Abstract

Penelitian ini membahas wanprestasi dalam perjanjian kemitraan antara perusahaan GOJEK dan mitra driver, khususnya dalam kasus jual beli akun GOJEK yang dilarang dalam perjanjian. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menganalisis peraturan yang berlaku serta dampak hukum dari pelanggaran tersebut. Hasil penelitian menunjukkan bahwa tindakan jual beli akun GOJEK oleh mitra driver dapat dikategorikan sebagai wanprestasi karena melanggar ketentuan dalam perjanjian kemitraan, yang berimplikasi pada pemutusan kemitraan, tuntutan ganti rugi, serta potensi sanksi pidana. Penyelesaian sengketa akibat wanprestasi ini dapat dilakukan melalui mediasi internal, arbitrase, atau jalur litigasi. Penelitian ini diharapkan dapat memberikan wawasan bagi para pihak terkait mengenai aspek hukum dalam kemitraan berbasis teknologi.

Abstract

Hidden defects are defects in goods that cannot be directly known by the buyer at the time of the transaction. In the Civil Code, hidden defects are regulated in Article 1491 of the Civil Code and Article 7, paragraph (2) of Law No. 8 of 1999 concerning Consumer Protection. This study aims to analyze the seller’s liability for goods containing hidden defects using a normative approach. The findings indicate that the seller's liability for hidden defects is strict (strict liability), obligating the seller to provide compensation to the buyer who suffers a loss. A harmed consumer is entitled to claim compensation in the form of returns, replacements, or reimbursements. Legal protection is essential to create a balance of rights and obligations within the legal relationship between consumers and business actors. Enforcing seller liability also promotes compliance with quality standards and increases consumer awareness of their rights. Therefore, the existing regulations play a significant role in ensuring justice and guaranteeing consumer safety in sales transactions.

Abstract

The phenomenon of buying and selling photocards is growing among music fans, with X social media widely chosen as a platform for buying and selling due to its ease of access and wide reach. However, this practice often raises legal issues, especially regarding the occurrence of fraud by the seller through the provision of false evidence of goods or the sale of non-original goods. This study aims to analyze the legal implications of photocard sale and purchase agreements that contain elements of fraud. This study uses a normative legal research method with a statutory approach and a conceptual approach. Based on the results of the research, it is known that the agreement containing elements of fraud does not fulfill the subjective aspects in the validity of the agreement as stipulated in the Civil Code (KUHPerdata), thus causing a defect of will. As a result, the agreement can be canceled through the mechanism of requesting cancellation in court.

Abstract

Customers who enter into insurance agreements online receive legal protection based on Law no. 40 of 2014, Consumer Protection Law, Civil Code, KUHD, and Law no. 11 of 2008 concerning Information and Electronic Transactions. Thus, an online insurance policy is recognized as a legally valid electronic document, both in digital and printed form. OJK is responsible for insurance supervision, both online and offline, with a focus on aspects of governance, business ethics and financial health. This supervision includes analysis of reports, examinations and investigations, which are part of the OJK's duties in regulating and supervising the financial services sector in Indonesia.

Abstract

This study examines the legal basis used by judges in granting the cassation request in Mahkamah Agung Decision Number 647 K/PDT.SUS-PAILIT/2021 and its implications for the legal protection of the insured. This research is a normative legal study using a statutory and case approach, utilizing primary and secondary legal materials collected through literature studies. The analysis is conducted using a syllogistic method and a deductive reasoning pattern. The findings indicate that if the insured does not agree with the homologation agreement or if there is a counterproductive element, there is a legal basis for filing a cassation under Article 286 of Law Number 37 of 2004.

