Abstract

 This research is aims to know the arrangement of whistleblowers Jo Juctise collaborator in no criminal corruption other than that this article also aims to find out enforcement of whistleblower jo juctise collaborator in no criminal corruption, Using a normative juridical method of study can be concluded, that in the arrangement of whistleblower jo juctise collaborator in no criminal corruption is obvious to any witnesses and victims of legal arrangements against whistleblower jo juctise collaborator Collaborato in criminal acts can be concluded that is tetera in the law only the protection of witnesses and victims is set in law number 13 year 2006 and Whtleblower and Justice Collaborato set in the SEMA No 4 year 2011corruption. The enforcement of whistleblower and justice Collabolator still uses weights in the Law No. 20 of 2001 on the Eradication of corruption and is also in the case of SEMA to strengthen the protection of witnesses and victims.

Abstract

Terhadap perbuatan hoaks dan ujaran kebencian tidak hanya diatur oleh hukum positif (hukum yang berlaku di Indonesia) saja, namun juga diatur oleh perjanjian/konvensi internasional. Sedangkan unsur dari perbuatan hoax dan ujaran kebencian termasuk dalam kategori sifat melawan hukum yang mana dalam hukum pidana juga dibenarkan hal tersebut berdasarkan peraturan perundang-undangan pidana yang berlaku terhadap perbuatan hoax dan ujaran kebencian. Dari penjelasan di atas, Brigjen Rikwanto menuturkan adanya beberapa peraturan hukum yang dapat menjerat perbuatan hoax maupun ujaran kebencian serta menjelaskan harus adanya korban atau pihak yang merasa dicemarkan nama baiknya dari perbuatan hoax atau ujaran kebencian berdasarkan penilaian subyektifnya. Kata Kunci : Ujaran Kebencian, Berita Bohong, Hukum Pidana

Abstract

Seiring dengan berkembangnya ilmu pengetahuan dan teknologi dari waktu ke waktu maka kebutuhan hidup manusia kian berkembang pula.Tidak hanya kebutuhan akan papan, sandang, pangan, kesehatan dan pendidikan saja. Kebutuhan untuk mempercantik atau memperindah diri pun sekarang  menjadi prioritas utama di dalam menunjang penampilan sehari-hari. Pada era perdagangan bebas sekarang ini banyak kosmetik yang beredar di pasaran dengan beraneka jenis merek. Keinginan seorang wanita untuk selalu tampil cantik banyak dimanfaatkan oleh pelaku usaha yang tidak bertanggung jawab dengan cara memproduksi atau memperdagangkan kosmetik yang tidak memenuhi persyaratan atau aturan yang ada untuk di edarkan kepada masyarakat. Menurut Badan Pengawas Obat dan Makanan (BPOM) ada sejumlah kosmetik yang mengandung bahan yang berbahaya, antara lain berupa Bahan Kimia Obat (BKO) yang dapat membahayakan  tubuh manusia. Oleh karena itu penggunaan bahan kimia obat yang mengandung bahan berbahaya dalam pembuatan kosmetik itu dilarang. Penegakan hukum yang tidak terlalu keras serta denda yang tidak diberatkan  pada pelaku usaha kecil menyebabkan pelaku usaha tidak merasa jera serta pelaku usaha merasa tidak takut untuk mengedarkan kosmetik berbahaya yang tidak mempunyai izin edar tersebut karena sanksi yang lemah. Adanya Undang-Undang Nomor 8 Tahun 1999 tentang perlindungan konsumen diharapkan akan dapat memberikan pengaruh positif terhadap pelaku usaha dan konsumen, serta diharapkan dapat menjadi payung hukum untuk meminimalisir tindakan sewenang-wenang dari para pelaku usaha untuk melindungi kepentingan konsumen sehingga nantinya dapat menjamin tercapainya suatu perlindungan hukum bagi konsumen di Indonesia.

Abstract

Desa Dukuhagung adalah salah satu desa di Kecamatan Tikung Kabupaten Lamongan dengan total jumlah Penduduk 3.146 jiwa terdiri  dengan  luas wilayah 509,80 Ha ( 5,10 Km2). 1762 jiwa berpendididikan SMP /sederajat. Dengan tingkat Pendidikan yang masih dasar pengtahuan hokum tentang Batasan usia minimal perkawinan sangatlah penting untuk itu diperlukan kegiatan penyuluahan hokum di desa dukuhagung kecamatan tikung lamongan sebagai upaya perlindungan hokum anak di wilayah Lamongan ini. Penelitian ini adalah penelitian yuridis normative dengan pendekatan konseptual, pendekatan perundang-undangan diperoleh hasil Analisa bahwa Dengan kegiatan penyuluhan hokum batas usia minimal perkawianan di desa dukuhagung tikung lamongan dapat memberikan informasi kepada masyarakat bahwa bahaya perkawinan di bawah umur dan cita-cita luhur tujuan ideal perkawinan. Menerapkan batas usia minimal perkawinan dapat menjadi salah satu upaya perlindungan anak.

