Abstract

Violation cases of children rights in every years more increase. Indonesian Child Protection Commision said that complaints to KPAI in 2015 were 4309 cases, after that in 2016 up to 4622. In 2017 were 4579 cases and in2018 reaching 4885 cases This phenomena its happened in society based on information from Indonesian Child Protection Commision that every year more and more increase. The fact that Violation cases of children rights caused og parents doesn’t know and realize about Child Protection Laws. Due to this problem, urgently needed socialize ang law counseling in giving a knowledge and understanding to the people, especially parental regarding a child’s rights guarantee in Child Protection Law then to provide assistance in preparing legal product, rules and assistance in preparing working program, its expected this activity will have awarnesess and attention to be able in helping government regarding a buse of child cases. The methode used is counseling and getting an outreach and assistance of each participants will be given a hardcopy materials/discussion/asking a question and answers and assistance to create a child friendly environment in order to realize a child protection and to prevent of a child against the law and to minimize increasing a numbers of abuse child cases.

Abstract

Globalisasi menyebabkan teknologi mengalami perkembangan yang cukup pesat bagi seluruh dunia. Dampak negatif dari berkembangnya teknologi adalah adanya tindak pidana siber. Bhabinkamtibmas sebagai ujung tombak Polri di tingkat Desa atau Keluruhan menjadi garda terdepan dalam menciptakan keamanan dan ketertiban masyarakat. Tujuan penelitian ini adalah untuk mengkaji peran Bhabinkamtibmas Dalam Pencegahan Tindak Pidana Siber Berdasarkan Undang- Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Informasi Transaksi Elektronik. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, yaitu suatu pendekatan penelitian hukum yang mengkaji implementasi peraturan perundang-undangan yang berkaitan dengan pelatihan dan pencegahan kejahatan siber oleh Bhabinkamtibmas. Spesifikasi Penelitian yang digunakan pada penelitian ini adalah penelitan deskriptif analitis, yaitu metode penelitian dengan cara mengumpulkan data-data sesuai dengan yang sebenarnya kemudian data-data tersebut disusun, diolah dan dianalisis untuk dapat memberikan gambaran mengenai masalah yang ada. Teknik pengumpulan data dilakukan secara studi dokumen dan dilakukan pula proses wawancara di Polres Karawang untuk menambah validitas data yang digunakan dalam penelitian. Hasil penelitian menunjukkan bahwa peran Bhabinkamtibmas di Polres Karawang belum optimal dalam mengatasi tindak pidana siber sebab belum memiliki keterampilan teknis memadai untuk menghadapi tantangan dalam melakukan pencegahan dan penanggulangan tindak pidana siber. Upaya penanggulangan untuk meningkatkan peran Bhabinkamtibmas dalam mengatasi tindak pidana siber diperlukan. Diperlukan upaya pelatihan dan pendekatan yang lebih sistematis, berbasis kebutuhan, dan didukung oleh sumber daya yang memadai agar dapat lebih siap dalam menghadapi tantangan tindak pidana siber di era digital.

Abstract

Pada tahun 2023, terjadi lebih dari 152.000 kecelakaan lalu lintas yang mengakibatkan sekitar 27.000 kematian. Pada umumnya penyebab kecelakaan lalu lintas adalah faktor manusia, kendaraannya, dan jalan. Dari ketiga faktor tersebut, faktor jalan sepenuhnya di luar kendali pengemudi. Sementara faktor manusia (pengemudi) sepenuhnya dikuasai oleh pengemudi. Sementara itu faktor kendaraan hanya sebagian yang dikuasai oleh pengemudi, sisanya dipengaruhi oleh berbagai hal di luar diri pengemudi. Khususnya terkait dengan penggunaan kendaraan yang memerlukan pengujian secara berkala, faktor penguji (orang yang melakukan pengujian) turut menentukan potensi terjadinya kecelakaan lalu lintas kendaraan yang diujinya. Dalam sebuah kecelakaan lalu lintas yang menyebabkan korban jiwa, pada umumnya faktor manusia dan faktor jalan lebih mendapat sorotan, tetapi sangat jarang faktor orang yang menguji kelayakan operasional kendaraan yang mengalami kecelakaan mendapat sorotan. Penelitian ini menggunakan pendekatan yuridis normatif, menganalisis sinkronisasi peraturan perundang-undangan terkait lalu lintas. Metode analisis yang digunakan adalah yuridis kualitatif, berfokus pada makna fakta hukum. Pelaksana uji kendaraan dapat dikenakan pertanggungjawaban pidana berdasarkan beberapa pasal, termasuk suap, pemalsuan, dan kelalaian yang menyebabkan kematian atau luka berat. Upaya penanggulangan kecelakaan lalu lintas melibatkan langkah pre-emtif, preventif, dan represif, seperti penanaman nilai positif, sosialisasi pentingnya pengujian berkala, peningkatan profesionalisme penguji, dan harmonisasi peraturan.

