Abstract

Lembaga bantuan hukum menjadi suatu kebutuhan praktek dalam proses peradilan, seperti halnya posbakum yang terbentuk di Pengadilan Agama berdasarkan kebutuhan masyarakat, persamaan dihadapan hukum dan hak untuk dibela oleh advokat dan penasihat hukum adalah hak asasi manusia yang perlu dijamin dalam rangka pencapaian keadilan sosial juga salah satu cara alternatif dalam mengurangi angka kemiskinan khususnya didalam bidang hukum. Bantuan Hukum yang ada di Pengadilan Agama berbentuk pelayanan Perkara Prodeo, pos bantuan hukum (posbakum), Posbakum di Pengadilan Agama bukan hanya digunakan oleh masyarakat miskin melainkan semua kalangan masyarakat umum yang membutuhkan batuan hukum (Ahmad Burhanudin : 2017). Diantara program yang masuk dalam kebijakan bantuan hukum adalah berperkara secara prodeo. Berperkara secara prodeo adalah pembebasan biaya perkara di pengadilan bagi para pihak yang berperkara (gratis/cuma-cuma), berperkara prodeo merupakan salah satu bentuk tanggung jawab ekonomi negara terhadap masyarakat yang tidak mampu, melalui pelayanan perkara prodeo masyarakat miskin yang tidak mampu membayar biaya perkara mendapatkan hak keadilan yang sama dihadapan hukum. Perkara prodeo hanya ditujukan kepada masyarakat miskin saja karena minimnya pengetahuan dan wawasan masyarakat menengah kebawah adanya bantuan hukum akhirnya tidak banyak masyarakat yang tahu adanya pelayanan perkara prodeo tersebut, Pengadilan Agama tidak memberikan sosialisasi secara khusus pada masyarakat tetapi pada saat pemohon mengajukan perkara di pengadilan. Dalam mengajukan perkara di Pengadilan Agama masyarakat banyak mengalami masalah, salah satunya pada saat pembayaran biaya administrasi, di lingkungan masyarakat masih banyak rakyat miskin yang tidak mampu membayar perkara di pengadilan dan kebanyakan rakyat miskin masih buta akan bantuan hukum dan pada umumnya mereka tidak memahami hak-hak dan kewajiban serta tidak tahu bagaimana menyelesaikan perkara sendiri di Pengadilan, oleh karena itu butuh pengenalan akan adanya bantuan hukum maupun pembiayaan bantuan hukum secara cuma-cuma (prodeo) pengaruhnya akan memberikan dampak positif bagi orang yang akan berperkara di Pengadilan Agama. Dalam peraturan perundang-undangan untuk mewujudkan program pelayanan perkara prodeo tidak terlepas dari peran pemerintah yang turut aktif dalam memenuhi hak mendapatkan keadilan bagi setiap anggota masyarakat, khususnya pelayanan perkara prodeo yang hanya ditujukan untuk masyarakat miskin secara finansial. Disebutkan pada Undang-undang Nomor 7 tahun 1989 tentang Pengadilan Agama Pasal 49 ayat 1 yang berbunyi “Pengadilan Agama bertugas berwenang, memeriksa, memutuskan dan menyelesaikan perkara-perkara ditingkat pertama antara orang-orang yang beragama Islam dibidang : Perkawinan, Kewarisan, wasiat , hibah, Waqaf dan shodaqoh, Ekonomi Syari’ah. Kekuasaan Relatif artinya kekuasaan pengadilan yang satu jenis dan satu tingkatan, dalam perbedaannya dengan kekuasaan pengadilan yang sama jenis dan tingkatan lainnya.

Abstract

Abu Talib's faith in the realm of Islamic thought still has a very long debate. Some scholars have claimed that he is an infidel, while others have claimed that he was a believer. Abu Talib was not uncommon also mixed up in political issues at the time of the power held by Mu'awiya sought to discredit Ali and his family. In the Koran, there are many verses that are considered by some scholars that the verses 113-114, al-Qasas verse 56, Surah al-An'am verse 26, and other letters relating to the faith of Abu Talib. The study was written as a reflection of the author's interest in knowing more about the subject by focusing Ibn Kathir's interpretation of the study as a Sunni interpretation and interpretation Tabataba'i as a homage to Shiite interpretation. The equation of these two interpreters is that Ibn Kathir explicitly says that these verses descend are addressed to Abu Talib (The Prophet's Uncle), who tells of Abu Talib's refusal to recite the two sentences of the shahadah at the end of his life, and still holds to his former religion Religion Abdul Mutallib. So also with T{abat{aba’i who said that Abu Talib died in a state of no faith and still hold on to the religion of his ancestors. While the location of the differences between them is contained in the interpretation of the letter al-An'am Ibn Kathir says the verse goes down with regard to Abu Talib who defends the Prophet to carry out his da'wah. T{abat{aba’i is different from Ibn Kathir in the explanation of his riwayah, namely the interpretation of 'Iyasi and Qumi's commentary, he says from the line of Ahl Bait that Abu Talib is a believer based on his evidence and his sayings. Essentially these two interpretations are the same, the most notable distinction lies only in the flow they profess, Ibn Kathir as a Sunni interpreter, T{abat{aba’i as a Shiite interpreter.