Abstract

In the Crime of Sexual Violence, a person with a disability is not only a potential victim, but can also be a perpetrator. People with disabilities are also categorized as legal subjects. This raises legal issues related to the capacity to be criminally responsible, as well as how the legal system provides fair treatment for both victims and perpetrators. However, it still provides fulfillment of rights and protection for people with disabilities as perpetrators of sexual violence. Legal accountability for people with disabilities as perpetrators of sexual violence must continue to be enforced in accordance with applicable regulations and perpetrators are required to be held accountable for their actions, if they are in a condition capable of being responsible. Therefore, in this case, it is not only providing justice for the victim but also for the perpetrator by paying attention to the law running fairly and non-discriminatory.

Abstract

This study discusses the crime of human trafficking committed with the purpose of taking and transplanting victims' organs. This criminal act is a modern form of human exploitation that involves illegal networks between countries, taking advantage of economic inequality and the scarcity of legal organs. The research method used is normative (literature), with a statutory approach and a conceptual approach. Legal sources include international legal instruments such as the Palermo Protocol, the United Nations Convention against Transnational Organized Crime, as well as national regulations such as Law No. 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons and Law No. 36 of 2009 concerning Health (especially related to organ transplantation). The results of the study show that although normative laws and regulations have prohibited the practice of trafficking in persons for organ transplantation, there are still weaknesses in the coordination of law enforcement between agencies, difficulties in proving elements of exploitation, and regulatory gaps related to organ transplantation between countries that are not strictly supervised. The conclusion of this study emphasizes the need for harmonization between criminal law and health law, increasing international cooperation, and strengthening the organ transplant supervision system to effectively prevent and crack down on human trafficking for organ transplantation

Abstract

This study presents a legal review of the special citizenship law concerning naturalization in Indonesia, employing a normative juridical research method. The research approach includes statutory analysis, conceptual analysis, and comparative legal analysis, utilizing primary legal materials such as Law No. 12 of 2006 on Citizenship of the Republic of Indonesia, as well as secondary legal materials including academic texts and legal doctrines. The analysis examines two primary naturalization pathways: ordinary naturalization and special naturalization. Special naturalization is granted to foreigners who have rendered exceptional services to the Indonesian nation or who possess high expertise beneficial to national development. This study explores the legal criteria, procedural distinctions, and discretionary authority vested in the executive branch in granting special citizenship through a qualitative normative analysis. Furthermore, it identifies legal ambiguities, inconsistencies in implementation, and potential conflicts with constitutional principles of non-discrimination and legal certainty. The findings indicate that while special naturalization serves as an instrument to attract talent and reward extraordinary contributions, its application lacks transparent guidelines, leading to potential arbitrariness from a legal perspective. This review recommends the formulation of clearer objective criteria and judicial oversight mechanisms to align special naturalization practices with the rule of law and principles of good governance.

Abstract

This study examines the legal and social paradox of marriage dispensation in Indonesia, particularly in cases of premarital pregnancy, where child protection objectives often conflict with the formal legitimacy of marriage. Although frequently justified as a protective legal mechanism, this article argues that marriage dispensation primarily functions as an emergency response, offering short-term legal relief while generating long-term social harm. Using a socio-legal and normative-empirical approach, the study applies the maqāṣid al-sharīʿah framework, particularly tarjīḥ maqāṣidī, to evaluate legal priorities in light of the higher objectives of Islamic law. Its novelty lies in measuring maṣlaḥah through multi-dimensional indicators scope, durability, precision, effectiveness, and temporal impact based on empirical data from Religious Courts and Women’s Empowerment and Child Protection agencies in East Java, Central Java, and West Java. The findings show that the benefits of marriage dispensation are limited to formal lineage recognition and stigma reduction. At the same time, its harms are extensive and enduring, including reproductive health risks, educational disruption, psychological vulnerability, and intergenerational poverty. From a maqāṣid perspective, this imbalance reflects a failure to protect life, intellect, and progeny. This study concludes that the marriage dispensation is normatively inconsistent and calls for prevention-oriented legal harmonization that prioritises child protection.
