Fakultas Hukum Universitas Brawijaya Email : datamrizki@gmail.com ABSTRAK Holding company Badan Usaha Milik Negara sektor Minyak dan Gas Bumi direalisasikan melalui Peraturan Pemerintah Nomor 6 Tahun 2018 tentang Penambahan Penyertaan Modal Negara Republik Indonesia Ke Dalam Modal Saham Perusahaan Perseroan (Persero) PT. Pertamina dan dilanjutkan dengan Conditional Sales Purchase Agreement antara PT. Perusahaan Gas Negara Tbk dan PT. Pertamina Gas. Hal ini berpotensi melanggar prinsip persaingan usaha yang diatur di dalam Undang – Undang No 5 Tahun 1999 tentang Larangan Praktik dan Persaingan Usaha Tidak Sehat. Sehingga dalam skripsi ini penulis mengkaji bagaimana analisa potensi pelanggaran terhadap prinsip – prinsip persaingan usaha yang sehat atas keberadaan holding company dan bagaimana rekomendasi keberadaan holding company agar sesuai dengan prinsip – prinsip persaingan usaha yang sehat. Kata Kunci : Keberadaan Holding Company Badan Usaha Milik Negara Sektor Minyak dan Gas Bumi, Persaingan Usaha Yang Sehat  ABSTRACT Holding company of the State-Owned Enterprise for the Oil and Gas sector has been realized through Peraturan Pemerintah Nomor 6 of 2018 tentang Penambahan Penyertaan Modal Negara Republik Indonesia Ke Dalam Modal Saham Perusahaan Perseroan (Persero) PT. Pertamina and continued with the Conditional Sales Purchase Agreement between PT. Perusahaan Gas Negara Tbk and PT. Pertamina Gas. This has the potential to violate the principle of monopoly and anti trust stipulated in Undang - Undang Nomor 5 of 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. So in this thesis the author examines how to analyze the potential violations of the principles of fair business competition on the existence of a holding company and how the recommendation of the holding company is in accordance with the principles of fair business competition. Abstract

The research goals were to explain the simultant and partially influence of physical (X1) and non-physical (X2) to work stress (Y). Research type is explanatory research method with quantitative approach. Population are employee of PT PLN (Persero) at Malang Service Area, East Java Distribution with seventy-five employee has picked as research sample. The result are the changes of working stress (Y) variable could be explained by physical (X1) and non-physical (X2) working environment variable as 34,6 percent and the balance about 65,4 percent remainder are affected by different factor that doesn’t covered by the research. While evaluating hypothesis, there are significant effect simultaneously and partially from physical and non-physical working environment on employee work stress variable. Working environment variable as partial have negative effect that mean if there is better working environment will reduce employee’s work stress. Working environment give sicnificant effect on employee’s work stress. This is shown by the regression coefficient physical work environment and non-physical work environment in a sequentially of -0,224 and -0,483 along with significant phisycal working environment value about 0,007 (0,007<0,05) and non-physical working environment about 0,009 (0,009<0,05). Keywords : Physical Working Environments, Non-Physical Working Environments, Work Stress ABSTRAK Penelitian ini memiliki tujuan untuk menjelaskan pengaruh secara simultan dan parsial lingkungan kerja fisik (X1) dan non fisik (X2) tehadap stres kerja karyawan. Jenis penelitian yang digunakan adalah penelitian penjelasan (explanatory research) dengan menggunakan pendekatan kuantitatif. Populasi dalam penelitian adalah karyawan PT PLN (Persero) Distribusi Jawa Timur Area Pelayanan Malang, dengan sampel 75 orang. Perubahan variabel stres kerja (Y) dapat dijelaskan oleh variabel lingkungan kerja fisik (X1) dan non fisik (X2) sebesar 34,6 persen sedangkan sisanya sebesar 65,4 persen dipengaruhi oleh faktor lain yang tidak diteliti dalam penelitian ini. Pada uji hipotesis yang dilakukan terdapat pengaruh signifikan secara simultan dan parsial dari lingkungan kerja fisik dan non fisik terhadap variabel stres kerja karyawan. Variabel lingkungan kerja secara parsial mempunyai pengaruh negatif yang artinya semakin baik lingkungan kerja dapat menurunkan stres kerja karyawan. Variabel lingkungan kerja mempunyai pengaruh yang signifikan terhadap stres kerja karyawan. Hal ini ditunjukkan dengan besarnya koefisien regresi lingkungan kerja fisik dan non fisik secara berurutan sebesar -0,224 dan -0,483 serta nilai signifikansi lingkungan kerja fisik sebesar 0,007 (0,007<0,05) dan lingkungan kerja non fisik sebesar 0,009 (0,009<0,05). Abstract

