Abstract

This study aims to identify and explore the challenges in the implementation of Resolution No. 4/2016 of the ICPO-INTERPOL concerning sharing and exchanging biometric data among the members of ICPO-INTERPOL in order to counter terrorist foreign fighters (FTFs). This research also aims to elaborate and describe the mechanism of collecting, recording, storing, and exchanging biometric data conducted by the Indonesian government.The mechanism of collecting, recording, and storing biometric data works through 3 main doors, namely: 1) in the process of making electronic Resident’s ID Cards (e-ID Cards); 2) in the process of making SKCK (Certificates of Police Record); 3) in the process of making e-Passports. In the implementation of Resolution No. 4/2016 of ICPO-INTERPOL, the most obvious obstacles and challenges are the absence of regulations concerning the protection of personal data, and also the fact that the biometric data system itself is still relatively new and the database is not fully developed. Until today, the INTERPOL National Central Bureau (NCB) for Indonesia does not have its own biometric database system; instead they are using the database that is centralized at Pusinafis Polri (the Indonesian National Police’s Center of Automatic Fingerprint Identification System).The results of the study reveal that the biometric data recorded, collected, and stored are big data, but so far in supporting law enforcement and crime prevention processes the data have only been used as comparative data. In addition, there have also been found indications of violations of personal data and privacy, for example in relation to the absence of mechanism for data retention, consent, processing, notification, and disclosure.

Abstract

Online marketplace system merupakan satu diantara bentuk perkembangan aktifitas e-commerce. Online marketplace system menyediakan sarana aktifitas belanja secara daring dimana memuat berbagai layanan untuk mempermudah konsumen daring (e-consumer). Disisi lain, layanan yang mempermudah tersebut terdapat memberikan potensi ancaman bagi konsumen daring terutama terkait dengan data pribadi dan privasi konsumen daring tersebut. Penelitian ini membahas tentang perlindungan data pribadi dan privasi e-consumer pada online marketplace system dengan menggunakan metode penelitian normatif (legal research). Pendekatan penelitian yang digunakan adalah Statute Approach, Conceptual Approach, Case Approach serta Comparative Approach. Hasil dari penelitian ini tampak bahwa perkembangan e-commerce di Indonesia telah berjalan sedemikian pesat, setidaknya Negara mendorong lahirnya start up baru yang dapat memanfaatkan pelbagai program, salah satunya adaalah “1000 technopreuner” serta ada program-program lainnya. Namun, hal tersebut tidak akan berjalan efektif tanpa adanya perlindungan hukum yang memadai, khususnya terkait hak privasi dari konsumen. Di dalam regulasi nasional saat ini terdapat UU Nomor 11 Tahun 2008 tentang ITE,  PP Nomor 28 tahun 2012 tentang Penyelenggaraan Sistem dan Transaksi Elektronik. Dengan dua regulasi hukum tersebut Kemenkominfo dapat melakukan pendaftaran dan pendataan bagi pelaku usaha e-commerce melalui serangkaian proses profiling dan report databased agar konsumen terhindar dari penipuan yang dilakukan oknum yang tidak bertanggungjawab Kata kunci: perlindungan hukum, data pribadi, privasi, e-commerce, online marketplace system

Abstract

The Bali Process Declaration on People Smuggling, Trafficking in Persons and Related Transnational Crime acknowledges the large scale and complexity of irregular migration challenges both within and outside the Asia Pacific region. As one of the efforts to decrease irregular migration in this region, the Regional Support Office of the Bali Process (RSO) was established in 2012 to support the implementation of the Bali Process. In this regard, the Bali Process led to an opportunity to develop the use of technology and biometrics data sharing in migration and border management. The purpose of this paper is to discuss the law and policy in addressing the issue of irregular migration in Indonesia. It also explores the development of the utilization of technology and biometrics in the area of migration, security and border management, as a measure in addressing the problem of irregular migration. The discussion focuses on the role and challenges of technology and biometrics data exchange in border management as one of the most important agreements on the Bali Process. This study finds that the gaps within the ASEAN member states in regulating privacy rights and data protection have caused the difficulties in sharing and exchange data/information particularly biometric data. The method used in this research is the doctrinal legal research, which is mainly referred to as library-based research.

Abstract

The banking sector is facing a new competitor, namely Financial Technology (Fin-tech). Fin-tech itself can be described as an industry composed of companies using a new tech-nology and innovation with available resources in order to compete in the marketplace of tradi-tional financial institutions and intermediaries in the delivery of financial services. In Indonesia, Fin-tech has been widely developed since the past 3 years. Fin-tech faces a new challenge as a new service for financial consumer which adapts to new ways of living in modern digital tech-nology era. Basically, Fin-tech offers three main categories such as payment, personal finance, and financing. In financing application there are peer to peer financing, social crowd funding, and loan marketplace. All of these kinds of application have some issues in legal framework and data protection due to the use of communication technologies such as internet, social networks, Smartphone, massive use of data with the Big Data, connected objects, etc. The use of big data and those new technologies create new opportunities for these sectors, and this development also raises significant data protection concerns. This paper discusses two legal issues of Fin-tech, the legal aspect, and the data protection.

