Abstract

Online gambling has become an increasingly serious problem in Indonesia, affecting not only individuals but also social structures more broadly. This study aims to examine the prevalence and characteristics of online gambling among Indonesian adolescents and university students and find challenges and strategies in dealing with this problem. The data were analyzed using theme analysis, and the findings show that online gambling is a complex problem influenced by various factors, including ease of access, social influence, and financial incentives. This research shows that a comprehensive approach is needed in dealing with online gambling, involving the government, law enforcement, and civil society organizations. The findings suggest that public education and awareness campaigns are crucial in preventing online gambling, and law enforcement should be equipped with effective resources and technology to monitor and block online gambling activities. This research contributes to the existing literature by providing insights into the experiences and perceptions of Indonesian adolescents and university students who engage in online gambling. The findings also indicate the importance of a multi-faceted approach in dealing with online gambling, including the development of alternative recreational activities and the provision of counseling services for those affected by gambling addiction.

Abstract

The objective concerning Anti-Illegal Gratification in the Perspective of Islamic Law and the Culture of Bugis-Makassar Community is to provide a profound understanding of the practice of illegal gratification within the Bugis-Makassar cultural context and Islamic legal perspective. This discussion also aims to provide a strong foundation for formulating effective prevention strategies related to illegal gratification. By exploring the perspectives of Islamic law and the culture of the Bugis-Makassar community, this discussion is expected to contribute positively to efforts to prevent illegal gratification and corruption in the Bugis-Makassar community, as well as to strengthen awareness of the importance of integrity and honesty in social interactions. This research employs a meticulous and in-depth literature review method, combining various reference sources. It is hoped that this research will provide a comprehensive understanding of the issue of illegal gratification from the perspectives of Islamic law and the culture of the Bugis-Makassar community. From the findings of this research, it can be concluded that efforts to prevent illegal gratification from the perspective of Islamic law and the culture of the Bugis-Makassar community require a holistic approach that integrates local cultural values with Islamic legal principles. Concrete steps are needed to address existing challenges and strengthen social awareness of the importance of integrity and honesty in social interactions.

Abstract

Customary criminal law is a key component of Indonesia's legal framework, originating from the nation's indigenous culture. The process of reforming criminal law in Indonesia, which aims to replace the old colonial criminal law, has included elements of customary criminal law as the legal basis and recognition of them in the latest revision of the "Kitab Undang-Undang Hukum Pidana" (KUHP). However, while welcoming the inclusion of customary criminal law as a positive step, it also has an impact on customary law itself through the formalization process, establishing criteria and limitations in its application. This article will review the implications arising from the harmonization of customary criminal law in the latest Criminal Code that will be implemented. The analytical approach used is normative research, which focuses on statutory regulations. Based on this analysis, the conclusion is that the recognition of customary law as an interpretation of the concept of "living law" in Article 2 of the National Criminal Code is an effort to integrate the two legal systems that apply in Indonesia, namely customary law. This step has important significance as an effort to reform the criminal law system in Indonesia, which tends to be formalistic and legalistic. According to the progressive theoretical view, it is emphasized that the formation of regulations must take into account the values and norms implemented by society (living law). The alignment of customary offenses in the reform of the national criminal law system has legal impacts on its implementation, so derivative regulations in the form of a compilation are needed. Regional governments that have customary offenses in their territory must develop Peraturan Daerah (Perda) to compile a compilation of these offenses. Hukum pidana adat adalah komponen kunci dalam kerangka hukum Indonesia, yang berasal dari budaya asli bangsa ini. Proses pembaharuan hukum pidana di Indonesia, yang bertujuan untuk menggantikan hukum pidana kolonial yang lama, telah memasukkan unsur-unsur dari hukum pidana adat sebagai dasar hukum dan pengakuan terhadapnya dalam revisi terbaru “Kitab Undang-Undang Hukum Pidana” (KUHP). Namun, sambil menyambut inklusi hukum pidana adat ini sebagai langkah positif, juga timbul dampak pada hukum adat itu sendiri melalui proses formalisasi, penetapan kriteria, dan batasan dalam penerapannya. Artikel ini akan mengulas implikasi yang ditimbulkan oleh penyelarasan hukum pidana adat dalam KUHP terbaru yang akan diterapkan. Pendekatan analisis yang digunakan adalah penelitian normatif yang berfokus pada peraturan perundang-undangan. Berdasarkan analisis ini, kesimpulannya yaitu bahwasanya pengakuan hukum adat sebagai penafsiran dari konsep "living law" dalam Pasal 2 KUHP Nasional merupakan upaya untuk mengintegrasikan dua sistem hukum yang berlaku di Indonesia, yakni hukum adat. Langkah ini memiliki signifikansi penting sebagai upaya reformasi sistem hukum pidana di Indonesia yang cenderung bersifat formalistik dan legalistik. Menurut pandangan teori progresif, ditekankan bahwa pembentukan peraturan harus memperhitungkan nilai-nilai serta norma-norma yang dijalankan masyarakat (living law). Penyelarasan delik adat dalam pembaruan sistem hukum pidana nasional memiliki dampak hukum dalam pelaksanaannya, sehingga diperlukan regulasi turunan berupa kompilasi. Pemerintah daerah yang memiliki delik adat di wilayahnya harus mengembangkan Peraturan Daerah (Perda) untuk menyusun kompilasi mengenai delik-delik tersebut.

