Abstract

The existence of leaders is needed in an organization, this is because leaders who will determine the direction of the organization will be brought to where. Leadership itself is a person's activity in influencing and moving all its members to be able to achieve the stated goals. leadership is understood as the power to move and influence people. The leader in the educational institution is the principal. the principal must be able to mobilize all citizens of the school to achieve educational goals. Educational leadership is carried out at educational institutions, with the aim of influencing all school citizens to carry out their duties and work properly and correctly in accordance with their respective responsibilities which ultimately aims to develop all the potential possessed by students.

Abstract

Muhammad Hasybi adalah seorang otodidak, ia menempu pendidikan hanya birkisar satu tahun lebih di bangku sekolah Al-Irsyad (1926). Namu, melalui pendidikan formal yang singkat tersebut ia mampu menojolkan dirinya menjadi seorang pemikir. Keahlian Hasybi dalam ijtihad ia mampu memperkenalkan diri sebagai intelektul yang tekenal di dunia internasional. Terkait dengan hasil ijtihad Hasybi mennggambarkan keadaan fiqh ke-Indonesiaan dapat dilihat pada ijtihad Hasbi tentang zakat dengan mengacu pada pandangan Abu Hanifah yang berbeda dengan pendapat jumhur ulama – Hasybi bependapat bahwa mesin-mesin produksi di pabrik besar wajib di zakati. Pandangan ini cukup relevan dengan konteks pembangun negara yang membutuhkan banyak modal. Pendapat Hasybi mengenai zakat diserahkan kepada pemerintah untuk mengelolanya. Sebab, bagi Hasybi zakat tersebut sepaket dengan pengebangan untuk kemakmuran masyarakat, baik non muslim maupun muslim. Oleh karena itu, pungutan zakat seharusnya juga tidak hanya ditujukan kepada kaum muslimin, akan tetapi juga kepada kaum nonmuslim. Kemudian, prinsip zakat, yaitu diambil pada jenis harta yang berkembang, harta yang sudah cukup nishabnya, dan zakat harta.

Abstract

This field research provides an overview and factual and explains the various relationships of all the data obtained. This research was conducted in Majene and precisely in the working area of the Majene Religious Court. The study is based on an application for marriage dispensation. Instruments used are researchers, observation, interview, and documentation data. The judge's consideration in granting or rejecting the application for marriage dispensation at the Majene Religious Court is the completeness of the administration at the time of applying for marriage dispensation following Perma No. 5 of 2019, and there is no pro; there on marriage as in Article 8 of Law No. 1 of 1974 concerning Marriage, while still taking into account the aspects of benefit and mudharatan arising from the granting of the application for marriage dispensation.

Abstract

Islam adalah agama yang universal dan integral yang ajarannya mencakup segala aspek kehidupan manusia, bahkan lebih luas dari itu bahwa Islam ajarannya bisa dirasakan dan dinikmati oleh tumbuhan, hewan, dan alam semesta. Di antara kesempurnaan ajaran Islam ini adalah adanya teori ta’aaquli dan ta’abbudi, yang dijadikan dasar pengambilan ijtihad oleh para ulama dalam menentukan suatu hukum. Ta’aqquli adalah suatu syariat yang diturunkan oleh Allah SWT yang hikmah, sebab, atau tujuannya bisa dipahami dan dicerna oleh akal dan nalar manusia. Sedangkan ta’abbudi adalah ajaran syariat yang diturunkan oleh Allah SWT kepada hamba-Nya yang hikmah, sebab, atau tujuannya tidak dapat dinalar oleh logika manusia namun bersifat penghambaan. Karena itu ta’abbudi tidak dapat diqiyaskan (dianalogikan) dengan permasalahan lainnya. Dilihat dari jenis hukum Islam, pendekatan ijtihad para ulama biasanya mengacu pada konsep ta’aqquli dan ta’abbudi. Semua hukum punya peluang untuk dicari hikmah dan tujuannya, tapi tidak semua hukum bisa tergali hikmah dan tujuannya. Hal itu karena keterbatasan akal manusia dan juga bertingkatnya pemahaman dan analisa dari para ulama. Oleh sebab itu, penting kiranya menjadikan ta’aqquli dan ta’abbudi menjadi dasar menentukan dan membatasi suatu hukum. Berdasarkan kajian ini diperoleh bahwa aktualisasi kaidah ta’aqquli dan ta’abbudi memiliki beberapa kaidah antara lain ta’aqquli bersifat ibadah yang dapat dinalar dan diketahui hikmahnya, sedangkan ta’abbudi tidak dapat dinalar dan diketahui hikmahnya, hukum dilaksanakan dari maksud dan substansinya, asal dari ibadah adalah haram sampai ada dalil yang mewajibkannya, dan asal dari suatu hukum adalah hingga ada dalil yang mengharamkannya.

