Abstract

The Gowa Regency Government enforces Regional Regulation No. 2/2020 concerning Mandatory Masks and Implementation of Health Protocols in Preventing the Spread of Corona Virus Disease 2019 on September 21, 2020. The enactment of this regional regulation has drawn a lot of criticism and protests from the public, especially those who have been caught in the operation of law enforcement. The bylaw is interesting to study further for reasons. First, this regional regulation was born and enforced for people affected by Covid-19 who feel the impact in various aspects of life. Second, the spread of the 2019 corona virus disease is determined by the Central Government as a non-natural national disaster, therefore the regulations governing it are also stipulated by the Central Government. This study is viewed from two aspects, namely: 1) What is the legal position of Perda No. 2 of 2020 Gowa Regency according tao the laws and regulations in Indonesia? and 2) What is the saddu zari'ah perspective on the enforcement of the sanctions in the perda? This study is expected to provide insight regarding the legal position of Perda No. 2 of 2020, Gowa Regency, as well as revealing the saddu zari'ah perspective on the imposition of sanctions in the perda. This discussion uses a juridical-syar'iy approach. This study shows that Regional Regulation Number 2 of 2020 Gowa Regency is legal and binding in accordance with the applicable laws and regulations. The Perda fulfills the formal and material requirements in the formation of legislation in Indonesia. Meanwhile, the saddu zari'ah perspective on the imposition of sanctions in this regional regulation is in accordance with the Shari'a, because the imposition of sanctions leads people to comply with the obligation to wear masks and implement health protocols to avoid and control the transmission of covid-19.

Abstract

Mediasi merupakan suatu proses informal yang ditujukan untuk memungkinkan para pihak yang bersengketa mendiskusikan perbedaan-perbedaan mereka secara pribadi dengan bantuan pihak ketiga yang netral. Pihak yang netral tersebut tugas utamanya adalah menolong para pihak memahami pandangan pihak lainnya sehubungan dengan masalah-masalah yang disengketakan, dan selanjutnya membantu mereka melakukan penilaian yang objektif dari keseluruhan situasi. maka dengan demikian pihak yang bersengketa bisa saling memahami apa yang hendak dicapai oleh lawan sengketa mereka. Kehadiran Perma No. 1 Tahun 2008 dimaksudkan untuk memberikan kepastian, ketertiban, kelancaran dalam proses mendamaikan para pihak untuk menyelesaikan suatu sengketa perdata. Hal ini dapat dilakukan dengan mengintensifkan dan mengintegrasikan proses mediasi ke dalam prosedur berperkara di pengadilan. Mediasi mendapat kedudukan penting dalam Perma No. 1 Tahun 2008, karena proses mediasi merupakan bagian yang tidak terpisahkan dari proses berperkara di pengadilan. Hakim wajib mengikuti prosedur penyelesaian sengketa melalui mediasi. Bila hakim melanggar atau enggan menerapkan prosedur mediasi, maka putusan hakim tersebut batal demi hukum (pasal 2 ayat (3) Perma No. 1 Tahun 2008).

Abstract

Salah satu pemikiran Imam Abu Hanifah adalah penetapan dalam transaksi perjanjian salam yang sangat menekankan kepercayaan untuk mencegah pihak-pihak bertransaksi dari transaksi yang merugikan pihak-pihak yang bersangkutan dengan merumuskan ketegasan dalam proses penawaran dalam kelangsungan perjanjian. perjanjian transaksi yang mirip dengan salam, yaitu kesepakatan jual beli online baik berdasarkan media sosial maupun e-commerce. Aktivitas jual beli online merupakan praktik jual beli yang banyak dilakukan generasi milenial saat ini dari berbagai kalangan termasuk generasi muda muslim juga tertarik dengan kemudahan jual beli secara online. Penelitian ini menggunakan penelitian pustaka dengan menela’ah pemikiran imam Abu Hanifah terkait akad jual beli salam melalui kita-kitab fiqih, artikel, karya ilmiah, dan dokumentasi terkait dengan pendekatan sosiologis dengan melihat aktivitas jual beli online generasi milenial muslim berdasarkan asas yang ditetapkan imam Abu Hanifah dalam sistem jual beli salam. Ditemukan bahwa aktivitas jual beli online yang terjadi di kalangan generasi milenial telah sesuai dengan asas yang ditetapkan oleh Imam Abu Hanifah dalam transaksi salam. Abstract

Qadzf ikhtilath jinayah an act that is set up in Aceh Qanun No. 6 of 2014 concerning jinayah, Qadzf ikhtilath are accusing others of committing ikhtilath or two-pair, and making out. The type of research used is library research (library research) Accusing others of committing acts of ikhtilath, including intentional acts because they have intended and done those acts. Although berikhtilat is forbidden in religion but do not accuse others. Exxon ikhtilath in Aceh in accordance with canon law if it could not prove the act of the accused offender qadzf will be chargedcaning and a fine of 30 times the gold. The accuser is also obliged to bring 4 witnesses at the same time if the accuser is unable to bring witnesses then the accuser will also be under the law of ta'zir. Witnesses who must be present must not come alone because they will be declared as accusers so the witnesses who must be present must come together. And the perpetrator of qadzf ikhtilath will lose his sentence if the accused person admits his robbery, so the one who gets the punishment is the person who is accused because he has admitted his deeds. To avoid the act of qadzf ikhtilath has been regulated in Law No.6 of 2014 on Crimes as a warning to the perpetrators not to hurt others and protect the community who are the victims of the accusation.