Abstract

Tindak pidana dalam Kitab Undang-Undang Hukum Pidana dikenal dengan istilah Strafbaarfeit dan dalam kepustakaan tentang hukum pidana sering mempergunakan istilah delik, sedangkan pembuat undang-undang merumuskan suatu undang-undang mempergunakan istilah peristiwa pidana atau perbuatan pidana atau tindak pidana. Adapun mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan para pihak dengan dibantu oleh mediator. Penelitian ini membahas mengenai seberapa efektif penyelesaian tindak pidana pengeroyokan dengan menggunakan mediasi penal yang dapat memberikan kepastian hukum kepada pihak pelaku dan juga korban. Tujuan penulisan ini untuk mengetahui dan mengkaji efektivitas penyelesaian tindak pidana pengeroyokan melalui mediasi penal dalam memberikan kepastian hukum kepada pihak pelaku dan korban. Penelitian ini diharapkan dapat memberi manfaat baik secara teoritis maupun secara praktis. Secara teoritis, hasil penelitian ini dapat dijadikan sebagai bahan kajian lebih lanjut untuk melahirkan pemikiran-pemikiran teoritis terhadap penerapan restorative justice dalam penanganan perkara pidana yang pada gilirannya memberikan sumbangan bagi pembangunan hukum pidana nasional. Adapun Secara praktis, hasil penelitian ini dapat digunakan sebagai bahan kajian bagi penyidik Polri dalam menerapkan restorative justice pada penanganan perkara pidana.

Abstract

The advancement of digital technology has accelerated the adoption of electronic signatures (ETS) in a wide range of civil transactions in Indonesia. However, their legal validity and evidentiary strength continue to present significant challenges. This study seeks to examine the legal foundations governing the validity of ETS within the framework of Indonesian civil law, evaluate their recognition as admissible evidence in judicial proceedings, and identify key implementation barriers related to technical infrastructure, procedural limitations, and public trust. Employing a normative legal approach combined with jurisprudential analysis of court decisions from 2018 to 2025, the study finds that while certified ETS are normatively recognized as legally valid, their practical application remains inconsistent—particularly in cases involving uncertified ETS. The primary impediments include limited technical capacity among law enforcement personnel, low levels of digital literacy, and uneven access to certification infrastructure. In conclusion, the effective implementation of ETS in Indonesia requires regulatory harmonization, capacity-building within judicial institutions, and efforts to strengthen public confidence in the legal validity and security of ETS within the national legal system.