Abstract

This research aims to analyze the problematic financing process of mudharabah products at PT. Bank Syariah Indonesia KCP. Stabat. The type of research used in this research is field research with a qualitative approach. The data used is primary data and secondary data. Data collection is carried out by interviews and documentation. Data analysis is carried out by data reduction, presentation of data (Display data), conclusion drawing and verification data. The results of the study showed that the financing procedure at PT. Bank Syariah Indonesia KCP Stabat can be said to be quite long and complicated. Problematic financing is always caused by the debtor's fault. But problematic financing that arises in a financial institution is based on 2 (two) factors, namely internal factors or factors from the financial institution itself that is less selective in providing a financing to its customers, while external factors that come from the customer / debtor itself, either intentionally or unintentionally in fulfilling its obligation to pay installments or the business carried out does not develop.

Abstract

This study focuses on the discussion of the mechanism for determining the selling price and profit margin of murabahah financing at PT. Bank SUMUT Syariah KCP Stabat and the factors that influence it. The research method used in this study is a descriptive qualitative research method with an empirical approach. Informants in this study were employees of PT. Bank SUMUT Syariah KCP Stabat. The results of the study explain that the mechanism for determining the selling price and profit margin of murabahah financing is carried out by PT. Bank SUMUT Syariah KCP Stabat uses the flat profit method where the calculation of profit margins on the value of the cost of financing is fixed from one period to another.

Abstract

This study focuses on the discussion of the E-Banking aplication offered, the perceived barriers, and the improvement in customer service perceived by the E-Banking facilities offered by PT. Bank Muamalat Stabat Sub-Branch Office.  The research method used in this research is a descriptive qualitative research method with an empirical approach. People who are used as informants in this study are employees and customers who use the E-Banking product of PT. Bank Muamalat Stabat Sub-Branch Office. In this study, researchers used a collection technique, namely by means of observation, interviews, and documentation. Data analysis in this study consisted of data editing, data classification, data verification, data analysis, and drawing conclusions. The results of the study explain that the application of the use of E-Banking technology offered by PT. Bank Muamalat Sub-Branch Office Stabat that is Automatic Teller Machine, Sala Muamalat, Muamalat Internet Banking, Muamalat Mobile Banking, Virtual Account Muamalat, Muamalat Cash Management System, and Muamalat Outlets (Payment Point Online Bank). Barriers to the use of E-Banking technology at PT. Bank Muamalat Stabat Sub-Branch Office, namely unsupported network, lack of customer capability regarding the use of technology, and technical problems using E-Banking. There was an increase in the service perceived by customers with the E-Banking facilities offered by PT. Bank Muamalat Stabat Sub-Branch Office. The existence of E-Banking facilities improves the service that customers feel when transacting, starting from increasing convenience, speed, security, and trust.

Abstract

In terms of development, Islamic banks are currently not behind with progress like conventional banks. Conventional banking that implements the interest system goes hand in hand with Islamic banking that implements a profit-sharing system. The problem faced by Islamic banks is the low level of public knowledge about Islamic banking, especially due to the dominance of conventional banking so that Islamic banking is still considered one eye. The purpose of this study was to find out how the public's understanding of Islamic banking in Baru Hinai Village. This type of research is a field research (Field Research) conducted in the village of Baru Hinai. The nature of this research is a qualitative descriptive method. There are two sources of data in this study, namely primary data sources and secondary data sources. The primary data sources were obtained directly from the community while the secondary data sources that the researchers used were in the form of documents from the Baru Hinai Village and from various books. To obtain valid data, researchers used data collection methods, namely interviews. After the data was collected, the researchers analyzed using qualitative data analysis techniques using inductive methods. The results of research in the field show that the understanding of the community about Islamic banks in Baru Hinai Village is that people only know about Islamic banks but do not understand Islamic banks in detail. Only some people understand about Islamic banks and some even don't know anything about Islamic banks. Most people do not know what products and services are in Islamic banks. The lack of understanding from the public is due to the lack of information obtained from Islamic banks and media such as television, print media and social media which causes people not to know what Islamic banks are and what products are available in Islamic banks

