Abstract

This paper aims to describe the phenomenon of the proliferation of zikir assemblies in the urban and rural communities, with various motives for their emergence and what benefits are generated by their existence. This phenomenon is fascinating to convey because there is a link between the spiritual and social dimensions. Mistakes in understanding will have fatal consequences for the people themselves. This study uses a normative and descriptive social approach, concluding that the zikir assembly phenomenon began to grow in the reform era around the 1990s. The zikir activities involve many people as Zikir Akbar, Zikir Nasional, Istighosah, Yasinan, Tahlilan, Mujahadahan. The motives for various activities include getting out of a crisis, calamities praying, treatment goals, facing a national exam, just routine activities, celebrations, salvation, thanksgiving or prayer for the soul, even as a mass rally to support specific candidates. The existence of the zikir assembly has many benefits, both from the spiritual aspect and the social aspect. Finally, it can be said that a zikir assembly is a place where the people need to grow and cultivate a sense of diversity.

Abstract

The ta’wil is a method of istinbath al-ahkam from texts (nash). In principle ushuliyyin agreed to say the use of ta’wil, if it’s meets the existing requirements, this ta’wilis called by the trem ta’wil maqbul, that is ta’wil wich not far from the meaning of zhahir, so that with simpleintructionscan be understood. But if the ta’wil is based only foundation to impulses and unfulfilled conditions,the trasnforming of meaning of lafazh wich away from, can’t be known by a dalil of simple proposition. So this ta’wil like this is rejeced or termed is ta’wil ghair al-maqbul. But in determining of dalil of ta’wil (argumantation support), the are differencesof opinion among ushuliyyin, thus are raising the trem ta’wil baid. overall, method of ta’wil is still considered relevant to the reform of Islamic law.

Abstract

Zakat profesi merupakan salah satu kasus baru dalam fiqh. Al-Quran dan sunnah, tidak memuat aturan hukum yang tegas mengenai zakat ini. Masalah pokok artikel ini adalah bagaimana pandangan ulama tentang zakat profesi serta menganalisis argumentasi kewajiban zakat profesi. Kajian ini berbentuk library reseach (kepustakaan), menggunakan metode (penalaran isi) (content analysis ). Kajian ini berkesimpulan ada beberapa ulama kontemporer yang mewajibkan zakat profesi; baik perorangan maupun berupa lembaga keagamaan. Ayat dan hadis yang digunakan sebagai dalil bersifat umum. Mengqiyaskan zakat profesi kepada rikaz atau pertanian sangat membingungkan dan tidak cocok dengan panduan penggunaan qiyas yang telah disusun oleh ulama Ushuliyin. Melemahkan semua hadits tentang haul tidaklah tepat karena hadits-hadits itu memiliki beberapa jalan dan penguat, sehingga bisa dijadikan hujjah. Tawaran solusi yang bisa difikirkan adalah menjadikan profesi tersebut pada zakat kekayaan berupa nuqud (uang) dengan kadar nishab emas (85 gram) dikeluarkan 2,5% setelah melewati haul. Selain itu, ada cara lain untuk membantu kaum muslimin dalam rangka bersyukur pada Allah SWT, di antaranya berupa; Shadaqah, Wasiat, Hibah, Waqaf, dan Qurban.

