Abstract

Pengabdian ini dilakukan dengan metode pemberdayaan partisipatoris. Peneliti melakukan pengabdian berupa pelatihan dan penyuluhan hukum dengan berpartisipasi langsung dengan para guru. Sasaran penyuluhan hukum ini adalah seluruh guru RA, MI, MTs Az-Zainiyah III di Desa Randumerak Paiton. Jumlah keseluruhan dari guru RA, MI, MTs Az-Zainiyah III di Desa Randumerak Paiton adalah 30 orang. Adapun tindak lanjut pengabdian ini disesuaikan dengan dana dan fasilitas yang tersedia maka pada saat ini kegiatan tersebut sudah terealisasikan. Pengabdian ini telah mencapai indikator, antara lain meningkatnya pemahaman peserta mengenai pendisiplinan yang harus dimiliki dan dijunjung tinggi oleh seluruh guru RA, MI, MTs Az-Zainiyah III Desa Randumerak Paiton. Pemahaman mengenai pendisiplinan guru bagi guru-guru RA, MI, MTs Az-Zainiyah III Desa Randumerak Paiton berdampak pada menurunnya jumlah pelanggaran dalam menjalankan kegiatan belajar mengajar.

Abstract

The high divorce rate in Indonesia indicates a lack of readiness among couples to build strong household. In response, the Ministry of Religious Affairs issued Circular Letter Number 2 of 2024 from the Director General of Islamic Community Guidance concerning the enhancement of premarital counseling quality for prospective brides and grooms. This study aims to examine the legal standing of circular letter within Indonesia’s legislative system and to analyze the normative opportunities and challenges within the marriage regulatory framework. As a normative juridical study, it employs a statutory approach with descriptive qualitative analysis. The findings show that the circular is an administrative legal product not included in the formal hierarchy of legislation and is non-binding externally, However, it plays an important role in the implementation of premarital counseling. Normatively, its implementation still faces substantial barriers, includes the absence of effective coercive norms, disharmony among cross-sectoral regulations, and disparities in regional understanding. Therefore, strengthening its legal foundation through higher-level regulation, cross-agency synergy, and increased capacity of implementers is necessary to ensure the effectiveness of this policy in building family resilience.

Abstract

The case of divorce due to apostasy is a civil case that is not directly regulated in Indonesian legislation. Therefore, there are differing decisions in cases of divorce due to apostasy. In the divorce case No. 0333/pdt.G/2013/PA.Bdw, with the reason of the husband's apostasy, the court issued a decision of talak bain sughra, while in the divorce case No. 3/pdt.G/2019/PA.Bky, with the same reason, the court issued a decision of fasakh. The research method used is a normative method with a statutory approach. The researcher employs descriptive analysis in discussing relevant theoretical studies related to divorce due to apostasy. The findings of this research are: 1) the legal considerations of the judges in the cases No. 0333/pdt.G/2013/PA.Bdw and No. 3/pdt.G/2019/PA.Bky were not appropriate and should have referred to KHI article 116 letter k. 2) the judges' decisions in the cases No. 0333/pdt.G/2013/PA.Bdw and No. 3/pdt.G/2019/PA.Bky were in accordance with the maqasid shariah in terms of preserving religion because both decisions terminated the marriage bond, either through talak bain sughra or through fasakh.

Abstract

The formation of legal products in Indonesia, particularly in the field of family law, is inseparable from the dynamics of legal politics, which are marked by ideological, social, and cultural contestations. Law No. 16 of 2019 concerning the Amendment to Law No. 1 of 1974 on Marriage serves as a concrete example of how legal politics shape regulations through compromise. The amendment raising the minimum marriage age for women from 16 to 19 years reflects a responsive legal character, as it was influenced by the Constitutional Court’s ruling and strong advocacy from civil society groups emphasizing child protection and gender equality. This demonstrates the characteristics of responsive law, as theorized by Nonet and Selznick, which underscores the law’s openness to societal aspirations. However, the provision under Article 7 paragraph (2), which still allows for marriage dispensation through the courts, reveals a conservative tendency within the legislation. This provision creates a normative contradiction: on the one hand, the state seeks to prevent child marriage; on the other hand, it legitimizes such practices under certain urgent circumstances. This phenomenon illustrates that family law in Indonesia is not neutral but rather a result of complex political negotiations involving the state, judiciary, religious organizations, and civil society actors. Consequently, Indonesian family law exhibits a dualistic character—responsive in its legislative process, yet conservative in the substance of its provisions. This study highlights the importance of understanding legal politics in evaluating whether family law reforms can genuinely promote substantive justice, human rights protection, and gender equality within society