Abstract

Sharia Bank is a financial institution tasked with collecting funds and distributing funds as well as providing other services based on the principles of partnership, fairness, transparency and universality as well as conducting banking business activities based on sharia principles. The development of Islamic banks is currently quite fast, but lately Islamic bank customers have different perceptions of Islamic banking, where some people hear about news or issues circulating about the perception of public figures who say that Islamic banks still use the principle of usury. which is a benchmark for some people and raises its own doubts about saving in Islamic banks, this is caused by several factors. First, the lack of socialization carried out by Islamic banks. Second, the lack of understanding of public figures regarding the system and objectives of Islamic banking itself. The formulation of the problem in this research is how is the perception of community leaders in increasing people's interest in saving? This type of research is a field research (field research), and is descriptive qualitative. The results of this study state that the perception of public figures in increasing public interest in saving in Islamic banks is in the Good category. Good category, customers already understand what Islamic banking is like, customers already know Islamic banks and not a few customers who already understand Islamic banking, and the public confirms that there are issues circulating in the community where public figures still have the assumption that Islamic banks are no different from conventional banks, while the issue of usury on people's interest in saving Islamic banks is in the medium category, meaning that the issue of usury circulating among the public has quite an impact on people's perceptions, therapy does not have much impact on people's interest in saving.

Abstract

The success of a business requires tips to attract consumers. One of them is business ethics, business ethics is an important part that must be owned by a businessman, because ethics is seen as a requirement in making decisions in business matters. Business ethics include fairness in weighing, honestly explaining the condition of the goods, as well as ihsan/being friendly in serving consumers. This study aims to determine 1). How much influence the application of the concept of justice has on consumer buying interest, 2). The influence of the application of the concept of honesty and 3). Great influence on the application of the concept of ihsan. This type of research is an explanatory research with a quantitative approach. This study uses multiple linear regression analysis, the method of collecting with questionnaires and observation and data analysis methods, namely classical assumption test and hypothesis testing. The result obtained is that the variable of justice has an effect of 2,032, meaning that there is a positive or unidirectional relationship between the variable of justice and consumer buying interest. The honesty variable has an effect of -0.513, which means that there is a negative or non-unidirectional relationship between the honesty variable and consumer buying interest. The ihsan/generous variable has an effect of 3.175, meaning that there is a positive or unidirectional relationship between the ihsan/generous variable and consumer buying interest.

Abstract

The purpose of this research is to find out the Financial Performance of Bank SUMUT Syariah Kcp.stab.To find out the Financial Performance of conventional Banks.To find out the difference between the financial performance of Islamic banks and conventional banks.Field research was used to obtain the data needed in this study, namely by using data collection tools through observation, interviews or structured interviews, and documentation.The data obtained was then processed and analyzed.In this study, qualitative research was used with an analytical description approach, namely by describing the research results obtained through structured interviews on research sources. The results of financial performance research are the results of operational activities which are presented in the form of financial figures. The results of the company's activities for the current period must be compared with financial performance in the past, budget, balance sheet and average profit and loss of the financial performance of similar companies.According to Cashmere, a bank's financial performance is a measure of the success of the bank's directors, so if the bank is bad, it is impossible for the directors to be replaced.The assessment of the company's performance according to management is as follows: To find out the liquidity factor, namely the company's ability to obtain its financial obligations that must be fulfilled immediately or the company's ability to fulfill its finances when billed. To determine the solvency level, namely the company's ability to fulfill its financial obligations if the company isliquidated both short term and long term financial liabilities.To determine the level of profitability and profitability, indicating the company's ability to generate profits for a certain period. Abstract

Penelitian ini memfokuskan pembahasan tentang pelaksanaan pembiayaan akad murabahah, penerapan prinsip kehati-hatian dalam penyaluran pembiayaan akad murabahah, serta hambatan dalam menerapakan prinsip kehati-hatian dalam penyaluran pembiayaan akad murabahah yang dihadapi oleh PT. Bank SUMUT Syariah KCP Stabat. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kualitatif yang bersifat deskriptif dengan pendekatan empiris. Subjek pada penelitian ini adalah PT. Bank SUMUT Syariah KCP Stabat. Pada penelitian ini peneliti menggunakan teknik pengumpulan yaitu dengan cara observasi, wawancara, dan dokumentasi. Hasil penelitian menjelaskan bahwa pelaksanaan pembiayaan akad murabahah pada PT. Bank SUMUT Syariah KCP Stabat hampir sama dengan pembiayaan pada umumnya yaitu diawali dengan permohonan, survei dan pencairan. Prosedur penerapan prinsip kehati-hatian dalam penyaluran pembiayaan akad murabahah pada PT. Bank SUMUT Syariah KCP Stabat yaitu seleksi administrasi harus teliti, penerapan prinsip 5C dalam proses analisis pembiayaan (Character, Capacity, Condition of Economy, Capital, Collateral), penerapan prinsip 7P dalam proses analisis pembiayaan (Personality, Party, Purpose, Prospect, Payment, Profitability, Protection), serta ditambah aspek 1S yaitu Syariah. Hambatan-hambatan yang sering terjadi pada Bank PT. Bank SUMUT Syariah KCP Stabat dalam menerapkan prinsip kehati-hatian dalam penyaluran pembiayaan terdiri dari faktor intern yang sering terjadi pada Bank PT. Bank SUMUT Syariah KCP Stabat dan faktor ekstern atau yang berasal dari nasabah.
