Abstract

Putusan Mahkamah Konstitusi No. 3/PUU-VIII/2010 menganulir konsep Hak Pengusahaan Perairan Pesisir (HP–3) yang ditetapkan dalam Undang-Undang No. 27 tahun 2007. Putusan ini memunculkan konsep baru yaitu izin pemanfaatan pulau-pulau kecil. Terdapat dua konsep yang berbeda antara hak dan izin, sehingga perlu dijelaskan perbedaan konsep dan implementasi keduanya dalam pemanfaatan pulau-pulau kecil. Penelitian ini menggunakan metode penelitian hukum normatif yang menekankan kajian perundang-undangan dan putusan hakim yang mengatur pemanfaatan pulau-pulau kecil. Penelitian ini menjelaskan bahwa izin pemanfaatan lebih tepat digunakan daripada hak pengelolaan karena menekankan agar pemerintah lebih memiliki peran dan tanggung jawab dalam pengelolaan wilayah pesisir dan pulau-pulau kecil, dengan konsep perizinan memberikan ruang yang luas kepada pemerintah untuk melaksanakan aktivitas kerja yang solid baik mulai perencanaan, pelaksanaan, dan pengawasan.Decision of the Constitutional Court No. 3/PUU-VIII/2010 annulled the concept of Coastal Water Concessions (HP-3) are defined in the Law No. 27 year 2007, this decision gave rise to a new concept that permits the use of small islands. There are two different concepts of “rights” and “permissions”, so it is necessary to explain the differences both in concept and implementation in those small islands utilization. This study uses normative legal research method that emphasizes the review of legislation and judgment decisions governing the utilization of small islands. This research explains that utilization permits are more appropriately used than management rights because it emphasizes that the government has more roles and responsibilities in the management of coastal areas and small islands, with the concept of licensing provides widespread space to the government to carry out solid work activities from starting planning, implementation, until supervision.

Abstract

The Indonesian nation is a pluralistic nation, especially in religiosity. This is becoming a nation is rich in differences. The fact that it can not deny, that, the existence of normative standards that are owned by their respective religion. These religious norms when viewed at a glance, only to the extent of universal teachings and values of religious open to consensus. However, if further review, in these religions there are also religious norms that are partial-specific, such as religious doctrine, which is certainly difficult strived occurrence of a harmony. This is based on the reality that everything must be followed by a doctrinal interpretation, and in turn will establish religious fanaticism among his people. Of this fact, it can be ascertained that the conflict across religious doctrine among the adherents of a religion will continue. Hence, it is necessary to build an awareness of the plurality of religions in this country. Pancasila as the nation's basic philosophy is the ideal model of a plurality basis, Pancasila is a result of the contemplation of the founding fathers of the open-minded and tolerant in religion and was the embodiment of traditional values and cultural heritage. Order to create a harmonious and democratic life in this country, it is important to review the Pancasila as the foundation of religious plurality in Indonesia. Pancasila is the objectification of the universal values in every religion and belief, Pancasila is the philosophical basis of the intersection or along the Indonesian people in religion, with the supreme deity, please indicate that this nation with living up to her religion, Indonesia has one the same religiosity, namely joint recognition of the supreme deity. Pancasila is a social contract and state and nation.

Abstract

Pemikiran Hazairin dalam hukum kewarisan Islam dalam perkembangannya, mengenai ahli waris pengganti yang bertujuan untuk mencari rasa keadilan bagi ahli waris. Pada dasarnya ahli waris pengganti menjadi ahli waris karena orangtuanya yang berhak mewaris meninggal lebih dahulu dari pewaris. Adapun dalam hukum Islam istilah mawali dalam Al-Qur‟an menurut tinjauan hukum Islam istilah mawali sebagai ahli waris pengganti tidak dikenal namun kedudukan mereka sebagai ahli waris dapat diketahui melalui perluasan pengertian ahli waris langsung yang dijelaskan dalam Al-Quran.

Abstract

This research aims to empower the regulatory challenges of artificial intelligence (AI) within the framework of the Indonesian legal state. By using a qualitative approach and literature study methods as well as analysis of legal documents, this research found that the exponential development of AI has not been matched by adequate legal instruments in Indonesia. Legal uncertainty, overlapping institutional authority, and the absence of a clear juridical definition of AI are the main obstacles in realizing legal sovereignty in the digital era. This research recommends the need for harmonization of regulations and strengthening institutional capacity to respond to technological dynamics

