Abstract

In carrying out its duties and functions as a mouthpiece of justice, it is necessary to carry out the function of monitoring and fostering judges optimally. So that every decision that has been determined by the judge maintains its authority and is still able to uphold the truth in maintaining its integrity and dignity. Because the judge's decision always contains instructions for the sake of justice based on the Almighty God and the decision must be accountable horizontally to the community and vertically to God Almighty. The research method used is normative legal research. This research is descriptive analytical. The data collection technique is done by means of literature study. The results of the study, namely the direction of supervision and guidance of judges that are relevant to actual problems related to the quality of judge decisions, will center on fostering a philosophical mindset, by introducing the philosophy of legal hermeneutics as a method for understanding texts and comprehensive facts, so that the quality of judge decisions always begins with a philosophical legal considerations that reflect the values ​​of philosophical justice contained in Pancasila. Because the judicial power is exercised based on the philosophy of Pancasila and the 1945 Constitution.

Abstract

Judi merupakan salah satu penyakit masyarakat yang terus ada sampai hari ini yang sangat sulit untuk ditanggulangi. Dalam kaca mata hukum judi merupakan salah satu perbuatan tindak pidana (delict) yang meresahkan dalam masyarakat. Pola judi mendorong orang untuk selalu terbuai dengan kemenangan sehingga menyebabkan orang malas untuk bekerja dan lainnya. Berdasarkan hasil penelitian diketahui bahwa mengenai judi merupakan tingkah laku manusia yang harus terus ditanggulangi, karena menimbulkan dampak yang tidak baik bagi masyarakat. Penegakan hukum dalam menanggulangi judi yaitu penanggulangan judi secara preventif artinya penanggulangan yang dilakukan dengan cara mencegah terjadinya judi itu sendiri. Pada hakekatnya judi merupakan perbuatan yang jelas bertentangan dengan norma agama, moral, susila, dan hukum, serta dapat membahayakan kelangsungan hidup masyarakat, Bangsa dan Negara.

Abstract

The incident of data theft or cyber attack (ransomware) some time ago taught us how important legal protection is as early as possible so that the same incident does not happen again in the future. That the law in this case must be able to protect as early as possible so that the same incident does not happen again and even if it does happen again, the law must be able to fully protect the data so that legal certainty is created in the protection of personal data nationally. What is protected by law is to protect important information and protect data from loss, damage to theft, how important the law is in protecting this kind of thing. The purpose of this study is to find out how important the law is in providing data protection from all forms of damage, loss to theft which can clearly harm many people and have an impact on the emergence of legal uncertainty in providing personal data nationally. The government in this case should create a clear and firm legal umbrella to provide security to every user of personal data so that hacked data can be protected by law and resolved in the best possible way, so that there is legal certainty for all users of personal data. The purpose of this study is to find out how the law provides national personal data protection. The method used in this case is by looking at various kinds of legal rules related to the protection of personal data normatively so that there is legal certainty from the side of the legal rules that have been determined by the provisions of the laws and regulations in force in Indonesia. The results of the study indicate that the legal rules are still weak so that the law has not been able to provide protection as early as possible for legal certainty in protecting all personal data nationally.

Abstract

Hutan adalah paru-paru dunia yang semua makhluk punya kewajiban yang sama untuk saling menjaganya dari segala bentuk kerusakan, bahwa hutan adalah pelindung bagi umat manusia dan merupakan karunia Tuhan Yang Maha Esa sebagai sumber kekayaan alam yang memberikan manafaat serbaguna yang mutlak dibutuhkan oleh umat manusia sepanjang masa. Pertanggungjawaban korporasi terkait dengan tindak pidana pengerusakan hutan dalam Undang-Undang Nomor 41 Tahun 1999 terdapat pada Pasal 78 Ayat (14) yang merumuskan bahwa tindak pidana sebagaimana dimaksud Pasal 50 apabila dilakukan oleh dan atau badan hukum atau badan usaha, tuntutan dan sanksi pidananya dijatuhkan terhadap pengurusnya, baik sendirisendiri maupun bersama-sama, dikenakan pidana sesuai dengan ancaman pidana masing-masing ditambah dengan 1/3 (sepertiga) dari pidana yang dijatuhkan”. Tanggung jawab korporasi pada Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan. Secara umum penulisan ini bertujuan untuk mengetahui pertanggungjawaban pidana terhadap penyimpanan hasil hutan secara tidak sah dan melawan hukum dan mengetahui kendala yang dihadapi oleh aparat penegak hukum dalam meminta pertanggungjawaban pidana bagi penyimpan hasil hutan hutan secara tidak sah. Jenis penelitian dalam penulisan ini adalah penelitian yuridis normatif metode yang digunakan dalam penelitian ini yaitu normatif yang bersifat deskriptif analisis peraturan perundang-undangan dan pustaka. Hasil penelitian ini bentuk pertanggungjawaban pidananya adalah sesuai dengan ketentuan isi yang termaktub dalam kandungan Pasal 1 Ayat 2 Undang-undang Nomor 5 Tahun 1967 Tentang Hasil hutan. Yang terdiri dari hasil nabati dan hewani yang dapat juga disebut sebagai hasil hutan langsung, kemudian diatur juga dalam Pasal 9 Ayat (2) dengan ancaman pidana 10 Tahun penjara dan denda paling banyak Rp. 100.000.000. kendala yang dihadapi penegak hukum dalam penegakan hukum kepemilikan hasil hutan adalah kurangnya pengalaman pegawai penyidik negeri sipil kehutanan dalam tugas-tugas penyidikan tindak pidana, kurangnya koordinasi penyidik polri dengan penegak hukum lainnya dan adanya tumpang tindih kewenangan dan kebijakan penegak hukum dalam penyelesaian hukum pidana hutan.

