Abstract

This research is motivated by the phenomenon of the loss of consignments experienced by CV Maju Berkah Tanjung Transport as a goods transportation service company. The research aims to describe the causal factors, the concept of responsibility, and the obstacles in resolving cases of loss of consignments. The research method used in this research is sociological/empirical legal research or other terms used are sociological legal research and can also be called field research conducted through interviews with CV employees. Maju Berkah Tanjung Transport and document studies related to cases of lost shipments over the past year. The results show that the main causal factors are human negligence in the company's operational system and criminal acts. The concept of responsibility is based on the transport agreement and insurance contract to ensure certainty of compensation for customers and financial protection of the company. There are several obstacles in the claims process such as lack of valid evidence, excessive consumer demands, and indications of claim fraud. In conclusion, effective risk management and claims handling are essential to ensure that cases of lost goods are resolved without harming all parties concerned.

Abstract

The development of information technology, especially in the banking sector, customers can now easily access their financial services through mobile banking platforms. However, amidst such convenience, there are concerns about the security of customer data. The focus of this research is on written law or law on the books and customs, as the protection of personal data is crucial as the data stored in the banking system includes financial details, personal identity, and other sensitive data. This research uses normative legal research methods, which are also known by other terms such as positive legal research methods, doctrinal legal research methods, and pure legal research methods. The main regulations in Indonesia in this case are Law Number 19 of 2016  concerning Electronic Information and Transactions (UU ITE), as well as Bank Indonesia Regulations (PBI) regarding Information Security and Banking Transactions (PBI 18/40/PBI/2016). Protecting the personal data of BRI mobile banking customers requires a deep understanding of the various types of digital crime, including social engineering practices. With appropriate protection measures and high awareness from all relevant parties, it is expected to effectively reduce the risk of data leakage and maintain the security of clients' personal data.

Abstract

Prevalensi putus sekolah pada anak pekerja migran Indonesia di Malaysia mencuat sebagai permasalahan mendesak. Studi ini bertujuan mengevaluasi peran Kedutaan Besar Republik Indonesia dalam memenuhi hak atas pendidikan komunitas rentan tersebut. Penelitian kualitatif dilakukan melalui wawancara mendalam dan kajian dokumen untuk memperoleh pemahaman mendalam. Hasil analisis mengindikasikan telah dilaksanakan sejumlah program pendukung akses pendidikan meskipun belum sepenuhnya efektif. Oleh karena itu, direkomendasikan perluasan kerja sama pendirian sekolah eksklusif, penyediaan beasiswa akademik, serta peningkatan diplomasi bilateral guna meniadakan kebijakan diskriminatif yang berlaku. Dengan adanya komitmen kolaboratif multidimensi, diharapkan terwujudnya akses pendidikan inklusif bagi anak pekerja migran Indonesia di Malaysia sebagai investasi menuju masa depan yang lebih cerah.

Abstract

Indonesia is the fourth most populous country in the world. The population growth in Indonesia is not matched with job opportunities, so many Indonesians choose to work abroad. Malaysia is a country that receives a lot of Indonesian workers. Many of the Indonesian workers who have been working in Malaysia for a long time decide to settle down because they feel comfortable there. Moreover, many Indonesian workers marry fellow workers, resulting in children being born in Malaysia who are unable to obtain Malaysian citizenship because Malaysia follows the principle of jus sanguinis. This community service activity aims to help Indonesian students access education. The research problem in this study is how the citizenship status of Indonesian descent students in Sanggar Bimbingan Kampung Bharu Malaysia. The research method used is field research, which involves interviewing informants. The research results show that based on the cooperation between PCIM and KBRI in establishing Sanggar Bimbingan, even though it is informal and without special attire, students can learn and achieve their dreams even though they are still undocumented. Once students complete their education at Sanggar Bimbingan, they will receive a diploma that can be used in Indonesian schools so that students can continue their education up to a bachelor's degree and reach their dreams. Because every child has the right to education no matter where they are.

Abstract

This research aims to analyze criminal acts of defamation by environmental activists against illegal shrimp ponds in Karimunjawa National Park. The research approach uses a statutory approach, namely using the laws of the Unitary State of the Republic of Indonesia, the Criminal Code. Criminal Procedure Code, Law Number 1 of 2024 concerning Information and Electronic Transactions and Article 66 of Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH). Type of research, in this research the author uses qualitative data. The results of this research are that a speech can be said to be hate speech if there is a malicious intention from the perpetrator of the speech to encourage hostility, invite discrimination, and calls for violence (incitement to violence), against certain groups of the population based on ethnicity, religion, race and between groups and Daniel Frits' upload is far from all of that. Efforts that an activist can take if he is criminally sued is by filing an appeal against the judge's verdict, in this case Daniel, who has been sentenced by the judge, files an appeal with the help of his attorney, because Daniel's attorney assesses Daniel as an environmental fighter in Karimunjawa who has experienced the impact. due to illegal shrimp farming, and is supported by Articles 65 and 66 of Law Number 32 of 2009 concerning Environmental Protection and Management.
