Abstract

Abstract. This study discusses the concept and function of wa'ad in the DSN-MUI Fatwa No.85/DSN-MUI/XII/2012 concerning Wa'ad in Islamic Financial and Business Transactions, changing the contract from non-binding to binding nature. This study aims to analyze wa'ad law in IMBT in terms of its risks and benefits. This study uses data from the DSN-MUI Fatwa, Islamic jurisprudence, and other scientific papers. This study finds out that IMBT combines an ijarah contract (lease) with a sale-purchase contract or a grant. The ijarah contract, the sale, and the purchase contract are linked with an agreement. In principle, the legal status of fulfilling wa'ad in Islamic finance and business transactions is binding because it will provide benefits for the Islamic economic community, and there will be no financing problems. In the DSN-MUI fatwa, the concept of "Doing two lesser evils" is used in determining the fatwa regarding promises (wa'ad) in a transaction.Keywords: Wa'ad, IMBT, Binding Promise, Islamic Jurisprudence Abstrak. Kajian ini membahas tentang konsep dan fungsi wa’ad dalam Fatwa DSN-MUI No.85/DSN-MUI/XII/2012, yang diubah dari tidak mengikat menjadi mengikat. Penelitian ini bertujuan untuk mengetahui analisis hukum wa’ad dalam IMBT ditinjau dari sisi kemaslahatan dan risikonya. Metode yang digunakan dalam penelitian ini adalah metode yuridis normative, dengan data berupa Fatwa DSN-MUI, literatur Hukum Islam/Fiqh, dan karya ilmiah lainnya. IMBT merupakan gabungan antara akad ijarah (sewa) dengan akad jual beli atau hibah. Akad ijarah dan akad jual beli  diikat dengan janji. Pada prinsipnya status hukum pemenuhan janji (wa’ad) dalam transaksi keuangan dan bisnis syariah adalah mengikat karena akan memberikan manfaat bagi masyarakat ekonomi syariah dan tidak menimbulkan masalah pembiayaan. Pada fatwa DSN-MUI, konsep “Melakukan dua keburukan yang lebih ringan” digunakan dalam menentukan fatwa tentang janji (wa’ad) dalam suatu transaksi.  Kata Kunci: Wa'ad, IMBT, Janji Yang Mengikat, Aturan Fiqhiyyah

Abstract

This article reconstructs Islamic family law in response to the household-level consequences of global climate change, placing ecological resilience within the framework of maqāṣid al-sharīʿah (the higher objectives of Islamic law). It argues that the stability of the Muslim household (ṣulb al-usrah al-islāmiyyah) cannot be separated from the twin duties of istiʿmār al-arḍ (stewardship of the earth) and ḥifẓ al-bīʾah (protection of the environment). To develop that argument, the article draws together three analytical traditions: Jasser Auda’s maqāṣid al-sharīʿah Systems Theory, David Schlosberg’s Ecological Justice Theory, and Margaret Urban Walker’s Everyday Ethics Theory. The research is qualitative and descriptive, applying critical hermeneutics to classical works in uṣūl al-fiqh and fiqh al-usrah alongside contemporary scholarship on Islamic environmental ethics. The findings indicate that climate resilience within Islamic family law depends less on technological or economic adjustment than on the ethical resources already embedded in the sharīʿah value system. The novelty of the study lies in its repositioning of Islamic family law as a framework of micro-ethical governance, one that operationalizes ecological justice at the level of the home and connects classical juristic reasoning with the climate debates of the present.

Abstract

The research is focused on the investigation of the global development of Qur’anic studies between 2000 and 2025 through a bibliometric analysis and a science mapping approach. For data collection and analysis, a database of Scopus was utilized with the use of VOSviewer software tools. The results show that there was consistent growth in the number of publications in the field. The most noticeable feature is that many contributions came from South East Asian countries like Indonesia and Malaysia, becoming the key centers for international cooperation in scientific research. Moreover, based on the analysis of co-authorship networks, one can note that the existing system was relatively clustered, implying the existence of well-established research communities in the regions with few connections between the regions. At the same time, the citation analysis reveals the multidisciplinary character of the research area and its interlinkage with many aspects of theological, ethic, gender, health, and socio-economic studies. In addition, the analysis of keyword co-occurrences and overlay networks shows that apart from classic keywords such as 'tafsir' and 'exegesis,' digital humanities and computation approaches also gained popularity. This study underscores the evolving and interdisciplinary character of Qur’anic studies and highlights the need for stronger international collaboration and methodological innovation to enhance its global academic impact.

Abstract

This qualitative case study investigates culturally responsive digital pedagogical practices in a multicultural Indonesian high school. Through semi-structured interviews, participatory observation, and document analysis involving three teachers and twelve students, the study reveals three core patterns of culture-technology integration: (1) contextual learning designs that incorporate local wisdom, (2) dialogic and egalitarian digital interactions, and (3) affirmation of cultural identity in digital learning spaces. The findings underscore that the success of digital pedagogy depends not on technological sophistication, but on the teacher’s role as a cultural mediator and facilitator of reflective dialogue. This study contributes to the global discourse on culturally responsive digital pedagogy by offering empirical evidence from the underrepresented Indonesian context and proposing an initial conceptual model relevant to Southeast Asian socio-cultural settings. The model emphasizes contextual design, reflective dialogue, and identity affirmation as foundational pillars. Practical implications highlight the need for teacher professional development programs focused on digital-cultural competencies and equitable infrastructure policies to support inclusive digital transformation. The study also aligns with Indonesia’s Merdeka Curriculum and national digitalization initiatives, advocating for pedagogy that harmonizes technology with local cultural values.
