Abstract

The development of the palm oil industry (CPO) in Indonesia is often confronted by challenges coming from the international community, one of which is the rejection of Indonesian CPO exports declared by the European Union on the grounds of deforestation and land clearing, specifically forest burning, that are aimed to convert the forest areas to oil palm estates. In an attempt to clean such a bad name in palm oil industries in the world and to avert the label ‘unsustainable’ given by European Union, President Joko Widodo issued Presidential Instruction Number 8/2018. However, the implementation of the Presidential Instruction is not without hurdles like the absence of specific guidelines to help to implement the policy at the regional level and the lack of opportunities to involve civilians to guard this policy. Juridical analysis of the policy aimed to improve palm oil management and to hamper deforestation is, thus, required. With the normative-juridical method, this research is aimed to recommend the government to grow the potential of CPO-based biofuel in Indonesia and the application of a one-map policy over the potential of oil palm estates to allow the implementation of transparency principle in the structure of good governance. All these recommendations are mainly aimed to give more opportunities to the members of the public to have meaningful participation as well as sustainable and enviro-friendly in improving the management of palm oil cultivation.

Abstract

Kelurahan Mergosono adalah salah satu kelurahan yang terletak di wilayah Kecamatan Kedungkandang, Kota Malang. Kelurahan ini mendapatkan julukan “daerah merah” karena rawan terjadi tindak pidana. Adapun tindak pidana yang sering terjadi seperti pesta minuman keras (miras) sampai mengganggu keamanan warga, pencurian dengan berbagai objek terutama curanmor (pencurian kendaraan bermotor), penadahan, judi, penyalahgunaan obat-obatan terlarang, penganiayaan, KDRT (kekerasan dalam rumah tangga) dan lain sebagainya. Tujuan dari penyuluhan ini adalah untuk memberikan pengetahuan dan pemahaman tentang hukum terutama hukum acara pidana terkait hak-hak masyarakat ketika berhadapan dengan hukum.. Adapun metode pelaksanaan dalam penyuluhan ini adalah: 1) Persiapan Pelaksanaan 2) Pelaksanaan Penyuluhan Hukum dan 3) Evaluasi. Penyuluhan hukum diberikan kepada warga RW.002 Kelurahan Mergosono, Kota Malang yang dihadiri oleh hampir semua ketua RT yang ada di RW.002, ketua dan anggota karangtaruna, ibu-ibu PKK, dan dihadiri sendiri oleh Ketua RW.002 Kelurahan Mergosono. Kegiatan penyuluhan hukum berlangsung secara efektif dan menyenangkan, terbukti dengan antusiasnya warga dalam mengikuti penyuluhan dan diskusi yang berlangsung selama acara penyuluhan berlangsung. Warga RW.002 mendapatkan pemahaman tentang hak-haknya ketika berhadapan dengan hukum terutama masalah hukum acara pidana. Hasil evaluasi dari pelaksanaan penyuluhan hukum ini adalah perlunya pemilihan satu tema yang fokus dan mendalam, waktu penyuluhan perlu ditambah, perbaikan sarana prasarana, perlu ada pretes dan post test sederhana. Selanjutnya ada masukan dari warga untuk tetap menjaga kelangsungan kerjasama pengabdian masyarakat baik penyuluhan hukum maupun pendampingan di bidang sains dan teknologi yang bersifat aplikatif.

