Abstract

Judicial Commission is an independent state institution created to carry out the judicial body reform. The Judicial Commission power of maintaining judge’s dignity and behavior  is no longer exist following  the Constitutional Court Verdict No.005/PUU-IV/2006. This article examines the existence of judicial commission in the realization of independent judicial power. Theories of constitution, power separation, power distribution and independent judicial power are used to study and analyze the study. The author concludes that the objective of the creation of the Judicial Commission is to monitor and maintain the efficiency and effectiveness of judicial power.   It is recommended that the Law No.22 of 2004 on  Judicial Commission be amended to enable the Judicial Commission to be able in exercising the task and power to realize  an independent judicial power following the above Constitutional Court Verdict.

Abstract

Abstract

Tanggung Jaawab Sosial Perusahaan atau sering dikenal dengan CSR merupakan komitmen perusahaan dalam pembangunana ekonomi untuk meningkatkan kualitas kehidupan yang berguna bagi perseroan maupun masyarakat pada umumnya. Perbankan Syariah dalam melakukan kegiatan CSR harus berdasarkan pada prinsip syariah dan sesuai dengan tujuan syariah yakni maqashid syariah. sehingga pelaksanaan dan implementasi CSR yang dilakukan telah sesuai dengan prinsip syariah dan maqashid syariah. perbankan syriah dalam pelaksanaanya telah sesuai dengan ketentuan dan prinsip syariah, baik secara tersirat maupun tersurat. Dengan harapan akan memberikan nilai ibadah bagi pemangku kepentingan di perbankan syariah tersebut.

Abstract

Abstract. There is news about the disposal of medical waste at the Temporary Waste Disposal Site (TPS) belonging to the Ciamis District General Hospital. This study uses a normative juridical research method. Research data is collected by examining theories, concepts, legal principles and legislation. As well as data analysis obtained both from literature studies and from field research will be analyzed qualitatively. The results of this study indicate that in its implementation the Ciamis District Hospital is guided by Law number 32 of 2009 concerning environmental protection and management. The parties involved are from the PRKPLH Service and the vendors who have been provided by the local government, while the hospital involved is the sanitarian section. There are still violations of regulations, meaning that the Government's Governance for the Environment at the Ciamis District Hospital has not been effective. The Ciamis District Hospital should always improve supervision in the management of B3 waste by providing direction or understanding about the importance of using waste symbols so that medical and non-medical waste is not mixed. It is recommended that the Ciamis Regency Government emphasize more on the agency by creating a B3 and B3 Waste management team at the Ciamis Regency Hospital to be more responsible in carrying out their duties so that monitoring activities can run effectively and efficiently. Abstrak. Adanya pemberitaan pembuangan limbah medis di Tempat Pembuangan Sampah (TPS) Sementara milik Rumah Sakit Umum Daerah Kabupaten Ciamis. Penelitian ini menggunakan metode penelitian yuridis normative. Data penelitian dikumpulkan dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang- undangan. Serta analisis data yang diperoleh baik dari studi kepustakaan maupun dari penelitian lapangan akan dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa dalam pelaksanaannya RSUD Kabupaten Ciamis berpedoman pada Undang-Undang nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup. Pihak yang ikut terlibat yakni dari Dinas PRKPLH dan pihak vendor yang sudah disediakan oleh PEMDA sedangkan dari pihak Rumah Sakit yang terlibat adalah bagian sanitarian. Masih adanya pelanggaran terhadap peraturan mengartikan bahwa Tata kelola Pemerintah terhadap Lingkungan Hidup di RSUD Kabupaten Ciamis belum Efektif. Sebaiknya pihak RSUD Kabupaten Ciamis selalu meningkatkan pengawasan dalam pengelolaan limbah B3 dengan memberikan arahan atau pemahaman tentang pentingnya pengunaan simbol-simbol limbah agar tidak tercampur limbah medis dengan non-medis. Sebaiknya pihak Pemerintah Kabupaten Ciamis lebih mempertegas kepada instansi dengan membuat tim pengelolaan B3 dan Limbah B3 di RSUD Kabupaten Ciamis agar lebih bertanggung jawab dalam melakukan tugasnya agar kegiatan monitoring dapat berjalan dengan efektif dan efisien.

