Abstract

This research is motivated by the problem, namely the high demand for crypto assets, while there is no reference asset (Underlying asset) on which to base the price publication. So Monkey Business practices will emerge. The aim of this research is to determine the occurrence of Monkey Business practices in Crypto transactions on Commodity Exchanges and the legal protection of investors regarding the potential for Monkey Business practices to occur in transactions on commodity exchanges. This research typology uses normative legal research and the approach methods used are the statutory regulatory approach and the conceptual approach. The result of this research is that the practice of Monkey Business begins by making the price of Crypto Asset tokens become a trend, after the price of Crypto Asset tokens is at its peak, within a short time the value of the token will fall back to its original price, one example is the Terra Crypto Asset token. Luna. The legal protection provided to investors can be classified into 2 (two) based on the potential for monkey business practices in transactions on the commodity exchange, namely including preventive legal protection and repressive legal protection. Suggestions from this research regarding provisions that need to be further regulated in regulations for Crypto Asset commodity trading in Indonesia include: additional requirements for physical crypto asset traders (Exchangers) in order to obtain approval; Anti-Manipulation, Fraud Provisions; Implementation of Provisions for Providing Compensation Funds

Abstract

This research is motivated by the existence of legal problems regarding the validity of the transfer of land rights where the land object is then used as a bankruptcy estate. The purpose of this research is to find out how the validity of the transfer of land rights that have been transferred by the parties and the validity of the land object which is then used as a bankruptcy estate. This research typology uses normative legal research. Normative legal research is research that refers to legal norms contained in laws and regulations and court decisions. The approach method used is the statutory approach and conceptual approach. The results of this study are related to the transfer of land objects carried out by Syaiful to Agung Nugroho is valid while that carried out by Agung Nugroho to Hermawan is invalid, this is based on the difference in the transfer time, namely the PPJB paid off and the PPJB has not been paid off. Then related to the validity of the land object used as the bankruptcy estate of PT STP is invalid because the object has not become the property of PT STP when it is used as a bankruptcy estate. The legal advice that can be given is that Hermawan as an aggrieved buyer can file a legal action in the form of a tort claim against Agung Nugroho to the Bantul District Court. The second legal advice is that Agung Nugroho can again file a lawsuit to the Semarang Commercial Court so that the land object can be removed from the bankruptcy estate of PT. STP.

Abstract

This study aims to analyze the basic legal considerations used by the Judges at the Denpasar District Court to ratify the sale and purchase agreement in case number 10/Pdt.G/2019/PN.Dps. This study examines two legal issues: First, how is the validity of the sale and purchase agreement in the Denpasar District Court decision number 10/Pdt.G/2019/PN.Dps. Second, what is the accuracy of the legal considerations of the judges in the Denpasar District Court decision number 10/Pdt.G/2019/PN.Dps. The research method in this research is normative juridical which is based on literature studies, laws, books, journals, news and other supporting research. The results of this study can be concluded that: First, the notary was proven to have abused the authority granted by law during the process of making a sale and purchase agreement in case number 10/Pdt.G/2019/PN.Dps, causing the sale and purchase agreement to be degraded. Second, the legal considerations of the Judges examining case number 10/Pdt.G/2019/PN.Dps are incorrect because they state that the sale and purchase agreement is an authentic deed and states that the notary has carried out his duties according to applicable law. The researcher’s suggestion is that the judges should have been more careful in examining the evidence and ensuring the skills and competence of a notary as a person authorized to make authentic deeds.

Abstract

This research is motivated by the rounding of prices that occurs when filling up fuel at gas stations, where rounding of prices also occurs even though the rupiah denominations are still in circulation, such as Rp. 200 and Rp. 500. This research examines the legality of rounding nominal payments by gas station officers according to Islamic law and analyzes the legal consequences of rounding off nominal payments by gas station officers according to Islamic law. This research uses normative research using a statutory and conceptual approach. This legal research is descriptive in nature, the data collection method is library research, then analyzed using qualitative analysis methods. The results of the research show that to round off nominal payments against rupiah denominations that are still in circulation, you must first obtain permission from the buyer. Rounding off nominal payments by gas station officers according to Islamic law is a type of defective contract, so that there are two legal consequences of a defective contract, namely, the contract can be canceled and can be null and void by law. As a result of the flawed contract above, Islamic law regulates the rights and legal remedies for the buyer as the injured party in the transaction, namely the right of khiyar. The suggestion from this research is that gas station officers should be more fair in rounding prices by confirming with buyers before rounding prices.