Abstract

The aim of this research is to investigate the regulations governing the position of the insured in credit life insurance and the responsibilities of insurance companies, as delineated in Decision Number 3079K/Pdt/2019. Credit life insurance serves as a mechanism for banks to mitigate the risk of debtor default in debt repayment resulting from the death of the debtor. It entails a collaborative effort between banks and insurance companies aimed at facilitating credit repayment to the bank in the event of the demise of the credit facility user (debtor). This research adopts a normative legal approach with a case study methodology, examining legal issues elucidated in court decisions of enduring legal significance. The findings from Decision Number 3079K/Pdt/2019 reveal that the insurance company bears the responsibility of settling the outstanding debt of the insured, contingent upon premium payments, in the event of the insured's demise. In the realm of insurance, the direct relationship typically exists between the insured and the insurer; however, in credit life insurance, the direct relationship materializes between the insurer and the policyholder, thereby rendering the position of the insured comparatively weak and indirect.

Abstract

In an agreement, there are often defaults committed by both debtors and creditors. One of the default cases that occurs is a default in a broadcasting cooperation agreement made by a television company. To protect the rights of parties who are harmed by the default that has occurred, there must be legal protection that regulates it. Therefore, this legal research aims to analyse the legal protection given to the sub-license right holder or as the licensor of television broadcast content for default in the broadcasting cooperation agreement made by the broadcast content licensee and then analyse the appropriate dispute resolution to resolve the default. This research uses a prescriptive normative research method with a statutory approach, conceptual approach, and case approach based on the dispute that occurred in Decision Number 08/Haki.Hak Cipta/2015/PN.Niaga.Sby. Based on this legal research, the author concludes that the form of legal protection that can be given to sub-licence rights holders as broadcast content licensors to broadcast content recipients in the event of default is internal and external legal protection with dispute resolution that can be in the form of alternative dispute resolution or the realm of the court applicable in Indonesia.

Abstract

The purpose of this study is to analyze the legal basis for the qualification of unlawful acts in disputes concerning the unilateral cancellation of life insurance policies by the insurer as reflected in Decision Number 5871 K/Pdt/2024. This research is a normative legal study with a prescriptive nature, employing both case and statutory approaches. The legal materials used in this study consist of primary and secondary legal materials which are analyzed qualitatively using the syllogistic method with deductive reasoning. The results of the study indicate that the qualification of an unlawful act in the a quo decision is based on a systematic interpretation of Article 1338 of the Indonesian Civil Code, which is understood in relation to the binding source of agreements under Article 1339 of the Indonesian Civil Code. Furthermore, the existence of naturalia elements also emphasizes the presence of legal obligations inherent in an agreement even though they are not explicitly stated therein. In life insurance, the obligation to pay claims after the insured risk has occurred constitutes a normative consequence inherent in the policy; therefore, the unilateral cancellation of a life insurance policy fulfills the elements of an unlawful act as stipulated in Article 1365 of the Indonesian Civil Code.

Abstract

Divorce gives rise to various legal consequences relating to the status of the parties, marital property, and the rights and obligations toward children, thereby requiring a legal mechanism that ensures legal certainty, justice, and legal protection. In practice, the parties often express their intention to divorce in the form of a Pre-Divorce Agreement Deed drawn up before a notary. This study aims to analyze the legal standing and evidentiary strength of a Pre-Divorce Agreement Deed as evidence in divorce cases decided by default judgment (verstek). The research employs a normative juridical method with a statutory approach and a case approach, focusing on the Decision of the Ngawi Religious Court Number 425/Pdt.G/2023, through a literature review of primary and secondary legal materials. The findings indicate that a Pre-Divorce Agreement Deed executed in the form of a notarial deed constitutes an authentic deed with perfect evidentiary value as written evidence in divorce proceedings. Although it cannot directly result in the dissolution of marriage, the deed is relevant to prove the existence of an agreement between the parties and the condition of a marital relationship that has irretrievably broken down. In cases decided by default judgment, the deed becomes an important basis for judicial consideration in granting the divorce petition. The implications of this study emphasize that a Pre-Divorce Agreement Deed may be lawfully and proportionately used as evidence to support the proof of grounds for divorce and to realize legal certainty in judicial proceedings.