Abstract

This article seeks to present a comparison of mediation with teleconference media, both within the PERMA and the scholars of the sect. Mediation is an attempt to resolve conflicts by engaging neutral mediators who do not have the authority to make decisions that help the parties in dispute to reach a resolution or solution accepted by both parties. The multidisciplinary approach used in this article is a juridical, sociological, theological-normative and managerial approach. This article is library research, a study by writing, clarifying, and making data obtained from various written sources. The method of data collection is to use document techniques (library studies). Quoting and analyzing data with document techniques is intended to collect related data contained in documents in the form of books, journals, and research results in the form of thesis, thesis, and dissertation. The results found that the most notable differences regarding the limits of mediation with teleconference media were found in the dissent of the Sect scholars. The Shafi and Hanbali sects argue that the ideal age in marriage is 15 years, while Abu Hanfah argues that the age of maturity comes at 19 years of age for women and 17 years for men, as is the case with Imam Malik arguing that the ideal age of manhood is 18 years for both men and women. The differences between the Imams of the Sect are influenced by the environment and culture in which they live. However, in Islamic law itself there is never a very firm limit, but the most basic thing about the age limit of marriage is that it is already in place

Abstract

Muhammad Hasybi adalah seorang otodidak, ia menempu pendidikan hanya birkisar satu tahun lebih di bangku sekolah Al-Irsyad (1926). Namu, melalui pendidikan formal yang singkat tersebut ia mampu menojolkan dirinya menjadi seorang pemikir. Keahlian Hasybi dalam ijtihad ia mampu memperkenalkan diri sebagai intelektul yang tekenal di dunia internasional. Terkait dengan hasil ijtihad Hasybi mennggambarkan keadaan fiqh ke-Indonesiaan dapat dilihat pada ijtihad Hasbi tentang zakat dengan mengacu pada pandangan Abu Hanifah yang berbeda dengan pendapat jumhur ulama – Hasybi bependapat bahwa mesin-mesin produksi di pabrik besar wajib di zakati. Pandangan ini cukup relevan dengan konteks pembangun negara yang membutuhkan banyak modal. Pendapat Hasybi mengenai zakat diserahkan kepada pemerintah untuk mengelolanya. Sebab, bagi Hasybi zakat tersebut sepaket dengan pengebangan untuk kemakmuran masyarakat, baik non muslim maupun muslim. Oleh karena itu, pungutan zakat seharusnya juga tidak hanya ditujukan kepada kaum muslimin, akan tetapi juga kepada kaum nonmuslim. Kemudian, prinsip zakat, yaitu diambil pada jenis harta yang berkembang, harta yang sudah cukup nishabnya, dan zakat harta.

Abstract

Pokok masalah penelitian ini adalah bagaimana kedudukan anak dalam kandungan dari perkawinan yang dibatalkan akibat tidak ada izin poligami Di Pengadilan Agama Klas IA Makassar dan perspektif Imam Syafi’i dan Imam Hanafi. Penelitian dilakukan secara field research dengan deskriptif analisis. Dengan pendekatan yuridis normatif dan pendekatan sosiologis. Hasil penelitian ini menunjukkan 1)  Bahwa sama saja antara anak yang sudah lahir dengan anak yang sudah dalam kandungan mengenai statusnya. Pembatalan perkawinan tidak berlaku surut terhadap status anak, sehingga anak itu harus dianggap sebagai anak dari kedua orang tuanya. Sehingga suami tetap bertanggung jawab punya hak keperdataan kewajiban hukum untuk membiayai anak yang masih dalam kandungan yang dibatalkan perkawinannya oleh pengadilan. 2) Kedudukan anak dalam kandungan dapat dihubungkan pada pemilik al-firasy (tempat tidur), jadi sahnya anak dari hasil pembatalan perkawinan dinisbatkan kepada laki-laki yang menikahinya.  3) Tidak menjadi persoalan apabila suami tetap bertanggung jawab terhadap janin itu tetapi akan menjadi sengketa hukum apabila suami mengingkari anak itu sebagai status anak yang harus dipertanggungjawabkan

Abstract

The separation of powers is a fundamental principle for ensuring justice and preventing the abuse of authority within a governance system. In the context of Islamic history, particularly during the Rashidun Caliphate, the need to distinguish between executive and judicial authority emerged as essential to uphold legal integrity and the rule of justice. This study aims to analyze the early development (embryo) of the separation of powers during the Rashidun era, identify the socio-historical factors that influenced it, and evaluate its impact on the effectiveness and integrity of the Islamic judicial system. This research employs a socio-historical approach, utilizing content analysis of classical Islamic texts and historical documents, as well as historical comparison of governance practices of the period. The findings indicate that the institutionalization of judicial independence began under the leadership of Caliph Umar ibn al-Khattab through the appointment of independent qadis, provision of stable salaries, and the establishment of judicial oversight mechanisms. Factors such as urbanization, territorial expansion, increasing societal complexity, and the need for administrative efficiency were central to these reforms. The study concludes that the separation of powers in the Rashidun era was not only a pragmatic solution to governance challenges but also a reflection of core Islamic principles of justice. This historical model offers a valuable precedent for strengthening judicial independence and ethical governance, and remains relevant as a reference for contemporary judicial reform in Muslim-majority societies.