Abstract

The development of Information Technology (IT) changes the patterns of community’s behavior. The presence of the Internet as the main platform of online activities including electronic transaction is vulnerable to the presence of cyber attacks by irresponsible parties. Criminal acts in cyberspace (cybercrime) pose a major threat in the governance of online activities and other electronic transactions. One of the efforts of the Government of Republic of Indonesia to face those challenges is by authorising the Government Regulations Number 82 Year 2012 concerning the Implementation of Electronic Transaction Systems in order to govern the electronic transaction activities. This article will discuss about how the Government of Republic of Indonesia copes the issue of the threat on electronic transactions.Keywords: cybercrime, electronic transactions system, goverment regulation No. 82/ 2012

Abstract

Hak-hak pengguna jasa transportasi udara, khususnya dalam lingkup penerbangan internasional telah diatur dalam  Konvensi Montreal 1999 ( vide Peraturan Presiden Nomor 95 Tahun 2016).  Masyarakat Jawa Timur, khususnya di Surabaya sering melakukan perjalanan ke luar negeri, mengingat tingkat ekonomi yang baik. Wilayah tersebut merupakan wilayah kerja Yayasan Lembaga Perlindungan Konsumen (YLPK) Jawa Timur. Tujuan dari kegiatan ini adalah untuk memberikan pendampingan dalam hal penggunaan dan pemahaman Konvensi Montreal 1999, mengingat sosialisasi terkait hal ini masih sangat minim. Metode yang digunakan melalui beberapa tahap, pertama persiapan dan perijinan dengan kelompok mitra; kedua identifikasi latar belakang pendidikan individu anggota mitra, pengalaman bekerja dan pengetahuan regulasi bidang penerbangan; ketiga pemaparan materi dua arah interaksi langsung tentang pengalaman lapangan dari para individu mitra yang dikombinasikan dengan transfer pengetahuan dari sisi akademik. Hasil yang diperoleh adalah anggota mitra dalam menyelesaikan permasalahan pengguna jasa transportasi udara bisa mengkombinasikan peraturan terkait perlindungan konsumen, penerbangan, dan Konvensi Montreal 1999.

Abstract

Consent is one of the foundations for data processing in the Operation of Electronic Systems by government and private institutions. Implementing consent as a basis for data processing has several shortcomings, particularly as it primarily relies on individuals being aware in providing authentic consent. In practice, individuals often give consent without considering any terms and conditions. Consent obtained without knowledge of data processing can jeopardize the right to privacy and the protection of personal data. This paper examines dynamic consent as a means to optimize the protection of privacy rights. The findings indicate that the concept of dynamic consent that prioritizes its approach to Data Subjects serves as a means to optimize personal data protection. Dynamic consent can strike a balance between on the one hand, the simplicity of the consent mechanism, and, on the other hand, the personal data protection standards and the right to privacy. Formulating dynamic consent should be based on legal elements, societal practices, technological features, and the involvement of personal data protection authorities. Additionally, as a form of implementing accountability for Electronic System Organizers as data controllers or processors, an effective mechanism for resolving personal data disputes is needed. These elements, when combined, can provide optimal personal data protection.

Abstract

Abstrak  KOPTRAS adalah sebuah organisasi non-profit yang didirikan untuk  mewadahi para pembina dan pelatih ekstrakurikuler di Surabaya. KOPTRAS lahir dilandasi rasa senasib  yang dimiliki pembina dan pelatih ekstrakurikuler. Masing-masing sekolah memilki kebijakannya dalam memberikan hak dan kewajiban terhadap para pelatih/pembina ekstrakurikuler. Dalam praktiknya, hak-hak sebagai pekerja para pembina/pelatih ekstrakurikuler ini seringkali dilanggar. Hasil identifikasi dan inventarisasi masalah menunjukkan bahwa, terdapat dua permasalahan krusial yang dihadapi oleh KOPTRAS, yakni ketidakjelasan status pembina dan pelatih akibat proses rekruitmen  dan juga masalah pembayaran honorarium, karena tidak ada standar pembayaran ekstrakurikuler. Metode yang digunakan dalam pengabdian masyarakat ini adalah melalui focus group discussion, capacity building dan pendampingan hukum melalui pendampingan proses pendaftaran KOPTRAS sebagai organisasi yang berbadan hukum. Dalam pelaksanaannya, rekomendasi bentuk badan hukum yang sesuai dengan kebutuhan KOPTRAS adalah perkumpulan. Pendaftaran KOPTRAS sebagai organisasi yang berbadan hukum dapat memperkuat posisi dan status hukum KOPTRAS dalam melakukan proses advokasi hak-hak pembina/pelatih ekstrakurikuler sebagai pekerja. Sehingga nantinya dapat meraih penghidupan yang layak, tidak mendapatkan diskriminasi dan mendapatkan perlindungan hukum yang memadai.

Abstract

AbstractAugmented Reality (AR) refers to a display of a real-world environment whose elements are augmented by one or more layers of text, data, symbols, images, or other graphical display elements. AR technology is always associated with online games. Beyond online gaming, AR has become part of daily life and affects every aspect of how society interacts with technology. In retail and marketing, AR and other virtual technologies play a very important role in saving costs. AR is also used in the education and medical sector, also in preventing crime. AR is even further used for humanitarian activities to reach remote areas affected by natural disasters and save human lives. Considered a new technology, the commercialization of AR may bring incredible business opportunities as well as potential legal risks. In the context of Intellectual Property (IP), AR systems and services can embody a variety of forms of IP. Meanwhile, the operation of AR systems in virtual spaces is creating issues about how to deal with data breaches and privacy. By using doctrinal methods, this paper will explore the legal challenge of AR in the context of IP protection in the virtual space and investigate the potential liability caused by the failure of AR systems from the Indonesian legal perspective.Keywords: Augmented Reality; Intellectual Property; Legal; Virtual Space.