Abstract

Law No. 1 of 2023 on the Indonesian Criminal Code introduces the principle of Judicial Pardon under Article 54(2), reflecting a progressive effort to advance substantive justice in Indonesia’s criminal justice system. However, its implementation remains problematic because procedural criminal law does not provide a clear mechanism for applying judicial pardon in practice. This study examines the concept and significance of judicial pardon from the perspective of dignified justice and proposes strategies to harmonize its regulation within the Criminal Code, the Criminal Procedure Code, and the Law on Judicial Power. Using a descriptive-analytical method, this research focuses on judicial pardon as regulated in the Criminal Code and applies qualitative juridical analysis to interpret the findings systematically. The results show that judicial pardon grants judges discretion to prioritize justice over legal certainty, yet such discretion requires procedural safeguards to ensure consistency and accountability. A comparison with the Dutch legal system confirms the importance of detailed procedural rules to prevent arbitrary application. This study recommends harmonization through: (1) technical guidelines in a Draft Government Regulation outlining procedures and parameters for judicial pardon; (2) formal recognition of judicial pardon as a type of judicial decision in Law Number 20 of 2025 on Criminal Procedure Law; and (3) revision of the Law on Judicial Power to establish ethical and technical standards for judges. Such harmonization is essential to build a criminal justice system that upholds dignified justice.

Abstract

This study examines cyber law issues in regulating the responsibility of digital platforms for the misuse of personal data based on Artificial Intelligence. The focus of the study is on the inconsistency between the development of autonomous technology and a legal framework that is still based on a conventional paradigm. This study uses a normative legal method with a legislative and conceptual approach to analyse the regulation of personal data protection and the legal responsibility of digital platforms. The results of the study show that existing regulations do not provide adequate legal certainty, particularly in terms of algorithm control and the division of legal responsibility. Therefore, it is necessary to reconstruct cyber law regulations that place digital platforms as active legal subjects with risk-based obligations and prevention principles. This reconstruction is expected to strengthen the protection of data subjects' rights and ensure the responsible use of Artificial Intelligence.

Abstract

In essence, law cannot be separated from social life, as it emerges, develops, and functions to regulate patterns of relationships between individuals within a social order. The concept of living law emerged, namely law that lives and develops through customs, traditions, and behavioral patterns recognized as guidelines for action. This study aims to analyze the role of empirical legal research methods in identifying and understanding living law in society. This research method uses a juridical-empirical approach by observing legal practices, social behavior, and the interaction between written legal norms and prevailing social norms. The results show that the empirical legal method enables an understanding of law as a dynamic social reality, while simultaneously revealing the gap between normative law and actual legal practice. This approach is also capable of identifying social, cultural, economic factors, and public legal awareness that influence the effectiveness of law. Thus, the empirical legal research method is a crucial instrument for the development of legal science, particularly in formulating legal policies that are responsive to societal needs and realities. Understanding living law through an empirical approach can encourage the creation of a legal system that is not only formally valid but also effective, relevant, and socially just.