Abstract

Abstract. Religion and belief systems are conceptions of divine teachings that citizens have the right to believe in. In Law no. 39 of 1999 concerning Human Rights. The main provisions of this law in Article 22 paragraphs 1 and 2 emphasize that everyone is free to embrace their own religion and to worship according to their religion and beliefs. Believers in administrative or social life still experience discriminatory things. In Law no. 24 of 2013 concerning Population Administration still does not guarantee the rights of believers by leaving the religion column blank in civil registration. This is contrary to the 1945 Constitution, the Constitutional Court issued the Constitutional Court Decision No. 97/PUU-XIV/2016 concerning Examination of the State Administration Law. After the Constitutional Court's decision was enforced to date, there are discrepancies in these policies that affect policies in the City of Cimahi. Therefore, this study aims to determine the implementation of the registration of beliefs in population administration based on the Constitutional Court's Decision No. 97/PUU/XIV/2016 concerning the Testing of the State Administration Law, Case Study of the City of Cimahi.The research method used is normative juridical law research, data sources and data collection techniques using secondary data sources consisting of primary, secondary and tertiary legal materials. The inhibiting factor for the realization of the Constitutional Court's Decision in the Disdukcapil City of Cimahi is the difference in the implementation of implementation policies. The Constitutional Court's decision listed believers in the KTP but the Cimahi City Disdukcapil in the Religion column was deleted and changed to the Trust column. The Dukcapil of Cimahi City regulates the recording of adherents of a belief in Cimahi City through Circular Letter Number 471.14/ 10666/ Dukcapil concerning the issuance of Family Cards for Believers in God Almighty. Abstrak. Agama dan aliran kepercayaan merupakan konsepsi ajaran ketuhanan yang berhak diyakini oleh warga negara. Dalam UU No. 39 Thn 1999 tentang HAM. Pokok pengaturan dalam undang-undang ini dalam Pasal 22 ayat 1 dan 2 menegaskan bahwa setiap orang bebas memeluk agamanya masing-masing dan untuk beribadat menurut agamanya dan kepercayaannya. Penghayat kepercayaan pada kehidupan administrasi ataupun sosial masih mengalami hal bersifat diskriminatif. Dalam UU No. 24 Thn 2013 tentang Administrasi Kependudukan masih belum menjamin hak penghayat kepercayaan dengan dikosongkannya kolom agama dalam pencatatan sipil. Hal ini bertentangan dengan UUD 1945, MK mengeluarkan Putusan MK No 97/ PUU-XIV/2016 tentang Pengujian Terhadap UU Administrasi Negara. Setelah Putusan MK diberlakukan hingga saat ini terdapat ketidak selaras dalam kebijakan tersebut yang memengaruhi kebijakan di Kota Cimahi. Maka dari itu penelitian ini bertujuan untuk mengetahui Implementasi Pencatatan Aliran Kepercayaan Dalam Administrasi Kependudukan Berdasarkan Putusan MK No 97/PUU/XIV/2016 Tentang Pengujian Terhadap UU Administrasi Negara Studi Kasus Kota Cimahi. Metode Penelitian yang digunakan adalah penelitian hukum yuridis normative, sumber data dan teknik pengumpulan data yang menggunakan sumber data sekunder yang terdiri dari bahan hukum primer,sekunder dan tersier. Faktor penghambat terealisasikannya Putusan MK di Disdukcapil Kota cimahi perbedaan implementasi kebijakan implementasi. Putusan MK mencantukan penghayat kepercayaan di KTP tetapi Disdukcapil Kota Cimahi dalam kolom Agama dihapus dan diubah menjadi kolom Kepercayaan. Dukcapil Kota Cimahi mengatur pencatatan penghayat aliran kepercayaan di Kota Cimahi melalui Surat Edaran Nomor 471.14/ 10666/ Dukcapil tentang penerbitan Kartu Keluarga bagi Penghayat Kepercayaan Tuhan Yang Maha Esa.

