Abstract

Traditional inheritance law has a collective, major, and individual system. Indigenous peoples in Bali have a system of inheritance which is based on a system called patililinial, which has the understanding that male or male descendants are preferred for inheriting from their families. Problems regarding land tenure without the consent of heirs often occur because the heirs only prioritize their own interests without prioritizing common interests, namely the interests of the entire extended family in the distribution of inheritance. This research was analyze the distribution of inheritance in the traditional legal system of inheritance in Bali and the legal consequences of inherited land without the consent of other heirs? The research method used is normative legal research, namely by conducting a literature study and writing in a descriptive manner from primary and secondary legal materials using the Supreme Court Decision Number 1899 K/Pdt/ 2008. The result of research is distribution of inheritance in the customary law system in Bali, based on a family system including the patrilineal system, that this system draws the lineage of men which means that the right to inherit this system is boys. The legal consequences of inherited land without the consent of other heirs will result in a dispute between the heirs who can take the court if the problems that occur cannot be resolved through a customary institution. So to the heirs who adhere to the Balinese inheritance customary law system in its distribution, carried out with the knowledge of all family members, especially the heirs concerned and with the knowledge of the traditional village. This division of inheritance is based on the nature of Balinese inheritance customary law which adheres to the principle of kinship and deliberation from all legitimate heirs. Hukum adat waris mempunyai sistem kolektif, mayorat, dan individual. Masyarakat adat di Bali memiliki sistem untuk mewaris yang dimana berdasar pada sistem yang disebut patrilinial, yang mempunyai pengertian bahwa keturunan pria atau laki-laki lebih diutamakan untuk mewaris di keluarganya. Permasalahan mengenai penguasaan tanah tanpa persetujuan ahli waris sering terjadi dikarenakan para ahli waris tersebut yang hanya mengutamakan kepentingan tersendiri tanpa mengutamakan kepentingan bersama yaitu kepentingan seluruh keluarga besarnya dalam pembagian waris. Penelitian ini menganalisis tentang pembagian harta (tanah) warisan dalam sistem hukum adat waris di Bali dan akibat hukum tanah warisan yang dikuasai tanpa persetujuan dari ahli waris lain. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu dengan melakukan studi kepustakaan dan penulisan secara deskriptif dari bahan hukum primer dan sekunder menggunakan Putusan Mahkamah Agung Nomor 1899 K/Pdt/2008. Hasil penelitian ini menemukan pembagian harta warisan dalam sistem hukum adat di Bali, berdasarkan sistem kekeluargaan termasuk sistem patrilinial, bahwa sistem ini melihat dan mengutamakan keturunan laki-laki artinya yang berhak mewaris dalam sistem ini adalah anak laki-laki. Akibat hukum dari tanah waris yang dikuasai tanpa persetujuan ahli waris lain akan mengakibatkan terjadinya perselisihan antara para ahliwaris yang dapat menempuh jalur pengadilan jika permasalahan yang terjadi tidak dapat diselesaikan melalui lembaga adat. Maka kepada ahli waris yang menganut sistem hukum adat waris Bali dalam pembagiannya, dilakukan dengan sepengetahuan seluruh anggota keluarga khususnya para ahli waris yang bersangkutan dan dengan sepengetahuan desa adat. Pembagian warisan ini berdasarkan sifat hukum adat waris Bali yang menganut asas kekeluargaan dan musyawarah dari seluruh ahli waris yang sah.

Abstract

Abstract—The deposit certificate according to bank Indonesia is proof of the debt issued by the bank for the amount of money entrusted to him for a certain period of time. Certificates of deposit issued can be purchased at per-sale at any time and can be played for a bank loan as well as PT. BRI Bank pays the mortgage by holding the original certificate of deposit guaranteed until the credit facility is paid off. The formulation of the problem in this study is as follows: how is the implementation of the credit agreement with collateral for deposit certificates at PT. BRI Bank Mataram Branch Office and how the legal consequences and method of settlement if the term deposit certificate has been completed, while the credit agreement is still running. In this study empirical legal research was used. The results of the discussion in this study are as follows: Implementation of credit agreements with collateral for deposit certificates at PT. BRI BANK Mataram Branch Office is carried out with several stages of the process that must be done to become a debtor at PT. BRI BANK, namely applying for credit, and signing credit. In implementing credit agreements with collateral/ collateral for deposit certificates at PT. BRI BANK prospective borrowers must have deposits in their own name, not on behalf of other people. The way to settle a deposit certificate with a shorter period of time compared to a credit agreement is where the bank will change the form of a certificate of deposit into an ARO (Auth Roll Over) certificate so that when the deposit certificate is due, the time period will automatically adjust to the credit period and the reimbursement are with the knowledge of the customer, if the debtor wants to apply for a loan with a guarantee of a certificate of deposit.

