Abstract

Corruption is one of the negative consequence of corporate crime. Corruption perpetrators from corporations are still relatively new in Indonesia, so legal reform is still needed, which is close to the purpose of criminal law. The existence of legal sanction in the form of compensation becomes a breakthrough for one type of sanction and can impose the perpetrator of corruption. Thus, in this study, we want to find a theoretical basis for corporate punishment that commits corruption and the existence of criminal sanctions for corporate compensation as perpetrators of corruption in efforts to renew criminal law. This study uses normative research by approaching the conceptual approach. From this research, finding a corporate foundation that commits corruption can be imposed by a criminal is in line with the purpose of punishment as well as by ius constituendum. For compensation that is an alternative to corporate punishment as a perpetrator of corruption, it can be brought down along with the principal penalty which has the purpose of accountability and reconciliation, guidance, reintegration, socialization or means of resolving conflicts to the community.

Abstract

Tindak pidana korupsi banyak terjadi akibat penyalahgunaan kekuasaan yang dilakukan oleh pejabat publik, diantaranya kepala daerah Upaya pemberantasan korupsi banyak dilakukan dengan preventif dan represif. Salah satu upaya preventif yang dilakukan adalah dengan memberikan larangan mantan terpidana mencalonkan diri dalam kontes pemilihan umum yang tujuannya untuk mencari pemimpin yang berkualitas. Namun pasca putusan MK Nomor 71/PUU-XIV/2016 mennggambarkan penurunan atau pelemahan pencegahan korupsi di Indonesia. Penulisan ini bertujuan untuk menemkan dasar akademis pentingnya pencegahan korupsi melalui pembatasan sesorang mencalonkan diri dalam jabatan publik. Diperoleh kesimpulan dari penelitian ini yaitu Putusan MK tersebut membuka peluang bagi mantan terpidana korupsi untuk mencalonkan diri. Sehingga sanksi pencabutan hak politik bagi terpidana korupsi yang menjalani sanksi penjara di bawah lima tahun perlu diprioritaskan untuk dijatuhkan. Sinergitas antara dua mekanisme tersebut, diperlukan guna mewujudkan cita-cita pemerintahan yang baik dan bersih, yang berkeadilan sosial. Corruption crimes occurred due to the misuse of power carried out by public officials, among them the regional head of anti-corruption efforts are carried out with preventive and repressive. One of the preventive efforts undertaken is to provide a former criminal ban to run for a general election contest whose goal is to find a qualified leader. However, after the decision of MK No. 71/PUU-XIV/2016, he described the decline or weakening of corruption prevention in Indonesia. This writing aims to accompany the academic basis of the importance of the prevention of corruption through the restriction of a person running in public office. Derived by the conclusion of this research, the COURT award opens an opportunity for former convicted corruption to run. Thus, the sanction of political Rights for criminal corruption under five years of imprisonment must be prioritized to be dropped. Synergity between the two mechanisms, necessary to realize the ideals of good and clean government, the social justice.

Abstract

Tanah merupakan objek penting bagi kehidupan manusia, tidak terkecuali bagi masyarakat di Dusun Klandungan Desa Landungsari Kabupaten Malang sebagai mitra pengabdian ini. Selain memiliki aspek ruang, tanah juga mengandung aspek hukum sehingga selain sebagai tempat bermukim tanah juga akan berkaitan dengan hak seseorang warga negara untuk memiliki dan menggunakan tanah tersebut. Memperhatikan hal tersebut maka tanah perlu untuk didaftarkan sebagai upaya perlindungan hak-hak masyarakat sekaligus upaya membantu pemerintah dalam pendataan bidang tanah di wilayah Kabupaten Malang. Tetapi terdapat permasalahan yang dialami oleh sebagian besar masyarakat mitra, yakni belum terdaftarnya tanah yang mereka miliki, sebagai akibat dari kurangnya pemahaman akan pentingnya pendaftaran dan sertifikasi tanah. Memperhatikan permasalahan tersebut maka tim Pengabdian Masyarakat Fakultas Hukum Universitas Muhammadiyah Malang melakukan kegiatan pengabdian ini sebagai upaya untuk menyadarkan masyarakat mengenai arti penting objek tanah dan urgensi tanah tersebut didaftarkan. Kegiatan pengabdian ini dilakukan dengan dua bentuk, yakni penyuluhan hukum dan konsultasi hukum, terhadap masyarkat mitra.

Abstract

The death penalty for corruptors, gaining a place in Indonesia's positive criminal law. As a country that makes Pancasila an ideology, it is interesting to be reviewed in this paper on the existence of the death penalty for the corruptor from a human rights perspective in Indonesia. Therefore, the author raised two issues, namely the first, how is the death penalty for corruptors in Indonesia's positive law? second, what about the death penalty for such corruptors if reviewed from a Human Rights perspective in Indonesia? To answer this, the authors chose legal research with a normative approach as part of its research methods. Based on the study obtained that the death penalty for corruptors does not conflict with Indonesian human rights values, because it is seen as the most serious crime. Even the formulation of the death penalty is currently seen as in line with the direction and ideals of reforming Indonesia's criminal law, which is increasingly humanist and puts forward the purpose of justice and benefit.

Abstract

Although until now Indonesia still applies capital punishment, efforts to limit its application are still beingmade, including improving the procedures for its implementation. One way to ensure that the execution ofthe death penalty is still carried out with respect for life is to involve doctors in treatment and the executionof the death penalty. In addition, in the reform of Indonesian criminal law (Draft KUHP), a policy forpostponing death penalty has been formulated. Those sentenced to death are given the opportunity to improvethemselves for a certain time (10 years). If within the grace period the convict can show improvement inhimself, then the death penalty need not be carried out and replaced with deprivation of liberty.

