Abstract

Community life continues to develop dynamically. Along with that, various demands emerged to make various changes towards the achievement of national goals. Changes to the framework of the national legal system that was built on the basis of Pancasila and the 1945 Constitution. The direction of development must take into account the plurality of society without limiting rights and giving respect to the implementation of the law without overriding other legal interests. The context of a pluralistic Indonesian society develops along with the dynamics and development of society, both socio-culturally and politically. This article discusses the legal tradition that grows and takes root in Indonesia. This article is a normative research, which is conducting a literature study or secondary data to collect data through documentation from various articles, books, and other sources that discuss legal traditions in Indonesia. The finding of this article is that legal practices that develop in Indonesia are customary law, Islamic law, and Continental Europe. In the development of national law through the “middle way” as a principle of compromise against legal traditions that influence and attract each other, taking into account the philosophical, sociological, and juridical. In essence, legal practice refers to welfare and benefit considerations: “maintaining old traditions that are still relevant, building new, better traditions.” What this article has in common with others is that it discusses legal traditions, while the difference is that this article analyzes the development of legal practice in Indonesia from various perspectives and approaches to religious values so as to create a just legal concept.

Abstract

ABSTRAKKonstelasi agama dan negara menjadi bahan permbincangan yang hangat dikalangan mereka yang berpaham sekularisme, agama dianggap berbeda dengan negara sehingga mesti dipisahkan. Sedangkan sejarah mencatat terkhusus peradaban Islam mencapai puncaknya melalui kedekatan dan ketataan mereka kepada agamanya, dan berbeda dengan apa yang telah dialami oleh Barat dimasa lalunya. Keberadaan agama adalah  menjadi “fitrah’ yang menimbulkan hak dan kewajiban yang mesti dijalankan, sehingga mengikat zahir dan bathin seluruh manusia untuk melaksanakannya.

Abstract

Partai memainkan peran penghubung yang sangat startegis antara proses-proses pemerintahan dengan warga negara. Dalam demokrasi kehadiran partai politik adalah suatu keniscayaan dalam rangka memainkan fungsi representasi manakala partai politik masuk ke arena pemilu. Dalam pemilu, partai politik boleh dikatakan sebagai aktor tunggal pengisian jabatan dalam lembaga-lembaga negara. Partai politik dapat mengusulkan pemberhentian anggota Dewan Perwakilan Rakyat Oleh karena itu, wajar apabila recall bagi kalangan politisi senayan dianggap sebagai momok, atau ranjau demokrasi. Mekanisme kontrol itu juga tidak boleh mengesampingkan kedaulatan rakyat, bahkan dapat membelenggu anggota dewan yang menyeruakan aspirasi yang diwakilinya. Mengingat kekuasaan yang besar cenderung melahirkan abuse of power sehingga mengakibatkan anggota Dewan Perwakilan Rakyat tidak dapat berekspresi secara bebas dalam menyuarakan aspirasi rakyat yang diwakili karena harus mengikuti kebijakan dan arahan partai sehingga yang terjadi hubungan antara wakil dan terwakili sebagai partisipan. Setiap negara memiliki sistem perwakilan begitu juga Indonesia melihat ada tiga lembaga yang berada dalam rumpun legislatif yaitu Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah dengan kewenangan secara tersendiri yang diberikan oleh Undang-Undang Dasar Negara Republik Indonesia 1945 maka dapat sistem perwakilan yang dianut Indonesia merupakan sistem yang khas Indonesia karena dibentuk sebagai perwujudan kebutuhan, kepentingan serta tantangan bangsa dan negara Indonesia.

Abstract

Indeed, Indonesia is a country that adheres to the notion of a "welfare state" with a "participatory welfare state" model which in social work literature is known as welfare pluralism.This model emphasizes that the state must continue to take part in handling social problems and the implementation of social security,although in its operation it still involves the community.The main goal of social forestry is the welfare or prosperity of the people.Locally, social forestry in Riau Province has an Indicative Map of Social Forestry Allocation (PIAPS) of 1.2 million hectares.However, the realization of social forestry achievements in Riau is far from the number of PIAPS.This achievement covers an area of 121,464.36 hectares with a total of 77 decrees and 24,136 households.Barriers to social forestry other than landconflicts, Social Forestry and Environmental Partnerships (PSKL), Working Groups (POKJA), the Environment and Forestry Service (DLHK) and the Forest Management Unit (KPH) have different ideas in accelerating social forestry.If the achievement of social forrestry is realized in accordance with the number of PIAPS 1.2 million hectares, it can help the community's economy so that the realization of community welfare in accordance with the mandate of the 1945 Constitution of the Republic of Indonesia.

