Abstract

Keuangan Desa dikelola berdasarkan praktik penyelenggaraan pemerintahan yang baik. Asas-asas Pengelolaan Keuangan Desa sebagaimana tertuang dalam Permendagri Nomor 113 Tahun 2014 yaitu transparan, akuntabel, partisipatif serta dilakukan dengan tertib dan disiplin anggaran. Penelitian ini menggunakan jenis penelitian adalah yuridis empiris dengan metode analisis yang digunakan adalah metode analisis deskriptif kualitatif. Pelaksanaan Tugas Bendahara dalam Pengelolaan Keuangan Desa Di Desa Sobol Baru Kecamatan Mantoh Kabupaten Banggai, telah dilaksanakan sesuai dengan peraturan perundang-undangan yang berlaku. Walaupun dalam pelaksanaannya belum secara maksimal, akan tetapi tugas bendahara dalam pengelolaan keuangan desa tetap dilaksanakan, berdasarkan ketentuan Pasal 7 ayat 2 Peraturan Menteri Dalam Negeri Republik Indonesia Nomor 113 Tahun 2014 Tentang Pengelolaan Keuangan Desa. Adapun Faktor-faktor yang mempengaruhi pelaksanaan tugas bendahara dalam Pengelolaan Keuangan Desa yaitu faktor yang mendukung adalah faktor peraturan perundang-undangan dan adanya pendamping desa dan pendamping lokal desa. Sedangkan faktor yang menghambat kurangnya pembinaan secara rutin tentang tata cara penatausahaan keuangan desa. Kata Kunci : Bendahara, Keuangan Desa

Abstract

Penelitian ini adalah untuk menganalisis konsekuensi hukum dari pemalsuan data di hadapan Pejabat Pembuat Akta Tanah (PPAT) dalam perjanjian jual beli tanah serta tanggung jawab Pejabat Pembuat Akta Tanah (PPAT). Dalam penelitian ini metode penelitian yang digunakan yaitu penelitian normatif. Pemalsuan data dalam perjanjian jual beli tanah dihadapan pejabat pembuat akta tanah (PPAT) merupakan tindakan yang melibatkan manipulasi atau penyajian informasi palsu atau tidak akurat dalam transaksi jual beli tanah. Akibatnya para pihak melakukan pembatalan akta jual beli tersebut dan melakukan gugatan perdata. Sedangkan PPAT memiliki peran penting dalam proses transaksi jual beli tanah. Tugas PPAT meliputi memastikan keabsahan dokumen, prosedur hukum, dan kebenaran data terkait tanah yang diperjualbelikan. PPAT bertanggung jawab untuk memastikan bahwa transaksi jual beli dilakukan secara sah dan sesuai dengan hukum. Jika terdapat pembatalan perjanjian jual beli tanah akibat adanya pemalsuan data, maka PPAT bertanggungjawab sebagai saksi di Pengadilan Negeri untuk memberikan penjelasan sehubungan dengan akta yang dibuatnya. PPAT tidak bertanggung jawab atas ketidakbenaran materiil yang dikemukakan oleh para pihak, apabila terdapat pihak yang bersangkutan dalam jual beli tanah mengantarkan data-data palsu seakan-akan asli. PPAT bertanggung jawab  atas kelalaian dan kesalahan isi akta yang dibuat di hadapannya. baik secara administratif, perdata, maupun pidana.

Abstract

Within the framework of human rights and the effects on gender equality, this study seeks to mainly clarify the philosophical elements of child marriage. The study takes a normative legal research stance in its examination of this matter, with an emphasis on the examination of legal principles, doctrines, and norms as solutions to legal problems. Normative juridical research, sometimes called legal product research, is the methodology used in this study. According to the results of the study, there are several philosophical problems with the concept of child marriage. The practice of underage marriage is harmful on many levels and greatly hinders children's development. Child marriage must also stop if we are to reach gender equality in society, according to the report. The ideal of gender parity will remain a distant dream so long as societies practise child marriage. The reason for this is that child marriage serves to reinforce preexisting gender stereotypes and impedes societal attempts to achieve gender equality. Thus, one must take great pains to eradicate child marriage if true gender equality is to be achieved.

Abstract

The COVID-19 epidemic has significantly altered the execution of business contracts, especially with regards to the renegotiation of duties and the use of force majeure. In light of the difficulties brought on by the pandemic, this research examines the ways in which Indonesian civil law, as codified in the Civil Code, deals with matters such as contract modifications. Studying both primary and secondary sources of law is at the heart of the normative legal research methodology. It is frequently necessary to renegotiate contracts in order to modify rights and responsibilities, since the study's findings demonstrate that force majeure does not necessarily apply to all contracts in a pandemic scenario. Findings from this research stress the need for more lenient laws to resolve contract disputes in the midst of the epidemic and for more transparent rules to govern the use of force majeure.

Abstract

The rapid development of information and communication technology has changed the mechanism of business competition in the era of the digital economy, where digital companies use aggressive pricing strategies such as predatory pricing to eliminate competitors. Predator pricing, which is the setting of prices very low below production costs with the aim of weeding out competitors, is often disguised as a promotion or market acquisition strategy by large startups and digital platforms. This poses a major challenge in competition law enforcement in Indonesia because it is difficult to prove predatory intent and set very low price limits in the context of complex digital business models and limited cost transparency. Article 20 of Law No. 5 of 1999 normatively prohibits this practice, but its application is less adaptive to the characteristics of the digital economy. This study uses a normative juridical method with a study of regulations, ICC decisions, and international literature to examine the adequacy of legal norms related to predator pricing in Indonesia. The results of the study show the need to update regulations and increase the capacity of ICC in order to overcome market distortions due to predatory pricing strategies, especially those that have an impact on the sustainability of MSMEs. A multidisciplinary approach that integrates legal analysis, the digital economy, and data is ess.

Abstract

This study analyzes the effectiveness of criminal sanctions against perpetrators of domestic violence and the level of legal protection provided to victims based on Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT Law). The approach used is a normative juridical method by examining relevant laws and regulations, doctrines, and judicial practices. The results of the study show that although the PKDRT Law has provided a strong legal basis in cracking down on perpetrators, its effectiveness is still weak due to structural constraints, patriarchal culture, and lack of victim perspective among law enforcement officials. Legal protection for victims is still formalistic and has not touched on the aspects of psychological and social recovery. Therefore, it is necessary to reconstruct the criminal law paradigm through a restorative justice approach that prioritizes the restoration of the dignity of victims, social reconciliation, and the prevention of repeated violence. Reformulation of norms and strengthening the capacity of law enforcement agencies is also an urgent need for the law to function as an instrument of substantive justice, not just a tool of punishment. This research emphasizes that justice in domestic violence cases must be realized through a balance between legal certainty, victim protection, and universal human values.
