Abstract

The development of democracy in Indonesia is running very rapidly after the 1945 amendment. One of the developments within the frame of politics characterized by constitutional formula that provides a basic framework state that sovereignty belongs to the people and carried out in accordance  with  the  Constitution. On the basis of the formulation of the succession of leadership in the executive and legislative branches are directly implemented as the mandate of Article 22 E of paragraph ( 2). However, in practice the constitutional arrangements in the Law Number 42 Year 2008 concerning General Pemlihan President and Vice President shows inconsistent with the statement in the constitution . As set out in Article 3 paragraph ( 5 ) states that the election of President and Vice- President held after an election DPR, DPD and DPRD. At the end of the Constitutional Court through Decision No. 14/PUU-XI/2013 stated that the selection of models is unconstitutional. Based on that assessment constitutionality of norms selection method based  on  the simultaneous interpretation of the constitution of both the original intent and interpretation of history. Design constitutional elections simultaneously referred born as an attempt to shift the direction of the transition towards democracy in the reinforcement system in order consolidation of democratic practice direct democracy tends opaque transactional, corrupt, manipulative, high costs and preserve power can be minimized in the practice of constitutional democracy dimention to understand and sovereignty of the  people.

Abstract

As stated in Article 8 of Law (UU) Number 8 Year 1999 regarding Human Rights, the state’s government is obliged to protect and demonstrate its citizens’ Human Rights. The state shall be committed to establishing protection and implementation of Human Rights as a discourse of necessity between the State, Constitution, and Citizens. The correlation between these three is foregrounded in Article 28I Section 4 in the 1945 Constitution of the Republic of Indonesia. The law regarding the State’s obligation was later implemented by establishing the Ministry of Law and Human Rights and regional-level regulations by the Minister of Law and Human Rights Regulation Number 34 Year 2016 regarding the indicator standards of Human Rights in the Regency/Municipal levels. However, the regulation is presumably still inadequate at representing the Central Government and Local Government’s commitment to designing regulations integrating Human Rights in civil, political, socio-economic, cultural, and developmental rights. This study uses legal constructivism as its approach and aims to develop a legal system that implements principles of law and human rights in social institutions, legal institutions, social regulators, social integration, and social engineering. The results highlight the reconstruction of Law Number 23 Year 2014 regarding Local Government, which allows local government to administer Government affairs with the Minister's or Governor's joint approval. Furthermore, the Law a quo currently urges revisions in Article 12 regarding the concurrent government’s affairs on law and human rights. To achieve this, a nomenclature of provincial and regency/municipal Law and Human Rights Office (Diskumham) is on demand to handle affairs concerning law and human rights at regional levels, in accordance with Government Regulation Number 18 Year 2016 regarding Regional Agencies.

Abstract

This paper aims to study the construction of an appropriate legal basis for a state of law in responding to the Covid-19 emergency. As a state of law, Indonesia has been making many regulations at both central and local government levels. The regulations vary, ranging from Government Regulations in Lieu of Law, Ministerial Regulations, Ministerial Decrees, and Joint Decrees of Ministerial Instructions, to the Regulations of Regional Heads, and these regulations have led to overlapping regulations. With normative-juridical methods, the prescriptive technique was used to further analyze the problem and find a new concept of the construction of an appropriate legal basis in responding to the Covid-19 emergency. The research results show that, juridically, the use of non-legal products such as Ministerial Instructions and Circular Letters issued by ministers during the Covid-19 emergency in Indonesia has fulfilled the procedural aspects of law-making but not the substantive ones regarding the curbs restricting people’s social activities. This research recommends that the construction of a legal basis intended to respond to a state of emergency should simultaneously meet both procedural and substantive aspects