AbstrakPerbedaan antara hukum pidana Indonesia yang tercermin dalam KUHP dengan struktur sosial menunjukkan telah terjadi pluralisme hukum. Perbedaan ini karena KUHP sebagai lex generalis berasal dari Belanda yang memiliki latar belakang perbedaan budaya dengan Indonesia. Pembaharuan hukum pidana Indonesia saat ini mengarah kepada usaha mengkristalisasi hukum yang hidup dalam masyarakat kedalam hukum positif. Melalui pembaharuan hukum pidana Indonesia arah pembangunan hukum pidana diarahkan kepada re-orientasi pokok-pokok pikiran, ide-ide dasar, atau nilai sosio-filosofis, sosio-kultural dan sosio-politik yang sesuai dengan keinginan masyarakat Indonesia yang tercermin dalam Pancasila. Pembaharuan hukum pidana yang menyasar re-orientasi substansi hukum pidana Indonesia dapat dilakukan melalui kriminalisasi perbuatan yang oleh masyarakat dianggap sebagai perbuatan jahat namun saat ini tidak dikategorikan sebagai tindak pidana. Kemudian kriminalisasi yang bersumber dari hukum adat juga harus diikuti dengan sanksi adat yang menyertai perbuatan yang di kriminalisasi untuk menjaga eksistensi hukum adat yaitu menjaga keseimbangan.AbstractThe difference the Indonesian criminal law as reflected in the Criminal Code with the social structure indicates there has been a legal pluralism. This difference is due to the Criminal Code as a lex generalis came from Holland with a background in cultural differences with Indonesia. Indonesian criminal law reform currently leads the effort to crystallize the law who live in societies into positive law. Indonesian criminal law reform through the development direction of the criminal law is directed to the re-orientation of the main ideas, basic ideas, or the value of socio-philosophical, socio-cultural and socio-political in accordance with the wishes of the people of Indonesia is reflected in the Pancasila. Criminal law reforms that address the substance of the re-orientation of the Indonesian criminal justice can be done through the criminalization of acts by communities as being evil deed but does not currently classified as a criminal offense. Then criminalization derived from customary law must be followed by the customary accompanying sanctions in criminalizing acts to keep the existence of customary law is to maintain a balance.

Abstract

This study discusses the prospect of criminal asset forfeiture in the Corruption criminal act as a staple criminal. The research is based on the fact that the state's financial loss recovery due to corruption crimes is not achieved, whereas the purpose of law enforcement corruption is aimed at restoring the state's financial losses. But these objectives are not manifested through proper pipetting to accomplish that goal. The purpose of this research is to assess the prospect of asset deprivation as a staple criminal in the framework of national criminal law reform. The methods used in this study used normative research methods with a conceptual approach as a breakthrough problem occurred. This research gain results when criminal asset forfeiture is placed as principal criminal; it will realise the goal of state financial recovery due to corruption crimes and will be aligned with community justice.

Abstract

The development of crimes should be balanced by the development of criminal law-oriented policies protecting society. The castration sanction policy as a government reaction on the rise of sexual violence against children has a negative side in its establishment. The research method used in this research was normative juridical research that examined the rules or norms in positive law to find the truth based on the legal scholarly logic of the normative side. The results of research obtained were, firstly, the existence of the castration sanction based on ius constitutum did not reflect the essence of punishment so that the offenders repented, and it only aimed to arrest the offender and focused on the dehumanization potential of the offenders. Since the reality of sex crime in Indonesia was seen as an alarming phenomenon, the existence of this castration sanction was not immediately abolished from the criminal law of Indonesia in the future. Secondly, the existence of the castration sanction is still needed as long as it is positioned as a specific action and alternative to aggravated sex offenders.Keywords: Castration, Crime, Criminal law renewal, Criminal law.

Abstract

Sistem hukum pidana Indonesia mengenal adanya berbagai macam tindak pidana, di antaranya tindak pidana yang berkaitan dengan larangan terhadap penyebarluasan ideologi-ideologi tertentu, atau yang bisa disebut dengan istilah delik ideologi. Delik ideologi ini berkaitan dengan penyebaran ideologi Komunisme, Marxis-Leninisme yang tidak bisa dipisahkan dari sejarah kelam Negara Indonesia. Tulisan ini ditujukan untuk menganalisis formulasi rumusan delik ideologi dalam hukum positif Indonesia serta untuk mengkaji delik ideologi tersebut dari aspek pembaruan hukum pidana Indonesia. Metode penelitian yang digunakan adalah penelitian yuridis normatif, karena permasalahan yang diangkat beranjak dari sistem norma hukum pidana yang berlaku. Hasil penelitian menunjukkan bahwa formulasi rumusan tindak pidana ideologi di dalam Kitab Undang-Undang Hukum Pidana (KUHP) maupun Rancangan KUHP (RKUHP) memiliki rumusan yang tidak jauh berbeda. Rumusan delik ideologi tersebut memiliki problematika yuridis khususnya dari aspek unsur perbuatan, jenis, dan objek tindak pidana. Maka dari itu perlu dilakukan reformulasi delik ideologi di dalam RKUHP, dengan memperhatikan arah politik hukum pidana Indonesia yang berbasiskan pada nilai-nilai Pancasila.
