Abstract

Since an aircraft was invented, an aircraft is not only used for transporting person from one place to another, but also can be used in war until revenge terrorism ideology and faith against a state. Furthermore, an aircraft is a representative of state where the aircraft is registered, which is also defined by terrorist as a target to attack a state. Attacking a civil aircraft is categorized as an international crime. Hereinafter, since Tokyo Convention 1960 declared, the evolution of crimes against civil aircraft has been evolved. The main target of offences is still an aircraft, however, the offence is diverted by attacking others target such as all facilitations relating to the security in civil aviation including airport and air navigation. 9/11 accident in USA is a picture how terrorism offence is still evolving. Now, aircraft and ground navigation facilitations are not the only main object in attacking by terrorist. The aircraft now is used to attack others ground target which are represented a state. The evolving of terrorism acts, in the end, is the reason why Beijing Convention 2010 on the Suppression of Unlawful Acts Relating to International Civil Aviation was made.

Abstract

ASEAN integration gives consequence in regional and national aviation. As a part of ASEAN Economy Community (AEC) programme, ASEAN Aviation proclaimed Open Sky as a policy for liberalization. In addition, the policy has dramatically implication in Indonesia aviation market including passenger, destination and facilities which Indonesia is not ready yet. Air space liberalization covers 3rd, 4th, and 5th freedom of the air and some soft right for facilities. For Indonesia these are no easy to face it. Indonesia government with all the limitation has to analyze and raise the capability of its human resources and facilities with international standard. In the other hand, Singapore with Singaporean airlines and some facilities are ready for enforcing the item of this policy. Furthermore, ASEAN integration should have seen from whole aspect, not only political reason as a tool for achieving international recognition but also the readiness of the members.

Abstract

The development of Information Technology (IT) changes the patterns of community’s behavior. The presence of the Internet as the main platform of online activities including electronic transaction is vulnerable to the presence of cyber attacks by irresponsible parties. Criminal acts in cyberspace (cybercrime) pose a major threat in the governance of online activities and other electronic transactions. One of the efforts of the Government of Republic of Indonesia to face those challenges is by authorising the Government Regulations Number 82 Year 2012 concerning the Implementation of Electronic Transaction Systems in order to govern the electronic transaction activities. This article will discuss about how the Government of Republic of Indonesia copes the issue of the threat on electronic transactions.Keywords: cybercrime, electronic transactions system, goverment regulation No. 82/ 2012

Abstract

The potency and unique characteristics of GSO for placing communication satellites located only above equatorial states makes the GSO as part of natural resources. The equatorial states realized that the use of GSO has many advantages and has implications to their national interest. However, basic principle in space law, Outer Space Treaty 1967 (Art.II), states that equatorial states forbidden to claim ownership of any part of outer space, particularly claim in sovereignty. The principle “first come first served” in placing of satellite on GSO, practically only gives the advantage to developed countries which have high satellite technology. Hence, the level of technology of a state plays important role in developing of space law internationally. The equatorial states which are mostly developing states (low and middle level in technology in outer space activities) claimed their right to use natural resources for their national interest based on equatorial position principle

Abstract

Hak-hak pengguna jasa transportasi udara, khususnya dalam lingkup penerbangan internasional telah diatur dalam  Konvensi Montreal 1999 ( vide Peraturan Presiden Nomor 95 Tahun 2016).  Masyarakat Jawa Timur, khususnya di Surabaya sering melakukan perjalanan ke luar negeri, mengingat tingkat ekonomi yang baik. Wilayah tersebut merupakan wilayah kerja Yayasan Lembaga Perlindungan Konsumen (YLPK) Jawa Timur. Tujuan dari kegiatan ini adalah untuk memberikan pendampingan dalam hal penggunaan dan pemahaman Konvensi Montreal 1999, mengingat sosialisasi terkait hal ini masih sangat minim. Metode yang digunakan melalui beberapa tahap, pertama persiapan dan perijinan dengan kelompok mitra; kedua identifikasi latar belakang pendidikan individu anggota mitra, pengalaman bekerja dan pengetahuan regulasi bidang penerbangan; ketiga pemaparan materi dua arah interaksi langsung tentang pengalaman lapangan dari para individu mitra yang dikombinasikan dengan transfer pengetahuan dari sisi akademik. Hasil yang diperoleh adalah anggota mitra dalam menyelesaikan permasalahan pengguna jasa transportasi udara bisa mengkombinasikan peraturan terkait perlindungan konsumen, penerbangan, dan Konvensi Montreal 1999.

