Abstract

Perekonomian masyarakat pada saat ini semakin berkembang secara dinamis, masyarakat membutuhkan dana untuk memenuhi segala aspek dalam kehidupan sehari-hari. Terkadang sebagian masyarakat merasa kesulitan dalam memperoleh dana tunai. Untuk mengatasi kesulitan tersebut dimana kebutuhan dana dapat dipenuhi tanpa harus kehilangan barang-barang berharganya, maka masyarakat dapat menjaminkan barangnya ke lembaga penyimpanan atau perbankan. Barang yang dijaminkan tersebut dapat diambil kembali atau ditebus pada waktu tertentu setelah nasabah melunasi pinjamannya.Kegiatan menjaminkan barang berharga tersebut untuk mendapatkan sejumlah uang dan dapat ditebus kembali pada waktu tertentu disebut usaha gadai.   Penelitian ini menggunakan penelitian hukum normatif. Usaha gadai swasta adalah kegiatan menjamin barang-barang berharga yang dilakukan oleh badan hukum non pemerintah kepada pihak tertentu, guna memperoleh sejumlah uang dan barang yang dijaminkan akan ditebus kembali sesuai dengan perjanjian antara nasabah dengan lembaga gadai. Usaha gadai ini harus didaftarkan kepada OJK guna menjamin kepastian dan perlindungan hukum bagi konsumen dan pelaku usaha serta mengatasi agar masyarakat yang sedang membutuhkan uang tidak jatuh ke tangan tukang rentenir yang bunganya relative tinggi. Mengenai rusaknya barang jaminan yang telah digadaikan, maka Usaha gadai swasta pada hakikatnya harus memberikan ganti rugi kepada nasabah gadai. Hal ini telah secara tegas diatur dalam Pasal 25 ayat (2) Peraturan Otoritas Jasa Keuangan Nomor 31/POJK.05/2016 tentang Usaha Pegadaian, diatur juga dalam Pasal 1157 Kitab Undang-Undang Hukum Perdata.

Abstract

Law has the power to improve the national economy and public welfare through public behavior. Oneof the methods is increasing financial literacy on online loans in the context of economic developmentlaw. There have been many legal cases related to peer-to-peer lending (P2PL) since its proliferation inIndonesia. For example, many parties impose interest rates that exceed the upper limit set by thestrategic partner of the Financial Services Authority (OJK, Otoritas Jasa Keuangan), the IndonesianFintech Joint Funding Association (APFI, Asosiasi Pendanaan Bersama Fintech Indonesia). Inaddition, there is minimal public knowledge regarding their rights and obligations towards creditorsor investors, loan service providers, information technology-based money lending services, and otherdebtors or online loan customers. These examples emphasize the importance of studies regarding thistopic. This study aims to elaborate on the role of law in increasing inclusive financial literacy on onlineloans in the context of economic development law.

Abstract

This research aims to analyze criminal acts of defamation by environmental activists against illegal shrimp ponds in Karimunjawa National Park. The research approach uses a statutory approach, namely using the laws of the Unitary State of the Republic of Indonesia, the Criminal Code. Criminal Procedure Code, Law Number 1 of 2024 concerning Information and Electronic Transactions and Article 66 of Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH). Type of research, in this research the author uses qualitative data. The results of this research are that a speech can be said to be hate speech if there is a malicious intention from the perpetrator of the speech to encourage hostility, invite discrimination, and calls for violence (incitement to violence), against certain groups of the population based on ethnicity, religion, race and between groups and Daniel Frits' upload is far from all of that. Efforts that an activist can take if he is criminally sued is by filing an appeal against the judge's verdict, in this case Daniel, who has been sentenced by the judge, files an appeal with the help of his attorney, because Daniel's attorney assesses Daniel as an environmental fighter in Karimunjawa who has experienced the impact. due to illegal shrimp farming, and is supported by Articles 65 and 66 of Law Number 32 of 2009 concerning Environmental Protection and Management. Abstract

Legal protection of wives and children in the household is very important both physically and psychologically. This domestic violence often occurs even the most dominant trigger for the collapse of household mahligai is violence experienced by wives and even children including victims. The most important issue to be discussed in this study is how the forms of legal protection for wives and children victims of psychological violence in the perspective of maqasid al-sharia. The method used in this research is with a normative juridical approach, namely by conducting research based on books of jurisprudence, legal / reference materials by examining theories and concepts of statutory materials related to this research. To process and analyze data obtained from library materials, descriptive-analytical analysis techniques are used. This analysis technique gives an idea of the logical flow of data analysis. As a result of the study revealed that the forms of protection for wives' and children victims of psychological violence in the household are protection of the provision of mental birth, protection of the fulfillment of their rights in the form of good treatment and the right to obtain useful knowledge. In addition, protection against physical, psychic, and sexual violence. In the view of maqasid al-Shari'ah, the form of protection for the wife is categorized as the maintenance of reason, soul and offspring as a manifestation of al-maqasid al-Shari'ah at the level of dharuriya.