Indonesia merupakan negara yang memiliki berbagai jenis sumber daya energi dalam jumlah yang cukup melimpah. Letak Indonesia berada pada daerah khatulistiwa, maka wilayah Indonesia akan disinari matahari selama 10 sampai dengan 12 jam dalam sehari. Data ditjen listrik dan pengembangan energi pada tahun 1997, kapasitas listrik tenaga surya diindonesia terpasang mencapai 0,88 MW dari potensi yang tersedia 1,2 × 109 MW. Energi surya melalui konversi dimanfaatkan menjadi energi listrik yang diperoleh dengan sistem fotovoltaik (Pembangkit Listrik Tenaga Surya) pembangkit listrik tenaga surya diarahkan agar dapat dimamfaatkan oleh para pemakai didaerah terpencil yang tidak mungkin dijangkau oleh jaringan PLN.

Abstract

Human Development Index (HDI) is a way to measure the success of human development based on a number of basic components quality of life. HDI is formed by three basic variables namely health, education and decent living standards. This study aims to identify factors that influence the Human Development Index in Central Java Province and get a model Human Development Index in Central Java province in 2008-2013. The data used in this study is a combination of cross section data and time series data are commonly called panel data, then this HDI modeling using panel data regression. There are three estimation of panel data regression model namely Common Effect Model (CEM), Fixed Effect Model (FEM) and Random Effect Model (REM).  Estimation of panel data regression model used is the Fixed Effects Model (FEM). FEM estimation results show the number of health facilities, school participation rate and Labor Force Participation Rate significantly affect the HDI by generating  for 93.58%.Keywords : Fixed Effect Model, panel data regression, HDI in Central Java Province

Abstract

Kampar is one of the regencies having the greatest agrarian conflict in Riau province due to many palm oil plantations as an agricultural sector that result in the highest causing factor of agrarian conflict particularly in Riau province, generally in Indonesia. One of the conflicts that occurred in Kampar regency is the conflict between Tasma Puja Company and Kampar village society. It had happened for a long time because the society did not obtain the land compensation from the company. The solutions previously taken did not work and demanded the conflict resolution. This research study, therefore, aims at exploring the role of Kampar regency government in conflict resolution between Tasma Puja Company and Kampar village society. The concept used in this study was the theory of conflict resolution adapted from Fisher in terms of negotiation, mediation, and arbitration. This research was a case study in qualitative method utilizing snowball sampling with observation, interview, library study, and documentation as the techniques of collecting data. The results of study indicate that resolving conflicts only reaches the negotiation stage, and the mediation stage. Not until the arbitration stage. Negotiation have not been effective in dealing with conflicts and the mediation stage led by the regent of Kampar, bright spot was found and the company was willing to pay compensation for the society.. It is suggested that the local government should abrogate the status of the conflict and recover it after the conflict in order to have a good relationship between the two parties.Keywords : Resolution, Conflict, Land

