Abstract

This paper examined the articulation of the interests of regional community through the authority of members of the Regional Representative Council (DPD) to see the extent of the functions and authorities of people representative officials in realizing the public interest of the regional people. This paper utilized conceptual approach and statutory approach to the law because of its normative type in nature. Therefore, the required data were in form of articles of the law regulating the authority of members of the Regional Representatives Council (DPD) as well as the interests of the society in the region. In addition, data from bibliography were also collected, such as results of scientific studies relevant to the object of study in the present study to compare theories leading to meet conclusions to be drawn. The results show that the articulation of the interests of regional community within the scope of the authority of the DPD is still very limited because it is at the theoretical level, instead of practical. The DPD should have taken strategic steps in helping to succeed the interests of the regional community of developemnts.

Abstract

AbstractThe research objective is to find out and understand the use of the right of immediate pursuit of foreign ships that violate the Indonesian sea territory; and know and understand the limits of Indonesia's authority in the use of the right of immediate pursuit in its territorial waters. The problem is how to use the right of immediate pursuit of foreign ships that violate Indonesia's maritime territory. And what about the limits of Indonesia's authority in the use of immediate pursuit rights in its territorial waters? The research method used is empirical legal research methods. The results of the research on the use of the right of immediate pursuit of foreign ships that violate the territorial sea of Indonesia include several things that must be considered, namely the chase must be carried out by the competent authority of the coastal State and have sufficient reasons and are convincing that the foreign ship has violated the law in waters of the jurisdiction of the coastal State. The pursuit must begin when a foreign ship or one of its partners is in inland waters, archipelagic waters, territorial seas, auxiliary routes or exclusive economic zones. The pursuit can only continue outside the territorial seas, outside the auxiliary routes or outside the exclusive economic zone if the pursuit is continuous and uninterrupted. The pursuit may only begin after giving a stop sign from a distance that the foreign ship can see or hear. The right of pursuit must be stopped as soon as the ship being chased has entered the sea of the territory of the third party. The limit of Indonesia's authority in the use of the right to immediate pursuit in its territorial waters, Indonesia can take actions, starting with a signal, for example with a sound sign or a flag signal or an optical light, not paying attention to the signal, then it may be followed by warning shots. the first shot with a blank bullet is also ignored, followed by the shot with a live bullet, provided that when shooting, the shot must be directed in front of the prow of the ship being chased. If you take a fight that endangers the patrol boat or the lives of people, balanced violence can be carried out, if possible avoiding casualties. The immediate chase is stopped if the foreign ship enters the territorial waters of another State.Key words: right of immediate pursuit; foreign ships; useAbstrakTujuan penelitian untuk mengetahui dan memahami penggunaan hak pengejaran segera terhadap kapal-kapal asing yang melanggar wilayah laut Indonesia; dan mengetahui dan memahami batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya. Permasalahan yaitu bagaimana penggunaan hak pengejaran segera terhadap kapal-kapal asing yang melanggar wilayah laut Indonesia. Dan bagaimana batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya. Metode penelitian yang dipergunakan metode penelitian hukum empiris. Hasil penelitian penggunaan hak pengejaran segera terhadap kapal asing yang melanggar wilayah laut Indonesia, mencakup ada beberapa hal yang harus diperhatikan, yaitu pengejaran harus dilakukan oleh pihak yang berwenang dari Negara pantai dan mempunyai alasan yang cukup serta meyakinkan bahwa kapal asing tersebut telah melakukan pelanggaran hukum di perairan yurisdiksi Negara pantai. Pengejaran itu harus dimulai ketika kapal asing atau salah satu sekocinya ada di perairan pedalaman, perairan kepulauan, laut teritorial, jalur tambahan atau zona ekonomi eksklusif. Pengejaran itu hanya dapat dilanjutkan di luar laut wilayah, di luar jalur tambahan atau di luar zona ekonomi eksklusif bila pengejaran itu terus menerus dan tidak terputus. Pengejaran hanya boleh dimulai setelah memberi suatu tanda berhenti dari suatu jarak yang dapat dilihat atau didengar oleh kapal asing tersebut. Hak pengejaran itu harus dihentikan sesaat kapal yang dikejar itu telah memasuki laut wilayah Negara pihak ketiga. Batas kewenangan Indonesia dalam penggunaan hak pengejaran segera di wilayah perairannya, Indonesia dapat melakukan tindakan-tindakan, diawali harus dilakukan dengan memberi tanda isyarat, misalnya dengan tanda suara atau isyarat bendera atau lampu optis, tidak diperhatikannya tanda isyarat, baru boleh dilanjutkan dengan tembakan peringatan, tembakan pertama dengan peluru hampa, juga tidak diindahkan dilanjutkan dengan tembakan dengan peluru tajam, dengan ketentuan bahwa waktu menembak, tembakan harus diarahkan di depan haluan kapal yang dikejar. Apabila melakukan perlawanan yang membahayakan kapal patroli atau jiwa orang, dapat dilakukan tindakan kekerasan yang seimbang, jika memungkinkan menghindari adanya korban jiwa. Pengejaran segera itu dihentikan apabila kapal asing tersebut memasuki wilayah perairan Negara lain.

