Abstract

Abstract: The Government of Indonesia signed a Memorandum of Understanding (MoU) with Microsoft in 2006. Society together with the House of Representatives and the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha) rejected this MoU. The reason why they rejected this partnership because it has the potential to harm Indonesia. This agreement also shows the government inconsistency of Indonesia, Go Open Source program that have been announced previously. This study aims to determine the position and arguments between the state and the society about the Indonesia Government MoU with Microsoft in 2006. This study uses a case study method. Competition between open source software and proprietary software become the context in this study. This research was also supported by a historical review of the position of the state and society in the development of computers in Indonesia. The results from this study showed that people with the House of Representatives and the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha) appeared as a dialectic of control of the government. It is shown by the discontinuation of the MoU in the implementation stage. Weak arguments of the government makes it difficult to continue the agreement. The society and informal institutions pressure that exist make the government do not have a reason other than not to continue the MoU.Abstrak:Pemerintah Indonesia menandatangani Memorandum of Understanding (MoU) dengan Microsoft pada tahun 2006. Masyarakat bersama- sama dengan Dewan Perwakilan Rakyat Republik Indonesia dan Komisi Pengawas Persaingan Usaha menolak Nota Kesepahaman ini. Alasan penolakan kemitraan ini karena memiliki potensi untuk merugikan Indonesia. Perjanjian ini juga menunjukkan inkonsistensi pemerintah terhadap program Indonesia, Go Open Source yang telah dicanangkan sebelumnya. Penelitian ini bertujuan untuk mengetahui posisi dan argumen antara negara dan masyarakat tentang Pemerintah Indonesia MoU dengan Microsoft pada tahun 2006. Penelitian ini menggunakan metode studi kasus. Persaingan antara open source sofware dan  propriertary sofware menjadi konteks dalam penelitian ini. Penelitian ini juga didukung oleh tinjauan historis posisi negara dan masyarakat dalam pengembangan komputer di Indonesia. Hasil dari penelitian ini menunjukkan bahwa masyarakat bersama DPR dan Komisi Pengawas Persaingan Usaha (Komisi Pengawas Persaingan Usaha) muncul sebagai dialectics of control bagi pemerintah. Hal ini ditunjukkan tidak dilanjutkannya MoU pada tahap implementasi kebijakan. Pemerintah sulit untuk melanjutkan kerjasama tersebut karena argument yang dimiliki lemah. Masyarakat bersama lembaga-lembaga formal yang menekan dan membuat pemerintah tidak memiliki alasan untuk melanjutkan MoU tersebut.
