Abstract

This article discusses the progressive Islamic movement developed by Muhammadiyah, a modernist Islamic organization established by Ahmad Dahlan on November 18, 1918. History has shown that Muhammadiyah, as a modernist Islamic organization, has instigated various social transformations that continue to affect Indonesian society by creating schools, hospitals, and orphanages that were inspired by modern, Westernized systems and modernist interpretations of the Qur'an. Even today, Muhammadiyah remains active in national activities and discourse, continuously responding to the ever-changing times. This article departs from the argument that the progressive movement developed by Muhammadiyah was translated from Ahmad Dahlan's desire to advance the ummah and to create a just and prosperous world, one that has been blessed by God. As such, it argues that Muhammadiyah's response to the problems of its ummah has been informed by the history of the movement and its founders.

Abstract

Pulang bale refers to a marriage that is carried out after death of the spouse (either husband or wife) with his/her siblings. This article aims to analyze pulang bale marriages in Aceh in relation to child protection. The facts so far show that many marriage models do not support their protection. To elaborate on this, researchers will highlight how this marriage typology can ensure support for the ḥaḍānah and how this typology encourages family resilience in protecting the children. Data was obtained through in-depth interviews and observations using qualitative technical analysts. This research used a Fiqh Munākaḥah and a sociological approach. The results of the research were; first, marriage strengthens the ḥaḍānah of children due to blood relationships (musaharah) and emotional between the child’s mother and stepmother. Second, family resilience is strengthened by the same extended family and there is minimal chance of conflict both economic and social. As a finding, pulang bale with the applicable customary provisions is a marriage typology that strengthens the family's commitment and resilience

Abstract

One concept of preserving family assets can be carried out through the practice of dzurri waqf. In Minangkabau, preservation of family assets is carried out in the form of high inheritance management. This article aims to discuss the legal concept of dzurri waqf and its implementation in high inheritance management in Minangkabau, West Sumatra. The findings of this study are very specific because the Minangkabau culture adheres to on one side, a matrilineal system but on the other hand, is based on the Islamic law. The data in this study were obtained through in-depth interviews with four experts, i.e., the expert council of MUI West Sumatra, the Chair of the West Sumatra Indonesian Waqf Board, the Chair of West Sumatra Nazir, and the expert council of the Lembaga Kerapatan Adat Alam Minangkabau (LKAAM) West Sumatra. This study found that first, the concept of dzurri waqf is identical to the management of high heirloom assets in Minangkabau. It is proven by some asset management that is almost the same as dzurri waqf, i.e., the element of property must be retained in principal and from the element of beneficiaries (mauquf alaih) who are family members. Second, there is a strategy to maintain high pusako treasures through religion, namely by managing high pusako treasures, such as dzurri waqf management so that the identity of high pusako treasures as culture can survive and be managed sustainably. Third, in order to maintain the identity of the high pusako treasure, the nazir in the context of dzurri waqf is appointed from the niniak mamak component as the holder of the power of the high pusako treasure.