Abstract

Banking is a public service that can be accessed by all people, including the blind, but there are problems for the blind in accessing banking which causes the blind to be discriminated against. The problem formulation involves questions related to the problems of account ownership for blind customers and mechanisms for protecting the confidentiality of blind customer data in the banking sector. The research method used is a normative legal research method with a statutory regulatory approach and a conceptual approach. The research results show that there are problems for blind customers in accessing banking, namely limited accessibility, technical obstacles such as administrative problems due to not being able to sign, data security risks and inadequate legal protection due to the absence of an effective legal framework for the special needs of the blind. The legal protection mechanism for blind customers is by opening a joint account which is enhanced by being accompanied rather than represented in accessing banking, absorbing PTO into legislation, banking administration problems can imitate other countries such as Hong Kong, and using preventive and repressive protection. The suggestion in this research is to improve regulations that are effective, efficient and uniform to minimize the problems of blind customers in the banking sector by taking into account the special conditions of the blind. And the OJK together with Bank Indonesia need to review regulations to create a holistic legal basis for synchronization and improve digital education and literacy for blind customers, including the development of appropriate banking technology.

Abstract

In football matches, there are often serious violations caused by the high and heated tension of the match. The high and heated tension sometimes causes losses for players, for example, there are players who are injured by opposing players in football matches. The problem studied is regarding the liability of players who injure other players in football matches and legal protection for football players who are intentionally injured in football matches. This research was conducted normatively through a legislative and conceptual approach. Based on the results of this study, it can be concluded that injuring other players is an unjustifiable act, both under lex sportiva and positive law, in addition, injured players also receive legal protection under lex sportiva and positive law and can file a lawsuit for unlawful acts. The government should make a clear separation of regulations between lex sportiva and positive law so that there is no overlap between lex sportiva and positive law and football players must be more careful and not take actions to injure other players. The referee must also be firm when football players start to commit serious violations.

Abstract

Penelitian ini bertujuan untuk menganalisis permasalahan mengenai keabsahan perjanjian pengikatan jaminan dengan polis asuransi jiwa konvensional sebagai objek jaminan. Masalah yang diteliti adalah mengenai penentuan perikatan sebagai suatu benda berdasarkan Pasal 511 ayat (3) KUHPerd dan keabsahan perjanjian pengikatan jaminan yang menggunakan polis asuransi jiwa sebagai objeknya. Metode yang dipakai dalam penelitian ini adalah penelitian normatif dengan mengumpulan data secara studi pustaka (library research). Hasil penelitian ini menyimpulkan bahwa benda dalam suatu perikatan bukanlah perikatan itu sendiri, melainkan prestasi atau utang yang terkandung dalam perikatan tersebut,dengan demikian, ada atau tidaknya prestasi sangat mempengaruhibisa atau tidaknya suatu perikatan diklasifikasikan sebagai benda. Polis asuransi jiwa bukanlah salah satu benda sebagaimana yang ditentukan Pasal 511 ayat (3) KUHPerd, dengan demikian perjanjian pengikatan jaminan yang menggunakan polis asuransi jiwa konvensional sebagai objek jaminan adalah tidak sah karena tidak memenuhi syarat sahnya perjanjian “suatu hal tertentu” berdasarkan Pasal 1320 KUHPerd.

Abstract

This study discusses legal protection for chicken farmers against the Core Plasma partnership agreement with PT. LS. The study was conducted on Hasoro, a broiler chicken farmer in Klaten, Central Java, who experienced legal problems due to the withholding of land certificates by PT. LS in the partnership agreement. The focus of the study includes the validity of the partnership agreement, the legality of PT. LS's actions in withholding land certificates, and the form of legal protection for farmers in partnership relations with Limited Liability Companies. The research method uses a legislative approach and a case approach, with data collection through document studies and interviews. The results of the study indicate that the partnership agreement between Hasoro and PT. LS does not meet the provisions of Article 1320 of the Civil Code because there are indications of a defective will and does not meet formal requirements. PT. LS's actions in withholding land certificates cannot be legally justified. This study recommends the need to strengthen regulations regarding partnership agreements so that farmers obtain legal protection, legal protection that has been provided by the government in addition to regulations, namely the role of the Business Competition Supervisory Commission. Settlement of this legal dispute can be resolved through litigation or non-litigation and the Government and related institutions must take an active role in implementing the partnership agreement in order to provide fair benefits for all parties involved.