Abstract

This study aims to analyze efforts to measure sociologically the emergence of terrorism in Indonesia, as well as the development of terrorism and its prevention. As well as aiming to see in more detail the formation of the National Counterterrorism Agency (BNPT) has more comprehensive steps in preventing terrorism in Indonesia. This research uses descriptive qualitative. The research approach uses library research which obtains secondary data which includes literature books, laws and regulations, official documents and others. The results of this study indicate that, apart from making arrests, the BNPT also conducts research, coaching and integration of former terrorists into society, with a deradicalization program for both former perpetrators and potential potential perpetrators. Anti-terrorism campaigns are also carried out in schools. In this writing, the writer uses an empirical juridical approach and a sociological approach to understand the culture of society. The results of this paper are that terrorism has many dimensions, namely local dimensions, regional dimensions and global dimensions. To overcome the sociological roots of the emergence of terrorism in Indonesia, to overcome this requires the cooperation of all parties, the government, the community and the international world, because the action to overcome it is not by using repression so that it can violate human rights, but also using a socio-cultural approach by inviting all components including religious leaders so that the seeds of terrorism that exist in society can be minimized, and cutting the roots of its development, the growth of understanding of radicalism in common life

Abstract

The proliferation of counterfeit vaccinations was producing significant public health problems and was related with legal issues. This article compared the sanctions imposed by Islamic criminal law and national legislation on counterfeiters and distributors of fake vaccines. Several rules and regulations control the use and distribution of vaccinations in Indonesia. In accordance with Articles 196 and 197 of Law Number 36 of 2009 on Health, the criminal act of distributing counterfeit vaccines is punishable by a maximum prison sentence of ten years and a maximum fine of one billion in IDR. As opposed to Article 197, which stipulates a maximum punishment of 15 years in prison and a maximum fine of Rp. 1,500,000,000,000. counterfeiting and distributing counterfeit vaccines are considered serious crimes in both Islamic criminal law and Jināyah. The punishment for these crimes varies depending on the severity of the offense and the harm caused to society. In both systems of law, the punishment can range from fines and imprisonment to the death penalty. It is important to note that these punishments are intended to deter individuals from engaging in these crimes and protect public health and safety. It was believed that the government would increase legislation addressing the punishment of counterfeiters and drug dealers, who can harm the Indonesian national character.

Abstract

Changing the law is a necessity in this life. This work is here to explore the influence of Ibn Qayyum al-Gauziyah's thoughts on one of the theories of legal change. Ibn Qayyim al-Jauziyah in his legal thinking provides the widest possible space for the door of ijtihad in responding to change as a reality that cannot be avoided. Qualitative research methods using literature research while the analysis knife used is by analyzing information that has been collected from library data and social theory, or what is called the doctrinal-deductive method. The results of the discussion are that the legal change paradigm method is inseparable from the factors of the era, place, situation, intention and custom. Ibn Qayyim al-Gauziyah's theory of legal change is a concept of renewing Islamic legal thought. This means that Islamic law is a law that is dynamic, responsive and adaptable to demands for change. The implication of al-Jauziyah's theory of legal changes to society is in the context of achieving universal benefit in society as the purpose of the law itself.

Abstract

Imam Syafi'i's ideas regarding qaul qadim and qaul jadid are interesting to observe. From the idea that shows flexibility in the application of Islamic sharia, Islamic law, or Islamic fiqh, it appears that Imam Syafi'i has provided a methodical framework in addressing the application of Islamic sharia, Islamic law, or Islamic fiqh which has relevance to various social contexts that covers it. This implies that Islamic sharia, Islamic law, or Islamic law is a process of grounding theocentric values ​​that are ideal and sacred to anthropocentric values ​​that are very dynamic and profane. In this process, Imam Syafi'i's constructive and innovative ideas regarding qaul qadim and qaul jadid, along with various sociological factors that became the background for changing his views, had practical implications for the birth of a methodical framework for the application of Islamic sharia, Islamic law, or Islamic fiqh that can be applied in different contexts of place, time or circumstances

Abstract

Ibn Taymiyyah is known as the inspiration of the Wahhabi movement that aims to the purification of the teachings of Islam. This movement departs from the separation between the ‘ubūdiyyah and un-‘ubūdiyyah teachings, which are also inspired by Ibn Taymiyyah's thought. In 'ibādah, Ibn Taymiyyah holds the rule that as long as there is no ordered argument it should not be done. However, the notion of ibādah according to Ibn Taymiyyah is not limited to mahdlah worship but more broadly. Whereas in mu'āmalah, he holds the rule of allowing doing anything as long as there is no prohibition against it. In shaping the concept of 'ibādah and mu'āmalah, at first, Ibn Taymiyyah accepted it as something normative from the thought of Ahmad ibn Hanbal. But when he saw the social reality with the number of deviations' in ibādah done by Muslims, the concept that has been obtained normatively from the thought of Ahmad ibn Hanbal is reaffirmed and expanded to become a sociological concept, in addition to being normative.