The existence of circulars in the Indonesian legal state is part of the policy regulations as further elaboration, both technically and administratively. Abstract

Crimes are not only committed by adults against children, but there are also crimes committed by children. Crimes involving children often end up in court, and there are some differences that courts make when a child sits as a convict. Children facing the law, whether children conflict with the law (Bad Boy), Victim's Child, or Witness's Child, must be provided legal assistance and accompanied by legal aid or legal counsel. Thus, there is a need for special assistance to ABH, to ensure the psychology of the child is not compromised. Legal aid organizations that are required to assist ABH both outside and in the trial, also play a role in ABH's psychological assistance. OBH PAHAM Riau is present in the effort to fight for the guarantee and protection of the rights of marginalized/poor people as well as the enforcement of fair laws specifically in pekanbaru city, Riau.Keywords: Role, OBH PAHAM Riau, Children's Case.

Abstract

After the promulgation of Law Number 11 of 2020 concerning Job Creation, there are still various responses and a judicial review application has even been submitted to the Constitutional Court (MK). Several points in the minutes of the Constitutional Court's decision have legal implications. This paper analyzes the Constitutional Court Decision Number 91/PUU-XVIII concerning the Judicial Review of Law Number 11 of 2020 concerning Job Creation and the executive power of the Constitutional Court against the Judicial Review of Law Number 11 of 2020 concerning Job Creation. The research method in this paper is normative. It is normative because it uses secondary data to examine rules or norms. This research is descriptive in nature so that researchers try to describe the object or present a complete picture of the object or subject under study in accordance with the circumstances as they are with the aim of systematically describing the facts and characteristics of the object or subject being studied appropriately. The results of the discussion show that the Constitutional Court Decision Number 91/PUU-XVIII concerning the Judicial Review of Law Number 11 of 2020 concerning Job Creation has provided legal implications, namely improvements were made within the specified time limit and a prohibition on issuing new implementing regulations related to the Act. -Copyright Act.

Abstract

Environmental damage by extractive activities is caused by the formulation of policies that have not placed nature and the environment as legal subjects. Policy formulation in the form of a contract of work tends to accommodate human interests and is profit-oriented. This study aims to examine strategies for mitigating environmental damage caused by PT Freeport’s mining activities based on an eco-contract perspective. PT Freeport’s contract of work is the object of analysis in this research, while data on environmental damage are obtained from national media. Theoretical-reflective approach is used in analyzing the data to formulate mitigation strategies. The results showed that the mitigation of environmental damage in the eco-contract perspective emphasizes the natural relationships and interactions between all components of the ecosystem. In other words, mitigation of environmental damage requires equal treatment between the environment and humans which also indicates equal rights. In fact, force majeure conditions and natural disasters are still viewed from a human perspective, so that efforts to identify and socialize environmental damage only focus on human aspects rather than nature and the environment. PT Freeport’s contract of work has not accommodated mitigation efforts of environmental damage that ecologically oriented. In addition, the weak mapping, control, and socialization of PT Freeport’s mining activities have implications for the lack of efforts to mitigate environmental damage.

AbstractProblems regarding the maintenance of children after the divorce of parents are always a problem, because many children's rights are neglected by parents, so they are not taken care of, especially matters relating to children's basic rights, namely the need for food, shelter, education and other facilities. other supporting facilities. Even though the two parents are no longer united in a marriage bond, the problem of fulfilling the maintenance of children is the responsibility of the parents and this should not be delegated to other people. Walaupun Kedua orangtua tidak bersatu lagi dalam satu ikatan Perkawinan, namun Permaslahan pemenuhan nafkah terhadap anak merupakan tanggung jawab orangtua dan hal ini tidak boleh dilimpahkan kepada orang lain. Abstract

Cases of child neglect are considered an indicator of the minimal quality of child protection in Indonesia. The law that is needed is criminal law because it is considered effective. Sanctions for perpetrators of criminal acts of child neglect are explained in Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. Criminal Provisions, Article 77B "Any person who violates the provisions as intended in Article 76B ("Every person is prohibited from placing, allowing, involving, ordering to involve a child in a situation of abuse and neglect"), shall be punished with a maximum imprisonment of 5 (five) years and/or a maximum fine of IDR 100,000,000.00 (one hundred million rupiah)”, however the fact is that sanctions against parents who do not support their children as per the court decision regarding the obligation to pay child support, especially for a father, are almost never implemented because of the umbrella There is no specific law that provides sanctions for fathers who do not support their children. Therefore, in order to increase the effectiveness of implementing child protection, it is necessary to provide criminal sanctions for child neglect committed by parents, especially for fathers who do not carry out their obligations, namely by revising the Elucidation to Article 76 B of Law Number 35 of 2014 concerning Child Protection, with the addition of an editorial explaining the article, "what is meant by Neglect, includes the Parent's (Father's) Denial of Payment of Child Support based on a Religious Court Decision which has permanent legal force.