Abstract

The Financial System Stability Committee or abbreviated as KSSK is a committee that organizes the prevention and resolution of Financial System Crisis to carry out the interests and resilience of the state in the economic sector in Indonesia, which has the following tasks; coordinate in the context of monitoring and maintaining Financial System Stability, handling Financial System Crisis, handling Systemic Bank problems, both in normal Financial System Stability conditions and Financial System Crisis conditions. The aims of this study are: 1) to find out how the position of the Financial System Stability Committee is in issuing State Administrative Decisions, and 2) to find out how the implications of the decisions issued by the KSSK are related to the principle of legal certainty. This study uses a normative juridical approach, namely conducting a study of the rules relating to the Authority of the Financial System Stability Committee. Research specifications by outlining the Authority of the Financial System Stability Committee based on Article 27 Paragraph (3) of Law Number 2 of 2020 concerning State Financial Policy and Financial System Stability for Handling the 2019 Corona Virus Disease Pandemic linked to the principle of legal certainty. Data collection techniques through library research on primary, secondary and tertiary legal materials related to the topic of the problem which will be used as a reference to solve problems as part of data analysis. The results of this study are: 1) the position of the Financial System Stability Committee in issuing State Administrative decisions, namely KSSK is a state administrative body or official or state administration official who is given direct authority by law. 2) the implications of the decisions issued by the KSSK after the existence of Article 27 Paragraph (3) of Law Number 2 of 2020, namely that the decisions issued by the KSSK cannot be filed with the State Administrative Court, where this is not in accordance with the principle of legal certainty. Komite Stabilitas Sistem Keuangan atau disingkat KSSK adalah komite menyelenggarakan pencegahan dan penanganan Krisis Sistem Keuangan untuk melaksanakan kepentingan dan ketahanan negara di bidang perekonomian di Indonesia yang memiliki tugas yaitu; melakukan koordinasi dalam rangka pemantauan dan pemeliharaan Stabilitas Sistem Keuangan, melakukan penanganan Krisis Sistem Keuangan, melakukan penanganan permasalahan Bank Sistemik, baik dalam kondisi Stabilitas Sistem Keuangan normal maupun kondisi Krisis Sistem Keuangan. Tujuan dari penelitian ini yaitu: 1) untuk mengetahui bagaimanakah kedudukan Komite Stabilitas Sistem Keuangan dalam mengeluarkan Keputusan Tata Usaha Negara, dan 2) untuk mengetahui bagaimanakah implikasi dari Keputusan yang dikeluatrkan oleh KSSK dihubungkan dengan Asas Kepastian Hukum. Penelitian ini menggunakan pendekatan yuridis normatif yaitu melakukan kajian terhadap kaidah-kaidah yang berkaitan dengan Kewenangan Komite Stabilitas Sistem Keuangan. Spesifikasi penelitian dengan menguraikan Kewenangan Komite Stabilitas Sistem Keuangan Berdasarkan Pasal 27 Ayat (3) Undang-Undang Nomor 2 Tahun 2020 Tentang Kebijakan Keuangan Negara Dan Stabiilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 2019 Dihubungkan Dengan Asas Kepastian Hukum. Teknik pengumpulan data melalui studi kepustakaan terhadap bahan hukum primer, sekunder dan tertier yang berkaitan dengan topik permasalahan yang nantinya dijadikan rujukan untuk menyelesaikan permasalahan sebagai bagian dari analisis data. Hasil dari penelitian ini yaitu: 1) kedudukan Komite Stabilitas Sistem Keuangan dalam mengeluarkan keputusan Tata Usaha Negara yaitu KSSK merupakan badan atau pejabat tata usaha negara atau pejabat adminsitrasi negara yang diberikan kewenangan langsung oleh Undang-Undang. 2) implikasi dari keputusan yang dikeluarkan KSSK setelah adanya Pasal 27 Ayat (3) Undang-Undang Nomor 2 Tahun 2020 yaitu bahwa keputusan yang dikeluarkan KSSK tidak dapat diajukan gugatan ke Peradilan Tata Usaha Negara, dimana hal tersebut tidak sesuai dengan asas kepastian hukum.

