Abstract

The development of the palm oil industry (CPO) in Indonesia is often confronted by challenges coming from the international community, one of which is the rejection of Indonesian CPO exports declared by the European Union on the grounds of deforestation and land clearing, specifically forest burning, that are aimed to convert the forest areas to oil palm estates. In an attempt to clean such a bad name in palm oil industries in the world and to avert the label ‘unsustainable’ given by European Union, President Joko Widodo issued Presidential Instruction Number 8/2018. However, the implementation of the Presidential Instruction is not without hurdles like the absence of specific guidelines to help to implement the policy at the regional level and the lack of opportunities to involve civilians to guard this policy. Juridical analysis of the policy aimed to improve palm oil management and to hamper deforestation is, thus, required. With the normative-juridical method, this research is aimed to recommend the government to grow the potential of CPO-based biofuel in Indonesia and the application of a one-map policy over the potential of oil palm estates to allow the implementation of transparency principle in the structure of good governance. All these recommendations are mainly aimed to give more opportunities to the members of the public to have meaningful participation as well as sustainable and enviro-friendly in improving the management of palm oil cultivation.

Abstract

In Indonesia, the rights of people with disabilities (PwD) have not been fully fulfilled despite vigorous attempts to accommodate human rights for decades. Indeed, the Government has a commitment to fulfill the PwD rights in PwD Law 4/1997 and ratified the Convention on the Rights of Persons with Disabilities. In practice, the Government could not fully fulfill the PwD rights by providing facilities in the health sector. In this context, the Regency of Tulungagung has not set any regulations governing the fulfillment of the PwD rights. This study aimed to assess the PwD rights to access public facilities in health sectors in the Regency of Tulungagung, following factors that impeded the fulfillment of these rights. In doing so, the empirical method and socio-legal analysis probed a gap between law in book and context, elucidated in three main findings. First, the PwD rights in the Regency of Tulungagung to public facilities in health service sectors have not been fully fulfilled since public facilities are not PwD-friendly. Second, most health cares in this region have no staff capable of communicating and handling PwD. Third, the absence of the regulations governing the PwD rights becomes another factor leading to discrimination, coupled with the paucity of knowledge of how to interact with the PwD properly. Human resources and economic issues served as problems in this case. Most PwD in Tulungagung Regency lived in poor economic conditions due to a lack of available jobs that could be accessed. Therefore, the local government should take a more specific measure to fulfill public health access for PwD by allocating more budget, training the health care personnel, and enacting local regulations. Abstract

Selama pandemi jumlah limbah infeksius mengalami peningkatan sebanyak 30-50% dengan akumulasi sebanyak 6.417,95 ton sepanjang maret 2020 hingga Februari 2021. Limbah infeksius tersebut membutuhkan penanganan yang lebih terintegrasi dan terpadu karena berbahaya dan merupakan salah satu media penularan Corona Virus Disease Tahun 2019 (COVID-19). Contoh limbah infeksius diantaranya adalah jaringan tubuh dan darah dari pasien virus corona, alat injeksi, bahan atau perlengkapan dan peralatan yang diperkirakan terkontaminasi saat menangani pasien virus corona seperti masker, sarung tangan medis, dan alat pelindung diri. Adapun tujuan penelitian ini yaitu untuk mengetahui upaya optimasi penanganan limbah infeksius di masa penademi COVID-19 di Indonesia. Penelitian ini merupakan jenis penelitian hukum doktrinal dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun hasil dari penelitian ini mengemukakan bahwa optimasi penanganan limbah infeksius COVID-19 di Indonesia dapat dilakukan melalui tiga strategi. Pertama, reformasi kebijakan hukum dalam penanganan limbah infeksius COVID-19 di Indonesia, yang dapat dilakukan dengan menerbitkan peraturan perundang-undangan seperti peraturan pemerintah dan/atau peraturan presiden sebagai aturan pelaksana, yang mana peraturan-peraturan tersebut dapat memiliki kekuatan hukum dan sanksi yang tegas untuk diterapkan. Kedua, meningkatkan pendistribusian fasilitas pengolahan atau manajemen pembuangan limbah infeksius. Ketiga, sosialisasi dan edukasi untuk meningkatkan kesadaran masyarakat akan pentingnya memperhatikan pengolahan limbah infeksius yang sesuai dan memenuhi standar prosedur yang telah ditetapkan yang dilakukan melalui seminar, diskusi, event, lokakarya, atau kegiatan lainnya.   Optimization of Regulations, Facilities, and Public Awareness of Infectious Waste Handling in the COVID-19 pandemic. During the pandemic the amount of infectious waste increased by 30-50% with an accumulation of 6,417.95 tons during March 2020 to February 2021. This infectious waste requires more integrated and integrated handling because it is dangerous and is one of the transmission media for Corona Virus Disease in 2019 (COVID-19). Examples of infectious waste include body tissue and blood from corona virus patients, injection equipment, materials or equipment and equipment that are thought to be contaminated when handling corona virus patients such as masks, medical gloves, and personal protective equipment. The purpose of this study is to find out how to optimize the handling of infectious waste during the COVID-19 pandemic in Indonesia. This research is a type of doctrinal legal research with a statutory approach and a conceptual approach. The results of this study suggest that the optimization of the handling of COVID-19 infectious waste in Indonesia can be done through three strategies. First, legal policy reform in handling COVID-19 infectious waste in Indonesia, which can be done by issuing laws and regulations such as government regulations and/or presidential regulations as implementing regulations, where these regulations can have legal force and strict sanctions. to apply. Second, improve the distribution of treatment facilities or management of infectious waste disposal. Third, socialization and education to increase public awareness of the importance of paying attention to the appropriate infectious waste treatment and meeting the standard procedures that have been established through seminars, discussions, events, workshops, or other activities.

