter of termination of investigation from a human rights perspective. This type of research is empirical juridical. The author's research results found that: 1). How is the validity of the letter to determine the suspect and the letter to stop the investigation from a human rights perspective? Is it running optimally? 2). What factors cause the validity of the suspect determination letter and the letter to stop the investigation from a human rights perspective in the jurisdiction of the Selayar Resort Police, namely; substance, structure and legal culture. These three factors have the greatest influence on the validity of the suspect determination letter and the investigation termination letter.

Tujuan penelitian menganalisis fungsi Dinas Komunikasi Informatika Statistik dan Persandian Provinsi Sulawesi Selatan Menurut penyelenggaraan Peraturan Presiden Nomor 39 Tahun 2019 tentang Satu Data Indonesia. dan (2) Mengetahui Faktor yang Memengaruhi Fungsi Dinas Komunikasi Informatika Statistik dan Persandian Pemerintah Provinsi Sulawesi Selatan Menurut penyelenggaraan Peraturan Presiden Nomor 39 Tahun 2019 tentang Satu Data Indonesia. Penelitian ini adalah penelitian hukum empiris. Hasil penelitian ini menunjukan bahwa: (1) Fungsi Dinas Komunikasi Informatika Statistik dan Persandian Provinsi Sulawesi Selatan dalam pelaksanaan satu data indonesia kurang efektif.; (2) Faktor-faktor yang memengaruhi fungsi Dinas Komunikasi Informatika Statistik dan Persandian Provinsi Sulawesi Selatan dalam Penyelenggaraan Peraturan Presiden No 39 tahun 2019 tentang Satu Data Indonesia adalah Faktor Subtansi Hukum, Faktor Saarana Fasilitas, dan Faktor Aparatur Pemerintah. The research objective is to analyze the function of the South Sulawesi Province Information, Communication, Statistics and Coding Service according to the implementation of Presidential Regulation Number 39 of 2019 concerning One Indonesian Data. and (2) Knowing the factors that influence the function of the South Sulawesi Provincial Government's Office of Communication, Informatics, Statistics and Coding according to the implementation of Presidential Regulation Number 39 of 2019 concerning One Indonesian Data. This research is empirical legal research. The results of this research show that: (1) The function of the South Sulawesi Province Information, Communication, Statistics and Coding Service in implementing one Indonesian data is less effective; (2) Factors that influence the function of the South Sulawesi Province Information Communication, Statistics and Coding Service in the Implementation of Presidential Regulation No. 39 of 2019 concerning One Indonesian Data are Legal Substance Factors, Facilities Factors, and Government Apparatus Factors.

Abstract

Tujuan penelitian menganalisis kekuatan hukum atas peran dan kewenangan BPN dalam penyelesaian sengketa tanah dan implikasi hukum putusan penyelesaian sengketa tanah atas peran dan kewenangan BPN terhadap para pihak yang bersengketa. Tipe Penelitian ini merupakan penelitian hukum normatif empiris. Hasil dari penelitian ini menunjukkan bahwa: 1). Kekuatan hukum dan peran BPN terkait penyelesaian sengketa pertanahan yang diajukan melalui pengaduan ke BPN di mana dalam proses penyelesaiannya BPN bertindak sebagai mediator diamanatkan dalam Peraturan Menteri Agraria/Kepala BPN No. 21 Tahun 2020 tentang Penanganan dan Penyelesaian Kasus Pertanahan, yang kemudian terhadap kesepaktan yang dicapai dapat membuatkan akta perdamaian kepada kedua belah pihak yang kekuatan hukumnya dapat disamakan dengan kekuatan hukum putusan pengadilan yang tercantum di dalam pasal 1858 ayat (1) KUHPerdata dan juga pasal 130 ayat (2) HIR.2). Impilkasi hukum terkait Putusan atau kesepakatan mediasi tersebut mengikat sehingga dapat langsung dilaksanakan pihak yang bersengketa. Sebagaimana ketentuan dalam Pasal 1338 Kitab Undang-undang Hukum Perdata tiap-tiap kesepakatan atau perjanjian yang dibuat berlaku layaknya Undang-undang bagi para pihak yang membuatnya. The research objective is to analyze the legal strength of the role and authority of BPN in resolving land disputes and the legal implications of land dispute resolution decisions regarding the role and authority of BPN towards the parties to the dispute. This type of research is empirical normative legal research. The results of this research show that: 1). The legal power and role of BPN regarding the resolution of land disputes submitted through complaints to BPN where in the resolution process BPN acts as a mediator is mandated in the Regulation of the Minister of Agrarian Affairs/Head of BPN No. 21 of 2020 concerning Handling and Settlement of Land Cases, which then based on the agreement reached can make a deed of peace to both parties whose legal force can be equated with the legal force of the court decision as stated in article 1858 paragraph (1) of the Civil Code and also article 130 paragraph (2) HIR.2). The legal implications related to the mediation decision or agreement are binding so that it can be directly implemented by the parties to the dispute. As stipulated in Article 1338 of the Civil Code, every agreement or agreement made applies like law to the parties who make it.