Abstract

This research is triggered from the qurban committee in Curup community to collect funds from the qurban participants by fixing the price of animals. The payment can be all at once and can also be paid in installments every month. This means buying and selling, even though the animals do not exist yet. After the money was collected and it was close to the sacrifice day, the committee went looking for an animal and then bought it. The role of the committee that made the sale and purchase contract was not the owner of the money. There is also buying and selling through brokers, who are not animal owners. Therefore, the main issue in this research concerns the validity of the contract for the sale and purchase of that qurban animals. This is a field research with qualitative approach. This study concluded that the implementation of the contract in muamalah transactions is elastic, especially in the oral form of al-ahwal. This is strongly influenced by the local community customs based on the rule of al-’adah muhakkamah.الملخصخلفية هذا البحث هي عمل لجنة الأضحية في مجتمع Curup لجمع الأموال من المشاركين في الأضحية من خلال تحديد أسعار الحيوانات. يمكن أن يكون الدفع دفعة واحدة ويمكن أيضًا سداده على أقساط كل شهر. هذا يعني البيع والشراء ، على الرغم من عدم وجود الحيوانات بعد. بعد أن تم جمع المال وقرب يوم الأضحية ، ذهبت اللجنة للبحث عن حيوان ثم اشترته. لم يكن دور اللجنة التي أبرمت عقد البيع والشراء هو صاحب المال. هناك أيضًا بيع وشراء من خلال سماسرة ليسوا من أصحاب الحيوانات. المشكلة الرئيسية في هذا البحث هي حول صحة عقد بيع وشراء حيوانات القربان. هذا البحث هو بحث ميداني بنهج نوعي. خلصت هذه الدراسة إلى أن تنفيذ العقد في معاملات المعامله مرن ، لا سيما في الشكل الشفهي للأحول. هذا متأثر بشدة بعادات المجتمع المحلي كصوت قواعد محاكمة العدة.

Abstract

Perjanjian perkawinan merupakan langkah persiapan untuk memasuki bahtera rumah tangga, yang harus mematuhi prinsip-prinsip syari'at Islam.Fungsinya adalah untuk mengurangi potensi perselisihan antara suami dan istri serta memberikan kerangka hukum yang jelas mengenai hak dan kewajiban mereka. Dalam Islam, hukum memiliki tujuan tertentu yang disebut maqasyid syari'ah, yang bertujuan untuk kemaslahatan manusia, terutama dalam konteks perkawinan. Sementara dalam hukum negara, tujuan utamanya adalah kebaikan dan kepentingan masyarakat secara umum. Dengan mempertimbangkan kedua tujuan ini, penelitian ini akan mengeksplorasi pertanyaan mengenai peran perjanjian perkawinan dalam mencapai tujuan-tujuan tersebut: (1) Bagaimana urgensitas perjanjian perkawinan dalam sebuah perkawinan, (2) Bagaimana urgensitas perjanjian perkawinan dalam membentuk keluarga sakinah perspektif hukum keluarga islam. Untuk menjawab pertanyaan tersebut, penelitian ini mengadopsi pendekatan penelitian pustaka(library research), dengan data penelitian yang diperoleh melalui metode kualitatif, mengandalkan pengumpulan data melalui studi dokumen.Setelah data terkumpul, dilakukan pengolahan dan analisis menggunakan teori maqashid syari’ah. Dalam penelitian ini, penulis menemukan bahwa dalam literatur fiqh klasik, istilah "Persyaratan dalam Perkawinan" sering digunakan untuk merujuk pada perjanjian perkawinan dengan makna yang sama. Menurut pandangan mayoritas ulama fiqh, termasuk Imam Syafi'i, Imam Hanafi, Imam Maliki, dan Imam Hambali, perjanjian perkawinan diperbolehkan asalkan syarat-syarat yang ditetapkan tidak bertentangan dengan prinsipprinsipsyari'at Islam. (2) Urgensitas perjanjian perkawinan dalam membentuk keluarga sakinah persfektif hukum islam dalam nikah itu hukum nya mubah (boleh) dalam arti tidak semua yang melakukan pernikahan harus membuat perjanjian. syarat-syarat yang tidak menyalahi tuntutan perkawinan dan ada larangan secara khusus namun tidak ada tuntunan dari syara’ untuk dilakukan.

Abstract

The reason for opposing polygamy is because it is considered to have many negative effects and is considered to discriminate against women. While those who agree, argue that Islam does not prohibit polygamy, under certain conditions polygamy is one solution to overcome household problems. This research is a library research. So based on the results of the research the authors conclude that the sirri polygamy practiced by the community today does not contain mashlamat because: first, sirri polygamy is legally flawed, both religious law and state law; second, polygamy sirri does not achieve the purpose of marriage in sharia, namely so that human life in this world is full of peace and love; third, sirri polygamy is detrimental to women and their offspring.