Abstract

Abstract Original of thedeed is a product of a Notary, Notary deed is stored in the form of minutes of the deed and also in the minuta deed from party contain signatures, witnesses, notary and renvoi if it have any. Based on Article 16 paragraph (1) letter b UUJN that the minutes of the deed must be prepared and stored as part of the protocol Notary. What juridical consequences if minuta deed Notary that is not owned it copying, what legal consequences for notaries who do not make a copy of the minutes of the deed in process. this research is a normative legal research with statutory approach and the conceptual approach. Consequences if the notary does not have the making of a copy of the minuta deedcause null and void because it violated the formal aspect in the Notary deed and not to perform any of its obligations under Article 16 paragraph (1) letter b of Law No. 02 of 2014 on the Amendment Deed No. 30 of 2004 concerning Notary. The legal consequences of the Notary is to accept the responsibility that sanctions as civil sanctions, administrative and criminal. Key words: notary authority, notary obligation, minuta deed Abstrak Akta otentik merupakan produk dari Notaris, akta yang disimpan Notaris adalah berbentuk minuta akta yang dalam minuta akta tersebut berisi tanda tangan penghadap, saksi, notaris dan renvoi apabila ada. Berdasarkan Pasal 16 ayat (1) huruf b UUJN bahwa minuta akta wajib dibuat dan disimpan sebagai bagian dari protokol Notaris. Tujuan dari penilitian ini adalah untuk menganalisis pentingnya notaris untuk membuat minuta akta dalam pembuatan salinan aktanya. Apa konsekuensi yuridis minuta akta yang tidak dimiliki Notaris dalam pembuatan salinan aktanya, apa akibat hukum bagi Notaris yang tidak membuat minuta akta dalam pembuatan salinan aktanya. Penelitian hukum ini merupakan penelitian hukum normatif pendekatan yang dilakukan adalah pendekatan perundang-undangan dan pendekatan konseptual. Konsekuensi yuridis minuta akta yang tidak dimiliki Notaris dalam pembuatan salinan aktanya menyebabkan akta tersebutbatal demi hukum karena melanggar aspek formil dalam pembuatan akta dan Notaris tidak melaksanakan salah satu kewajibannya yang tertera dalam Pasal 16 ayat (1) huruf b Undang-undang Nomor 02 Tahun 2014 tentang Perubahan Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Akibat hukum terhadap Notaris adalah dengan menerima sanksi sebagai pertanggungjawabannya yaitu sanksi perdata, administratif dan pidana. Abstract

Penelitian ini bertujuan untuk mengemukakan permasalahan mengenai asas kepatutan dalam perjanjian kawin yang mana dalam perkembangannya mengenai perjanjian kawin mulai merubah konsep dimana tidak hanya mengatur mengenai harta benda dalam perkawinan, dimungkinkan perjanjian kawin diartikan seperti perjanjian pada umumnya. Masalah yang diteliti adalah bagaimana penerapan asas kepatutan dalam perjanjian kawin. Metode yang dipakai dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep,  pengumpulan bahan hukum dengan studi pustaka yang dianalisis dengan metode interprestasi teleologis. Sehingga dapat disimpulkan bahwa belum dilakukan penerapan asas kepatutan dalam perjanjian kawin tersebut karena masih ada klausula yang dianggap tidak sesuai dengan moralitas.

Abstract

Notary as a public official whose obligation is to make an authentic deed. The deed has a very important role in helping to create legal certainty for the community. The deed also serves as the most perfect evidence. With authentic deeds, the rights and obligations of the parties can be clearly defined so that this is where the legal certainty exists for the community. In making a legal product that is in the form of deed, Notary must be oriented towards Law Number 2 Year 2014 about Notary Position. However, there is also the possibility of any negligence made by a Notary in the making of his act which causes the deed to be doubtful of his authenticity because it does not guarantee the certainty of the date in the making. In this case, the Notary shall be personally liable for the deed of antidathy which is made in the form of compensation in accordance with the loss incurred by the parties or in accordance with the agreement between the parties and the Notary concerned. Such damages can be in the form of money or other matters set by the court. This is because the Notary deliberately makes the deed of antidatir even if the deed is desired or agreed by the parties and the action fulfills the element of the law in the form of negligence caused by the element of error as mentioned in Article 1336 of the Civil Code. Abstract

Notaris memiliki kewajiban untuk menyimpan dan menjaga akta-akta yang dibuatnya. Sekumpulan akta yang dibuat oleh Notaris disebut Protokol Notaris. Protokol Notaris merupakan arsip negara yang harus disimpan dan dipelihara oleh Notaris sesuai dengan ketentuan peraturan perundang-undangan. Notaris yang meninggal atau tidak dapat menjalankan tugasnya sebagai Notaris harus menyerahkan protokol Notaris yang ada dibawah tangggungjaabnya kepada Notaris lain yang ditunjuk. Adapun cara penyerahan diatur dalam Pasal 63 Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Dalam hal penyerahan tersebut dimungkinkan ada masalah-masalah seperti ketidaklengkapan, kerusakan, dan kehilangan Protokol Notaris; penyerahan  melebihi waktu yang ditentukan dan kerahasiaan akta tidak terjaga serta masalah-masalah lain. Namun hal tersebut tidak diatur dalam regulasi tersebut. Karena artikel ini berupaya memberikan landasan argumentatif dalam reformulasi pengaturan penyerahan Protokol Notaris Protokol Notaris dengan tujuan memberikan kepastian hukum bagi Notaris dan masyarakat.