Abstract

Prior to the 1990s, there was no agency that managed Batur tourism objects and resources. In 2017 a tourism area management body was formed, but at that time its authority was limited to the imposition of levies for tourists visiting the Geopark tourism area. It is not clear which agency has the authority to organize tourism areas, so a problem arises: The agency authorized to organize tourism areas and the factors that affect the arrangement of tourism areas. This research aims as evaluation materials in arrangement the Batur Unesco Global Geopark Tourism Area in Bangli Regency The research method used is empirical legal research. The analysis techniques that will be used are Legal-Content Analysis and Futuristic Analysis. This legal research aims to analyze the problem, namely the agency authorized to organize the Batur UNESCO Global Geopark tourism area in Bangli Regency. The authority of the management body is limited only in collecting fees, whereas for a significant increase, the authority of the agency is not only to collect tourist fees, but also to organize the area to increase its tourist attractiveness. The results of the discussion of the regulation of the authority for structuring tourism areas are the Bali KSDA and the Bangli Regional Government, as well as the not yet implemented regional arrangement based on natural preservation, community empowerment, and environmental economic progress. Meanwhile, the conclusions and suggestions are that the Management Agency has not yet been authorized to organize tourism areas. Factors that influence the structuring of the tourism area are the substance of the Bangli regional regulation, concerning households, local law enforcers, and the legal culture of the local community. Suggestions that the tourism area management body should be changed to Perumda. Law enforcement must have synergy between the Bangli Regional Government and the Bali BKSDA.

Abstract

The purpose of this study was to analyze the justification for the involvement of Traditional Villages in the implementation of the prevention and control of the Covid 19 Pandemic in Yang Api Village and Peninjoan Village. The Bali Provincial Government synergizes activities to prevent the transmission of the Corona Virus (Covid-19) by involving Indigenous Villages in Bali. The implementation of policies such as PPKM in traditional villages cannot be carried out alone by the government but requires cooperation with various parties, including the community, health workers and security officers. In general, Babinkamtibmas are security officers in the village. However, in Bali, every traditional village has a pecalang as a traditional security officer based on traditional local wisdom. The local government through the Decree on the formation of the Customary Village-based Mutual Assistance Task Force has provided space for indigenous village communities to independently handle the Covid-19 pandemic faced by the Fire and Peninjoan Traditional Villages. With the provision of this space, the Covid-19 Gotong Royong Task Force can handle the ongoing pandemic on its own, starting from education, socialization, prevention and even handling. In addition, traditional villages also receive support from the Village Service so that they can coordinate with each other. The maintenance of conduciveness in the village is carried out well, with the synergy of traditional villages with official villages in handling Covid-19. The involvement of elements of the Traditional Village (pecalang) in a pandemic emergency situation is indeed possible and does not become a serious problem because what is put forward is the principle of benefit for humanity. Meanwhile, the success rate of involving traditional pecalang in Yang Api and Peninjoan Villages has worked well, although in August there was a surge in people infected with Covid 19, but it was more due to the many traditional events in the village, and not because of the negligence of the Covid task force in synergizing its main functions. The positive performance of the involvement of traditional villages in pandemic prevention needs to be continued in the future for activities that benefit the indigenous village community.