Abstract

Purpose: Violence against women and children in Indonesia's rural areas is frequently concealed by cultural normalization and limited access to formal legal tools. Method: This legal counseling activity was carried out in Sei Mencirim Village, Sunggal District, Deli Serdang Regency, The approach method used is counseling involving village officials, community leaders, women and the surrounding community by conducting discussions and questions and answers in accordance with the conditions of the village community. Practical Applications: Practically, this social transformation is realized through the establishment of Village Movement Cadres who actively engage in micro-sharing, safe zone mapping, and enhancing the national complaint channel, as evidenced by real case reports submitted via SAPA 129 after the activities. Conclusion: This study enhances the PAR methodology by translating formal law into local language and empowers rural Indonesian communities as active legal agents.

Abstract

The dissemination of hoaxes in the digital era has expanded from social domains to private corporate sectors, posing serious threats to brand reputation and industrial relations. This community service (PKM) activity aims to educate and elevate the legal awareness of employees at PT. Mitsubishi Dipo Medan regarding the multi-layered legal consequences of spreading false news, encompassing cyber criminal law, civil law, and labor law. The community partners are employees across two major branches of PT. Mitsubishi Dipo Medan, namely the Sisingamangaraja Branch and the Krakatau Branch. Program implementation methods included interactive lectures, judicial case studies, and legal dispute simulations, evaluated via pre-test and post-test questionnaires aligned with the Ministry of Communication and Informatics’ digital literacy pillars. The results demonstrated a significant 109.4% increase in the participants' legal comprehension. The deep legal analysis examines the implications of the 2024 EIT Law amendment, the annulment of false news provisions in Law 1/1946 by the Constitutional Court through Decision Number 78/PUU-XXI/2023, the enforcement of the New Criminal Code (Law 1/2023) in 2026, and the application of civil vicarious liability doctrines under Article 1367 of the Indonesian Civil Code. The outcome of this program is the formation of a corporate internal risk mitigation framework through recommendations for updating Company Regulations and implementing Non-Disclosure Agreements to protect the automotive business stability of the partner.

Abstract

Abortion is criminal act. So that in law enforcement, the village, sub-district and so on governments should also be involved in providing information about the dangers of abortion crimes, especially to families and young generations in Tanjung Morawa District. Abortion crimes that occurred in Tanjung Morawa District, Deliserdang Regency also increased from the previous 15 incidents in 2022 and around 28 incidents until 2025. Of course, this criminal act of abortion must be carried out by law enforcement so that in the future the same criminal act will not be repeated in the future. Many individuals commit the crime of abortion secretly, and most of them are assisted by people who do not have adequate training. The obejctives of the research include to enforce criminal law for every abortion perpetrator, especially in Tanjung Morawa District. The topic was chosen because of a sense of concern in the people of Tanjung Morawa to be more responsible and not to have abortions for various specific reasons. Combinations normative and empirical to describe and explain events from various reference sources and the study's findings, which included interviews with members of the Deliserdang Resort police, revealed that the dread of becoming pregnant outside of marriage led to a number of criminal abortions, having free sex, and lack of responsibility from the male side. With this research, in the future the crime of abortion can be minimized in Tanjung Morawa sub-district.

Abstract

This study explores role law in development digital economy with a focus on existing opportunities and challenges. The digital economy, which includes innovation in technology information and communication, has create impact significant in the way business run and service given. However, the development fast technology​ often goes beyond ability regulations to follow, resulting in gap laws that can affect stability and growth this sector. Through studies literature, analysis document law, interviews with experts, and studies case, this study found that framework effective law can facilitate​ growth digital economy by providing clarity law, protect right consumers, and increase investor confidence. However, the challenges main covering need for update more regulation​ frequent and handling difference regulation between countries. Case study from countries like Singapore and Estonia show that approach proactive and adaptive laws can provide​ effective solutions to support​ digital economy. This study recommends the need for further legal reform flexible, improvement collaboration between government, industry, and academia, as well as development policies that can keep up with the pace change technology. This finding is expected to provide outlook valuable for the maker policy, practitioner law, and stakeholders interest other in formulate and implement supporting regulations​ growth digital economy while overcome existing challenges.​

Abstract

The research focuses on consumer protection related to the availability of product information on children's snacks sold at public elementary schools (Public Alementary School) in Indonesia. Many snacks lack essential details such as nutritional information, waste management education, halal certification, ingredients, and Food and Drug Monitoring Agency license numbers on their packaging, which violates Indonesian regulations. This study aims to explore the concept of consumer protection regarding product information, children's rights to safe goods and services, and the implementation of consumer protection in public elementary schools. Using a qualitative research method with a normative-empirical juridical approach, the study collects primary data through interviews and secondary data from literature, journals, and other related sources. The findings indicate that consumer protection involves safeguarding consumer rights by ensuring adequate product information. Educating children as consumers is crucial for developing awareness of their rights. Public elementary schools play a vital role in ensuring that snacks sold are safe, of good quality, and meet hygiene standards. Schools should implement effective monitoring systems, including regular inspections of snack production and compliance with health standards. Additionally, consumer education at schools should teach children to choose healthy snacks, read food labels, and understand their rights as consumers, fostering informed decision-making and healthier choices.
