Abstract

As the 2010 Indonesian demographic Statistic data predicted that in the year 2020-2030 Indonesia will have overpopulation of young people at the productive age (18-50 years old) in about 69%. So there is a need to find solution on jobs and welfare for those segments of people. Islam as the religion of majority people of Indonesia has a teaching regarding this matter that has been known as Islamic economic security system, by means of zakat, waqf, trading and business manner that could give some solutions for the betterment for human economic security to this country. By using normative and comparative method of research, this paper will lead to the conclusion that the country needs to lagislate the shariah principles of contract and economic system due to secure the human rights on transactions and economic activities.

Abstract

This article discusses about the extent of readiness of the government regulation to meet the need of Islamic investment in the field of banking in Indonesia and Turkey, especially how legal protection to the banks and the customers in implementing sharia investment in both countries. This article is based on normative legal research, descriptive comparative through analysis the literature and regulatory provisions in force in the two countries. It is concluded that both Indonesia and Turkey have an arrangements of legislation and procedures in which guarantees the legal protection for every parties to apply islamic contract law through its secular legislation system. Depending on the customers would need to seek an appropriate mechanism in sharia based on freedom of contract. The difference is that in the legal systems being used also has differences, in which Indonesia has such a specific sources of law in which regulating the syariah principles. On the other hand Turkey does not.

Abstract

The progressive development of International law can be seen also in the concept of trust in business transaction based on its evolution from time to time. This is because the trust institution, which is considered as an achievement of the Anglo-Saxon legal system that has tremendous benefit, actually started from the concept of separation between ownership and mastery in the form of charitable trust of waqf , known in Islamic law. Research proves that in the history of “Trust”, waqf is forerunner of the establishment of “Trust”. How the concept of waqf develops a business type of Mutual Fund that is in compliance with Sharia Law, is the problem that is discussed in this paper. By using a normative and comparative law method, this paper found that by implementing only Nazhir functions that reflect the concept of trust by means of Islamic Trust Fund (ITF), the benefit of the object of cash waqf can be multiplied. For this purpose, the Islamic Trust Fund concept is defined in the real meaning of cash waqf mandate which today can be used in business activities, other than worship sector0. With ITF concept like this does not preclude the general public to participate in purchasing units in the form of a business Sharia Mutual Funds (SMF), so thus also can create investment opportunities that also drives the wheels of development.

Abstract

The practice of Foreign Direct Investment (FDI) in developing countries often cause the labor problems, such as the labor on strike demanding higher wages or the severance pay as the results of the “down-sizing” whose made changes etc. In the country who has inadequate labors regulation or even does not have a strong labors union, it is difficult to enforce the rights of the labors. With the extreme separation position system between the labors and the employer, the problem is always decreasing, so the concept of alternative working relationship to solve this problem. The mudharabah principle in working agreement may be the way to solve the problem. That principle puts the labor and the employer to the same position, so the worker can develop their self to be productive and will gain the the profit for the company and also increase the labors income. In that principle, the company does not need “downsizing” or facing the labors “strikes” or “layoffs”, because the labor welfares can directly obtain from the hard work for the company. Besides the welfare for the labors, this concept is also can attract the foreign investment in our country.

Abstract

Salah satu akibat hukum yang berdampak pada kepemilikan harta setelah dilangsungkannya perkawinan adalah harta bersama. Hal ini memberikan permasalahan dalam hal perkawinan tersebut merupakan perkawinan campuran dimana perkawinan ini dapat membatasi hak-hak WNI atas kepemilikan harta, khususnya kepemilikan hak atas tanah. Undang-Undang No. 1 Tahun 1974 tentang Perkawinan memberikan pengesampingan hukum agar tidak terjadinya percampuran harta akibat perkawinan dengan memperbolehkan adanya perjanjian perkawinan yang perlu disahkan oleh pegawai pencatatan perkawinan atau Notaris. Namun, sering terjadi perjanjian perkawinan tersebut tidak dilampirkan pada saat pencatatan perkawinan campuran yang dilakukan di luar negeri. Tujuan penelitian ini adalah untuk mengetahui akibat hukum yang timbul sehubungan dengan tidak dicatatkannya perjanjian perkawinan dalam perkawinan campuran. Penelitian ini merupakan penelitian yuridis normatif dengan melakukan studi kepustakaan serta peraturan perundang-undangan yang berlaku. Hasil dari penelitian ini menunjukkan bahwa tidak dicatatkannya perjanjian perkawinan dalam perkawinan campuran tidak mempengaruhi keberlakukan dari perjanjian perkawinan itu sendiri, hanya saja perjanjian perkawinan tersebut tidak memenuhi asas publisitas dimana hal ini dapat berpengaruh kepada pihak ketiga.

Abstract

 Investment Manager (MI) as a sharia mutual fund manager is done in two ways are the establishment of Sharia MI and Sharia Investment Management Unit (UPIS) for conventional MI. Most of conventional MI is not ready to spin off to become a Sharia MI because it is considered the current governance of MI is still low. OJK issued regulation No. 10/POJK.04/2018 on the Implementation of Investment Manager Governance that applies to both. However, the arrangement is still general and has not led to sharia governance system, while Indonesia has good governance guidelines for Sharia Business Governance (GGBS) that can be used as a reference standard. Based on these issues, the author reviewed the principles of GGBS to the extent of their implementation in the regulation of investment manager governance. This research is normative juridical with an analytical descriptive approach. Based on the results of the study the authors found that the governance arrangements of investment managers have not been sufficiently the basis for the implementation of sharia governance because principle of Independence has not been implemented for the ban on multiple positions for the Sharia Supervisory Board and spin off mechanisms for UPIS.

