Abstract

The Dispute Council is a construction dispute resolution forum mandated by Law Number 2 of 2017 concerning Construction Services. The existence of the Dispute Council as a construction dispute resolution forum is actually not much different from other alternative dispute resolution forums, such as negotiation, mediation, and arbitration. However, the Construction Services Law mandates that a Dispute Council be formed by the parties simultaneously with the preparation of a construction work contract. In practice, decisions made by the Dispute Council are often not final and binding if one of the parties is not willing to implement the decision of the Dispute Council. This study aimed to compare the effectiveness of the authorities between the Dispute Council and other alternative dispute resolution forums. This research was normative research. The data used were secondary data consisting of primary, secondary, and tertiary legal materials. The data collection technique used literature study, and the data analysis technique used qualitative analysis. The results of the research show that the dispute resolution process with the Dispute Council is ineffective because it takes a long time. Parties who do not want to implement the decision of the Dispute Council will continue the dispute resolution process to arbitration. In fact, when the arbitration process fails, the dispute is submitted to court. This situation becomes more effective and saves time when the resolution of construction disputes directly uses arbitration without going through the Dispute Council first.

Abstract

Pembentukan Lembaga Pengawas Data Pribadi sangat dibutuhkan dalam penerapan Undang–Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi (UU PDP) karena peran krusial yang dipegang adalah fungsi pengawasan dan memfasilitasi penyampaian pengaduan terkait dugaan pelanggaran UU PDP baik dalam negeri maupun luar negeri. Penelitian bertujuan mengkaji urgensi pembentukan Lembaga Pengawas Data Pribadi di Indonesia sebagai upaya pelindungan transfer data pribadi lintas negara dan merekomendasikan pembentukan Lembaga Pengawas Data Pribadi berdasarkan konsep Independent Regulatory Agencies (IRAs). Jenis penelitiannya penelitian normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Data sekunder yang digunakan diperoleh menggunakan metode studi kepustakaan, yang dianalisis dengan menggunakan metode kualitatif. Hasil Penelitian menunjukkan bahwa Tahun 2024 pengguna internet di Indonesia mencapai 79.50% dengan kalkulasi 221.563.479 jiwa dari total populasi 278.696.200 penduduk. Setidaknya setiap pengguna Internet memiliki satu platform media yang mengumpulkan data pribadi. Kasus kebocoran data pribadi sering kali terjadi di Indonesia dikarenakan pelindungannya yang kurang kuat. Maka dari itu Indonesia perlu segera membentuk lembaga khusus pengawas data pribadi yang independen berdasarkan konsep ideal lembaga negara independen atau Independent Regulatory Agencies (IRAs), dimaksudkan untuk meminimalisasi intervensi kewenangan lembaga lain dalam melakukan pengawasan dan penegakan hukum terkait pelindungan data pribadi mengingat transfer data pribadi lintas negara kian meningkat setiap tahunnya.

Abstract

This analysis explores the various international and national legal frameworks designed to safeguard migrant workers, emphasizing these protections’ significance for the workers and their families. The optimal legal protection for Indonesian migrant workers and their families can be classified into internal and external. The process encompasses the execution of international accords concerning the safeguarding of migrant workers and their families, the enhancement of the enforcement of Indonesia’s Law on the Protection of Migrant Workers, and the advocacy of Village Regulations designed to shield citizens employed abroad, especially in regions with a significant population of migrant workers. The government ought to enhance the comprehension of human rights among migrant workers and their families. It should also increase public awareness through outreach, dissemination, and campaigns focused on safe and dignified labor migration while empowering and building the capacity of migrant workers and their families. The optimal approach to protection necessitates the formulation of bilateral agreements with the reception countries. These agreements ought to integrate the essential elements of the ICMW.

Abstract

Perwujudan HAM sepenuhnya menjadi kewajiban negara. Konsep HAM dimasukkan dalam konstitusi, UUD NRI Tahun 1945 pada Bab XA (Pasal 28A hingga Pasal 28J) untuk mendapat jaminan hukum bahwa hak setiap warga negara dilindungi. Hak kebebasan berpendapat dan berekspresi dilindungi Pasal 28, 28E ayat (2) dan (3), dan Pasal 28F UUD NRI Tahun 1945 serta Pasal 19 ICCPR. Di dalam mewujudkan pemenuhan hak kebebasan berpendapat dan berekspresi, Indonesia harus berpedoman pada Komentar Umum ICCPR No. 34 dan prinsip Siracusa. Hak berpendapat merupakan hak yang tidak bisa dikurangi pemenuhannya dan kebebasan berekspresi dibatasi oleh hukum dan diperlukan untuk menghormati hak atau nama baik orang lain, melindungi keamanan nasional atau ketertiban umum atau kesehatan atau moral umum.
