Abstract

ABSTRACT: Fisheries management will determine the sustainability of fisheries resources in Indonesia. The concept of sustainable fisheries management is a response to occupation of the development of growth which lead to increased utilization of fish resources. This paper wants to answer how the concept of the implementation of sustainable fisheries management, as well as its importance for Indonesia. Of solution known that the concept of sustainable fisheries management is applicable in the practical implementation of regulation and the concept of development. Abstract

Lahirnya Undang-Undang No. 7/2016 tentang Perlindungan dan Pemberdayaan Nelayan, Pembudidayaan dan Petambak Garam, memunculkan masalah baru bagi nelayan kecil. Undang-undang ini memperbesar ukuran gross tonnage kapal nelayan kecil dari ukuran 5 GT menjadi 10 GT. Ketentuan ukuran 5 GT diatur dalam Undang-Undang No. 45/2009 tentang Perubahan Undang-Undang No. 31/2004 tentang Perikanan. Perubahan GT tersebut tidak sederhana. Masalah utama adalah terdapat perbedaan antara undang-undang yang mengatur perlindungan nelayan dengan undang-undang yang mengatur perikanan. Implikasi dari perbedaan ini tidak terbatas pada kapal semata, melainkan pada jalur penangkapan ikan, fishing ground, hingga proses perizinan kapal. Dengan semakin besar GT, maka fishing ground yang selama ini dipakai oleh kapal nelayan ukuran 5 GT, turut dipakai oleh kapal berukuran 10 GT. Hal ini berpotensi konflik sesama nelayan. Tawaran pemetaan untuk harmonisasi hukum diharapkan akan menjawab permasalahan hukum perlindungan nelayan. Legal Arrangement of Small Fishermen Protection The birth of the Act No. 7/2016 on Protection and Empowerment of Fishermen, Cultivation and Fishers of Salt, raises new problems for small fishermen. This act enlarges the gross tonnage size of small fishing vessels from 5 GT to 10 GT. The 5 GT size requirement is regulated in the Act No. 45/2009 on Amendment of the Act No. 31/2004 on Fisheries. The GT changes are not simple. The main problem is that there are differences between laws governing the protection of fishermen and the laws governing fisheries. The implications of this difference are not limited to ships alone, but to fishing lanes, fishing ground, to the licensing process of ships. With the bigger GT, then the fishing ground that has been used by fishing boats size 5 GT, also used by the ship size of 10 GT. This has the potential to conflict among fellow fishermen. The legal to harmonization mapping offer is expected to address legal protection issues of fishermen.

Abstract

Local wisdom is an impoertant fact in Indonesian society. One of wisdoms is the custom of the sea and the Panglima Laot in Aceh. it shows living legal perspective having long history in the fishery sector. This research aims to explore to which extent the extence of the wisdom having relation for the position of the leader expecially by looking the role and function focuising on the meaning of nature based on religious values. Abstract

Anti-corruption ideology will get through deeply into the system of beliefs. Individuals with anti-corruption ideals are strengthened with their values, ideas, and norms, saying that corruption is atrocious. One of the potential opportunities for instilling the beliefs system is in higher education, where the education and teaching process and its recycling are taking place. The educational process at a higher education level is considered more established in understanding various levels of sciences and knowledge. Therefore, higher education has the greatest potency to ingrain anti-corruption ideals and encourage resistance against corrupt behavior. However, the potential is still debatable because educated persons conduct corruption, as it has been categorized as white-collar crime. Figures displayed by corruption statistics are outrageous. First, the rate of corruption targeted for investigation, being investigated, and punished is growing. Second, there is a tendency that the more a person developed, becomes more respected and educated, the more chances for the person to have a corrupted mindset. Hence, it can be concluded that education does not cause neglectfulness and powerlessness of someone to avoid corruption, but their intellectuality determines it. Keywords: Ideology; Epistemology; Anti-corruption; Higher education.