Abstract

Pergantian anggota legislatif merupakan suatu prosedur di mana konstituen memiliki kekuatan untuk memberhentikan anggota parlemen atau legislatif provinsi sebelum masa jabatannya berakhir. Dalam Pasal 16 ayat (1) Undang-Undang Nomor 2 Tahun 2008 tentang Partai Politik mengatur pergantian anggota legislatif yang dalam undang-undang dikenal dengan pergantian antar waktu. Pemberlakuan pergantian anggota legislatif yang hendak diberlakukan di Indonesia terdapat beberapa prosedur yang harus dijalani oleh partai politik untuk melakukan mekanisme recall kepada anggotanya di lembaga legislatif. Penulis menganalisis pengaturan pergantian anggota legislatif telah di Indonesia dan Kanada serta probabilitas penerapan recall referendum dari Kanada untuk sistem hukum Indonesia. Probabilitas penerapan pergantian anggota legislatif dibahas dari aspek struktural dan aspek budaya hukum. Jenis penelitian yang digunakan ialah penelitian hukum doktrinal menggunakan bahan hukum primer serta bahan hukum sekunder. Pendekatan yang digunakan dalam penulisan ini merupakan perundang-undangan. konseptual dan perbandingan. Penulis menjelaskan probabilitas terhadap pergantian anggota lembaga legislatif di Indonesia dan Kanada dapat dilihat dari aspek budaya hukum serta aspek struktural.

Abstract

Regional Development Planning is a process of compiling the stages of activities involving various elements of stakeholders to improve social welfare in an area/region within a certain period. In the provisions of Article 260, Law No.23 of 2014 concerning Regional Government, it is stated that the regions under their authority shall prepare regional development plans as an integral part of the national development planning system. The pentahelix planning model is an alternative to building a participatory and partnership planning framework that emphasizes the partnership principle, that it is necessary to know the urgency of the pentahelix planning model and the pentahelix planning model in the implementation of the regional medium-term development planning (RPJMD) to realize good governance (good governance), with a normative juridical research method with a statute approach, a conceptual approach, and a cross-disciplinary approach to law to solve related problems. The Pentahelix model has five actors who play a role in it, namely academics, business actors, communities, government, and media.

Abstract

The freedom to express ideas and participate in the government is often manifested through democratic voting or involvement in general elections, but the processes taking place in elections cannot fully ensure that the members of the public can get their rights to the freedom of speech and participation in the government. With doctrinal legal method, this research has found that there seems to be an urgency to initiate an online petition platform in Indonesia as an alternative channel accessible to all the members of the public in order to optimize the exercise of the freedom of speech and equal participation in the government. Online petition systems have been around in Indonesia for quite some time, initiated and managed by change.org as a private organization along with other non-governmental organizations, but the legal loophole regarding online petitions that represent public participation in forming policies has not been capable of guaranteeing the attention or responses from the government over particular issues. In order to gain more perspectives, this article compare the online petition systems in the US and South Korea that were initiated by presidential agencies, and also the online petition in Germany that is under the direct management of the Petition Committee bellow the parliament (Bundestag). Therefore, it is concluded that Indonesian president has the power to rule the government in order to respond the urgency to give protection and fulfill Human Rights, especially freedom of speech and the rights to participate in the government by setting the legal basis.