Abstract

Many women want to have clean and healthy skin. So that there is an increase in perpetrators or unscrupulous actors who make masks with natural ingredients from nature which are used as beauty ingredients for women, but many ask for making natural mask makers to cheat by not registering their products with the relevant agencies for safety. The formulation of the problems raised in the writing of this thesis are: 1) What is the form of legal protection for consumers against the circulation of illegal organic face masks through online media? 2) How is the regulation of legal sanctions against perpetrators / sellers of illegal organic face masks through online media that are detrimental to consumers? The method used is a normative research method. The existence of legal guarantees to consumers against the circulation of illegal natural face masks through online intermediaries is regulated in Article 3, Article 4, and Article 5. In terms of legal sanctions, illegal face mask business actors receive sanctions in the form of administrative sanctions in which online site owners are blocked. temporarily by the relevant authorities and the revocation of business sales in the online business.

Abstract

A grant as one of the delivery or levering of an item for free to another person, with consequences without being able to withdraw it which is intended for the benefit of the grantee is one of the legal actions that are quite common in legal subjects in private law traffic. The Civil Code has not explicitly regulated the prerequisites for adopted children as subjects in grants. The problems of this research are: 1. How is the arrangement of granting land to adopted children in the legal regulations in Indonesia; 2. What are the legal consequences arising from the agreement on granting land to adopted children made before the Land Deed Maker Official according to the Civil Code. The results of the study show that the Civil Code stipulates that legal subjects who can carry out land grants are all people who are adults and are capable of carrying out legal actions. The legal consequence of the agreement to grant land grants before PPAT to adopted children who are adults and legally capable is the transfer of ownership rights to the land object of the grant to the adopted children as grantees, where the agreement binds both parties with the PPAT grant deed registered with the National Land Agency.

Abstract

Credit is the provision of money and types of loans that must be paid back. Credit has a high risk for banks, so notaries as public officials make cover notes in credit agreements. The formulation of the problem discussed is How is the Authority and Responsibility of Notaries in Credit Agreements and How is Legal Protection for Creditors in Credit Agreements Related to the Use of Notary Covernote? The research method used is normative juridical. The results showed that the obligations and responsibilities of notaries in credit agreements are to bridge the interests of creditors and borrowers in making deeds to credit agreements. Lending and borrowing agreements are regulated in the Civil Code Article 1754 to Article 1769. Legal protection for bank creditors in credit agreements using notary covernote in the event of default before the issuance of mortgage rights gives the bank's position only as a concurrent creditor and legal protection for banks is based on Articles 1131 and 1132 of the Civil Code.

Abstract

Illegal importation of used clothing is a common practice in Indonesia. It is not uncommon for used clothing that has been illegally imported to be traded freely. The problems discussed in this study are 1) the legal regulation of imported used clothing according to Law Number 7 of 2014 and 2) the role of the government in overcoming the phenomenon of illegally imported used clothing that is freely traded in Indonesia?. The research method used is normative juridical research method through literature study. The legal materials used are primary legal materials and secondary legal materials. The results of the study stated. Legal arrangements for imported used clothing have been explicitly explained through Article 47 paragraph 1 of Law Number 7 of 2014 concerning trade. The role of the government in overcoming the phenomenon of illegal imports of used clothing that is freely traded in Indonesia is realized through supervisory efforts with the formation of regulations of Law Number 7 of 2014 and enforcement efforts through sanctions against illegal importers and used clothing business actors in Indonesia.