Abstract

Palm Oil Mill Effluent (POME) is a potential source of bioenergy but it is also known as one of the biggest emission's contributor from palm oil industry thus capturing the produced methane (CH4) is necessary in creating a sustainable energy for the environment. This article examines current regulations of generating electricity from POME. The aim is to promote renewable energy deployment in Indonesia in order to support the just energy transitions to a low carbon economy. This study initially looks at the existing regulations by using legal doctrinal and socio legal research. Afterwads, interviews are conducted to the palm oil industry in order to explore potential threats in developing this source of energy. The main findings suggest that there are number of government interventions needed to support the construction of POME based biogas power plant, such as providing a scheme of green loans, adjusting the feed-in tariffs and revising the grid systems, imposing incentives for carbon reduction, and applying the power purchase agreement. In addition, increasing public perception to combat the climate change by moving significantly to a low carbon economy is critical to fostering the 2030’s emission reduction target.

Abstract

AbstractThis article aims to explore the history of the existence of the Presidential Decree ("Perpres") in the hierarchy of laws and regulations in Indonesia. Inspired by the controversy over the position of the Perpres which had become a heated debate in the Special Committee Meeting (Draft Bill) concerning the Establishment of Invitation Laws. In fact, the House of Representatives (DPR) had proposed the abolition of Perpres from the hierarchy of laws and regulations. This is a normative legal research that uses statute approach, historical approach, and conceptual approach. This research attempts to find the history of the existence of Perpres in Indonesia. Which was then followed by an analysis of the position of the Perpres in the hierarchy of laws and regulations, both as a regulation of delegation (delegated legislation), and as "Independent Perpres", along with the problems of the test. AbstrakArtikel ini bertujuan untuk menelisik sejarah keberadaan Peraturan Presiden (“Perpres”) dalam hierarki peraturan perundang-undangan di Indonesia. Terinspirasi dari kontroversi kedudukan Perpres yang sempat menjadi perdebatan yang cukup hangat dalam Rapat Panitia Khusus (Pansus) Rancangan Undang-Undang (RUU) tentang Pembentukan Peraturan Perundang Undangan. Dengan menggunakan penelitian hukum normatif yang menggunakan pendekatan peraturan perundang-undangan, pendekatan sejarah, dan pendekatan konsep, penelitian ini berusaha untuk menemukan sejarah eksistensi Perpres di Indonesia. Kemudian dilanjutkan dengan analisis tentang kedudukan Perpres dalam hierarki peraturan perundang-undangan, baik sebagai peraturan delegasi (delegated legislation), maupun sebagai “Perpres Mandiri”, beserta problematika pengujiannya.

Abstract

Penelitian ini bertujuan untuk menganalisis potret penggunaan bukti ilmiah (scientific evidence) dalam putusan perkara pidana lingkungan hidup di Indonesia dan kesesuaian penggunaan bukti ilmiah dengan prinsip kehati-hatian pada pertimbangan Hakim dalam putusan perkara pidana lingkungan hidup. Permasalahan tersebut didasari pada pentingnya keberadaan bukti ilmiah serta pengaruhnya terhadap penerapan prinsip kehati-hatian dalam pemeriksaan perkara, khususnya berkaitan dengan kekuatan alat bukti ilmiah yang dihadirkan di persidangan. Jenis penelitian yang digunakan ialah penelitian hukum interdisipliner dengan pendekatan perundang-undangan (Statute approach), pendekatan konseptual (conceptual approach) dan pendekatan studi kasus analisa putusan pengadilan (case law approach). Hasil penelitian menunjukkan bahwa kuat lemahnya bukti ilmiah sangat dipengaruhi oleh keabsahan atau validitas dari masing-masing isi dan bentuk dari bukti ilmiah itu sendiri. Penggunaan bukti ilmiah pada pertimbangan hakim dalam memutus perkara juga erat kaitannya dengan penerapan prinsip kehati-hatian sebagai salah satu substantive legal principles dalam penanganan perkara pidana lingkungan hidup.
