Abstract

This study aims to find out what factors cause the large number of Girik lands to be abandoned by their owners and can be certified by other parties, to find out the legal status of abandoned Girik lands when they have been certified by other parties, and to find out the efforts to resolve disputes over Girik lands which have been certified by other parties. other. For this reason, the research method used is a type of qualitative research using a descriptive analysis method which applies a literature study approach accompanied by observations of something that happens in society. There are many factors that have caused this neglected land to be certified by other parties, because it has been neglected, because land administration has been less orderly, because of legal uncertainty. Awareness for landowners to cultivate their land and legal certainty in matters of land is urgently needed.

Abstract

Salah satu kasus yang diputus di bawah minimal khusus yang diatur dalam undang-undang adalah kasus narkotika yang diputus di Pengadilan Negeri Karawang Nomor : 315/Pid.Sus/2017Pn.Kwg. terdakwa dituntut pasal 114 ayat (1) Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika. Permasalahan dalam skripsi ini meliputi dasar pertimbangan hakim dalam menjatuhkan pidana di bawah batas minimal khusus yang ditentukan oleh undang-undang dan pandangan hakim yang menjatuhkan pidana di bawah batas minimal khusus. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan data primer dan sekunder, metoda pengumpulan datta menggunakan metoda studi kepustakaan. Analisis data dilakukan dengan melakukan analisis terhadap bahan kepustakaan secara kualitatif. Hasil penelitian menunjukkan bahwa Hakim dengan tetap memperhatikan rumusan pasal yang didakwakan Jaksa Penuntut Umum, Hakim juga melihat fakta-fakta hukum lain bahwa jika memang baarang bukti narkotika tersebut relatif lebih sedikit hakim dapat memutus dibawah ancaman minimal khusus, yang mana ancaman dibawah minimal khusus itu berpedoman pada pasal 127 UU Narkotika.
