Abstract

This study aims to explain descriptively about the implementation of ex-gratia claims on life insurance agreements, how to pay and settle ex-gratia claims and ex-gratia claim terms. In the Life Insurance agreement, the insured party when experiencing an unexpected risk of obtaining its rights in the settlement of claims. The occurrence of rejection of claims on life insurance, becomes the cause of a lack of understanding of the actual articles and regulations must be understood before deciding to use insurance. In fact, not all losses suffered by the insured in the insurance agreement can be paid according to the agreement. It is caused by several factors that are considered to violate the principles of insurance and regulations that have been determined in the insurance agreement, resulting in the cancellation of the insurer pays its obligations to the insured or commonly called rejected claims. But customers sometimes still demand that the company pay, therefore the insurance company takes the initiative to pay claims rejected through Ex-gratia. But many people do not know about the ex-gratia claim. Some insurers take the initiative to pay ex-gratia rejected claims. Implementation of ex gratia claims can be done by negotiation, good faith from the insurer to the insured. Received: 15 October 2021 / Accepted: 30 November 2021 / Published: 5 January 2022

Abstract

ABSTRACTThe banking industry is a dynamic sector along with economic growth, an increasing of complex financial transactions, and the impact from global trade, therefore the presence of an independent institutions is really needed. The Deposit Insurance Agency (LPS) is an institution that is independent, transparent and accountable in implementing its duties and authorities. As an independent agency, accountability is very important to be applied, so that stakeholders aware of what and how LPS implement the functions and duties as mandated by Law No. 24 of 2004 concerning the Deposit Insurance Agency (LPS). Procedurally, if the Financial Services Authority (OJK) indicate a bank that is experiencing liquidity problems, Financial Services Authority (OJK) immediately inform the Bank of Indonesia (BI) to take steps in accordance with BI's authority. In practise, Financial Service Authority (OJK) coordinate withBank of Indonesia (BI) to make regulatory supervision in banking sector. Coordination in handling between failed banks between the Deposit Insurance Agency (LPS) and Financial Services Authority (OJK) is shown by a confirmation from Financial Services Authority (OJK) to the Deposit Insurance Agency (LPS) about troubled banks that are in the restructuring efforts by Financial Services Authority (OJK), then the Deposit Insurance Agency (LPS) investigate the banks in accordance with its functions, duties and responsibilities. The Deposit Insurance Agency (LPS) as an institution that checks condition of banks surely will review and determine whether the troubled banks will be saved or not saved.

Abstract

Perjanjian baku mengharuskan semua ketentuan yang ada dalam suatu perjanjian menghilangkan hak konsumen untuk melakukan negosiasi yang di dalam perjanjian asuransi lajim disebut dengan klausula eksonerasi di mana tanggungjawab dibatasi berdasarkan kepentingan sepihak. Asuransi menerima peralihan risiko dari adanya evenement, Perjanjian antara tertanggung dan penanggung di tuangkan dalam suatu akta tertulis yang disebut polis, dalam tatanan praktisnya perjanjian Asuransi agar dapat dinyatakan sah, maka harus berdasarkan kepada pasal 1320 KUHPerdata dan pasal 251 KUHD (Notification). Dalam tulisan ini akan diuraikan mengenai bagaimana akibat hukum dengan adanya klausula eksonerasi sebagai perjanjian baku dalam polis Asuransi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan yang mengkaji Undang-undang No. 8 Tahun 1999 Tentang Perlindungan Konsumen dan pasal 1320 KUHPdt serta aturan-aturan lain yang relevan. Hasil penelitian ini menemukan bahwa dengan adanya penuangan klausula eksonerasi dalam perjanjian baku dapat menimbulkan kerugian pada pihak tertanggung dikarenakan adanya penafsiran pemahaman isi kesepakatan pada hubungan kontraktual para pihak. Dengan demikian, perjanjian dapat dibatalkan dan batal demi hukum karena tidak memenuhi syarat kesepakatan.