Abstract

This study is motivated by the empirical finding that judges in the Religious Court Class 1A Pekanbaru do not explicitly use gambling as a legal ground for divorce, despite its inclusion in Government Regulation No. 9 of 1975 Article 19(a) and the Compilation of Islamic Law (KHI) Article 116(a). Moreover, Law No. 1 of 1974 on Marriage does not specifically recognize gambling as a cause of divorce, resulting in limited legal protection for affected parties. This research aims to analyze judicial reasoning and standards in adjudicating divorce cases involving gambling from an Islamic law perspective. This study employs a qualitative normative legal approach based on secondary data, utilizing statutory, case, and historical approaches. Data were collected through literature review and supported by interviews, and analyzed using qualitative analytical techniques to derive systematic and interpretative conclusions. The findings reveal that judges tend not to explicitly consider gambling as a primary ground for divorce, instead relying on arguments of continuous disputes and conflicts. Consequently, the normative provisions of Government Regulation No. 9 of 1975 Article 19(a) and KHI Article 116(a) are not optimally applied. From an Islamic law perspective, which prioritizes family welfare (maslahah), gambling can constitute a legitimate (syar’i) ground for divorce. In conclusion, there is a normative and practical gap in judicial application, indicating the need for legal reform. This study recommends strengthening legal provisions by explicitly incorporating gambling as a ground for divorce through amendments to Law No. 1 of 1974 to ensure legal certainty and protection.

Abstract

Jastip actors avoid the obligation to pay Import Duty and Tax in the Context of Import so that they are considered detrimental to the domestic industry because they sell goods at low prices. The Jastip perpetrators used the splitting method, namely dividing goods ordered by entrusted to certain people in one group. If this is always done, it will have an impact on domestic business actors of the Republic of Indonesia. This type of sociological legal research uses an empirical juridical approach using data sources of primary legal materials, secondary legal materials and tertiary legal materials. Implementation regarding Domestic Imports in the practice of online delivery services besides using PMK Number 203/PMK.04/2017 and PMK Number 199/PMK.010/2019, but also using a system from Customs and also using BTKI as a guideline based on Risk Management . There are several problem factors, namely the ignorance of the public about the latest regulations related to BM and PDRI and related to the provisions on Import of consigned goods, several reasons for the public to avoid paying Import Duty and Tax in the Context of Import, namely using vouchers, discounts and also using consignment reasons. is based on the results of the giveaway where the reason is not justified by the provisions of the applicable laws and regulations.

Abstract

This study analyses the paradigm shift in the regulation of territorial boundaries and jurisdiction of the Unitary State of the Republic of Indonesia as stipulated in Law No. 43 of 2008 on State Territory. The study focuses on Articles 2, 3, 5, and 14–18 with an International Cooperation approach, which emphasises the importance of shifting from defensive sovereignty to collaborative sovereignty in state border governance. Normatively, this study uses a doctrinal legal analysis method with a conceptual and comparative approach to the principles of international law, particularly the United Nations Convention on the Law of the Sea (UNCLOS). The results of the study indicate that the norms in Law No. 43 of 2008 need to be transformed from an administrative paradigm to a diplomatic-integrative paradigm. The management of state borders not only serves to maintain territorial integrity but also strengthens Indonesia's position as a norm entrepreneur in border diplomacy and regional maritime cooperation. This paradigm shift places international cooperation, mutual benefits, and the principle of equity as the new foundation for the formulation and implementation of state territorial boundary policies. Thus, the concept of state territorial regulation shifts from a closed sovereignty approach to an open, cooperative sovereignty, in line with Indonesia's free and active foreign policy.

Abstract

This article addresses the fundamental question of how siyasah syar'iyyah can integrate the principles of the Green Constitution to guarantee intergenerational ecological justice in the management of natural resources in Indonesia. Against the backdrop of rampant mining exploitation and deforestation that threaten environmental sustainability with nickel mining in Central Halmahera alone causing damage to 299 watersheds and deforestation of 27,900 hectares of forest cover this study employs a qualitative conceptual research method, analyzing the Mining Law (UU Minerba), the Job Creation Law (UU Cipta Kerja), and the concept of sustainability. The study argues that the current legal framework for natural resource management has failed to uphold intergenerational justice, as evidenced by the regression in environmental protection under UU Minerba No. 2 of 2025 which expands mining concessions, weakens oversight mechanisms, and prioritizes short-term economic interests over ecological sustainability and UU Cipta Kerja, which reduces environmental permits to mere approvals and limits public participation in environmental impact assessments. From the perspective of siyasah syar'iyyah particularly the principles of maslahah (public welfare), 'adl (justice), and the prohibition of mafsadah (harm) and the Green Constitution framework rooted in Articles 28H(1) and 33(4) of the 1945 Constitution, the study finds that effective natural resource governance requires a paradigmatic shift from anthropocentric, short-term oriented constitutional interpretation toward a substantive constitutional approach that embeds precautionary principles, non-regression, and state trusteeship for future generations. The study proposes an integrative "Siyasah Ekologis" framework that harmonizes Islamic political ethics with green constitutionalism to ensure that natural resource exploitation does not sacrifice the rights of future generations for the sake of present economic gains
