Abstract

Legal certainty in the form of legislation, among others, can be shown by the consistency of the formulation of legal norms with the sub ordinate regulations. Therefore, the study on the influence of different formulations of the norm in the implementation of the law needs to be done. Evidently, the different formulations of the norm of the applicant's position as a legal entity has the right to a judicial review against the decision of a negative correlation, ie, the emergence of disparity in the results of the trials. Abstract

Penerapan Asas Freies Ermessen Dalam Pengambilan Kebijakan Oleh Administrasi Negara Berdasarkan Hukum Administrasi Negara  Merupakan  suatu kebebasan yang diberikan kepada tata usaha negara dalam melakukan penyelenggaraan pemerintahan. Sehingga Freies Ermessen merupakan kemerdekaan bertindak atas inisiatif dan kebijakan sendiri dari administrasi negara. Keberadaanya  yang lain karena adanya suatu peningkatan akan  tuntutan pelayanan publik yang harus di berikan tata usaha negara terhadap kehidupan sosial ekonomi pada warga memiliki keberagaman, dan untuk menyelesaikan persoalan-persoalan yang mendesak yang belum ada aturannya  dan harus dapat dipertanggungjawabkan secara hukum dan moral.