Abstract

This study delves into the vulnerability of Indonesia's National Budget (APBN) to corruption, specifically in the Procurement of Goods and Services, with a particular focus on the potential for misallocation across regions. Building on significant scholarly contributions from both Indonesian and international researchers, the research undertakes a thorough examination of preventive measures against corruption in public procurement. Employing a Participatory Action Research (PAR) approach, the study integrates community solidarity into its corruption prevention model, utilizing a combination of data collection methods such as questionnaires, interviews, and focus group discussions (FGDs). A central topic in the study is the important role of e-procurement in combating corruption, advocating for its transparent and accountable application as a deterrent. To bolster preventive efforts, the research proposes mandatory declarations from tender participants, along with an enhanced auction rebuttal mechanism throughout the various stages of procurement. The preventative framework underscores the significance of civilian, academic, and journalistic supervision to proactively identify corruption and conflicts of interest. Recognizing the nuanced nature of fraud patterns at the provincial level, the study advocates for a region-specific approach to maximize the effectiveness of e-procurement. This regional focus aligns with the study's emphasis on the involvement of relevant agencies operating at the local level. In essence, this research contributes a targeted analysis to complement existing literature, aiming to curb corruption in public procurement through strategic and context-specific preventive measures.

Abstract

Background: This paper explores the critical role of the aviation industry in facilitating the transportation of goods and passengers in an archipelagic country like Indonesia. As a fast, efficient, and economical alternative for inter-island and interregional transport, aviation has become indispensable. However, the growing competition among national airline companies has led to significant challenges, with some carriers suffering losses and even facing bankruptcy. Methodology: A normative legal research approach is employed to examine the legal framework governing business competition in the aviation sector, as well as aviation safety regulations. The study further analyzes Indonesia’s obligations as a member of the international community, particularly its commitments under the International Civil Aviation Organization (ICAO). Objectives: To analyze the intersection between aviation safety and competition law in Indonesia, identifying legal challenges and ensuring fair business practices among national airline operators. Findings: The research finds that unhealthy business competition among national airline companies has led to legal disputes and interventions by the Indonesian Competition Commission (KPPU). These include findings of violations under Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Such practices have not only harmed competing businesses but also threatened the sustainability of the aviation industry. Originality/Novelty: This study provides a legal perspective that integrates competition law and aviation safety regulations, an area that is often treated separately in academic discourse. It also contributes to the understanding of how Indonesia's dual obligations–to maintain market fairness and ensure international aviation safety standards–can be harmonized through effective legal mechanisms.

Abstract

Program pembinaan mitra yang berfokus pada peningkatan pemberdayaan kelompok perempuan Dusun Cakru’an melalui usaha produk olahan pisang yang berkelanjutan menjadi suatu pengabdian kepada masyarakat dengan pendekatan pendampingan yang mencakup berbagai tahap. Tahap tersebut dimulai dari pendampingan pada peningkatan keterampilan dalam pengemasan produk hingga strategi perluasan jaringan pemasaran. Program ini juga mengintegrasikan pelatihan dasar pemasaran, khususnya pemasaran digital, guna memperluas cakupan produk mitra di pasar yang semakin dinamis. Langkah-langkah dalam pengabdian masyarakat ini didesain untuk memaksimalkan potensi mitra dalam mengembangkan produk dan mencapai lebih banyak pelanggan. Evaluasi berkala menjadi landasan untuk memastikan keberhasilan strategi pemberdayaan, sambil memberikan ruang bagi perbaikan dan peningkatan berkelanjutan. Dengan demikian, pemberdayaan masyarakat diarahkan pada peningkatan kemandirian ekonomi mitra, berkontribusi pada kesejahteraan keluarga, dan mendukung pencapaian tujuan pembangunan berkelanjutan. Kesimpulan ini menegaskan peran penting pemberdayaan masyarakat dalam meningkatkan kualitas hidup dan menciptakan dampak positif dalam berbagai aspek kehidupan masyarakat.