Abstract

Pengaturan dan pengawasan terhadap sektor perasuransian pada saat ini telah berada di bawah Otoritas Jasa Keuangan (OJK). Oleh karena itu yang memiliki legal standing dalam mengajukan permohonan kepailitan dan Penundaan Kewajiban Pembayaran Utang (PKPU) bagi perusahaan asuransi yang dinyatakan pailit, harus dilakukan atas dasar adanya rekomendasi dari Otoritas Jasa Keuangan (OJK). Pihak tertanggung maupun pihak penanggung tidak diberikan kewenangan untuk melakukan permohonan PKPU secara langung. Dengan demikian majelis hakim tidak serta merta mengabulkan permohonan PKPU, apabila permohonan PKPU dilakukan tanpa adanya rekomendasi dari OJK. Namun pada perkara yang penulis teliti justru majelis hakim Pengadilan Niaga mengabulkan permohonan PKPU tersebut yang seharusnya tidak dapat diterima karena tidak adanya rekomendasi dari OJK. Dengan dikabulkannya permohonan PKPU tersebut dapat menimbulkan implikasi dan konsekuensi terhadap proses hukum selanjutnya. Penulis melakukan penelitian ini untuk dapat mengetahui bagaimana dampak permohonan PKPU yang dilakukan oleh perusahaan asuransi yang mengalami pailit tanpa rekomendasi dari OJK. Penelitian ini menggunakan metode penelitian hukum normative dengan pendekatan perundang-undangan yang mengkaji Undang-undang Nomor 40 Tahun 2014 Tentang Perasuransian, putusan pengadilan dan aturan-aturan lain yang relevan. Hasil penelitian yang penulis dapatkan bahwa dengan dikabulkannya permohonan PKPU tanpa adanya rekomendasi dari OJK dapat menimbulkan implikasi dan konsekuensi terhadap proses hukum selanjutnya dan membawa dampak yang menimbulkan kontradiktif antara hak dengan kewajiban serta menimbulkan ketidak pastian hukum sehingga pihak tertanggung di dalam posisi yang sangat dirugikan.

Abstract

This research evaluates the legal protection of famous trademarks under Indonesian law, examining the extent to which existing regulations safeguard trademarks with strong public recognition. As valuable corporate assets, famous trademarks require effective legal protection to prevent misuse and infringement. However, globalization and technological advancements have intensified intellectual property violations, posing significant challenges to trademark owners. Using a normative juridical approach, this research analyzes relevant legislation and judicial practices in Indonesia while identifying obstacles in maintaining trademark exclusivity in both domestic and international markets. Through this analysis, the research aims to provide policy recommendations to strengthen trademark protection and develop a more adaptive legal framework that responds to technological and global challenges.

Abstract

Interfaith marriage in Indonesia is still controversial even though Law No. 1/1974 on Marriage explicitly states that marriage must be carried out by the laws of each religion and belief. In practice, cases of interfaith marriage still often occur in the community. Meanwhile, human rights and pluralism activists argue that everyone has the right to form a family, including through interfaith marriage, so the state should not prohibit it. This controversy was reignited when several District Courts granted applications to register interfaith marriages in 2022-2023. In response, the Supreme Court (MA) issued Supreme Court Circular Letter (SEMA) Number 2 of 2023 which essentially prohibits courts throughout Indonesia from granting registration of interfaith marriages. This policy has been appreciated by conservative religious circles, but regretted by human rights activists. They believe that the SEMA has the potential to violate the freedom of religion and family guaranteed by the Constitution. This study aims to analyze SEMA No.2/2023 in managing requests for registration of interfaith marriages The study aims to offer insights into the Supreme Court's policy and the challenges encountered by courts, providing constructive suggestions for future interfaith marriage policies.

Abstract

An insurance policy is a legal contract between the Insurer and the Insured, serving as written proof of their agreement. The Insurer agrees to compensate the Insured for actual losses from damage, loss, or destruction of property—or the loss of interest—caused by an uncertain event. In the perkara a quo, the Plaintiff claimed they still had the right to file against Defendant II for a toll road accident involving Co-Defendant II’s vehicle, despite having already submitted a claim to Co-Defendant II’s insurer. This research uses a qualitative method, analyzing a final and binding court decision (inkracht van gewijsde), with a descriptive-analytical approach. It explores two key questions: (1) How do legal principles of insurance contracts influence dispute resolution? and (2) What is the role of the policy as legal evidence, and how do courts interpret it? A policyholder’s right to claim arises after full premium payment and a covered loss. In this case, the Panel of Judges rejected the Plaintiff’s claim entirely. In the amar putusan, they also rejected the Defendants’ objections, concluding the Plaintiff failed to prove their claim.