Abstract

Model pembelajaran yang dapat menciptakan suasana belajar aktif dan menyenangkan adalah metode mind mapping berbantuan gambar. Saat pembelajaran berlangsung siswa melakukan serangkaian kegiatan mencatat atau menginventaris alternatif jawaban hasil diskusi pada tiap kelompok, tiap kelompok akan membacakan hasil diskusinya dan guru mencatat di papan tulis, selanjutnya siswa membuat kesimpulan dan guru memberikan bandingan sesuai dengan konsep yang telah ditetapkan. Penelitian ini bertujuan untuk mengetahui peningkatan hasil belajar siswa melalui penerapan metode mind mapping berbantuan  gambar  IPS  Terpadu siswa kelas VII SMP Negeri 7 Banda Aceh, aktivitas guru dan siswa, keterampilan guru dan respon siswa dalam penerapan metode mind mapping  berbantuan gambar  untuk meningkatkan hasil belajar IPS terpadu siswa  kelas VII SMP Negeri 7 Banda Aceh. Subjek dalam penelitian ini adalah siswa kelas VII-6 SMPN 7 Banda Aceh yang berjumlah 32 orang. Pengumpulan data dilakukan dengan menggunakan lembar soal, lembar pengamatan aktivitas guru dan siswa, lembar pengamatan keterampilan guru dan lembar respon siswa. Analisis data menggunakan statistik deskriptif persentase. Hasil penelitian menunjukkan bahwa persentase ketuntasan klasikal siklus I 78.12%, siswa yang tuntas sebanyak 25 orang dan yang tidak tuntas 7 orang. Siklus II ketuntasan klasikal 96.9% siswa yang tuntas naik menjadi 31 orang dan yang tidak tuntas hanya 1 orang. Aktivitas guru yang dominan adalah saat guru menunjukkan/memanggil salah satu siswa secara bergantian memasang atau mengurutkan gambar menjadi urutan yang logis dan menanyakan dasar alasan dasar mengurutkan tersebut. Keterampilan guru dalam menerapkan metode mind mapping berbantuan gambar selama siklus pertama dan kedua mengalami peningkatan yaitu dapat dikategori baik dengan perolehan skor 2.62, dan siklus II mendapat skor 2.87. Respon siswa terhadap metode mind mapping berbantuan gambar dapat dikatakan baik, siswa berpendapat bahwa dengan belajar melalui metode mind mapping berbantuan gambar dapat meningkatkan pemahaman siswa terhadap materi yang dipelajari.

Abstract

This research held in PT. Delta Internusa Pekanbaru in order to analyze the influence of job satisfaction and job characteristics to employees’ commitment. Population are all employees, consist of 53 people among all division. Considering the number limitation so sampling method used is census that covers all employee as the respondents. Data analyzed by using multiple linier regression analysis by using SPSS 17 for windows.Result of this study shows that both job satisfaction and job characteristics significantly influence, either in simultenously or partially, to employees’ commitment. Among both independent variables, employee’s commitment is more dominant effected by job satisfaction rather than job characteristics. It is recommended to company determine a transparant indicator of career development, creating a comfort work-space and conducting a consistant employee development program. It is also recommended to hold temporary job rotation among all employees on to other division.Keywords: Job Satisfaction, Job Characteristic and Employee’s Commitment

Abstract

The Beam is a structural element that has the function of bearing the load perpendicular to the longitudinal axis. The collapse of reinforced concrete beams without shear reinforcement can be caused by the collapse of one of the shear force transfer components. Beams without shear reinforcement will experience changes in behavior both in terms of strength and collapse patterns. Crack patterns that occur in the test specimen due to loading can change due to changes in the shear strength of the concrete. The purpose of this study was to analyze the shear behavior of reinforced concrete beams without shear reinforcement to obtain crack patterns maximum load, and maximum deflection values through finite element model. The crack pattern of the specimens through the finite element program started by the initial cracks that initially occur in the tensile region in the form of flexural cracks, then cracks turned into diagonal cracks towards the compressive part of the beam near the load bearing which cause a failure in the form of shear failure. The results of finite element model showed the maximum load obtained by reinforced concrete beams without shear reinforcement is 31.493 kN with a deflection of 8.054 mm.Keywords: beam without shear reinforcement, FEM, shear behavior, crack pattern

