Abstract

Perceraian menganut prinsip harus dipersaksikan dan dipersulit dengan tujuan untuk melindungi hak perempuan. Hal ini berarti setiap perceraian harus dilakukan di depan pengadilan dan diselesaikan sesuai dengan ketentuan. Dalam kenyataannya di Kota Langsa masih banyak perceraian dilakukan di luar pengadilan dan perceraian tersebut diselesaikan secara adat desa. Permasalahan utama dari penelitian ini adalah bagaimanakah perlindungan hukum terhadap korban perceraian di luar pengadilan yang terjadi di Kota Langsa? Metode penelitian yang digunakan adalah penelitian yuridis empiris. Data primer diperoleh melalui penelitian lapangan dan data sekunder diperoleh melalui penelitian kepustakaan, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa hak korban perceraian sering diabaikan, karena belum ada perlindungan hukum yang diberikan terhadap perceraian di luar pengadilan. Hak-hak korban yang sering diabaikan antara lain biaya masa iddah, biaya nafkah anak, biaya tempat tinggal, penyelesaian harta bersama dan hak untuk menikah lagi. Kepada pihak yang akan bercerai disarankan agar perceraian tersebut dilakukan di depan pengadilan sehingga hak-hak istri setelah terjadi perceraian dapat terpenuhi dan diakui secara hukum. Kepada pemerintah disarankan agar membuat regulasi yang lebih tegas untuk menghindari terjadinya perceraian di luar pengadilan. Kepada pemerintah desa agar tidak mengabaikan aturan yang telah ditetapkan oleh pemerintah tentang larangan perceraian di luar pengadilan.

Abstract

Surat An-Nisa ayat 35 menyatakan bahwa satu tahapan penyelesaian sengketa (rumah tangga) haruslah mengutuskan seorang hakam (juru damai) dengan tujuan agar permasalahan mencari sumber masalah diantara keduanya dan kemudian mendamaikan kembali keduanya. Penjelmaan ayat tersebut tercermin dalam prilaku masyarakat adat Aceh dimana dalam penyelesaian permasalahan cek-cok (perselisihan ringan) dalam rumah tangga diselesaikan melalui peradilan adat dengan harapan para pihak yang bersengketa bisa saling memaafkan, rukun, damai dan tidak lagi mengulagi kesalahan yang sama.

Abstract

ndonesia is included as a state which already ratified the Convention on the Elimination of Discrimination Against Women (CEDAW) 1979. Those matters oblige Indonesian governments to give full protection to women regarding to crimes of violence. However, it also includes protection to the victim of economic abuse in family scope. The annual report of Women Commission show that economic abuse on family scope is always happen in every year. Article 9 of Law No 23 of 2004 on the Elimination of Domestic violence regulated economic abuse as a form of domestic violence. The aim of this research is to describe the protections of economic rights for women covered by International Human Rights Law in Indonesia and to describe the responsibility of Indonesian government to protect women as the victim of economic abuse.This research is conducted under normative method. The data used in this research comes from primary sources such as statutes, Law, decision, or regulation and secondary sources, which includes legal textbook, papers and journals. Both sources then combined with tertiary sources, such as dictionary. Indonesian stipulated the equality and nondiscrimination on women’s economic rights under the 1945 Constitution, Law No. 39 of 1999 on Human Rights, the Law No.13 of 2003 on Labor and Law No. 1 of 1974 on Marriage. In term of avoiding economic abuse in family scope Indonesian government also established the Law No. 23 of 2004 on the Elimination on Domestic Violence. The article found that one of the biggest problems is the need of women’s victim protection when they made the report on the economic abuse cases. Domestic Violence Law has been provided the protection and recovery towards the victim of economic abuse. Furthermore, Indonesia Government has also established National Commission on Violence against Women to help the women’s victim acquire their rights. In the provincial/district level, Integrated Services Center for Women and Children was established in each area. Local and provincial efforts are the key solution on the enforcement issue. The government whether national, provincial, and regional has to socialize the economic abuse and women’s economic rights to make sure that they are aware on their rights. The evaluation towards the implementation of law No. 23 of 2004 on the Elimination of Domestic Violence is needed to know how the efficiency of this law.

Abstract

In the past, the Central Government managed oil and natural gas in a centralized manner without involving the Government of Aceh. However, currently, Aceh has its authority in managing the upstream oil and gas sector. This authority is regulated in Government Regulation Number 23 of 2015 concerning the Joint Management of Oil and Gas in Aceh. Based on special autonomy, the Government of Aceh can regulate CSR based on local wisdom whose programs are compiled by the community around the company itself so that it can increase the economic growth of the community around the company in a sustainable manner. Using normative legal methods, this research examines the current practice of CSR at PT Medco E&P Malaka and proposes for its improvement.   The research approach used is statutory approach. The research results show that the existence of PT Medco E&P Malaka CSR is unable significantly contribute to Local Own Revenue and create sustainable economic growth for the people are living around the company. This is because the implementation of CSR so far is top-down and only partially based on programs created by the community based on the community's actual needs. A CSR Forum is needed as a new CSR model responsible for designing and implementing various CSR based on a real need assessment of the local community.

Abstract

The creation of Family Cards for couples resulting from serial marriages is an administrative policy of the government, but this policy raises legal problems. This is because serial marriages are still not officially recognized according to Law Number 1 of 1974 concerning Marriage. This policy is considered not to provide complete legal protection and has the potential to weaken the principle of legality in the Indonesian marriage legal system. This study aims to analyze the background of serial marriages, analyze the policies of the Dukcapil government in providing legal protection for serial marriages, and analyze the policy of issuing family cards for serial marriage couples. The type of research used is normative legal research using legislative, conceptual, and case study approaches. Data is collected through literature research and compiled qualitatively. The results of the study show that serial marriage occurs due to economic, religious, cultural, social, and lack of legal understanding. Many people choose it because it is considered practical, cheap, and religiously legal, even though it is not recognized by the state. Dukcapil can indeed issue Family Cards for serial couples for administrative needs, but that does not make the marriage legally valid. As a result, legal protections for wives and children remain weak, especially related to inheritance, alimony, child recognition, and civil disputes.  The Marriage Law requires registration for marriage to be legal, so the issuance of family cards for serial couples has the potential to cause multiple interpretations and conflicts of legal norms. The suggestions of this research are to improve legal education, simplify marriage registration, strengthen the role of religious/traditional leaders, and expand isbat nikah so that the family rights of serial couples are legally protected.