Abstract

One of the main problems experienced by information technology-based co-funding services is the high amount of loan interest from the organizer. This resulted in a pile of interest that never finished and eventually became a default and was determined to be in default. The beneficiary fails to pay the funds along with interest. This is considered burdensome and it is necessary to find alternative funding services that do not charge high interest to users. This article aims to solve the problem of minimizing default through Islamic financial technology to provide access for business actors. The concept of financing through syariah fintech companies is a solution and answer for business actors, especially MSMEs, regarding the complexity of capital and without determining interest from the lender. All will be determined through an agreement that has been agreed between the funder and the recipient of funds. The agreed agreement is also not the same from one another, which is based on the allocation of funds from the loan applicant. The difference between Islamic and conventional fintech in reducing risk can be clearly seen. That is, if in conventional fintech is to raise interest as a form of prudence. So that the absence of interest will be the main attraction for syariah fintech. The method used in this paper is literature research. The result is the minimization of defaults by fund recipients through Islamic financial technology to provide financial access for business actors.

Abstract

Online lending products have become an integral part of the modern banking industry, fundamentally changing the financial services landscape. They provide greater accessibility for consumers, allowing them to apply for loans without having to visit a physical bank. The place of online loan products in banking also raises various questions and debates. From the perspective of supporting financial inclusion, online lending products expand the reach of financial services, benefiting individuals or small businesses that find it difficult to qualify for traditional loans. The existence of online loan services in the non-bank financial industry in recent years is the answer to the lack of access to funding to small communities. The purpose of this research is to find out how the position of online loan products in banking and also to find out about the position of online loan services in the Non-Bank Financial Industry and targeting the un-banked people segment which is often associated with people who do not have sufficient open access to the banking service system. This research uses the literature research method. In this article, the researcher has concluded that the position of online loan products in banking is in accordance with the function of banks, namely collecting funds from the public in the form of deposits and channeling them to the public in the form of credit and/or other forms. This includes offering online loan products in the context of its role as a digital bank. However, it cannot be equated with online lending or fintech peer-to-peer lending.

Abstract

Kemakmuran dan kesejahteraan rakyat adalah hukum yang tertinggi dalam suatu negara. Di era yang modern ini kendaraan tidaklah hanya menjadi kebutuhan tersier semata tetapi sudah menjadi kebutuhan primer (pokok) yang wajib dimiliki oleh setiap orang atau kepala keluarga sebab kendaraan merupakan alat transportasi sumber mata pencaharian juga sebagai alat transportasi kehidupan sehari-hari. Perpindahan hak kepemilikan dalam konsep pengaturan fidusia diterapkan dengan metode constitutum possessorium (penyerahan kepemilikan benda tanpa menyerahkan fisik benda sama sekali) artinya pengalihan hak kepemilkan suatu benda dengan meneruskan hak kepemilikan terhadap pemberi fidusia yang kemudian objek penguasaan suatu benda selanjutnya dikuasai untuk kepentingan penerima fidusia. Dalam mengadakan perjanjian biasanya kreditur selaku pemberi piutang akan mengikatkan perjanjian dengan mengikutkan jaminan fidusia sebagai bentuk kepastian hukum dan disertai dengan isi klausula perjanjian yang harus disepakati debitur, perjanjian tersebut dinamakan perjanjian standard (klausula baku).

Abstract

This study uses normative research methods to examine the comparative legal aspects between Donasi onlineservices and online donations in the context of Indonesia's electronic delivery system. Using this approach, this study investigates the comparison and regulations governing the two mediums, namely Donasi onlineservices and online donations. In the era of increasing globalization, businesses are no longer viewed as mere economic units, but as an integral part of the society in which they operate. In this context, studying the legal aspects of companies is becoming increasingly important to understand how they deal with legal complexities and their presence in society. This approach is expected to enable the investigation of the legal aspects of co-funding and online donation services to not only provide an in-depth understanding of the two enterprises individually, but also reveal the common patterns and challenges that enterprises face in the context of law and their presence in society.

Abstract

Increasing financial inclusion is one of the main agendas in sustainable economic development. One of the instruments that plays an important role in this is student loans, which provide access to funding for students to continue their higher education. This paper analyzes the legal aspects that govern student loans in Indonesia, including government policies, banking regulations, and consumer protection in financial transactions. In addition, the challenges faced in the implementation of student loans were also discussed, such as the risk of default, transparency of terms and conditions, and dispute resolution mechanisms. Using normative legal research methods, and using a legal and regulatory approach, this study aims to identify existing regulatory weaknesses and provide policy recommendations to increase the effectiveness of student loans as an instrument of financial inclusion. The results of this study are expected to contribute to the formulation of a more inclusive and equitable financial policy for students in Indonesia.

Abstract

Paylater services in the marketplace have grown rapidly as an alternative to credit-based payments without a card. However, this financing model raises various legal issues, including regulatory aspects, consumer protection, and fairness in determining interest and fees. This study analyzes the legal framework of Paylater in Indonesia, including regulations of the Financial Services Authority (OJK), Bank Indonesia (BI), and consumer protection in digital transactions. The study also compared Paylater regulations in several countries to identify best practices. In addition, the study explores potential legal risks, such as misuse of personal data, cost transparency, and billing practices. The results of the study show that existing regulations still have gaps in controlling aspects of fairness and risk mitigation for consumers. Therefore, stricter policies are needed to increase the transparency and accountability of Paylater services in order to realize an inclusive and equitable digital financial ecosystem.