Abstract

This paper aims to explain the opinion of some traditionalist Muslim scholars who refute feminist opinions of verse 34 of an-Nisā’ about household leaders. This study takes the form of a library with the content analysis method. Utilizing qawāʿid al-lughawi'ah (linguistic rules) like the ta'wīl method which is inherited uṣūliyyīn (Islamic law expert, scholars such as Rasyīd Riḍā ‘Alī aṣ-Ṣābūnī, and aṭ-Ṭabāṭabāʿī argued that men are more superior than women in some aspect such as intellectual. Therefore, it is men who have a duty to become the leader. Tulisan ini menjelaskan tentang pendapat beberapa sarjana Muslim tradisional yang menolak pendapat kaum  feminist tentang kesejajaran laki-laki dan perempuan dalam menafsirkan surat Nisā’ ayat 34. Dengan menggunakan data literer dan analisis isi, tulisan ini menunjukkan bahwa beberapa sarjana Muslim Rasyīd Riḍā ‘Alī aṣ-Ṣābūnī, and aṭ-Ṭabāṭabāʿī berpendapat bahwa laki-laki berbeda dengan perempuan. Laki-laki mempunyai kemampuan intelektual lebih dibandingkan dengan perempuan. Oleh karena itu, maka kepemimpinan ada di punggung laki-laki.

Abstract

The issuance of SEMA (Supreme Court Circular Letter) No. 2 of 2023, revived the discussion about the meaning of ahl al-kitab in surah al-Maidah verse 5. Al-Qur'an as a holy book is responsible for explaining the terms used so that people do not misunderstand them, according to one of its functions, namely, al-baiyyinah (explainer). One of them is the term ahl al-kitab. This study is very important because it relates to the issue of marriage. This paper aims to understand the meaning of ahl al-kitab in the Qur’an by using the interpretation method that has been passed down by scholars. This was done to be guided and avoid mistakes. This study is in the form of library research (literature) with a method (content analysis) in the form of reduction, verification, and inference steps. This paper concludes that Ahl al-kitab are Jews and Christians descended from the Children of Israel who still believe, and they are the ones who are allowed to marry. Even so, reality teaches that a new marriage will be lasting and peaceful, if there is conformity in the views of life between husband and wife, especially in matters of religion.

Abstract

This paper aims to examine how the ontology, epistemology and axiology (paradigm of philosophy of science) ushul fiqih. This is very important because ushul fiqih has its own epistemological construct that cannot be separated from the principles of science in an Islamic perspective which are clearly at odds with the West. This misunderstanding raises negative accusations against the science of ushul fiqih. Even though usul fiqih is the highest degree of science, because it combines naql and 'aql. This is a library research using content analysis method. This study concludes that the three pillars (ontology, epistemology and axiology) are closely related. The combination of the power of revelation and reason is the hallmark of ushul fiqih epistemology. Revelation is positioned at the highest level, because it comes from the omniscient. Intellect is positioned at a lower level hierarchically, implying that reason submits to the truth of revelation. In this construct, it is revelation that becomes the standard of truth.

Abstract

This study aims to examine more deeply the opinion of Imam ash-Shafi'i regarding the pilgrimage for women without a mahram, and then see its relevance in today's times. Imam ash-Shafi'i has opinion that a mahram or husband is not obligatory for a woman in carrying out the pilgrimage, but on condition that the woman is protected from harming her body and soul and her honor. The majority of fiqh scholars are of the opinion that women must be accompanied by their mahram to perform the pilgrimage. According to the provisions of the Shari'ah, a woman may not travel alone but must be accompanied by her husband or mahram. Even the al-Hanafiyah school of thought argues that a mahram for women is a mandatory requirement for Hajj. This study is in the form of a character study categorized as library research. It used secondary data, either in the form of primary materials, tertiary secondary. Data analysis used heuristic, critics (internal and external), interpretation, and historiography. The results of this study suggest that Imam asy-Syafi'i's opinion which emphasizes law based on its 'illat, namely the factor of women's safety is very relevant to current conditions.
