Abstract

Pentingnya Pendaftaran Tanah dilaksanankan di Desa Binaan Kecamatan Pematang Siantar, Kabupaten Simalungan selama 2 hari yakni tanggal 14, 15 agustus 2019. Dilaksanakan dalam bentuk penyuluhan Hukum di bidang Hukum Pertanahan, bertujuan untuk memberikan pengetahuan dan kesadaran pada masayarakat pentingnya pendafatran tanah bagi masyarakat untuk mendapatkan kepastian hukum bagi tanahnya yang dimiliki sehingga menimbulkan rasa mantap dan rasa aman bagi masyarakat yang memiliki tanah yang dihaki. Selanjutnya ada perlindungan hukum untuk untuk mencengah gangguan dan penguasaan sesama warga masyarakat. Dengan alat bukti yang dihasilkan pada akhir proses pendaftaran tanah berupa buku tanah dan sertifikat tanah yang terdiri atas salinan buku tanah dan surat ukur. Dari hasil kegiatan dapat diperoleh data bahwa masyarakat kecamatan Sidamanik belum memahami pentingnya pendaftaran tanah, masyarakat merasa aman saja dengan sikon selama ini, karena kurangnya sosialisasi yang diberikan kepada masyarakat, sementara kebijakan pemerintah presiden Jokowi tahun 2018 sudah mengeluarkan Peraturan Menteri Agraria dan Tata Ruang/Kepala BPN Nomor 6 Tahun 2018 Tentang Pendaftaran Sistematis Lengkap (PTSL) program percepatan pendaftaran tanah bagi masyarakat. Abstract

This study analyzes legal protection in Build, Operate, and Transfer (BOT) agreements through examination of Supreme Court Decision No. 600K/Pdt/2018 concerning The High End City Korea Town (THECKT) project. of Indonesia Number 600K/Pdt/2018. The purpose of this research is to analyze the application of the principles of justice and balance in the legal relationship between the landowner and the investor, as well as to assess the extent of legal protection granted to the parties in the event of unilateral termination of the BOT agreement. The research employs a normative juridical method with statutory, case, and comparative approaches. The data consist of primary and secondary legal materials, along with relevant non-legal materials. The analysis is conducted qualitatively using deductive reasoning. The findings reveal that unilateral termination without clear legal grounds violates the principle of legal protection and may cause economic losses to investors. The Supreme Court’s decision affirms that BOT agreements must be interpreted through the pri. Unilateral termination of the agreement without clear legal grounds constitutes a violation of the principle of legal protection and may cause economic losses to the investor. Therefore, the application of the principle of justice as proposed by John Rawls’ theory of justice and the principle of balance in contract law serves as an essential foundation to create a fair and proportional legal relationship in the implementation of BOT agreements in Indonesia.

Abstract

The reform of the financial sector governance framework in Indonesia through Law Number 4 of 2023 concerning Financial Sector Development and Strengthening (P2SK Law) and its subsequent amendment has significantly transformed the institutional role of the Deposit Insurance Corporation (LPS). This study examines the legal implications of strengthening LPS authority in maintaining financial system stability, focusing on legal certainty, institutional accountability, and regulatory balance. Using a normative (doctrinal) legal research method, this study applies statutory, conceptual, and comparative approaches to analyze relevant legal frameworks, including the LPS Law, P2SK Law, and subsequent regulatory developments. The findings indicate that the post-P2SK framework has expanded LPS functions beyond deposit protection and bank liquidation toward a more comprehensive financial safety net mechanism involving prevention, resolution planning, and systemic risk management. However, the expansion of authority also creates challenges related to institutional coordination, moral hazard, and accountability mechanisms. The study argues that strengthening LPS requires not only broader legal authority but also clear governance safeguards, transparency, and harmonized relationships with other financial authorities, particularly Bank Indonesia and the Financial Services Authority. The reform of LPS represents an important advancement in Indonesia’s financial stability architecture, provided that institutional power is balanced with effective legal control mechanisms.