Abstract

The central government gives authority to regional governments to take care of their household affairs which are unique to the region with the aim that local governments are more effective in managing regional affairs both in terms of development, utilization and management of natural resources and human resources. The Regional Head who plans the APBD to organize his administration is also required to be able to provide accountability/provide reports on the results of the use of the APBD. The use of this APBD, of course, must have an agency that oversees it, in the administration of regional government that supervises it, namely the DPRD. Based on this description, the problems examined in this study are: What is the mechanism for preparing the APBD accountability report? according to Law Number 17 of 2003 is a regional financial plan approved by the Regional People's Representative Council (DPRD). This research is a normative research that uses a statutory approach. The legal material used in this study comes from the results of library research which consists of primary and secondary legal materials obtained through literature review techniques supported by analytical techniques. From the results of this study it can be interpreted that accountability and oversight are one unit to realize good governance, because it can provide an evaluation of the performance of the government for the future.

Abstract

Environmental law enforcement in Indonesia, particularly under Law No. 32 of 2009 on Environmental Protection and Management, faces persistent challenges in applying the principle of ultimum remedium—treating criminal sanctions as a last resort. This study aims to evaluate the effectiveness of non-criminal sanctions, namely administrative and civil measures, as prerequisites to criminal enforcement in environmental cases. Using a normative juridical method and descriptive-analytical approach, the research analyzes statutory regulations, judicial decisions, and enforcement practices in pollution cases, including hazardous and toxic waste violations. The findings reveal that administrative and civil sanctions remain weak due to limited supervision, lengthy civil procedures, and inadequate compensation mechanisms. Additionally, poor institutional coordination and limited enforcement capacity hinder the transition to criminal sanctions. Community involvement is also underutilized in supporting legal accountability. The study concludes that a more structured three-layered enforcement approach—integrating administrative, civil, and criminal mechanisms—is needed to uphold environmental justice. Strengthening institutional capacity and aligning reparative and retributive principles are essential to ensure the ultimum remedium principle operates effectively. These findings contribute to legal reform efforts and the development of sustainable environmental governance in Indonesia.

Abstract

Narcotics are indeed badly needed for health care, but when its misused narcotics will make people become dangerous, let alone to make people dependent so hard it let go of that dependency in the body. Narcotics himself has become the enemy in the countries to be destroyed because the effect is so dangerous to human life and could weaken national resilience. Enforcement of criminal laws against narcotics not apart on principles of criminal law in order to realize a certainty of law from any form of settlement of the matter the crime of narcotics on the basis of the legal system of Indonesia. This research aims to find out how law enforcement undertaken against narcotics addicts, and to find out how law enforcement measures to prevent narcotic addicts. The research results obtained are law enforcement against narcotics addicts who where its application has not pursuant to section 127 subsection (3) and section 54 of the Act Number 35 Year 2009 About Narcotic addicts which is supposed to be in rehabilitation instead of prison, given the addicts are simply victims and sick people is not a hustler given jail sanctions. Narkotika yang memang sangat diperlukan untuk Kesehatan, tapi ketika narkotika yang disalahgunakan akan membuat orang menjadi berbahaya, apalagi untuk membuat orang tergantung begitu keras untuk melepaskan bahwa ketergantungan dalam tubuh. Narkotika sendiri yang menjadi musuh di negara-negara untuk dimusnahkan karena pengaruh jadi berbahaya bagi kehidupan manusia dan bisa melemahkan ketahanan nasional. Penegakan hukum pidana terhadap narkotika tidak terpisah pada prinsip-prinsip hukum pidana dalam rangka mewujudkan suatu kepastian hukum dari segala bentuk penyelesaian masalah kejahatan narkotika berdasarkan sistem hukum Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana dilakukan terhadap pecandu narkoba dan untuk mengetahui bagaimana langkah-langkah penegakan hukum untuk mencegah pecandu obat bius penegakan hukum. Hasil penelitian yang diperoleh adalah hukum penegakan terhadap narkotika addict’s yang mana penerapannya memiliki tidak sesuai dengan bagian 127 ayat (3) dan bagian 54 dari undang-undang Nomor 35 tahun 2009 tentang narkotika addicts yang seharusnya rehabilitasi sebaliknya penjara, mengingat pecandu hanya korban dan orang sakit tidak pengedar diberikan sanksi penjara.

