Abstract

This study aims to determine the view of the medical ethics code regarding the doctor’s profession as the chemical castor of child sexual offenders who has been decided by the court as mandated by Article 82 A paragraph (2) of Law Number 17 of 2016 concerning Child Protection in conjunction with Article 9 of Government Regulation Number 70 of 2020 concerning Procedures for Implementing Chemical Castration, Installing Electronic Detection Devices, Rehabilitation and Announcement of the Identity of Perpetrators of Sexual Violence Against Children. This research is a normative legal research. Based on the results, it is known that theoretically related to the authority of the medical profession as a party ordered by law to carry out the castration process for perpetrators of sexual abuse against children who have been decided by the court is contrary to the principles contained in the medical code of ethics and oaths. doctor, in this case the presence of such a thing makes the doctor feel that he is not doing his profession in accordance with the Code of Medical Ethics which has been agreed upon and highly upholds moral values, one of which is “informed consent” or consent from family or patient. all actions that result in a decrease in the patient’s physical endurance, although not necessarily reduce his psychological endurance. Second, that chemical castration is not a type of medical service but a punishment, so it is not the domain of medical or health personnel to do it.

Abstract

Within the framework of human rights and the effects on gender equality, this study seeks to mainly clarify the philosophical elements of child marriage. The study takes a normative legal research stance in its examination of this matter, with an emphasis on the examination of legal principles, doctrines, and norms as solutions to legal problems. Normative juridical research, sometimes called legal product research, is the methodology used in this study. According to the results of the study, there are several philosophical problems with the concept of child marriage. The practice of underage marriage is harmful on many levels and greatly hinders children's development. Child marriage must also stop if we are to reach gender equality in society, according to the report. The ideal of gender parity will remain a distant dream so long as societies practise child marriage. The reason for this is that child marriage serves to reinforce preexisting gender stereotypes and impedes societal attempts to achieve gender equality. Thus, one must take great pains to eradicate child marriage if true gender equality is to be achieved.

Abstract

Kebijakan diskresi merupakan aspek penting dalam administrasi pemerintahan. Dalam setiap struktur pemerintahan, konsep diskresi harus digunakan. Diskresi memungkinkan otoritas pemerintah untuk membuat penilaian yang tidak harus diatur secara ketat oleh hukum. Salah satu contoh kebijakan diskresi adalah ketika seorang pejabat di kantor perizinan memiliki kemampuan untuk memberikan izin mendirikan bangunan (IMB) setelah memeriksa rencana pembangunan. Penelitian ini merupakan penelitian normatif yang menyelidiki tujuan hukum, nilai-nilai keadilan, validitas aturan hukum, konsepsi hukum, dan norma hukum. Penelitian ini mengandalkan sumber-sumber hukum primer, sekunder, dan tersier sebagai sumber informasi. Penggunaan pertimbangan independen oleh badan/pejabat administrasi negara hanya diperbolehkan dalam hal peraturan perundang-undangan yang berlaku tidak mengaturnya atau peraturan yang ada tidak jelas mengaturnya, yang dilakukan dalam keadaan darurat/mendesak demi kepentingan umum sebagaimana ditentukan oleh peraturan perundang-undangan. Kegentingan yang dimaksud adalah suatu masalah yang berkembang secara tidak terduga demi kepentingan umum dan harus diselesaikan dengan cepat, namun peraturan perundang-undangan belum mengaturnya atau hanya mengatur secara umum. Sedangkan pengertian kepentingan umum adalah kepentingan bangsa dannegara atau kepentingan masyarakat bersama atau kepentingan pembangunan, sesuai dengan peraturan perundang-undangan yang berlaku. Disamping itu, batasan atau rambu-rambu dalam penggunaan diskresi adalah Asas-Asas Umum Pemerintahan Yang Baik (AUPB).
