Abstract

Pernikahaan merupakan sesuatu hal yang dilakukan setiap manusian untuk menghalalkan yang semula haram dilakukan bedasarkan ajaran Agama. Dengan adanya pernikahan maka akan terbentuk keluarga baru yang tentunya menjadi harmonis dan sejahtera. Maka untuk mewujudkan hal itu perlunya adanya persiapan pra menikah.Dalam pernikahan dibutuhkan persiapan baik mental, finansial dan pengetahuan tentang pernikahan. Maka perlulah adanya bimbingan pranikah sebelum melaksanakan pernikahan agar mengetahui kehidupan pernikahan kelak dan mempersiapkan diri untuk kehidupan rumah tangga nanti.Dalam pengabdian ini menggunakan metode kualitatf difkriptif yang mana peran peneliti mendiskripsikan strategi dan mpdel bimbingan bagi calon pengantin, adapun teknik penggalian data dalam penelitian ini menggunakan angket dan wawancara serta observasi secara langsung.langkah yang dilakukan adalah Tim akan bermitra dengan KUA Kecamatan Doko Kabupaten Blitar untuk melaksanakan program dari KUA tersebut dan dalam hal ini akan berkolaborasi dengan Prodi Hukum Keluarga Islam UNU Blitar untuk menindaklanjutinya.Hasil dari penelitian menunjukkan proses bimbingan pranikah di KUA Kecamatan Doko dilakukan melalui dua tahapan yaitu tahap pra pelaksanaan dan tahap pelaksanaan.Tahap pra pelaksanaan yaitu masing-masing calon pengantin harus memenuhi beberapa prosedur sebelum melaksanakan bimbingan pranikah.Pada tahap pelaksanaan materi yang disampaikan yaitu tentang UU perkawinan dan Fiqh munakahat, kesehatan, materi penyuluhan, dan materi upaya membentuk keluarga sakinah.Materi tersebut dilakukan dengan metode presentasi, tanya jawab dan tes.Bedasarkan hasil kajian menunjukan bahwa pengantin yang akan menikah mempunyai kesiapan yang matang untuk membina rumah tangga.Bedasarkan hasil surve kepuasan pelanggan menunjukan pengantin merasa terbantu dengan bantuan pendampingan ini.

Abstract

This article discusses law enforcement regarding human rights in Indonesia based on law positive in Indonesia. The author chose this title because until now law enforcement in particular related to human rights in Indonesia is still not optimal. Main problem in this article are: how the law is applied to violations of human rights, which institutions prosecute human rights violators, means of settlement used in cases of violations of human rights in Indonesia. The conclusion of the problems discussed is the application of law to violations of human rights in Indonesia is guided by law no. 26 years 2000 concerning the Human Rights Court, where in the Act is mentioned about ad hoc human rights courts, which do not different from ordinary courts, especially criminal courts. Abstract

Ijab and qabul become one of the shamans who must get more attention. Ijab and qabul are required to be carried out in one mejelis/place. It will be a problem when ijab and qabul are carried out virtually in the event of conditions that do not support the covid-19. it affects the validity of marriage. The method used by the author uses a normative method, whose analysis is based on regulations and also the Library study. Researchers aim to know the validity of marriages that are carried out virtually. The results of this study, the researcher found that at the time of the pronunciation of the qabul when the bride and groom was not in one place, then the bridegroom must appoint a representative to represent himself carrying out the ijab and qabul. Abstract

Marriage is formed through a sacred bond between a man and a woman, said to be sacred because it is regulated by religion and then confirmed by state laws , customs and society. Pre-marital guidance itself is something that must be done and prepared in order to obtain provisions to live a new life. The importance of premarital counseling is due to several aspects, including problems of individual differences, economic problems, problems of individual development and problems of socio-cultural background. This is what encourages researchers to conduct research. Islamic Religion Counselors as well as guidance partners of the Directorate General of Islamic Community Guidance, and as the spearhead in carrying out the task of guiding Muslims in achieving a quality and prosperous life both physically and spiritually. This study aims to find out the role of the Islamic Religious Counselor at the KUA in Srengat District in providing religious guidance or counseling to the community in an effort to form a sakinah family. What is the method used by Islamic Religious Counselors in changing the paradigm of society in understanding sakinah families and how is the process of premarital guidance taking place at KUA Srengat District. This study uses an approach qualitative. The data collection method is through observation, interviews and documentation. The research objects are: Islamic Religious Counselors at the KUA Srengat, while the subjects of this research are the people in the Srengat area (youths who have married and who will carry out the marriage). The number of informants who were the target of this research data source were two prospective brides, two newlyweds (married) and one Islamic religious instructor. In this study, the researchers proved that the role of the Islamic Religious Counselor in providing premarital guidance to the community was quite efficient, because the function of the Islamic Religious Counselor at the Srengat District Office of Religious Affairs was to convey information to the public and give advice or so-called guidance, function as a consultant and function as an advocate. . The method used by the Islamic Religion Counselor at KUA Srengat to change the community's paradigm in understanding the meaning of a sakinah family is by providing an explanation of the position of the prospective husband and wife, the rights and obligations of the husband and wife, the joint rights of the husband and wife, and the joint obligations of the husband and wife. The process of pre-marital guidance carried out by Islamic Religion Counselors at the KUA in Srengat District uses two methods, namely directly and indirectly. Straight to the point Every couple who registers a marriage at the KUA is required to attend pre-marital counseling. When following the guidance, the bride and groom will be asked questions related to the sakinah family. Indirect premarital guidance is done online (via a temporary wasap group formed after registering until one month after the wedding), via Facebook and YouTube. Abstract

Joint assets are assets acquired during a legal marriage. Husband and wife have the same rights and obligations over joint property. In the practice of implementing law in the community,especially regarding the distribution of joint assets, there are variations/diversities in accordance with the customary provisions and habits of each region. In this regard, this research is focused on examining the method of sharing joint assets after divorce in Pandanarum Village, Blitar Regency. This research uses a qualitative method with a phenomenological approach, phenomenology is a type of qualitative research that looks at and looks more closely and in detail about individual explanations and understanding of their experiences. Data is collected by data reduction methods, data display, and verification or drawing conclusions. The results of this study indicate that in the practice of the Pandanarum village community, marriages that break up due to death then all assets become inheritance assets. if the husband dies first, then all assets become inheritance and are distributed to heirs based on fiqh provisions. The wife in this case only gets 1/8 if there are children and ΒΌ if there are no children. Meanwhile, if the wife dies first, usually the assets will not be divided until the husband dies.