Abstract

Abstract Representative Council (DPRD) is an element of regional government administering that is equal to the local government in making regional regulations in implementing regional autonomy, so that a good performance is needed between the executive and the legislative to create good governance. This study examines the mechanism of the implementation of the supervisory function, the follow-up to violations of a Regional Regulation, obstacles and efforts to overcome the obstacles that arise in carrying out the supervisory function carried out by the Tabanan Regency DPRD on the implementation of Regional Regulations. Approach to the problem used in empirical legal research is the legal sociology approach where legal research is taken from the facts in a society, legal entities or government, observation and documentation. The results of this study indicate that the implementation of the supervisory function of DPRD Tabanan Regency on the implementation of local regulations has been carried out properly in accordance with applicable regulations and mechanisms, and supervision of these regulations is carried out with the following mechanism: DPRD Conducts work meetings, field visits, hearings. The follow-up action of DPRD Tabanan Regency on violations in Regional Regulation number 14 in 2018 concerning the Arrangement of Supermarkets is by sending recommendations to the relevant OPD to provide shopkeepers with a warning letter that violates the provisions and if it is not heeded the shop must be closed. The obstacles that are often faced are the lack of understanding among council members about the limitations and scope of conducting supervision of the Perda and the lack of participation from the community. The step of the Tabanan Regency DPRD to overcome obstacles is by providing experts in order to support the smooth functioning of the DPRD in carrying out the oversight function. Keywords: Local Regulation ; Representative Council Tabanan Regency; Supervision Function Abstrak Dewan Perwakilan Rakyat Daerah (DPRD) Kabupaten Tabanan merupakan unsur penyelenggaran pemerintahan daerah yang sejajar dengan pemrintah daerah dalam membuat peraturan daerah dalam melaksanakan otonomi daerah, sehingga diperlukan sebuah kinerja yang baik antara eksekutif dan legislatif untuk menciptakan pemerintahan yang baik. Penelitian ini mengkaji mengenai mekanisme pelaksanaan fungsi pengawasan, upaya hukum terhadap pelanggaran sebuah Perda, hambatan-hmbatan serta upaya mengatasi hambatan-hambatan yang timbul dalam melakukan fungsi pengawasan yang dilakukan oleh DPRD Kabupaten Tabanan terhada pelaksanaan Peraturan Daerah. Pendekatan masalah yang dipergunakan dalam penelitian hukum empiris ini yaitu pendekatan sosiologi. Hasil penelitian ini menunjukkan bahwa pelaksanaan fungsi pengawasan DPRD Kabupaten Tabanan terhadap Perda dilakukan dengan mekanisme sebagai berikut: DPRD Melakukan rapat kerja, kunjungan lapangan, rapat dengar pendapat. Tindak lanjut DPRD Kabupaten Tabanan terhadap pelanggaran dalam Perda Nomor 14 Tahun 2018 tentang Penataan Toko Swalayan adalah dengan cara mengirimkan rekomendasi kepada OPD terkait untuk memberikan surat peringatan terlebih dahulu kepada pemilik toko yang melanggar ketentuan dan apabila tidak diindahkan maka toko tersebut wajib untuk ditutup. Sedangkanyang menjadi hambatan DPRD dalam melakukan fungsi pengawasan adalah kurangnya pemahaman anggota dewan terhadap ruang lingkup dan batasan-batasan dalam melakukan fungsi pengawasan dan kurangnya pasrtisipasi dari masyarakat. Langkah DPRD Kabupaten Tabanan dalam mengatasi hambatan adalah dengan cara menyediakan tenaga ahli khusus dalam rangka mendukung kelancaran DPRD dalam melaksanakan fungsi pengawasan. Abstract