Abstract: The purpose of this study was to discuss disfemism in publicstatements Tapung Hulu of the sub-district. This study aims to describe the form andfunction of Tapung District of Hulu of the speech community. In this study, the datasource in this study were persons residing in the Tapung Hulu district. The search fordata by the author is the sentence that contains disfemism in public statements TapungHulu of the sub-district. Data collection techniques in speech research disfemismTapung Hulu community using techniques of subdistrict interview and recordingtechnique by finding phrases containing disfemism in the district community of theTapung Hulu speech. This method is operationalized by collecting data relevant to theanalysis analysis penulisan.Teknik used in the analysis of data on sentences containingdisfemism analysis techniques namely descriptive. Descriptive analysis techniques areused to describe the form and function of Hulu's Tapung district of the speechcommunity. Abstract

Democracy is one of the power management systems considered the most suitable to be applied in modern countries today. As a source of guidance for humans, the Qur'an has explained the concept of the system of administering power. The conception of democracy is thus believed to be accommodated in the Qur'an. On that basis, the main problem that needs to be answered is, what is the conception of democracy in the Qur'an? The data for this paper was collected by following the steps in the mawḍu'i interpretation, after that, it was analyzed by following the thematic interpretation stage. The results of the analysis show that the term of the Qur'an, which represents the meaning of democracy, is syurā. In suyrā, norms are found that regulate the necessity of conducting deliberation in worldly affairs, both family affairs, muamalah, and political affairs. The concept of democracy in the form of syrā is mentioned in QS. Al-Baqarah: 233, QS. Ali 'Imrān: 159, and QS. al-Syurā: 38. There are four points of connection between the verses of the Qur'an about democracy and democracy today. First, the obligation to hold opinion meetings and prohibit dictators. Second, freedom of expression. Third, respecting opinions that are superior to the results of deliberation. Fourth, the majority vote is taken into account by protecting the rights of minorities. Demokrasi merupakan salah satu sistem pengelolaan kekuasaan yang dipandang paling cocok untuk diterapkan di negara-negara modern dewasa ini. Sebagai sumber petunjuk bagi manusia, Al-Qur’an telah menjelaskan konsepsi mengenai sistem penyelenggaraan kekuasaan. Konsepsi mengenai demokrasi dengan demikian diyakini terakomodasi dalam Al-Qur’an. Atas dasar itu, permasalahan utama yang perlu dicarikan jawabannya adalah, bagaimanakah konsepsi demokrasi dalam Al-Qur’an? Data untuk tulisan ini dikumpulkan dengan mengikuti langkah-langkah dalam tafsir mawḍu’i, selanjutnya dianalisis dengan tahapan penafsiran secara tematik. Hasil analisis menunjukkan bahwa terma Al-Qur’an yang merepresentasikan makna demokrasi adalah syūrā. Dalam syūrā ditemukan norma yang mengatur keharusan melakukan musyawarah dalam urusan-urusan duniawi, baik urusan keluarga, muamalah, maupun urusan bidang politik. Konsep demokrasi dalam bentuk syūrā disebutkan dalam QS. Al-Baqarah: 233, QS. Āli ‘Imrān: 159, dan QS. al-Syūrā: 38. Terdapat empat poin hubungan ayat-ayat Al-Qur’an tentang demokrasi dan demokrasi masa kini. Pertama, kewajiban melakukan temu pendapat dan melarang diktator. Kedua, kebebasan mengeluarkan pendapat. Ketiga, menghargai pendapat yang lebih unggul dari hasil musyawarah. Keempat, suara mayoritas diperhitungkan dengan melindungi hak-hak minoritas.
