Abstract

This study aims to understand in-depth the representation of Coastal Javanese Islam in Pekalongan with cultural approach. This approach puts Pekalongan people onto its social world center, in order to understand how they identify and interpret the world, particularly the articulation of economic activity protected by culture and mediated by Islam tenet. The research method used was qualitative one. Data was obtained through observation and in-depth interview, and analyzed descriptively, by focusing on social practice of batik business performer as the basic vehicle, meaning competition place, and contributing to Islam. The result of research shows that the role of Islam in Pekalongan social life is very strong and dominant represented in dialectical Islam with the manifestation of symbolic spiritualism. Therefore, Islam functions not merely as an effective means of solving life problem, including batik business, confirming Geertz’s argument that religion serves not merely as ethical foundation, but moral vitality source. Culture is an important power in social life. This finding declines Weber’s thesis that Islam does not have theological affinity supporting economic growth, because empirical fact in Pekalongan Indonesia shows that Islam spirituality becomes an effective means of solving business problem.

Abstract

Since the MUI fatwa regarding cash waqf was issued on May 11 2002 and the Law on waqf number 41 of 2004 and PP Number 42 of 2006 was issued, nazir is considered a pillar of waqf waqf. Nadzir is considered an important element in waqf management in developing waqf assets significantly. This research discusses how to update cash waqf regulations in the management and development of waqf assets in Indonesia? How is the implementation of cash waqf regulations at the Insan Qur'an Foundation?  What is the impact of the implementation of cash waqf regulations on Insan Qurani Indonesia Pamekasan Madura? This research uses qualitative research methods, with field research. With a normative-sociological approach. The findings from this research show that changes to waqf regulations regarding the management and development of waqf assets in Indonesia, the implementation of cash waqf regulations at the Indonesian Insan Qurani Foundation opened up opportunities and awareness for the Pamekasan community regarding the urgency of empowering productive waqf for the sake of realizing welfare and social justice. Waqf regulations can make it easier for Nazirs to develop productive waqf in Indonesia. Cash waqf has made a positive contribution to the development of Quran houses, trade, agriculture and livestock under the Insan Qur'an Foundation, expanding access to education and creating new jobs. This research offers an in-depth view of the practice of cash waqf as an effective strategy in developing waqf land assets in Indonesia, with the Insan Qur'an Foundation as the locus of this research study.

Abstract

This study aims to examine the renewal of cash waqf regulations in Indonesia, analyze their implementation in the management and development of waqf assets at the Insan Qur’ani Indonesia Foundation in Pamekasan, and identify the socio-economic impacts of such implementation. This research employs a qualitative field research approach with a socio-legal perspective. Data were collected through in-depth interviews, observations, and document analysis involving key informants within the foundation. The findings indicate that the renewal of waqf regulations, particularly after the MUI Fatwa (2002), Law No. 41 of 2004, and Government Regulation No. 42 of 2006, has significantly transformed the paradigm of waqf management in Indonesia. The implementation of cash waqf at the Insan Qur’ani Foundation has enhanced community awareness, supported the development of productive waqf in sectors such as agriculture, trade, and livestock, and contributed to expanding access to education and employment opportunities. This study is limited to a qualitative case study approach within a single institution; therefore, future research is recommended to conduct broader empirical studies across different regions and institutions to validate these findings. This study provides a socio-legal analysis of the practical implementation of cash waqf in a pesantren-based institution, offering empirical insights into productive waqf governance at the local level in Indonesia.

Abstract

Existing studies on Islamic family life and family resilience have predominantly focused on normative-religious frameworks or individual family dynamics, while limited attention has been given to traditional settlement systems as socio-cultural structures shaping everyday family practices. The study aimed to analyse how the Taneyan Lanjhang system structures family interactions, organizes kinship relations, and contributes to the formation of harmonious family life in Madurese society. Using a qualitative approach with a focused family ethnography design, this research involved 15 informants from five extended families residing within one Taneyan Lanjhang complex in Madura. Data were collected through semi-structured interviews, participant observation, and socio-cultural documentation. Moreover, data were analysed using reflexive thematic analysis. The findings indicate that Taneyan Lanjhang functions not only as a residential arrangement but also as a kinship-based social system that regulates intergenerational interaction, moral authority, collective responsibility, and religious practices within family life. The spatial proximity of households and communal spaces, along with the role of elders, contributes to mechanisms of conflict mediation, social control, emotional support, and resource sharing among family members. At the same time, the study also identifies tensions within the system, including limited privacy and the persistence of hierarchical authority in family relations. This study presents Taneyan Lanjhang as a socio-cultural and spatial framework through which family harmony and collective resilience are negotiated and maintained in the everyday lives of Madurese Muslim communities.

Abstract

The study of the settlement of jarimah khalwat in Aceh generally separates the study of customary and formal sharia courts, so that cooperative interaction between systems is still poorly explored. This research is here to fill this gap through the framework of cooperative legal pluralism. This research is a type of normative legal research with a conceptual study approach. The analysis of the synchronization of norms between Qanun Jinayat and Qanun Pembinaan Kehidupan Adat shows the functional relationship between the Syar'iyah Court in ensuring legal certainty and the Gampong Court in maintaining social harmony. The main findings of the study offer a reconstruction model that prioritizes customary justice as an instrument of restorative justice. If the customary court fails, the settlement of the case is continued to the formal realm with customary decisions remaining a legal consideration in the Syar'iyah Court. This reconstruction contributes to normative integration that guarantees legal certainty, prevents double punishment, and still respects local wisdom of Aceh. Studi penyelesaian jarimah khalwat di Aceh umumnya memisahkan kajian peradilan adat dan syariat formal, sehingga interaksi kooperatif antar-sistem masih kurang tereksplorasi. Penelitian ini hadir untuk mengisi kekosongan tersebut melalui kerangka cooperative legal pluralism. Penelitian ini berjenis penelitian hukum normatif dengan pendekatan studi konseptual. Analisis sinkronisasi norma antara Qanun Jinayat dan Qanun Pembinaan Kehidupan Adat menunjukkan hubungan fungsional antara Mahkamah Syar’iyah dalam menjamin kepastian hukum dan Peradilan Gampong dalam menjaga harmoni sosial. Temuan utama penelitian menawarkan model rekonstruksi yang memprioritaskan peradilan adat sebagai instrumen keadilan restoratif. Jika peradilan adat gagal, penyelesaian perkara dilanjutkan ke ranah formal dengan keputusan adat tetap menjadi pertimbangan hukum di Mahkamah Syar’iyah. Rekonstruksi ini berkontribusi pada integrasi normatif yang menjamin kepastian hukum, mencegah hukuman ganda (double punishment), dan tetap menghargai kearifan lokal Aceh.
