Abstract

Pulau Legundi Kecamatan Punduh Pedada Kabupaten Pesawaran Provinsi Lampung merupakan sebuah pulau yang terletak di lepas Selat Legundi. Potensi ekonomi wilayah ini sangat besar. Wilayah ini memiliki potensi yang sangat besar untuk dikembangkan. Salah satu elemen yang dapat digunakan untuk mengembangkannya adalah melalui BUMDes.  Bumdes adalah kependekan dari badan usaha milik desa, artinya, suatu lembaga/badan perekonomian desa yang berbadan hukum dibentuk dan dimiliki oleh Pemerintah Desa, dikelola secara ekonomis mandiri dan profesional dengan modal seluruhnya atau sebagian besar merupakan kekayaan desa yang dipisahkan. Melalui pengabdian yang Optimalisasi dan Penguatan BUMDes (Badan Usaha Miik Desa) Guna Meningkatkan Ekonomi Nelayan Di Pulau Legundi di Pulau Legundi Kecamatan Punduh Pedada Kabupaten Pesawaran, Provinsi Lampung. Keberadaan BUMDes, memiliki urgensi karena dapat menjadi harapan masyarakat desa untuk meningkatkan ekonomi desa melalui pengelolaan keuangan desa yang di dasarkan pada Anggaran Pembangunan dan Belanja Desa (APBDes).

Abstract

Desa merupakan entitas terkecil dalam pemerintahan Indonesia yang diakui dan dihormati berrsadarkan konstitusi. Desa telah melalui sejarah pengaturan yang panjang yang akhirnya pengaturan tentang desa secara khusus diatur dalam Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Pengaturan tersebut membawa desa memasuki babak baru dan membawa harapan-harapan baru bagi kehidupan kemasyarakatan dan pemerintahan desa yang berdampak erat kepada keuangan desa terkhusus terkait dengan sistem pengelolaan dana desa. Dengan menggunakan pendekatan yuridis-normatif, penelitian ini menyimpulkan bahwa Indonesia telah memiliki regulasi signifikan terkait dengan pengelolaan dana desa mulai dari tahapan pengelolaan dana desa sampai kepada sistem pengawasan pengelolaan dana desa. Tahapan pengelolaan dan pengawasan pengelolaan dana desa seperti yang terdapat dalam peraturan perundang-undangan akan berpotensi positif dalam pelaksanaan akuntanbilitas penyelenggaraan ataupun akuntanbilitas publik pemerintahan desa.

Abstract

The purpose of this research is to determine the constitutional complaint mechanism based on comparisons in other countries, practices, and adaptation of constitutional complaints under the authority of the Constitutional Court of the Republic of Indonesia. Many cases with constitutional complaint substance have been submitted to the Constitutional Court of the Republic of Indonesia even though they don’t have this authority. This research uses a normative legal research method using a statutory approach, a conceptual approach, a comparative approach, and a case approach. This research indicates that the constitutional complaint mechanism in Germany, South Korea, and South Africa has been well implemented. In practice, cases with constitutional complaint substance are filed to the Constitutional Court of the Republic of Indonesia by changing the form by using the legal means of a judicial review, such as case number 16/PUU-VI/ 2008, case number 140/PUU-XIII/2015 and case number 102/PUU-VII/2009. Due to the consideration of the structure, substance, and culture of law, adaptation of constitutional complaint within the authority of the Constitutional Court of the Republic of Indonesia needs to be carried out by amending Law Number 24 of 2003 jo. Law Number 7 of 2020 concerning the Constitutional Court.

Abstract

The state of Indonesia has a grand design and a national time reform roadmap related to good governance 2010-2025. The grand design of Indonesian reform is regulated by presidential regulation no 81 of 2010 and the employee roadmap is regulated by the ministerial regulation of State Apparatus Empowerment and Bureaucratic Reform, overseeing the task of managing the village, namely the village ministry. The purpose of this study was to determine Bureaucratic reform needed to reorganize the bureaucratic process from the highest to the lowest level and make new breakthroughs (innovation breakthroughs) with gradual, concrete, realistic, earnest steps, thinking outside the existing habits/routines (out of the box thinking), a new paradigm shift, and with extraordinary efforts. The method used in data collection is to analyze the data qualitatively by describing the data. The analysis stage starts by collecting data from primary legal materials (Laws and Regulations) by selecting and classifying systematically to find out the general picture of the research. The data that has been collected is analyzed by using descriptive-analytical, analysis qualitatively as well as conceptual approach, constitutional, and historical approaches. The results of this study can be concluded that the implementation should be applied from the center to the regions and villages in Indonesia. Villages also recognize the concept of good governance directly related to the community.

Abstract

This study aims to find out the problems that occur related to the appointment and dismissal of village officials, provide suggestions regarding problems in South Sukadana Village and Bumi Nabung Village, and find solutions to differences in norms related to the laws and regulations governing the appointment and dismissal of village officials. This research is a legal research using a normative writing method using a statutory approach and empirically using a direct field investigation approach by conducting interviews with the South Sukadana Village Head, Bumi Nabung Village Head and Sukadana Sub-District Head. Based on the results of the study, there was an expansion of norms which then caused problems in each village in terms of recommendations issued by the sub-district head. The problem dragged on and there was a temporary stagnation of the wheels of government in South Sukadana Village and Bumi Nabung Village.

Abstract

Indonesian Legislative Assembly is the high institutions and public representatives with the authority to design, discuss and establish a law that the state requires. As in Article 7 Verse (4) Act number 13 in 2019 on MD3 that the term of parliament was five (5) years and ended when new members of the parliament were taking an oath. There is a legal vacuum to the effectiveness of the legislative regulatory management, which needs to be examined for whether or not there is a fight on the principle of certainty of law and democracy. To find answers to questions of formulated problems treated using normative law research with a descriptive approach with secondary data. The result of this study has been decided that the effectiveness of the regional autonomy and policy on micro finance as well as law.