Abstract

This study analyzes the role of living law in realizing the principle of fair trial within the Indonesian criminal justice system following its formal recognition in the Indonesia’s 2023 Criminal Code. It aims to examine how living law can be operationalized as a legal instrument to bridge the gap between formal legality and substantive justice, while preventing abuse of power across criminal proceedings. Despite its normative acknowledgment, the implementation of living law remains inconsistent and often constrained by a positivistic legal approach, resulting in disparities and legal uncertainty in judicial practice. This research employs a normative juridical method using statutory and conceptual approaches, supported by an analytical-descriptive design based on secondary legal materials, including legislation, jurisprudence, and legal doctrines. The findings demonstrate that living law contributes significantly to the realization of fair trial principles by incorporating societal values, ensuring proportionality in sentencing, recognizing customary sanctions, and preventing double punishment (ne bis in idem). However, the absence of standardized criteria, formal validation mechanisms, and procedural guidelines creates risks of subjectivity and arbitrariness. The novelty of this study lies in positioning living law as an operational and structured legal mechanism within criminal justice, emphasizing the need for a comprehensive regulatory framework integrated with human rights safeguards to ensure legal certainty, consistency, and substantive justice.

Abstract

This paper examines psychic causality in Iindonesian crimiinal law through normative legal research and a material offence approach. Classical criminal law tends to identify criminal causation through physical acts, such as stabbing, striking, oir poisoining. However, contemporary criimiinal cases increasingly involve non-physical acts, includiing verbal intimidation, psychological pressure, threats, humiliation, coercive communication, and digital harassment, which may allegedly trigger severe psychological harm or even suicide. The central legal question is whether psychological pressure may be legally constructed as a cause of a prohibited result. This paper argues that psychic causality cannot be assessed solely through the conditio sine qua noin theory because such theory is too broad when applied to psychological events. Instead, legal causation requires a coimbination of factual causation, adequate causation, objective foireseeability, and normative attribution. Indonesian law has recognized psychological suffering through several legal instruments, including the Criminal Code, the Domestic Violence Law, the Sexual Violence Crime Law, the Electronic Information and Transactions Law, and the new Criminal Code. Nevertheless, the main difficulty lies not in the existence of norms, but in proving the causal chain between the perpetrator’s conduct and the victim’s psychological condition. Therefore, forensic psychiatric expertise, psychological autopsy, medical records, digital evidence, and witness testimony are crucial to bridge legal certainty and scientific probability.

Abstract

Radicalism has become a serious threat to child protection in the digital era. Children are vulnerable groups easily influenced through social media, social environments, and inappropriate parenting patterns. This community service program aimed to increase public understanding regarding legal protection for children from the dangers of radicalism through legal education, digital parenting counseling, and assistance in drafting community-based child protection regulations. The implementation method consisted of three stages: preparation, implementation, and evaluation. The program was conducted in RW 14 Pasanggrahan Village, Ujung Berung District, Bandung City, targeting RT/RW administrators, PKK members, and parents. The results showed an increase in public understanding regarding the dangers of radicalism and the importance of child protection, with achievement levels ranging from 80% to 85%. In addition, an RW regulation regarding curfew implementation for children and adolescents was successfully established as a form of community-based social protection. This program demonstrates that legal education and community participation strengthening are effective approaches in preventing the spread of radicalism among children.

Abstract

Restorative justice has become an important alternative for settling minor criminal cases in Indonesia. Unlike the conventional criminal justice approach, which emphasises punishment, restorative justice prioritises victim recovery, offender accountability, reconciliation, and restoring social relations. This article examines how restorative justice is regulated in the Indonesian criminal justice system, how it applies to minor criminal offences, and the obstacles to achieving legal certainty and justice. This research applies a normative legal method using statutory, conceptual, and analytical approaches. The study finds that Indonesia regulates restorative justice through various sectoral and institutional instruments, including police regulations, prosecutorial regulations, judicial guidelines, juvenile criminal justice legislation, and the new Criminal Code. Such fragmented regulation creates different procedures and requirements among law enforcement institutions. In minor criminal cases, restorative justice may provide substantive justice by facilitating restitution, apology, reconciliation, and direct offender responsibility. However, implementation faces several challenges, including inconsistent legal standards, unequal bargaining positions, possible coercion of victims, the commercialisation of peace agreements, and inadequate monitoring. Therefore, restorative justice should be implemented through harmonised regulations, voluntary participation, victim protection, transparent procedures, measurable recovery, and integrated supervision. Restorative justice can reconcile legal certainty and substantive justice when it is treated not merely as a mechanism for terminating cases, but as a legally accountable process of recovery and responsibility.
