Abstract

Membahas kekosongan hukum yang terjadi dalam pelaksanaan diskresi kepolisian, khususnya dalam penyelesaian perkara tindak pidana ringan melalui mediasi penal, yang berpotensi menimbulkan ketidakpastian hukum dan ketidakadilan. Tanpa adanya pedoman hukum yang jelas, proses mediasi penal sering kali dipengaruhi oleh interpretasi yang tidak konsisten dan penyalahgunaan kewenangan oleh aparat penegak hukum, sehingga dapat mengurangi efektivitas penerapan restorative justice yang bertujuan untuk memberikan solusi yang lebih adil dan berorientasi pada pemulihan hubungan antara pelaku dan korban. Konsep restorative justice menjadi penting dalam menciptakan sistem peradilan yang lebih responsif terhadap kebutuhan masyarakat, karena menekankan pada pemulihan hubungan dan penyelesaian yang mengedepankan keadilan sosial, bukan semata-mata hukuman. Oleh karena itu, regulasi yang komprehensif dan terperinci mengenai pelaksanaan mediasi penal diperlukan untuk memastikan keadilan yang lebih transparan, efisien, dan sesuai dengan nilai-nilai sosial.

Abstract

Abstract The purpose of this study is to determine the extent of the perspective of organizational members about the meaning of commitment to organizational management. With the background, namely the mindset of organizational members in interpreting the form of commitment to organizational management, the main problem that arises is the inability to interpret the form of actual commitment that is based on organizational members including understanding commitment, realization of commitment, commitment obstacles, so that it becomes a dilemma when commitment clashes with circumstances or conditions in organizational management. This research is descriptive qualitative research that measures the concept of thinking from a questionnaire about the relationship of commitment to organizational management so that it will get an idea of the meaning of commitment in the organization. Data collection using questionnaires with interview methods with respondents to explore information about the process of forming commitments and to get how much perspective on commitments. In addition, this study also uses observation methods to get an overview of what happens about the respondents' perspective on the meaning of commitment and its application to the organization, whether it is limited to encouragement in the implementation of organizational management or extends to responsibility for organizational management with risks that occur when it clashes with non-conformities. The conclusion obtained is: that commitment is a meaning that serves as a positive encouragement that aims to arouse work passion in achieving the goals of the organization. Commitment cannot be made something to blame when the final results achieved do not follow organizational expectations because the nature of commitment is only as a positive bait and only as one's self-motivation to build enthusiasm in achieving organizational goals. The need for a policy is an effort used to bridge situations that are not by the actual situation so that the role of commitment will still be maintained to lead to the planned final results. Without rules, a commitment can still be implemented, because a commitment is an affirmation or expression conveyed to others as an effort to convince themselves of their sincerity or seriousness in acting. Even without rules, social sanctions will still occur if the perpetrators of the commitment do not carry out the consequences. On the other hand, with the application of written rules, a commitment will be more effective in its implementation because the rules are an order that must be obeyed and carried out and accompanied by written sanctions Keywords: Commitment, Organization, Management, Management

Abstract

This research aims to analyze the criminal law policy on narcotics in Indonesia and evaluate the reform of strengthening the role of law enforcement officials in combating narcotics offenses. The study focuses on examining the existing legal framework governing narcotics crimes, assessing the effectiveness of its implementation, and identifying the challenges faced in the law enforcement process. Through a comprehensive analysis, this research highlights various obstacles, including limitations in resources, inconsistencies in legal interpretation, and gaps in inter-agency coordination, which hinder the effectiveness of narcotics law enforcement. Furthermore, this study explores reform efforts to enhance the professionalism, capacity, and integrity of law enforcement officials as key agents in addressing narcotics-related offenses. It emphasizes the importance of improving training, adopting technology-driven approaches, and fostering accountability to ensure a more transparent and efficient enforcement system. The findings of this research are expected to contribute to the development of a more effective, just, and sustainable law enforcement policy that can better respond to the ongoing threat of narcotics in Indonesia. By addressing systemic challenges and implementing strategic reforms, this study advocates for a holistic approach to combating narcotics offenses and safeguarding society from their adverse impacts.

Abstract

The inconsistent imposition of sanctions on drug abuse offenders in Indonesia highlights significant challenges in the enforcement of narcotics legislation. Despite comprehensive regulations, discrepancies persist in the fairness and uniformity of punishments. This research examines these issues by employing a normative juridical method with a statutory and conceptual approach. The study identifies gaps between existing legal provisions and their application, revealing legal loopholes that undermine the objectives of narcotics legislation. Findings indicate that while efforts to enforce strict laws exist, inadequate coordination among law enforcement agencies exacerbates the inconsistency. This research aims to evaluate these discrepancies and propose solutions to strengthen legal frameworks and enforcement mechanisms. By enhancing inter-agency collaboration and revisiting the sanctions framework, the study advocates for a more just and effective legal system to combat drug abuse. These recommendations are expected to bridge gaps in narcotics legislation, ensuring justice for offenders while promoting the rule of law.