Abstract

Introduction: Contracts form the backbone of business dealings, establishing the foundations and binding all collaborative endeavors between parties involved. In the Indonesian context, the use of the national language in contractual agreements has been explicitly governed by laws and regulations, specifically Law Number 24 of 2009 concerning the National Flag, Language, Emblem, and Anthem.Purposes of the Research: This study aims to scrutinize and analyze the regulatory framework surrounding the use of the Indonesian language in contract drafting, as mandated by the positive laws of Indonesia. Additionally, it seeks to elucidate the legal ramifications that may arise from non-compliance with these provisions. Furthermore, the research endeavors to provide legal clarity and offer recommendations pertaining to this issue.Methods of the Research: This research adopts a normative legal approach, employing both statutory and conceptual frameworks. The legal materials utilized encompass primary, secondary, and tertiary sources. The collection of legal materials is facilitated through library research, while the analysis of these materials is conducted qualitatively, employing content analysis and legal interpretation techniques.Results of the Research: The findings of this research present a comprehensive analysis of the regulations governing the use of the Indonesian language in contract drafting, shedding light on the legal implications of non-compliance with these provisions. Furthermore, the research offers recommendations and suggestions tailored for government agencies, business entities, and legal practitioners, guiding them in implementing the use of the Indonesian language in contracts in accordance with the applicable legal framework.

Abstract

Smart contracts in blockchain systems are widely used as automated agreements that can expedite the execution of a contract. Based on the characteristics of smart contracts analyzed through agreements in the Indonesian Civil Code (BW), it can be concluded that smart contracts can be legally used in contractual legal activities in Indonesia. This is because smart contracts meet the requirements outlined in the BW as guidelines for contract formation, particularly concerning the validity of contracts. Using a normative method, which employs literature as legal material for this writing, the result shows that the validity of smart contracts in blockchain, based on Indonesian contract law, aligns with the contract law that fulfills the requirements of Article 1320 BW. Smart contracts can also be classified as standard agreements where the parties agree based on an existing and mutually agreed-upon contract. Until now, there are no specific regulations regarding smart contracts in Indonesia, even though smart contracts are already widely used in the country.

Abstract

This research departs from the regulatory provisions regarding privatization of a subsidiary under State-owned Enterprises that are deemed to have a legal loophole that may lead to multiinterpretations because the existing regulation has not specifically governed this matter. Privatization of the subsidiary as mentioned above is intended to give legal protection to the members of the public in line with the statement ‘natural resources are controlled by the state for the benefits of the people’. With normative-juridical methods, statutory, case, and analytical approaches, this research aims to investigate whether the subsidiary under the State-owned Enterprises can be privatized by the Government and how the synchronization of the regulation governing privatization towards the State-owned Enterprises in natural resources is performed. The primary and secondary materials were analyzed using the library technique. The analysis referred to the A Contrario argumentative technique and systematic interpretation technique. This research concludes that the subsidiary under the state-owned Enterprises can be privatized as long as it does not deactivate the authority of the state to control the subsidiary to ensure that this approach is not deviating from the objective to bring the welfare to the people. Not only can the concept of the control of the state be seen based on private ownership but it may also involve policies, administration, regulation, management, and supervision for the welfare of all people.

Abstract

Buying and selling products with murabahah contracts are ranked first in financing practices in Indonesian sharia banks but receive particular attention regarding conformity with sharia principles and the position of consumers from a consumer protection perspective. In the framework of realizing "implementation and development of risk management, prudential principles, good corporate governance & sharia compliance" as well as encouraging the creation of a regulatory union, contract standards, products and transactions, in accordance with the recommendations of the Islamic Finance Service Board (IFSB), a study is needed to analyze the suitability of murabahah financing agreements in sharia banking in Indonesia with Islamic law and positive law. Through legal research, a study was carried out on Indonesian sharia banking murabahah contracts based on the legal principles that should be the basis. From the results of the analysis of murabahah financing contract clauses, there are several clauses that do not comply with Islamic law and positive law (Consumer Protection law and Civil law), including those relating to down payments (urbun), actions when customers are in trouble, as well as promising something that is uncertain. For the future. Likewise, based on the Consumer Protection Law, it does not support the creation of consumer protection which contains elements of legal certainty and information disclosure as well as access to information (Article 3 (d) UUPK). Apart from that, it also conflicts with consumer rights as regulated in Article 4 UUPK.