Abstract

State Sharia Securities which in technical terms are commonly known as state sukuk, are state securities issued based on sharia principles. One form of state sukuk is a Sukuk Savings. Sukuk Savings is managed based on sharia principles, and has been declared sharia compliance by the National Sharia Council - Indonesian Ulema Council. The proceeds from the issuance will be used for investment activities in the form of purchasing rights to the benefits of State Property to and the procurement of projects to be leased to the Government. Rewards come from the profits from the investment activities. How to regulate the issuance of savings sukuk in the development of road infrastructure in Indonesia and how the potential benefits of its application for economic infrastructure development in Indonesia are the main issues to be analyzed in the paper this. This research uses normative legal research methods. Basically, sukuk is one of the breakthrough sources of funding funds made by the government in implementing its commitment to accelerate infrastructure development and as an alternative investment product with sharia principles for the community.Keyword: Financing; Infrastructure Development; Sukuk Savings

Abstract

As a tradition that has been practised for a long time, waqf or endowment is clear evidence that Muslims in Indonesia are developing through this worship. However, what if the waqf is in the form of a mosque, Islamic school, and grave (3M’s waqf). It is an unusual thing in the contemporary Islamic tradition, but its existence persists. Meanwhile, 'Urf as one of the legal propositions in establishing Islamic law has known the concept and has been practised for generations in suburban areas where most of the population is Muslim. This tradition is then accommodated in Law Number 41 of 2004 concerning endowment, which contains land endowment and endowment organiser (nazhir). This paper examines the tradition of endowment in Indonesian society to benefit mosques, Islamic schools, and graves. By using the historical and analytical-conceptual approaches, this paper will analyse waqf in these three forms. The results of this study can be taken into consideration by stakeholders in developing strategies for strengthening and empowering 3M's donated land to create benefits for the Indonesian since 3M’s endowment is commonly found in Indonesian society.

Abstract

AbstractSince the enactment of Law no. 11 of 2020 concerning UU Cipta Kerja, there are several rules related to simplification of synchronization and trimming of regulations in order to facilitate the UMK in licensing their business establishment, one of the polemics is related to halal self declare which is contrary to Law Number 33 of 2014 concerning Halal Product Guarantee. In this case, the author reviews the rules in UU Cipta Kerja in terms of maṣlahah. The research method that used is a normative descriptive and analytical type of research. The results from this research that the concept of legal discovery by maṣlahah  about halal self declare policy related to UMK is in line with the five goals of Islamic law and in order to achieve the benefit and eliminating/rejecting harm. So that in its application, as producers in order to protect all Indonesian people in choosing and consuming halal food and beverages, as well as the strength of the commitment of policy makers and so the related institutions to be in line with what has been regulated so that the law can be effective in public. Keywords: Halal Sertification; Maṣlahah; Micro and Small Business. AbstrakSejak disahkannya UU Cipta Kerja, beberapa aturan terkait penyederhanaan sinkronisasi dan pemangkasan regulasi dalam rangka memudahkan pelaku UMK dalam perizinan pendirian usahanya, salah satu aturan yang menimbulkan pro dan kontra yaitu terkait halal self declare yang mana hal tersebut bertentangan dengan Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal. Dalam hal ini penulis meninjau terkait aturan pada UU Cipta Kerja ditinjau dari keberlakuan maṣlahah. Metode penelitian yang penulis gunakan dalam penelitian ini menggunakan pendekatan hukum normatif dengan jenis penelitian deskriptif analitis/eksplanasi. Adapun hasil dari penilitian ini bahwa konsep istinbath hukum melalui pendekatan maṣlahah terkait kebijakan halal self declare bagi UMK telah sejalan dengan tujuan syar’i yang lima dan dalam rangka mencapai kemaslahatan dan menghilangkan/menolak kemudharatan. Sehingga dalam penerapannya, peran produsen dalam rangka melindungi segenap masyarakat Indonesia dalam memilih dan mengkonsumsi makanan dan minuman halal, serta kekuatan komitmen para pembuat kebijakan dan lembaga yang terkait agar sejalan sebagaimana yang telah diatur agar hukum dapat berlaku efektif di tengah masyarakat. Kata kunci: Sertifikasi Halal; Maṣlahah; Usaha Mikro dan Kecil (UMK).

Abstract

Indonesia's future economic development is directed at sustainable development that considers environmental aspects. This sustainable development requires funding support from both the government and the private sector. Sharia instruments in the capital market have the opportunity to be developed as sharia investment products that are environmentally sound, both green sukuk, blue sukuk, and green sharia mutual funds. Green sukuk are sukuk that are oriented towards development in land areas, while blue sukuk are focused on marine ecosystems. The diversification of thematic sukuk issuance can increase the choice of investors who have a preference for environmental concerns. On the other hand, there are still challenges from the issuance of these two types of instruments. These challenges include the identification of underlying assets that meet the sustainability requirements, the interest and readiness of the issuing company, as well as the limited number of parties conducting environmental assessments/certifications. In 2018, the Indonesian government issued a green sukuk which is the first green sukuk issued by a country in Asia. The issuance of the sovereign green sukuk was offered specifically for global investors and received appreciation from the international community. In 2019, the government again issued green sukuk intended for retail investors in Indonesia. The use of green sukuk that have been issued by the government is for the construction of new irrigation networks, drainage management in urban areas, as well as for the use of railway lines. After being initiated by the government with the issuance of green sukuk, it is expected that the development of environmentally friendly sukuk will be carried out by corporations, both green and blue sukuk. In addition, it is necessary to develop an environmentally friendly sharia index along with encouragement to investment managers to create sharia mutual fund products with environmental insight, such as green sharia mutual funds. OJK needs to work together with stakeholders in order to support the availability of adequate infrastructure to develop these environmentally sound investment products.