Abstract

Abstract. This research is important to obtain the concept of developing the Principles of Environmental Sustainability in Indonesia, in order to preserve the marine environment againts various forms ofviolations in the field of marine fisheries. The Principle of Environmental Sustainability is a moral approach and emphasizes more on preventive measures in the preservation of the environment in general and in particular the marine environment. For conditions in Indonesia, there is a potential for local wisdom of the community of an area spread throughout the archipelago as a form of real efforts to involve the community in the preservation of the marine enviroment. This research was carried out using a normative juridical approach, qualitative legal analysis with legal interpretation methods, and literartur studies. The inclusion of Local Wisdom in the preservation of the marine environment is an important instrument as a form of Development of Environmental Sustainability Principles. The existence and role of local wisdom of coastal communities that are evenly distributed throughout the archipelago conceptually have the opportunity to be included as a form of the developing the Principles of Environmental Sustainability in order to support the effectiveness and efficiency of monitoring the conservation of marine fishery resources.

Abstract

Abstrak. Indonesia yang merupakan dari sebagian negara dimana sudah menjunjung tinggi kedaulatan rakyat sebagaimana yang tercantum pada Pasal 1 angka sebagaimana isi dari UUD 1945. Dengan menyatakan secara tegas hal tersebut dalam peraturan perundang-undangan dasar membuat Indonesia secara langsung menerapkan demokrasi dimana hal menjadi bentuk dari implementasi dari apa yang diharapkan pada pasal dengan maksud kedaulatan rakyat dalam bentuk perwujudan adalah penyelenggaran pemilihan secara umum. Pemilihan umum yang menjadi bentuk wujud dari adanya kedaulatan rakyat memperlukan wakil yang berada di parlemen maupun di eksekutif sebagaimana yang tercantum pada Pasal 18 dalam isi UUD 1945 yang menyatakan, “Gubernur, Bupati, Walikota, masing-masing sebagai kepala pemerintahan daerah provinsi, kabupaten, dan kota yang dipilih. Dalam terjaringnya kepala daerah yang berkualitas, maka bagi calon pasangan kepala daerah harus memenuhi yang tercantum pada Pasal 7, Pasal 40, dan Pasal 41 UU Pilkada. Tetapi, persyaratan yang telah disebut tidak dapat dipenuhi, maka terjadi pilkada berjalan satu pasangan calon. Maka, dalam penelitian mencakup terkait dengan prosedur yang harus dilalui setiap pasangan calon dan bagaimana kualitas kepala dari hasil pilkada satu pasangan calon ini. Metode penelitian menggunakan yuridis normatif dan berdasarkan bahan baku hukum primer, sekunder, dan tersier. Hasil dari penelitian menunjukan bahwa, adanya kesulitan dalam pemenuhan persyaratan kepala daerah dan juga kualitas kepala daerah sendiri dipengaruhi apakah pedoman AAUPB dijalankan dengan baik atau tidak. Dengan demikian, penyesuaian terkait persyaratan calon kepala daerah dan memperkuat dari AAUPB bagi kepala daerah. Abstract. Indonesia is one of the countries which has upheld the sovereignty of the people as stated in Article 1 number as the contents of the 1945 Constitution. By expressly stating this in the basic legislation makes Indonesia directly implement democracy where it becomes a form of implementation of what is expected in the article with the intention of popular sovereignty in the form of manifestation is the holding of general elections. General elections which are a form of manifestation of the sovereignty of the people require representatives who are in parliament and in the executive as stated in Article 18 in the contents of the 1945 Constitution which states, "Governors, Regents, Mayors, each as the head of the provincial, district and city regional governments are elected. In capturing qualified regional heads, candidates for regional head pairs must fulfill the requirements listed in Article 7, Article 40, and Article 41 of the Pilkada Law. However, the requirements that have been mentioned cannot be fulfilled, so the election runs one candidate pair. So, the research includes procedures that must be passed by each candidate pair and how the quality of the head of the election results of one candidate pair. The research method uses normative juridical and based on primary, secondary, and tertiary legal raw materials. The results of the study show that, there are difficulties in fulfilling the requirements of the regional head and also the quality of the regional head itself is influenced by whether the AAUPB guidelines are implemented properly or not. Thus, adjustments related to the requirements for regional head candidates and strengthening of AAUPB for regional heads.