Abstract

Konstitusi hijau merupakan konsep yang mengakomodasi jaminan perlindungan lingkungan hidup ke dalam konstitusi sebagai hukum dasar negara. Dalam perkembangannya, Konstitusi Ekuador 2008 merupakan salah satu konstitusi yang mengatur jaminan hak konstitusional lingkungan secara progresif dan lebih lengkap. Dengan diaturnya norma lingkungan ke dalam konstitusi, maka hal itu menunjukkan keseriusan negara menjamin kelestarian lingkungan dan keberlangsungan generasi di masa mendatang. Penelitian ini menggunakan metode yuridis normatif atau doktrinal yang mengkaji hukum tertulis dari aspek teoritis dan peraturan perundang-undangan. Pendekatan yang digunakan adalah peraturan perundang-undangan, konseptual, dan perbandingan. Hasil penelitian ini menyimpulkan dua poin, pertama, konsep konstitusi hijau merupakan gagasan tentang konstitusionalisasi norma hukum lingkungan ke dalam konstitusi. Konsep konstitusi hijau tersebut dipengaruhi karena berkembangnya paham yang menjadikan lingkungan sebagai bagian dari pusat kehidupan (ecocracy). Sehingga jaminan hak konstitusional terkait lingkungan harus dianggap sebagai norma penting dalam konstitusi. Kedua, pengaturan hak konstitusional lingkungan dalam Konstitusi Ekuador 2008 menunjukkan adanya norma yang relatif jauh berbeda dengan UUD NRI 1945. Pengaturan hak konstitusional terkait lingkungan di dalam UUD NRI 1945 masih menjadikan lingkungan sebagai bagian dari HAM atas lingkungan yang melekat pada individu. Sedangkan dalam Konstitusi Ekuador 2008 memuat pengaturan yang lebih luas karena memberikan lingkungan sebagai penyandang hak konstitusional serta memberikan kewajiban kepada negara dan masyarakat untuk menjaga kelestarian lingkungan.Kata Kunci: Hak Konstitusional; Green Constitution; Perbandingan Konstitusi.The Green Constitution is a concept that embodies guarantees of the protection of the living environment into the constitution as the fundamental law of the state. In its development, the Ecuador Constitution of 2008 is one of the constitutions that progressively and more fully guarantees the constitutional rights of the environment. By putting environmental norms into the constitution, it shows the state's seriousness of ensuring environmental sustainability and the sustainability of future generations. This research uses normative legal research methods that study written law from theoretical aspects and the rule of law-legislation. The approaches used is statutory, conceptual, and comparative. The results of this research conclude two points, first, the concept of a green constitution is the idea of constitutionalizing environmental law norms into the constitution. The concept of a green constitution is influenced by the growing understanding that makes the environment part of the center of life. So the guarantee of constitutional rights related to the environment should be regarded as an important norm in the constitution. Secondly, the provisions of the constitutional rights of the environment in the Ecuador Constitution of 2008 show that there are relatively far different norms from the 1945 Indonesian Constitution. The constitutional provisions relating to environmental rights in the 1945 Indonesian Constitution still make the environment part of human rights over the environment that is inherent to the individual. The Ecuador Constitution of 2008 contains broader provisions because it gives the environment a constitutional right and gives the state and the people a duty to maintain environmental sustainability.Keywords: Constitutional Rights; Green Constitution; Constitutional Comparative.

Abstract

The Government's commitment to fulfilling and mainstreaming Children's Rights (PUHA) is carried out to realize the goals of national development, namely advancing general welfare and educating the nation's life as mandated by the fourth paragraph of the Preamble of the 1945 Constitution of the Republic of Indonesia which explicitly states that the State exists in order to protect all of Indonesia's bloodshed, promoting public welfare and educating the life of the nation. Furthermore, the commitment referred to is also based on the constitutional basis as set forth in the provisions of Article 28B paragraph (2), "Every child has the right to survival, growth and development and is entitled to protection from violence and discrimination. **)” and the provisions of Article 34 paragraph (1) which reads, “The state takes care of the poor and neglected children”. Therefore, a research was compiled with the theme of Legal Reconstruction of the Hexsa Helix Synergy and Collaborative Model of Mainstreaming of Children's Rights (PUHA) in the Implementation of Child-friendly District/City Programs. The formulation of the problems raised are (1) Why is a legal reconstruction of the Hexsa helix model of synergy and collaboration the Mainstreaming of Children's Rights (PUHA) needed in the implementation of the Child-Friendly District/City program? (2) What is the legal reconstruction model of the Hexsa helix synergy and collaboration model for Mainstreaming Children's Rights (PUHA) in the implementation of the Child-friendly District/City program as an alternative form of building a social inclusion strategy to achieve a more equitable development for fulfilling children's rights? The research method used is Normative Juridical with statutory approach and conceptual approach. While the literature used includes literature on children, the hexa helix concept, and child-friendly districts/cities. Further identification of legal materials is carried out on Primary Legal Materials which consist of a set of legal norms in the form of laws and regulations in the field of children's rights. Meanwhile, Secondary Legal Materials consist of libraries, journals, research findings, and KLA program performance reports stipulated by the Central Government and Regional Governments. For further analysis of legal material is carried out using the method of content analysis or content analysist to answer legal problems related to the idea of ??Legal Reconstruction of the Hexa helix Synergy and Collaborative Model of Mainstreaming Children's Rights (PUHA) in the Implementation of Child-Friendly Districts/Cities Programs

Penulis menjelaskan probabilitas terhadap pergantian anggota lembaga legislatif di Indonesia dan Kanada dapat dilihat dari aspek budaya hukum serta aspek struktural.