Abstract

The definition of build-to-transfer agreements in several laws and regulations varies, particularly concerning the objects they govern. However, when associated with build-to-transfer agreements as contracts subject to contract law, complications arise, especially in relation to such agreements involving privately owned land. The determination of specific objects, particularly regarding the duration of build-to-transfer agreements on privately owned land, remains unregulated. Therefore, there is a need to establish legal protections for build-to-transfer agreements on privately owned land that do not include the granting of building rights. This research aims to determine the implementation period of build-to-transfer agreements and to regulate legal protections for such agreements on privately owned land without building rights. The article employs a normative research method with approaches including legal analysis, conceptual exploration, and comparative study. The findings suggest that legal protection can be enhanced by granting building rights on privately owned land, incorporating clauses reflecting the principle of special personality in agreements, and pursuing breach of contract litigation as a final legal recourse. This study contributes significantly to providing legal protection for parties involved in build-to-transfer agreements on private land. Pengertian perjanjian bangun guna serah dalam beberapa peraturan perundang-undangan bervariasi terutama terkait dengan objek yang diatur. Namun, ketika diterapkan sebagai perjanjian yang tunduk pada hukum perjanjian, terdapat tantangan, terutama jika berhubungan dengan perjanjian bangun guna serah atas tanah milik privat. Penetapan objek, khususnya mengenai jangka waktu perjanjian bangun guna serah pada tanah milik privat, masih belum diatur secara spesifik. Oleh karena itu, perlu adanya regulasi perlindungan hukum yang jelas dalam perjanjian bangun guna serah atas tanah milik privat tanpa pemberian hak guna bangunan. Penelitian ini bertujuan untuk menetapkan jangka waktu pelaksanaan perjanjian bangun guna serah serta mengatur perlindungan hukum dalam perjanjian tersebut atas tanah milik privat yang tidak dilengkapi dengan pemberian hak guna bangunan. Metode penelitian yang digunakan adalah pendekatan normatif dengan menggunakan Undang-Undang, pendekatan konseptual, dan pendekatan perbandingan. Hasil dari penelitian ini menyarankan bahwa perlindungan hukum dapat ditingkatkan dengan memberikan hak guna bangunan atas tanah milik privat, menambahkan klausul yang mencerminkan asas personalitas khusus dalam perjanjian, dan mengajukan gugatan wanprestasi sebagai upaya terakhir dalam perlindungan hukum. Penelitian ini diharapkan dapat memberikan kontribusi signifikan dalam meningkatkan perlindungan hukum bagi semua pihak yang terlibat dalam perjanjian bangun guna serah di tanah milik privat.

Abstract

The validity of the transfer of rent in a lease agreement against the leased object without the owner's knowledge is an action that cannot be justified by law. The Lease Agreement is one type of agreement regulated in the civil code. Lease - Renting is a form of legal relationship that regulates two parties, where one party binds himself to provide the other party with the enjoyment of an item, for a specified time with the payment of a price by the last party that he agrees to. In connection with this, the background to the transfer of rent against the leased object without the knowledge of the leased object. The purpose of this study is to determine the things that cause the transfer of leased objects without the knowledge of the original owner which turns out to be a mixture of third parties. The research typology used in this study is normative legal research. The results of this study are that there has been interference from a third party or a party outside the lease agreement, related to the leased place (object), namely a kiosk used by the tenant as a place of business for the UII Jakal penyetan food stall, which has been rented by the tenant with the previous owner, the third party feels that the tenant's business is disturbing his business so that he urges the tenant to immediately move and make an agreement to transfer the kiosk lease object to him without the owner's knowledge, and the third party is the owner of Warmindo and the third party is the tenant's brother-in-law. The legal recommendation that can be given is that the third party is responsible for compensating for the losses for their actions and the dispute that occurs between the parties, the owners can be resolved amicably because the parties are still related by family ties, if the dispute cannot be resolved then it can be resolved through mediation until the dispute is resolved through litigation in court. If the parties are deemed unable to pay for the legal services of a lawyer, then the parties can request legal assistance through the Law Center Institution which provides free legal assistance and provides voluntary assistance to the parties by directing the things that must be done during the dispute resolution process, especially during the trial in court.