One of the natural resource wealth of the biodiversity that exists in Indonesia that is viewable from wildlife that exists, whether protected or not protected by the Government. But in fact there is a protected wildlife by the use by a person who is not liable to benefit himself regardless of the impact that will be brought about from his actions. The problems of this research were: 1) how setting criminal sanctions against perpetrators of trafficking protected wildlife and 2) what kind of accountability against perpetrators of trafficking protected wildlife. The research method used is the method of normative legal research so that issues approach used namely legislation, conceptual, and case law materials and using primary, secondary, and tertiary. So the legal materials collection techniques are used namely engineering documentation by processing and analyzing legal material has been collected with the use of legal argumentation. As for the results of this research it can be concluded that the arrangements regarding sanctions for perpetrators of trafficking protected wildlife is contained in section 40 of the Act number 5 Year 1990 about conservation of natural resources, the ecosystem and Biodiversity as well as form liability imposed upon the perpetrators of proven trade protected wildlife i.e. criminal liability in accordance with provisions of laws and regulations that govern these actions. Salah satu kekayaan sumber daya alam hayati yang ada di Indonesia yaitu dapat dilihat dari satwa yang ada, baik yang dilindungi maupun tidak dilindungi oleh pemerintah. Tetapi pada kenyataannya terdapat satwa yang dilindungi oleh pemerintah diperjualbelikan oleh seseorang yang tidak bertanggung jawab guna menguntungkan dirinya sendiri tanpa melihat dampak yang akan ditimbulkan dari tindakannya tersebut. Permasalahan dari penelitian ini adalah: 1) Bagaimana pengaturan sanksi pidana terhadap pelaku perdagangan satwa yang dilindungi dan 2) Bagaimana bentuk pertanggungjawaban terhadap pelaku perdagangan satwa yang dilindungi. Metode penelitian yang digunakan adalah metode penelitian hukum normatif sehingga pendekatan masalah yang digunakan yaitu pendekatan perundang-undangan, konseptual, dan kasus serta menggunakan bahan hukum primer, sekunder, dan tersier. Sehingga teknik pengumpulan bahan hukum yang digunakan yaitu teknik dokumentasi dengan mengolah dan menganalisis bahan-bahan hukum yang telah terkumpul dengan mempergunakan argumentasi hukum. Adapun hasil dari penelitian ini dapat disimpulkan bahwa pengaturan mengenai sanksi bagi pelaku perdagangan satwa yang dilindungi terdapat pada Pasal 40 Undang-undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya serta bentuk pertanggungjawaban yang dikenakan kepada pelaku tersebut yang telah terbukti melakukan perdagangan satwa yang dilindungi yaitu pertanggungjawaban pidana sesuai dengan ketentuan peraturan perundang-undangan yang mengatur tindakan tersebut.

Abstract

In many societies, marriage customs, who married her partner of different nationality for example a man citizen of Indonesia who married women foreign nationals or otherwise. It is caused due to the influence of globalization today. Of course, the marriage will having problems in the determination of citizenship status if they have children, especially if they settled in Indonesia. This research intended to find answers about the determination of the status of citizenship of children born of mixed marriages and the legal protection of children of mixed marriages that result. This research uses research methods through a conceptual approach to normative. The author uses primary law binding and also secondary legal material as a reference. The results of this research is the child of a mixed marriage deserve the status of dual citizenship is limited and is also entitled to preventive legal protection to guarantee the certainty of the law as a citizen of Indonesia. Dalam melangsungkan perkawinan, banyak masyarakat yang menikah dengan pasangannya yang berbeda kewarganegaraan misalnya seorang pria warga negara Indonesia yang menikah dengan wanita warga negara asing ataupun sebaliknya. Itu disebabkan karena pengaruh globalisasi saat ini. Tentu saja perkawinan tersebut akan menimbulkan masalah dalam penentuan status kewarganegaraan apabila pasangan tersebut memiliki anak, terutama apabila pasangan tersebut menetap di Indonesia. Penelitian ini dimaksudkan untuk menemukan jawaban tentang penentuan status kewarganegaraan anak yang lahir dari perkawinan campuran tersebut dan perlindungan hukum terhadap anak hasil perkawinan campuran terserbut. Penelitian ini menggunakan metode penelitian normatif melalui pendekatan konseptual. Penulis menggunakan bahan hukum primer yang bersifat mengikat dan juga bahan hukum sekunder sebagai referensi. Hasil penelitian ini adalah anak hasil perkawinan campuran berhak mendapatkan status kewarganegaraan ganda terbatas dan juga berhak mendapatkan perlindungan hukum preventif untuk menjamin kepastian hukumnya sebagai warga negara Indonesia.
